Over the past decade there has been an explosion in literature on imperialism and international law. This scholarship has focused on the use of force, especially humanitarian intervention and the war on terror. These accounts foreground the issue of race, arguing that these legal arguments reproduce the dynamic of the civilising mission. This article argues that such analyses miss some key elements. Contemporary interventions must be counterposed to the First Iraq War, which was enabled through the uncontroversial authorization of the Security Council. Humanitarian intervention and the war on terror emerged in reaction to the fear that other states would veto Security Council resolutions. Consequently, the ‘racial’ discourse around intervention cannot simply be read as ‘othering’ the peripheries, but was also a response to inter-imperialist rivalry. The article then advances a conception of the arguments as an attempt to articulate hegemonic coalitions against emerging rivalries, and reads racialization in this light.  相似文献

A prominent question in the literature on democracy is concerned with the role of external factors in stimulating the process of democratization and uploading rule of law. This paper tackles the following questions: How does the political conditionality of an international organization—the EU in this case—stimulate democracy in third countries? Equally important, does conditionality always have a positive impact and could it be possible to witness the EU undermining democracy in an unexpected manner? This paper addresses these questions through an analysis of the Turkish democracy in the light of its accession to the EU and through an application of the EU membership conditionality by looking at rule of law in Turkey. The general contention in the political conditionality literature is that the EU enables an acceding country to adopt its democratic principles, and facilitates transition to democracy, while strengthening rule of law. However, the Turkish transformation seems to challenge this contention. This paper proposes that the EU’s political conditionality in bringing about political transformation in Turkey as a membership precondition unexpectedly illuminated the underlying anti-democratic tendencies and tensions in Turkish politics. The democratization process in Turkey since 1999, partly stimulated by the EU, has opened up a Pandora’s box releasing the conflict between the secularists and religious conservatives in Turkey that has long been suppressed. This article attempts to explore the post-Cold War international system in which regional orders intermingle their influence. It pays special attention to regional conflicts in East Asia in the new era and what roles global powers could play to maintain regional stability. I will first examine the characteristics of the new global order after the end of the bipolarity. I will then focus on American foreign policy in the new international system in the context of its dealing with major global events that have strategic implications for its relations with other major global powers. As to discussions of regional orders, this article focuses on East Asia, where conflicts between states have not evaporated despite the relaxation of the global Cold War confrontation. What makes this area special is the involvements of many great powers and less-powerful nations that could somehow easily manipulate the seniors into the conflicts to their favour. While the regional order in East Asia is being shaped by the post- Cold War international order, the regions peace and conflicts will in turn significantly influence global order. Finally, I will argue that dealing with problems in East Asia should acquire involvements of powers that would give necessary momentum to the existing participants to solve conflicts by the means of multilateralism. The European Union (EU) is often forgotten for its role in contributing to world order, and the EU should be taken seriously by the powers in East Asia as a possible player in maintaining the regional peace. I conclude that both global and regional security depend on continuing US unipolarity, strengthened by the co-operation of the EU in the form of multilateralism. By the same token, US unilateralism without a EU counter-balancing it, only invites potential challengers, such as China, to threaten the USs preponderant position, thereby destabilising world peace.This article was supported by a research project (NSC-P3-2414-H-004-018) of the National Science Council, Taiwan, which is gratefully acknowledged.  相似文献

What happens when the ‘international’ as a distinct social space is approached from the perspective of war rather than war from the perspective of the ‘international’? Tarak Barkawi's question (Millennium, 39:3, 2011, 701–706) is best answered by attempts to understand war not as part of inter/intra-state relations but as a socio-cultural, trans-historical institution that impacts on the ‘everyday’ lives of men, women and children. In this article I argue that war is not a disruption of the ‘everyday’, an abstraction that has a definite beginning and end, something we enter into and exit. Instead, it can be captured in daily and mundane lived experiences of people and in powerful emotions that constitute ‘self’, community and the ‘other.’ Drawing upon my research on wars in South Asia, I particularly reflect on how war shapes the banal and the fervent and how cultural and political narratives of ‘war bodies’ perform the ‘international’ in a variety of ways. Most significantly I want to draw attention to how international relations as a scholarly discipline is so deeply engaged with war and yet seems to have an estranged relationship with it.  相似文献

The current revenue system of the EU is still structured like that of an organization based on intergovernmental cooperation, although the EU is already far advanced in legislative and political integration. This antagonism gives reason to discuss whether or not the EU should be granted an autonomous tax source. Our contribution to this debate explores the factors which shape the acceptance of the EU tax option among European policy makers. A self-conducted survey among Members of the European Parliament (MEPs), which resulted in a response of some 150 of the representatives, offers us a unique database. Concerning MEPs’ revenue system preferences, our findings confirm an important impact of party ideology and individual characteristics while they indicate that country-specific factors also contribute to understand the attitudes towards an EU tax. In the light of our findings the status quo bias in the revenue system of the EU can be attributed to the persistent importance of national interests with respect to tax policy.

