Human Rights,Public Budgets,and Epistemic Challenges

Ideally, governing institutions would be designed so that they would produce and implement with certainty ‘human rights-compatible budgets’, i.e. budgets that adequately reflect the obligations enshrined in human rights. However, there are various reasons why a government may ultimately fail to produce such budgets. This article focuses on under-examined challenges for budgeting for human rights: epistemically oriented challenges. More specifically, the article engages in ‘horizon scanning’, and it maps key underlying factors that can be conducive to epistemically oriented challenges to produce and implement human rights-compatible budgets. In addition, the article considers the road ahead from the perspective of institutional design.

Abraham Maslow’s classic theory of motivation was in some ways a precursor to modern evolutionary approaches to human behavior, in that he posited multiple independent and universal motivational systems. Maslow’s hierarchical model, often conceptualized as a pyramid of motives, has recently been renovated to fit with the last half century of research and theory at the interface of evolutionary biology and the social sciences. Adopting a modern evolutionary life history approach to human motivation could be useful to understand important social problems.

人性中的恶是腐败的深层基础,但权力的异化和滥用则是导致腐败的根本原因。必须正视人性中的恶及善恶互变现象,以外在的刚性制度约束和内在的文化心理约束激发人性的正能量;必须加强权力制约和监督,把权力关进制度的笼子里,防微杜渐、惩恶扬善,这是人性向善和政治走向文明的内在需求;必须加强制度设计,提高制度执行力,规范权力运用,防止制度虚置,形成不敢腐的惩戒机制、不能腐的防范机制、不易腐的保障机制,提高制度反腐的科学化水平。广大领导干部必须习惯于在监督下谨慎用权,为民掌好权,自觉抵制形式主义、官僚主义、享乐主义和奢靡之风的侵蚀,为全体人民的全面而自由的发展营造民主、平等、公正、和谐的社会氛围和精神乐土。     

Justice,Human Rights,and Reconciliation in Postconflict Cambodia

Retribution? Restitution? Reconciliation? “Justice” comes in many forms as witnessed by the spike in war crimes tribunals, Truth &; Reconciliation Commissions, hybrid tribunals and genocide trials. Which, if any form is appropriate should be influenced by the culture of the people affected. It took Cambodia over three decades to finally address the ghosts of its Khmer Rouge past with the creation of a hybrid Khmer Rouge Tribunal. But how meaningful is justice to the majority of survivors of the Khmer Rouge auto-genocide when only a handful of top officials are tried? Further, given the persistent abuse of political and economic rights in post-conflict Cambodia, we are skeptical that justice or reconciliation is presently possible.     

Human Rights,Intellectual Property,and Struggles for Recognition

This article examines recent controversies over the relationship between human rights and intellectual property rights (IPRs). Many activists have claimed that IPRs conflict with human rights. Others have argued that IPRs are themselves human rights. The article approaches the debate as an opportunity to clarify the nature of IPRs in relation to human rights, as well as the nature of contemporary struggles over these rights. After surveying the dual expansion of both human rights and IPRs and rejecting the view that IPRs are rooted in human rights, the author investigates the example of the HIV/AIDS crisis and the global Campaign for Access to Essential Medicines in order to illustrate attempts to represent IPRs as an outright threat to human rights. Highlighting the limitations of a human rights-based critique of IPRs, he concludes by proposing to study contemporary conflicts over IPRs and human rights as struggles for recognition and as struggles over the institutionalization of a transnational “recognition order.”

Human Rights Reporting: Rights,Responsibilities, and Challenges

This essay critically examines the intersections between news media and human rights in the context of the existing human rights framework. A survey of the fundamental provisions of international human rights law and of the evolving case law of human rights organs relating to media freedom and responsibilities reveals that existing gaps and underspecified obligations render problematic the normative guidance offered by the framework in addressing the pertinent human rights issues. However, this is part of the story. The problems associated with normative guidance are compounded by media practitioners’ contending approaches on the role of the media as “promoters of human rights.” The interplay between these factors is then examined through the prism of the two communities’ converging commitment to “truth-seeking.” This commitment can provide entry points to a more constructive engagement between the news media and the human rights community.     

Human Rights Violations,Weak States,and Civil War

This study examines the role of human rights violations as a harbinger of civil wars to come, as well as the links between repression, state weakness, and conflict. Human rights violations are both part of the escalating process that may end in civil war and can contribute to an escalation of conflict to civil war, particularly in weak states. The role of government repression and state weakness in leading to civil war is tested empirically. The results show that both closely correlate with civil war onset, especially if they are observed in combination. A two-stage model shows that, while low-level conflict leads to human rights violations, they increase the risk of an escalation to civil war in turn. Human rights violations are identified as an important aspect of understanding civil war onset as the result of an escalation over time and a clear early warning sign of wars to come.     

Human capital,committee power and legislative outcomes

This paper presents a model in which legislators use informational asymmetries to engage in rent-seeking behavior. Previous work in the informational and distributive traditions could not explain deviations from the median preference without reference to “committee power”. Integration of these forces demonstrated that legislative outcomes need not correspond to the median preference regardless of the extent to which committee power is present in a legislature. While deviations from the median preference are consistent with committee power, recent empirical evidence suggests that observed deviations in Congress are in fact caused by human capital differentials rather than committee power.
