MEDIATION IN CHILD PROTECTION IN BRITISH COLUMBIA

The child protection mediation or case conference–implemented under the new Child, Family, and Community Services Act–is a mandatory conference in British Columbia that attempts to provide a plan of care for the apprehended child or children through a combined cooperative effort of parents, social workers, their respective counsel, parties that have an interest in the child's welfare, and the mediation judge. It is also a process that undertakes to counter the adversarial effects of trial where the potential for conflict is great and seeks to achieve the spirit of building solutions through cooperation for the continued care of the child. A year later, the results look encouraging, as two thirds of cases settle and, in British Columbia, unlike any other province, the case conference is made available in every community where court is held.     

JUDICIAL DECISIONS IN FAMILY RELATIONS IN POLAND

At a time of sweeping political, economic, and social changes in Eastern Europe, the family courts in Poland are under threat. This article traces their development and unique approach to family law and outlines the proposals for change in the Polish court system.

作者用免疫固定薄层聚丙烯酰胺凝胶等电聚焦(PAGIF)技术,调查了成都地区无关的125名健康汉族人血清Gc亚型分布。其6种亚型频率(%)分别为:Ge1F=20.8,Ge1S=8.0,Gc1F-1S=18.4,Gc2-1F=30.4,Gc2-1S=16.0和Gc2=6.4。Gc的基因频率为:Cc~(1F)=0.452,Gc~(1S)=0.252和Gc~2=0.296。对保存于室温条件下20周的陈旧血痕进行了Gc亚型定型,获得满意结果。     

THE HARMONIZATION PRINCIPLE IN CORPORATE GOVERNANCE REFORM IN CHINA

The agency theory has laid a foundation of knowledge for the review and design of corporate governance in large public corporations, but they are never exclusively symbiotic. Another insight to observe corporate governance is the adaptive efficiency demonstrated by the level of development of venture capital. Therefore, any proposal for corporate governance reform in large public corporations must be based on perspectives of both the agency theory and the adaptive efficiency theory. Otherwise, it is likely that improvements to one value (i.e. improvements by means of agency) will be at the expense of the other (i.e. improvements by means of adaptive efficiency). This theory is termed as the “harmonization principle.” Taking the Chinese State-Controlled Listed Companies (SCLCs) for example, the harmonization principle is applied to testing the reform measures for its corporate governance. With this demonstration, it intends to show the normative implication of the harmonization principle in the overhaul of corporate governance of large public corporations worldwide.     

THE HEDGEHOG DILEMMA IN THE COURT-MEDIA RELATIONSHIP IN CHINA

This paper explains why Schopenhauer＇s ＂Hedgehog Dilemma＂ may be the most apposite metaphor for the relationship between the courts and the media. Whatever they get from each other, the media＇s role representing the public and the court＇s role representing justice are both essential to modern democracy. Therefore, their relationship has attracted attention, not just in legal and media professions, but also in public and government debate. In the last two decades, China ＇s highest court has issued judicial interpretations and guidelines to regulate the activities of the media and the court, which has brought the topic to a new level of discussion. As a drafter of these official documents, the author will comment on development in this field and their interaction with values inherent to democracy.