An important theory of international cooperation asserts that governments comply with international law because of the reputational costs incurred by reneging on public agreements. Countries that sign binding international agreements in the realm of monetary relations signal their commitment to an open economic system, which should reassure international market actors that the government is committed to sound economic policies. If the theory is correct, we should observe evidence that noncompliance is in fact costly. I test this argument by examining the effect of noncompliance with Article VIII of the IMF’s Articles of Agreement on sovereign risk ratings. The results show that noncompliance with the agreement mitigates any benefits that accrue to Article VIII signatories. The empirical evidence suggests that, in addition to improving economic and political conditions at home, governments in the developing world would improve their access to financial markets by signing and complying with international monetary agreements.  相似文献

While research has addressed the effects of international nongovernmental organizations (INGOs) advocacy on human rights outcomes, less is known about how INGOs choose advocacy targets and tactics. We combine insights from political economy and constructivism to understand how INGOs come to choose targets and tactics through the concepts of information and leverage politics, first articulated by Keck and Sikkink (1998), and salience politics, or the need to select cases that energize organization members and donors. INGOs select potential targets for advocacy and choose their tactics based on considerations of leverage potential and political salience, both of which are a function of potential target states’ aid, trade, and security linkages with major Western powers. Using data on Amnesty International’s written advocacy efforts - background reports, press releases, and new data on Urgent Actions - we find robust evidence that Amnesty International accounts for these linkages with Western powers in choosing targets for its advocacy campaigns.  相似文献

This study examines reforms aimed at strengthening the rule of law in Guatemala implemented since the signing of the peace accords in December 1996. Despite nearly US$200 million in foreign aid to the justice sector, impunity remains the rule, the judicial process is subverted by military and criminal networks, citizen confidence in the judicial system remains low and recourse to non-judicial measures – the ‘privatisation of justice’- is on the increase. It is argued that the institutionally-focused approach to rule of law reform currently predominating in donor thinking ignores the historical context within which understandings of ‘law’, ‘justice’ and ‘rights’ are shaped. Institutions do matter, but only by understanding the role of law in long-run processes of state formation and the dynamic, inter-subjective nature of legal interactions can we begin to understand the specificities of socio-legal change.  相似文献

Recent world events have highlighted the democratic potential of information and communication technologies. This article draws upon the democracy literature to develop a multilevel conceptual framework that links country-level Internet penetration and individual-level Internet use to citizen attitudes about governance in 34 developing countries. In doing so, it deconstructs “Internet penetration” into three dimensions—hardware (e.g., computers), users, and broadband—to provide greater theoretical specificity about how Internet diffusion leads citizens to adopt democratic attitudes. Results from multilevel analyses indicate that individual Internet use and the diffusion of Internet hardware shape citizens’ perceptions of the supply of democracy in their countries, and individual Internet use and diffusion of broadband lead citizens to adopt stronger democratic preferences. Theoretical and normative implications are discussed.  相似文献

Distinctions between the common and civil law are crucial when considering the rule of law and judicial independence in a political system. The 1993 Constitution of the Kingdom of Cambodia provides for a democratic government with separation of powers, judicial independence and human rights guarantees consistent with international legal instruments. However, Cambodia ranks poorly in international indices of political interference and corruption in the judiciary and for the rule of law. Drawing on interviews with Cambodian state officials and legal practitioners, the article situates the domestic judiciary within the socio-political environment and constitutional arrangements in which it must operate and examines the limits to judicial independence in the country. The article argues that the lack of judicial independence in contemporary Cambodia is not only attributable to its neopatrimonial political culture but also to the legal-institutional framework established during the United Nations Transitional Authority in Cambodia (UNTAC) period. The legal-philosophical underpinnings of civil law, the nature of the civil law system operating in Cambodia, and how it is interpreted locally, are crucial to understanding the limits to judicial independence in the country.  相似文献

Young sportspersons now serve abroad within the ‘Sport for Development and Peace’ (SDP) movement. Drawing on interviews with former interns from Commonwealth Games Canada's Canadian Sports Leadership Corps programme, this study explored what interns brought to, and learnt from, international SDP service. Interns confronted notions of expertise and privilege and, in some cases, considered the limits of Northern development stewardship. Interns also experienced a sense of ‘First World guilt’ that secured their sense of self at the expense of deeper engagements with inequality and struggles for development justice. Based on these findings, recommendations for supporting future volunteers are considered.

Identité et apprentissage dans le volontariat international : stages « Sport for Development and Peace »

De jeunes sportifs sont désormais actifs à l'étranger dans le cadre du mouvement « Sport for Development and Peace » (SDP - Sport pour le développement et la paix ). Sur la base d'entretiens avec d'anciens stagiaires du programme du Groupe canadien de leadership dans le sport des Jeux du Commonwealth Canada, cette étude a examiné ce que les stagiaires ont apporté au service SDP et ont appris de ce dernier. Les stagiaires se sont confrontés aux notions de connaissances spécialisées et de privilège et, dans certains cas, ont réfléchi aux limites de la gestion du développement émanant du Nord. Les stagiaires ont aussi ressenti une mesure de « culpabilité du Premier Monde » qui a renforcé leur sentiment de soi aux dépens d'engagements plus approfondis contre l'inégalité et de luttes pour la justice en matière de développement. Sur la base de ces conclusions, des recommandations pour soutenir les volontaires futurs sont considérées.

