According to the international legal system, countries in transition from authoritarian rule have the duty to provide truth, justice and reparations, and to prevent the recurrence of systematic human rights violations. Security sector reforms are a key preventive mechanism, and this article analyzes the impact of these reforms on the recurrence of torture, killings, and disappearances. As there are many types of reforms in the security sector, the main research question is: which reforms, or combination of reforms, are effective in preventing the recurrence of human rights violations? Brazil experienced a brutal military regime between 1964 and 1985, when security forces were involved in systematic human rights violations. A case study of the Brazilian transition from military authoritarian rule was conducted and the findings suggest that the involvement of armed forces in domestic issues, weak civilian authority, overlapping jurisdiction, and blurred lines of command within the security forces have a negative impact on the outcome of interest. During the last 30 years, many public administration reforms promoted by New Public Management have been undertaken. These reforms have spread to Latin‐American countries and include changes in governmental accounting systems, where the implementation of International Public Sector Accounting Standards (IPSASs) has been a stimulus for modernization. This article aims to clarify the situation of IPSASs implementation in the Latin‐American context as well as the stimuli for and effects of their implementation. The analysis shows that there is an emerging international trend to adopt IPSASs in Latin‐American countries although at the same time, there are evident obstacles to achieving reform goals. In Colombia, reforms are still underway, and the usefulness of IPSASs to improve decision‐making at an organisational level cannot be evaluated. Meanwhile, in Peru, the modernization is more rhetorical than real, and many efforts remain to be made for the effective implementation. Copyright © 2016 John Wiley & Sons, Ltd.  相似文献

Reform is a common theme in American public administration. During the twentieth century at least 12 major administrative reforms have taken place at the federal level and countless others in state and local governments. Frequently, these reforms have addressed the operation of public personnel management systems. Recent efforts associated with the reinventing government movement, for example, have proposed numerous alterations to civil service rules and procedures, and many jurisdictions have implemented significant changes in their personnel practices. This article examines the extent to which these kinds of personnel reforms have been implemented by state governments. A reform index is developed to document the considerable variation among the states in their approach to personnel practices. Several state characteristics are associated with scores on this index, including legislative professionalism, which bears a positive relationship to reform, and the level of unemployment within a state and the proportion of state employees associated with public employee unions, which are both negatively associated with reform.  相似文献

This paper uses March Current Population Survey data from 1985 to 2004 to explore whether social policy reforms implemented throughout the 1990s have different impacts on employment and welfare use depending on economic conditions, a topic with important policy implications but which has received little attention from researchers. I find evidence that many reforms operate differently as labor market conditions fluctuate. Although social policies increase employment during economic slowdowns, the largest effects are generated in favorable labor market conditions. The impact of time limits, mandatory job search, and cash diversion programs are particularly sensitive to the macroeconomy, while the earned income tax credit is associated with similar employment effects in most environments. The results vary substantially across policy “carrots” and “sticks,” levels of work intensity, and subsamples of single mothers, but a tentative conclusion is that a strong economy reinforces the positive incentives created by social policy reforms. © 2008 by the Association for Public Policy Analysis and Management.  相似文献

Trends in states’ civil service reforms since the Winter Commission’s report was published in 1993 are described and evaluated in the context of its recommendations. The authors argue that the commission’s reform agenda relies on a public service bargain that requires public employees, elected officials, and other stakeholders to respect, trust, and support each other’s efforts to serve the public interest. Its recommendations for modernizing state and local personnel systems are discussed and related to the “reinvention” and New Public Management initiatives of the past 20 years. Many of these ideas have been adopted by state governments, but there is no single reform model that has been followed across the states. Some states, such as Georgia and Florida, have engaged in radical reforms that include replacing traditional merit systems with at‐will employment models. The general pattern involves decentralization, deregulation, and limitation of employee protections. While many of the management‐oriented changes advocated by the Winter Commission are staples of states’ civil service reforms, its emphasis on a “trust and lead” strategy based on public service values, partnership, and leadership in the public interest has not received much attention. In general, objective evaluations of states’ reforms are needed to determine whether their purposes are being achieved.  相似文献

From zero-base budgeting to the Government Performance and Results Act, state budgeting systems have been synonymous with budgeting reform for over 30 years. This article examines the trends, both long-term and short-term, which have been identified through analysis of state budgeting office practices. Particular emphasis has been placed on understanding the changes in performance measurement over the period of 1970 to 2000. The findings reveal trends such as changes in the makeup of budget office personnel, a lack of budget offices in moving toward cost accounting, and trends in budget preparation and budget documents. Some budget reforms seem to have plateaued, beginning in the mid-1990s, while other reforms have exhibited "backsliding." It is clear that the states are not all marching in unison in reforming their budget systems. As with earlier phases of this study, the 2000 data raise many questions that will be explored in future research.  相似文献

