Full enjoyment of human rights, a lofty ideal pursued by the human race for a long time, is what the people of contemporary China have spared no efforts to attain. The Chinese people were virtually denied human rights when the "three large mountains"-imperialism, feudalism and the bureaucratic bour-geoisie-oppressed them. To achieve national liberation, independence, democracy, freedom and human rights, the unyielding Chinese people fought protracted struggles for which they made huge sacrifices.  相似文献

In a statement issued on the 2004 World Human Rights Day, Ms. Louse Arbour, United Nations High Commissioner for Human Rights, described human rights education as a strategy for attainment of "human rights for all," as a basic means for developing a universal culture of human rights, as an instrument for promoting equality and involvement of the people in decision-mak-ing under democratic mechanisms, and as an investment to prevent infringements upon human rights and to ward off conflicts of violence. It should be noted that so much importance attached by UN human rights organ to human rights education epitomizes the empowering characters of human rights education and the functions it performs in the global human rights system.  相似文献

During the revolutionary times, the Chinese people had fought for national independence, whereas now they are devoted to free and comprehensive development. The transition from the former to the latter is a fundamental characteristic of human rights development in contemporary China. Standing at this juncture in history, human development in China and the dream of national rejuvenation in a globalized world can actually be interpreted as a "human rights dream" shared by each and every individual in China.  相似文献

What is summarized as"harmony is of paramount importance" is a most prominent philosophical approach embraced by China's Confucian culture. This is an extension of the approach summarized as "the people are of paramount importance." It calls for harmonious human relations, obliging one to respect others' rights and interests while protecting the rights and interests of one's own. Harmony as a philosophical approach manifests itself, in many ways, in the realm of human rights in China today. To name just a few: the country's political system of multi-party cooperation under the leadership of the Chinese Communist Party, harmony that prevails between different religions in the country, and the country's call for international dialogue and cooperation to promote the human rights cause. As a fine Chinese tradition, this philosophical approach is being carried forward.  相似文献

In performing its duties, the Chinese Government has always followed the principle of "governing the country in the interest of the people," and attached importance to respect for and protection of human rights to which the Chinese people are entitled. Social and economic conditions for protecting human rights have kept improving over the past two decades, in step with the constant growth of the national strength under the state policy of reform and opening up to the outside world. Moreover, the 15th Congress of the Chinese Communist Party established "rule of law" as the fundamental principle for governance of the country and called for a judicial reform to better protect the legitimate rights and interests of the Chinese people. Judicial organs across the country have yielded positive results in implementing the principle and the reform.  相似文献

Traditional human rights theory tends to hold that human rights should be aimed at defending public authority and that the legal issue of human rights is a matter of public law. however, the development of human rights concepts and practices is not just confined to this. A textual search shows that the term “human rights”exists widely in China’s civil judicial documents. Among the 3,412civil judicial documents we researched, the concept of “human rights”penetrates all kinds of disputes in lawsuit...  相似文献

With the advent of the era of economic globalization, the United States has intensified its human rights cultural expansion as the base of its human rights diplomacy. Some people in the United States are trumpeting about "human rights dialogue" to engage in "transnational civil society" movement to sell "universalism." This new development in the US human rights culture merits full attention. This paper tries to make an initial analysis of this development for discussion with experts and scholars.  相似文献

Introductory Remarks
Nobody denies that the West was the cradle of the concept of human rights. Since the American and French revolutions of the end of the eigh- teenth century, the human rights were centered on the individual. Human rights were considered to be individual rights. However, within the expression "human rights," the word "human," meaning individual human beings, was during a rather long time understood in a rather narrow sense.  相似文献

What we call "human rights" literally refers to those rights to which members of the human race are entitled. The concept of value and human rights assume a paramount importance in China when the country is striving to develop by complementing the enforcement of rule by law and the enforcement of rule by virtue. Neither principle can be truly implemented if human rights are not adequately protected. In other words, development and improvement of human rights conditions will guarantee the development and improvement of rule by law and rule by virtue.  相似文献

This year, nothing has sparked so much interest both at home and abroad as the "China Dream" concept initiated by Xi Jinping, president of the People's Republic of China and general secretary of the Central Committee of the Communist Party of China (CPC). It not only represents a dream of national rejuvenation, prosperity and the people's well- being that has been pursued from generation to generation in China, but also a dream of human rights for which the Chinese people have long strived.  相似文献

Human rights are not isolated; rather, they are human rights situated in the soci- ety, the network interwoven with economy, politics, society, culture and so on, and human rights protection has to depend upon certain interior and exterior environments and institutional arrangement. As early as in 1948, the Universal Declaration of Human Rights has pointed out, "Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized." The realization of human rights not only involves the claim to rights themselves,  相似文献
