目标设置与评估的集中化及其指引价值的缺失与重建

在中国,目标的设置与评估主要是一个集中化的过程,是贯彻上级政策的一种手段。当绩效评估不可避免地和地位、荣誉、晋升或收入联系在一起时,指标体系的设计实际上成为奖惩体系的设计。目标设置与评估的集中化以及压力体制和干部任期制等的交互作用导致目标实现过程中的荒谬行为和短期行为,并使目标设置与评估失去导向作用。公众参与、政府职能的合理界定、灵活的目标设置与重视公众满意度是绩效目标设置与评估指引价值重建的路径。

论人学和历史学结合的必要性和可能性

市场经济社会的个体主体性原则和目前我们国家个体主体性建设落后的现实及其复杂性要求我们以一种新的视角重新审视我们的哲学和史学研究，这是我国近年来人学研究兴起的根本原因。目前我国的人学研究基本上局限在哲学领域，属于哲学人学。它首倡加强对个体人的研究，并提出了许多有价值的观点，但其学科的局限性使它无法继续深入到人学研究的核心层次——对人的一般发展规律的历史考察。而人学的历史化既克服了哲学人学的局限性，又能有效摆脱史学本身的危机。     

生产、销售有毒有害食品罪的刑法规制及其司法防范

食品安全是关系国计民生的重要问题,民以食为先,食以安为本。但是,我国现阶段食品安全的现状却不容乐观。毒奶粉、毒馒头、毒豆芽、苏丹红、皮革奶、瘦肉精等等,无不令人谈食色变。因此,如何规制食品安全,净化食品生产和销售的环境,将是国家和政府亟待解决的重要问题。本文以刑法修正案八的相关规定为切入点,探讨了生产、销售有毒有害食品罪的刑法规制和司法防范问题。
