In an attempt to understand the meaning of prison quality for Australian First Peoples, the authors examine the aspects of prison considered to be positive and negative for First Peoples serving sentences of imprisonment in the Kimberley Region in Western Australia. The meaning of prison quality as experienced by First Peoples is compared with the meaning of prison quality as defined by an existing measure of the quality of prison life. Through a qualitative analysis of interviews with 25 prisoners and staff members from West Kimberley Regional Prison and Broome Regional Prison, seven key aspects of prison as experienced by First Peoples are identified. Six of these key aspects, respect and courtesy, staff-prisoner relationships, bureaucratic legitimacy, fairness, family contact, and personal development, are consistent with dimensions previously identified as pertaining to the quality of prison life. An additional culture-traditions dimension was also identified. The findings show that the differences between prison quality as experienced by First Peoples and non-Indigenous peoples are influenced by aspects relevant to the culture and traditions of First Peoples. The authors highlight the importance of considering culture and traditions in understanding the meaning of prison quality for First Peoples.  相似文献

We focus on discovering, describing, and understanding prison recidivism; secondly, we intend to know if the prison policy contributes to deterrence of crime; thirdly, we want to know if prison labor and vocational education and training influence the rate of prison recidivism by increasing social reintegration or decreasing prison recidivism. We use a sample of n = 1643 prisoners, multivariate clustering methods, focusing on latent class models, to trace the profile of prisoners, and we use the chi-square test to test dependence/independence of some variable pairs. Data support the heterogeneity of inmates, resulting in two clusters, recidivists (50%), and nonrecidivists.  相似文献

In order to distinguish prison myth from reality, the authors examine both official and unofficial estimates of the violence and disorder in prison, as well the dual issues of whether drug abuse and gang activity in prison can be directly linked to the level of violence and disorder in correctional institutions. Based on this review, current responses to prison violence and disorder are examined; the authors argue that the key to reducing the current level of prison violence and disorder is to determine the appropriate tipping point between formal and informal social control mechanisms. The authors conclude by highlighting three distinct strategies for reducing violent incidents in prisons: (1) demand transparency, (2) require evidence-based practice, and (3) implement innovative measures of prison performance and quality.  相似文献

Operations to counterterrorism in the southern Philippines have resulted in the arrest and incarceration of a significant number of key militants. As a result, the Philippine government has expressed concern that these inmates may radicalize others and continue to operate while incarcerated. As a preventive measure, the government has considered a number of “soft” counterstrategies, including the development of a de-radicalization program. To study the feasibility of running such a program in the Philippine corrective system, this article examines two interrelated areas of enquiry concerning how terrorist inmates are housed and whether prison gangs foster or discourage radicalization in the Philippine prison system. Initial findings suggest that the integration of terrorist inmates with prison gangs may temporarily encourage disengagement and set the foundations for de-radicalization. However, without a specifically designed intervention strategy, the terrorist inmates may revert to militancy once they have returned to their original social settings.  相似文献

Opportunities for gambling in mainstream North American society have increased greatly over the past two decades. Despite the popularity of legalized gambling and attention it is receiving among social science researchers and economists, gambling within jails and prisons has been overlooked. This study utilized a semistructured interviewing procedure (Smith, 1995) to gain information about prison gambling from 11 sexual offenders on parole—all had spent significant time incarcerated. Qualitative analyses of responses suggest that offenders may gamble in various forms and for a variety of reasons, including a means of alleviating boredom, providing excitement and risk, and an opportunity to socialize. Prison gambling appears to be a complex phenomenon. A substantial amount of prison gambling seems to be associated with certain psychosocial benefits, while for a minority of cases there may be severe violence and victimization.  相似文献