Theories of self‐regulation in higher education claim that autonomous institutions are better able to fulfil their educational and scientific goals. The reforms initiated in Spain in thel970s and which finally crystallised in the Ley de Reforma Universitaria (University Reform Act) in 1983 have taken this path, granting autonomy to the universities and acknowledging that the policy network has been enlarged through the incorporation of new actors (students, junior lecturers, regional political elites), and that this is no longer the exclusive domain of the university professors. However, this article argues that the reforms have not had the expected results insofar as quality is concerned: deregulation has been introduced without establishing the conditions for the institutions to become fully responsible for their decisions, so encouraging the persistence of self‐interested and often anti‐scientific attitudes among many academics.  相似文献

Although Many African states have pursued substantial decentralization reforms in the previous twenty years, many of these reforms are still experiencing problems in bringing about effective local governance. Often these problems grow from the difficulty in translating general reform initiatives into specific working arrangements at the local level that are effective in several key processes and operations. Specifically these include planning and capital investment, budgeting and fiscal management, personnel systems and management, and finance and revenue. A combination of central reluctance to relinquish authority in these key areas and the complexity of organizational redesign to support decentralization seem to explain these problems. Because of difficulties collecting sales taxes on Internet sales, several states have engaged in an effort (the Streamlined Sales Tax Project, SSTP) to simplify their sales tax systems. One hope among SSTP proponents is that a simplified system will result in Internet vendors voluntarily collecting the sales tax. We address two issues:
  • ? Will states adopt the extensive reforms proposed by the SSTP?
  • ? Will vendors voluntarily collect the sales tax?
We argue that states are unlikely to adopt extensive reforms, but if they did, many vendors would voluntarily collect sales taxes.  相似文献

Abstract.  During the past decade, prevailing scholarship has portrayed France and Germany as suffering from a persistent syndrome of 'welfare without work' entailing a vicious circle between stubbornly high rates of unemployment and non-wage labor costs. Scholars blame this disease on dysfunctional political arrangements, deep insider-outsider cleavages and failed systems of social partnership. As a result, the two countries are said to be more or less permanently mired in a context of high unemployment that is highly resistant to remediation. This article departs from this conventional wisdom in two important respects. First, it argues that France and Germany have undertaken major reforms of their labor market policies and institutions during the past decade and remediated many of their longstanding employment traps. Second, it shows that the political arrangements that adherents of the 'welfare without work' thesis identify as reasons for sclerosis have evolved quite dramatically. The article supports these arguments by exploring some of the most significant recent labor market reforms in the two countries, as well as the shifting political relationships that have driven these changes. In both countries, recent labor market reforms have followed a trajectory of 'buttressed liberalization'. This has involved, on the one hand, significant liberalization of labor market regulations such as limits on overtime and worker protections such as unemployment insurance. On the other hand, it has entailed a set of supportive, 'buttressing' reforms involving an expansion of active labor market policies and support for workers' efforts to find jobs. The article concludes that these developments provide reasons for optimism about the countries' economic futures and offer important lessons about how public policy can confront problems of labor market stagnation.  相似文献

During the last decade in many European Union countries it has clearly emerged that states with weak administrative capacity at the subnational level are more likely to have serious problems with the mismanagement of Structural Funds, or even with accessing them. As a result, some member states such as Italy have embarked upon a programme of institutional and administrative reforms aimed at increasing their administrative capacity. However, retrospective data shows that even though some regions have implemented all the required reforms, their performance has remained unchanged. Along with administrative requirements, are political conditions as such to guarantee that administrative capacity can produce the desired effects? What happens if we do not have political stability that allows for continuity and coherence in administrative actions? Political stability is a controversial variable and theories within the literature present ambiguous results. Some authors strongly claim that stability hinders performance because it fosters the practice of clientelism and the entrenchment of distributional coalitions. In contrast, I aim to explore whether and why, in some cases, stability is actually a variable that accounts for better and improved administrative performance.  相似文献

The managerial reforms that have been implemented in the public sectors of many countries over the past decade are part of an international trend (Aucoin 1990, 134). Managerial reform in public administration can be seen as a Zeitgeist , a pervasive idea whose time has come. As Caiden (1988, 354) points out, effective administrative reform can be sustained only by a "crusading spirit" or the burning flame of idealism, and such a flame has blazed up in the past ten years. History may well show that the managerial reforms of the late 20th century had as dramatic an impact on public administration as the merit reforms of the late 19th century.
These managerial reforms have invariably involved an emphasis on giving the public better value for money, and have usually included the introduction of efficiency measures and corporate planning techniques, the improvement of financial management procedures, the assessment of performance in terms of results against goals, the adoption of private sector human resource management practices, and the use of management information systems and other management tools. The implementation of such managerial reforms has typically been heralded by the establishment of a unified elite group of senior executives in the higher civil service. This paper reviews the recent trends in the higher civil services of America, Canada, Britain and Australia, and considers how they exemplify the managerial approach to administrative reform.1  相似文献