Identidade e Aprendizado no Voluntariado Internacional: Estágios do Esporte para Desenvolvimento e Paz

Jovens esportistas agora atuam no exterior dentro do movimento “Esporte para Desenvolvimento e Paz” (SDP). Baseando-se em entrevistas com antigos internos do programa “Canadian Sports Leadership Corps” do Commonwealth Games Canada, este estudo examinou a contribuição dos internos ao serviço do SDP internacional e o que eles aprenderam com este serviço. Os internos confrontaram noções de conhecimento e privilégio e, em alguns casos, consideraram os limites da liderança do desenvolvimento do hemisfério norte. Os internos também vivenciaram uma sensação de “culpa do Primeiro Mundo” que assegurou a consciência do seu eu às custas de engajamentos mais profundos com desigualdade e lutas por justiça de desenvolvimento. Com base nestes resultados, as recomendações para apoiar voluntários futuros são consideradas.

Identidad y aprendizaje en el voluntariado internacional: pasantías del programa Deportes para el Desarrollo y la Paz

Actualmente varios deportistas jóvenes cooperan en el extranjero en el marco del movimiento “Deportes para el Desarrollo y la Paz” (DDP). Basándose en entrevistas a excooperantes del programa Cuerpo de Líderes Deportivos Canadienses de los Juegos de la Mancomunidad en Canadá, este ensayo analiza lo que los cooperantes aportaron a y aprendieron de su experiencia internacional en el DDP. Los cooperantes afrontaron juicios de experiencia y privilegio y, en algunos casos, reflexionaron sobre los límites de la gestión basada en el desarrollo del Norte. Los cooperantes experimentaron la “culpabilidad del Primer Mundo”, que si bien provocó la autoreflexión, se hizo a costa de un compromiso más profundo contra la desigualdad y por la lucha a favor de la justicia en el desarrollo. En función de estos resultados, el ensayo formula recomendaciones para el apoyo a futuros voluntarios.  相似文献

Zambia, like a few other African countries, has been grappling with the adoption of the Access to Information (ATI) law over the past 25 years. This article argues that the Zambian approach towards easing access to public information has been faulty, because it is narrowly focused and this has resulted in the process stalling. The argument is made here, that the ATI law is part of a global social movement towards greater transparency. Furthermore, the article focuses on Zambia's approach to the law (whose push is dominated by executive control) and how that approach has impacted on good governance. The article also discusses how some countries have dealt with similar laws, before concluding that unless Zambia's move towards this law is broadened, whatever may be enacted in the future could be faulty.  相似文献

The objective of this article is to clarify the significance and usefulness of levels of analysis, a central IR concept, but one often used unproblematically. I argue that a level of analysis should be defined as a social structure that is examined for its effects on another social structure, or on the same social structure. Therefore, levels of analysis are also relational, meaning that one is defined, in part, in terms of its associated unit of analysis. Because this definition conceptualizes levels of analysis as methodological tools rather than ontological postulates, it is consistent with a wide range of positions on the agent-structure debate. More specifically, I show that the methodological issue of which levels of analysis a researcher employs is separate from the ontological issue of whether the theoretical lens is atomistic (reductionist) or holistic at any given level. One implication of this definition is that researchers need not view their ontological commitments as overly methodologically constraining. This article also addresses some questions raised by this conceptualization, among them the possibility of multiple social structures existing at a single level.  相似文献

During the past decade, academic attention to the role of private foundations in international development cooperation has greatly intensified. The largest foundations have increased their global giving and moved towards strategic social impact, but we do not know if such processes have also occurred at a more micro level. This article explores this issue by studying the international activities of Danish foundations. It finds that grant-making on global issues is increasing, and that several foundations have undergone transformations in their approach to grant-making, making them surprisingly similar to established development organisations.  相似文献

EU migration and asylum policy is facing tough challenges at the southern borders of the Union as migration and asylum pressures rise, fuelled by political instability and poverty in several regions of Asia and Africa. Current European border control practices create three spaces of control: externalised borders, through readmission and return agreements which enrol third countries in border control; the EU borders themselves through the work of Frontex and the development of a whole arsenal of technology tools for controlling mobility to and from the EU; and the Schengen area, whose regulations tend to reinforce deterrence at the borders through the Smart Border System. As a result, the EU’s balancing act between irregular migration control and protection of refugees and human life clearly tips towards the former, even if it pays lip service to the latter. More options for mobility across the Mediterranean and more cooperation for growth are essential ingredients of a sustainable migration management policy on the EU’s southern borders. In addition asylum management could benefit from EU level humanitarian visas issued at countries of origin.  相似文献