Dostoevsky, Mandela, and others have long noted that prisons expose social realities, often hidden, particularly inequality and gaps between policy and practice. Prisons symbolize, mirror, and shape the communities and countries in which they exist. Although prisons informed and were intertwined with many of the defining moments of 1989, in the 20 years since, societies often failed to recognize the important role prison and punishment play in relationship to democracy. By not recognizing that “prison matters” in relationship to democracy, polities (whether in transition to democracy or established democracies) failed to adequately learn “prison lessons.” Starting with a case study of South Africa, this paper considers prisons during apartheid and under democratic governance. This case is connected to other comparative and international examples (including Russia, Brazil, and the USA) to identify five lessons learned and not learned concerning prison and democracy. First, policies and practices of imprisonment reflect social orders, especially structures of inequality and understandings of legitimate power and opposition. Second, countries transitioning to democracy seldom anticipate rising crime and invariably neglect the relevance of prisons. Third, nations do not adequately grapple with the role of prison in the past, especially the nondemocratic past. Fourth, in established and recent democracies, penal populism resulted as politicians defined prison as a solution to a host of social ills, ignoring the consequences of expanded punishment. Fifth, prisons shaped key substantive realities beyond their walls, from leadership to recidivism, scandals, fiscal deficits, and crises of legitimacy.  相似文献

Mental illness in older inmates remains an underexplored topic of interest for prison research. The present study addresses gaps in extant literature, using a nationally representative sample of 1,907 male and female geriatric inmates in the United States (age range 50–84 years; = 56) to analyze the association between mental health and predictors, such as gender, victimization, physical illnesses, and protective/ameliorative factors. The authors discuss their findings in relation to a theoretical framework that integrates the importation and deprivation models, as well as provide discourse on policy implications and future directions for research on older prison inmates.  相似文献

Suicide rates among inmate populations in prisons are considerably higher than in the general population. Suicide prevention is a common need among penal institutions around the world. Traditional approaches involving only correctional staff in suicide prevention efforts have proven to have their limitations. The involvement of inmates in peer prevention efforts seems to be a reasonable alternative approach. This study examines such a program, called SAMS in the Pen, operated jointly between the prison and the Samaritans of Southern Alberta. This service, the first of its kind in Canada, involved inmate volunteers, known as SAMS, who were trained in listening skills, suicide prevention, and risk assessment. Data was collected for the research from volunteers, correctional staff, general inmate population, and professional staff. However, given the low absolute number in the one institution where the study was carried out, statistical analyses were not practical. As with any new service, the SAMS in the Pen experienced some developmental problems but was perceived to be a worthwhile service to both inmates and staff of the prison.  相似文献

For-profit prison corporations have sold prison privatization as a tool for economic development. The idea of prisons became more appealing once for-profit prison corporation demonstrated that they could finance, build, design, and construct prisons with private capital from private investment companies. Many private prisons throughout the United States are provided local, state, and federal economic development subsidies — which may include tax advantaged financing, property tax abatements, infrastructure improvements, and personnel training and development resources. Most research on prison privatization has examined costs and quality comparisons of private run prisons to government run correctional facilities. This article examines the factors that predict economic development subsidies to private prisons, which include: economic, social control, geographic, and political factors. Logistic regression results indicate the per capita gross state product, political ideology, black male disenfranchisement, and mandatory sentencing laws predict economic development subsidies to private prison corporations.  相似文献

Thirty-two cases of suicide outside prison were identified among 7008 Irish men under investigation for sexual offenses between 1990 and 1999. Previously this risk category has not been identified. Risk ratios of 1/1644 for those accused of offenses against adults, and 1/24 for those accused of offending against minors, respectively, were estimated based on the conservative estimates found here. The increase in the base rate of suicide in Ireland during the study period is an insufficient explanation. The frequency is comparable to prison suicides for the period, and the population of risk may overlap. The incidence increases over the study period. It outpaces increases in prosecutions and may reflect responses to the changing social environment of these investigations. These men use community psychiatric services that may need to become aware of the increased risk of suicide they pose.  相似文献

Recent research suggests that women fail in leadership because men in one way or another target them and put them in unusual, difficult, and risky positions where chances for failure are high. The purpose of this article is to examine this argument based on its literature. The study also collects data from two waves of interviews with 62 women holding leadership positions in public and private sector organizations. The study finds that, while gender is the main theme in the glass cliff argument, the impact of other factors––such as jealousy, departmental politics, and self-interests––on women is inadequately examined. The study concludes that, because injustice in the workplace is oversimplified and reduced to a single factor (gender), the literature creates a glass prison that both confines women and reiterates stereotypical assumptions about women’s capabilities. The blaming and demonization of men therefore tends to have an alternative that has been neglected. Future research on women leadership should depart from the trap of genders, and engage in a wider examination of organizational, cultural, economic, political, psychological, and social factors. These factors shape not only the roles of women in leadership, but the entire the workplace.  相似文献