This article examines whether economic reforms in transition countries reduce the incidence of informal payments to government officials. Using the 2009 EBRD-World Bank Business Environment and Enterprise Performance Survey (BEEPS) data, empirical models of the likelihood and frequency that firms are asked to make informal payments are estimated. Eight measures of economic reform developed by the European Bank for Reconstruction and Development (EBRD) are also included in the analysis, both individually and as a combined index of overall reform, to test whether reforms reduce informal payments. Firm, country, and economic reform factors are all found to have an impact. In particular, the overall reform index and all but one of the eight EBRD reform indices are found to significantly reduce informal payments. The marginal effect of a one-standard-deviation increase in the overall reform index is to reduce the probability of a firm reporting that it gives a gift by 2.5% and reduce the probability that the firm reports that gift giving is a usual practice in its industry by 4%. Enterprise reforms, markets and trade reforms, financial sector reforms, and infrastructure reforms all have the effect of reducing the likelihood and frequency of informal payments.  相似文献

ABSTRACT

The UK government under the Thatcher administration was one of the first to launch NPM-type reforms. Since then, several generations of reform initiatives can be identified in the UK—including the “quality” initiative under Major, the Blair administration's early emphasis on “Best Value,” followed by its emphasis on targets and inspection, and its recent reconversion to public governance concerns. The UK, then, represents an interesting test case for studying how several generations of reforms co-exist and inter-relate. This article examines the imprint of past reforms in the current drive towards contestability and choice in local government modernization. It argues that coercive isomorphism has been evident in local government but that resistance has been successfully mounted against each generation of reforms, that these resistance efforts have themselves displayed isomorphic tendencies but that, nevertheless, a gradual move towards a mixed economy of provision has emerged in many local authorities.  相似文献

Over the past three decades, various power sector reforms have overhauled the governance of electricity generation, transmission, and distribution in almost a hundred countries. Have these reforms produced benefits? Using instrumental variables, we improve upon earlier studies and demonstrate that power sector reforms enacted between 1982 and 2008 have both had large positive effects on the availability of generation capacity and reduced transmission and distribution losses. We also show that the positive effects on generation capacity are pronounced in developing countries and that hybrid reforms falling short of privatization and free competition are effective in improving generation capacity in particular. Overall, the results show that these reforms are an effective tool to remove an important constraint on economic growth.  相似文献

This article seeks to explain why civil service reform trajectories have differed in post-communist Europe, and why reforms have so far not led to the de-politicisation of personnel policy. It argues that the communist legacy of over-politicised personnel policy, the mode of transition and the constellation of actors after the first free elections shaped the personnel policy and civil service reform dynamics in the period directly after the change of regime. However, in terms of reform outcomes, the road to de-politicisation of post-communist civil services posed too many obstacles to lead rapidly to successful reforms. Neither governments of the left and the right nor new generations of senior bureaucrats have an incentive to engage in efforts to de-politicise post-communist civil services. The context of post-communist transformation has tended to lock in a pattern of civil service governance that is characterised by high levels of political discretion.  相似文献

Researchers have long recognized administrative reform as a constant feature of American public administration. The employee engagement initiative of the U.S. Office of Personnel Management (OPM) has become one of the most prominent administrative reforms underway in the federal government. Like many reforms, the veracity of claims about this reform have gone untested. This article addresses this gap by testing the relationship between the OPM's employee engagement initiative and agency performance. After establishing the psychometric validity of the OPM's Employment Engagement Index, the authors use a five‐year panel data set of federal agencies and two‐way fixed‐effects regression to test the efficacy of this prominent reform. The analysis shows that efforts to encourage employee engagement generally have the expected relationship with performance, but the relationship varies according to the components that make up the index and the organizational level at which these efforts are expended.  相似文献

Budgeting is an important mechanism for ensuring public accountability. How do budget reforms in the United States during the Progressive Era compare to those in contemporary China? Are administrative and legislative budget controls essential to an effective, efficient government? Though the two countries differ in many respects, significant parallels between their budget reforms are evident. In the United States, electoral accountability alone does not guarantee overall government accountability if proper budgetary institutions are absent. China's recent budget reform reveals that it is possible to develop accountability, absent open elections, but with limitations and constraints. Lessons on budgeting and accountability for other developing and transitional countries are drawn from this comparative study.  相似文献

Licensing of businesses by local governments is a common practice in many countries. While business licensing has its origins in regulation, it is often seen as little more than a revenue source for local government. This article reviews the potentially conflicting objectives of regulation and revenue generation, and outlines the various forms which local taxation of business has taken in a number of countries. In practice, the regulatory aspects of local business licensing in many developing countries are ineffective at best and counterproductive at worst, and there are pressures to sweep away most local business licences as part of deregulatory reform. Yet local governments in many countries are in dire need of revenue sources in order to finance local service provision. The article analyses the reforms that have been introduced to business licensing in Kenya. There, traditional business licences have been replaced with a Single Business Permit, with the twin objectives of increasing local revenues and reducing regulatory compliance costs on businesses.