This study examines the recidivism of sexual offenders in New Jersey at three different time intervals: three years, five years, and ten years after release from prison. The sample is comprised of sexual offenders released from the general prison population (untreated sample, n = 150) and the Adult Diagnostic and Treatment Center (ADTC) (treated sample, n = 150), a sex offender specific facility. The goals of this study were twofold: (1) to identify the recidivism rates of sexual offenders and to determine whether sexual offenders who receive treatment demonstrate lower levels of recidivism and (2) to examine whether differences in recidivism exist among the varying time frames and offender subtypes. The results indicate that treated sex offenders maintained decreased nonsexual recidivism rates. Additionally, offenders who committed acts of rape and offenders followed up after six years had increased rates of recidivism.  相似文献

Abstract

Our review of global trends in the use of incarceration reveals that both the number of people incarcerated worldwide and the global rate of incarceration continue to increase in every global region. In addition, there have been sizable global increases in the use of pretrial detention, the proportion of female prisoners, the proportion of foreign prisoners, prison privatization, and prison crowding. After reviewing these global trends, we examine the available data on correctional performance, focusing on global crime trends in the subgroup of countries (n = 20) where three-quarters of the world’s prison population is currently located. While most (17/20) of these countries continued to increase their prison population despite decreases in most crime categories, three countries—the Russian Federation, South Africa, and Pakistan—have reduced their reliance on incarceration (number and rate) while also reducing their crime rates. Compared to other countries with large prison populations, the United States’ overall increase in both the prison population (+14.4% since 2000) and incarceration rate (+2.2) can be described as modest. Our review of global trends in corrections and sentencing policy reforms revealed an emerging focus on offender rehabilitation in both prison and community corrections settings and a growing recognition of the link between community development and crime. Focusing on the potential impact of rehabilitation-rich policy reforms in the United States, we highlight the results of a recent simulation modeling study (Taxman & Pattavina, 2013 Pattavina, A., & Taxman, F. This study reported significant, but relatively small, long-term reductions in prison populations when treatment capacity and treatment quality are increased. These findings suggest that even major improvement in the quantity and quality of prison programming—by itself—will not fundamentally change the life course of prisoners, resulting in continued high return-to-prison rates for these offenders. We conclude that for the United States to significantly reduce its reliance on incarceration, we will need to rethink our approach to crime and punishment. Our global review of corrections and sentencing strategies identified a number of possibilities. Using the global incarceration rate and the global crime rate as benchmark performance “tipping points,” we call for the development of corrections and sentencing policies—and the hiring of corrections personnel—based on the new goal of corrections: individual and community rehabilitation.  相似文献

Abstract

The movement for restorative justice (RJ) has struggled with marginalization on the soft end of the criminal justice system where the threat of net widening and iatrogenesis looms large. To realize the full potential of RJ as an alternative philosophy of justice, restorative practices need to expand beyond the world of adolescent and small-level offenses into the deeper end of the justice system. Disciplinary hearings inside of adult prisons may be a strategic space to advance this expansion. This article presents findings from a study of prison discipline in four U.K. prisons. The findings strongly suggest that in their current form such disciplinary proceedings are viewed by prisoners as lacking in legitimacy. Although modeled after the adversarial system of the criminal court, the adjudications were instead universally derided as “kangaroo courts” lacking the basic elements of procedural justice. Based on these findings, we argue that RJ interventions may offer a viable redress to these problems of legitimacy which, if successful, would have ramifications that extend well beyond the prison walls.  相似文献

For a generation, students of comparative public policy and international politics have argued that global market discipline and the increasing mobility of international "best practices" have given rise to policy convergence at the global level. This paper uses the American case to investigate some of the forces thought to have given rise to the spread of private prisons. It finds that while there are prisons in a number of countries, the evidence of convergence is thin and seems to suggest that the core of the prison privatization is in the American South. It then examines several theories—the political economy of the prison boom and overcrowding, globalization theory, the politics of the new right and the idea of a "prison-industrial complex"—that have been used to explain prison privatization and the extent to which they are consistent with the empirical pattern. Each takes us some way to understanding that pattern, but none can provide a clear theoretical mapping.  相似文献

Suicides in prison are not merely self-destructive acts or a "cry for help." They reflect the inherent need for freedom and the repercussions of imprisonment. SPACE statistics on suicides in prison reveal a rate above 10 per 10,000 in 10 European countries, 4 of which have a rate above 20. Greek data do not appear in all SPACE statistics. This fact has stimulated the present paper. Unpublished data obtained from the Greek Ministry of Justice reveal that Greece belongs to the group of countries with a rate below 10 in 1995 (the year of SPACE statistics). However, the suicide rates fluctuated widely in Greece from a low rate of 3.2 per 10,000 prisoners (convicted, on remand, or hospitalized) in 1982 to the incredibly high rate of nearly 40 in the year 1979 (11 suicides, 10 of which occurred in prison hospitals). A review of the literature indicates that various limitations mentioned in relevant studies lie in the unreliability of data (doubts about the validity of official statistics, missing data in archives, missing files on the victims, suicide in juvenile institutions not always recorded separately, etc.). The research emphasizes the importance of improving suicide statistics (recording, clearing up the incidents of deaths that are recorded without specification of cause, etc.) in order to plan and enforce suicide prevention and intervention strategies that seem to "work" in a particular milieu and are not debatable (e.g., the use of "suicide proof" cells).  相似文献

Private companies become like public agencies because competition for contracts is keen and they must be perceived by the contacting agent, government, as being agreeable with the government's demands in order to be contracted with again. Government makes suggestions, sets requirements, and provides recommendations to private companies which, over time, cause the private companies/facilities to look more and more like government agencies – and company managers are left pressed between their need to re-contract and the business instincts and acumen for which they've presumably been contracted with in the first place.
This paper will briefly visit the common arguments for and against privatization. Additionally, the results of a limited study of the effect of publicization on private prison companies operating nationally in the US will be examined.  相似文献

ABSTRACT

The purpose of this study was to determine whether persons of different racial/ethnic backgrounds differ in their perceptions of the role racial discrimination plays in the overrepresentation of Black people in the U.S. prison system. The paper also tested the gradient hypothesis of comparative conflict theory, which predicts Black people perceive the greatest amount of racial discrimination, followed by Latinx and white people, respectively. This study also tested whether perceptions of race relations between Black, Latinx, and white people influenced the role participants thought racial discrimination played in Black people’s overrepresentation. Nationally representative Gallup Poll data were used. Results partially supported the gradient hypothesis. Black people were more likely than Latinx and white people to perceive racial discrimination to explain Black people’s overrepresentation in prison, but Latinxs’ views did not differ from whites’. Participants who perceived poorer relations between Black, Latinx, and white people were more likely to consider racial discrimination to explain Black people’s overrepresentation. Findings suggest Black people and those who perceive poorer race relations are most likely to support criminal justice reform efforts aimed at reducing racial disparities in the criminal justice system.  相似文献

Two very serious prison escapes in 1994–5 prompted the Home Secretary, Michael Howard, to dismiss the Prison Service head, Derek Lewis (a contracted businessman) who successfully sued for full compensation and costs. This sacking and law suit were unprecedented events which highlighted familiar tensions about the 'policy' and 'administrative' ('operational') distinction and what passes for the theory of individual ministerial responsibility to Parliament. This article reviews four serious prison security failures in England and Northern Ireland since 1983 and the standard ministerial posture blaming operational error rather than their own policy framework. Drawing on interviews with relevant senior figures, the exceptionally politically sensitive case of executive agency status for the Prison Service of England and Wales is considered. The 'Lewis vs. Howard' affair is placed in its context of the increasingly managerial ambitions of both 'incomer' and career civil servants which conflict with traditionally comprehensive, but symbolic, ministerial responsibility.  相似文献
