In this essay an evaluation of the content and determinants of the EU's response to the ICJ is provided. Two core questions are addressed: firstly, did the ICJ's judgment alter EU policy towards Kosovo and Serbia and, secondly, was EU policy towards Kosovo and Serbia effective? It is argued that the EU's response to the ICJ's judgment in 2010 has been consistent and effective, but that the underlying determinants of the policy have not changed since 2008. It is argued that the EU's response to the ICJ's judgment in 2010 has been consistent and effective and that the ICJ judgment has had a catalytic effect on the EU's influence over Serbia and the Serbia–Kosovo relationship. Overall, EU policy has been effective, despite being periodically ad hoc.  相似文献

This paper examines the 15-point agreement on normalization of relations between Kosovo and Serbia. Two mainstream discourses have prevailed since the agreement was ratified by both countries: on one hand, the Government of Kosovo has branded this agreement as historic, given the fact that in the last century no agreement has ever been reached between Kosovo and Serbia. On the other hand, Kosovo's political opposition has critiqued this agreement stressing that the 15-point agreement devastates Kosovo's statehood. Beyond both extreme stances, we argue that an enhanced autonomy for four northern Serb municipalities ought to be seen as a tool for integration, rather than disintegration of Kosovo statehood. This paper concludes that the dialogue between Kosovo and Serbia as a top-down arrangement lacks transparency, and this might jeopardize the achievements reached through this process. Moreover, the EU position should be clearly articulated that redrawing and rearranging the borders of Kosovo and Serbia might overturn the EU's and USA's immense investments in stability, peace, and prosperity in the Western Balkans.  相似文献

This article investigates the role of women's organizations and activists in the electoral breakthroughs in Serbia and Croatia in 2000. When, how, and to what effect, it asks, did women organize during transformational moments to promote their goals of political liberalization and gender equality? I argue that political opportunities—shaped by the domestic constellation of forces and international assistance programs—are essential to explaining political success. I identify what I call the insider/inclusionary strategy that characterizes women's organizing in Croatia and the outsider/oppositional strategy that characterizes women's organizing in Serbia. These strategies resulted in different immediate outcomes for women's political equality in the electoral breakthroughs in Croatia and Serbia.  相似文献

Abstract

Approximately 30 percent of all local government revenues in Serbia come from shared sales taxes. In the immediate future, the Government will have to replace sales taxes with a value added tax in order to meet EU norms. This will require a fundamental overhaul of Serbia’s intergovernmental finance system because unlike sales tax, the VAT cannot be shared on an origin basis. This paper outlines the origins of Serbia’s current intergovernmental finance system, summarizes its strengths and weaknesses, and then, in light of the necessity of change, sketches a set of reform proposals. These include creating a formula-based equalization grant funded by a fixed percentage of national budget revenues; introducing the legal possibility for block grants, categorical grants, and grants for delegated functions to fund the devolution of new responsibilities to local governments and to support specific (investment) programs; and restoring local government control over Serbia’s ad valorem property tax.  相似文献

Abstract

State death, understood as the formal loss of control over foreign policy, is an important but neglected issue in the international relations literature. When do states die and why? How do states exit the system? The consequences of state death can be wide-ranging, from forced migration movements, regional instability, to general famine. Despite these severe consequences, political scientists have yet to adequately study the causes of state death. Fazal finds that states are prone to death when they are located as a buffer between two rivals; this suggests that being a buffer state is a cause of state death. Our expansion of current research seeks to add the concept of territorial disputes to the state death literature. We suggest that states are at greater risk of death when they become involved in territorial disputes that raise the stakes of conflict. The resulting research demonstrates that a reliable predictor of state death is engagement in a territorial dispute. Territorial disputes are the most prevalent issue that leads to war and can also be a leading cause of state death.  相似文献

In 1989, as the countries of the Soviet bloc took a turn toward democracy and Europe, Yugoslavia and Serbia plunged into a bloody war and moved in the opposite direction. This article argues that the legacy of that era is still strongly felt in postwar and post-Milosevic Serbia. Now, like then, the choice is not simply for or against Europe. By holding on to the nationalism of the Kosovo myth, which territorializes both the Serbian ethnos and the opposition between Christianity and Islam, Serbia is tracing a tortuous path toward democratization and European integration. In the contemporary context, the Kosovo myth impedes Serbia’s recognition of Kosovo as an independent state; it continues to fuel the rhetoric of fractious elites that never cease to tap its capacity for rallying the public; and it provides room for “pro-European” leaders to negotiate EU integration, straddling the fence between Europe’s Atlantic propensities and the resurgent power of Russia. This nationalist myth thus plays a normative and an instrumental role, both domestically and internationally. Outside Serbia, it also engages with a narrow and “thick” notion of Europe, which gained traction within Europe itself in the post-9/11 climate of heightened fear of Islam, where cultural identity trumps the values of liberal democracy.  相似文献

This article seeks to determine whether parties’ governmental/opposition and core/peripheral positions in the Serbian and Croatian party systems are related to their responses to European integration. In general, parties’ positions in the party system were not crucial driving forces behind their stances towards the EU. However, the experience of opposition significantly contributed to ideological transformation and the adoption of a Euro-enthusiastic agenda by strategically motivated, formerly Eurosceptic parties. Also, different types of party systems in Serbia and Croatia created different opportunities for parties to express Eurosceptic sentiments, with a fragmented and polarised system in Serbia being more conducive to the sharp contestation of EU issues.  相似文献

This article contributes to debates about the break-up of Yugoslavia by focusing on Serbia’s ‘anti-bureaucratic revolution’, a large protest wave that occurred in 1988. Unlike most discussions which focus on elite involvement, this article emphasises the wider cultural resonance of anti-bureaucratic populism. More generally, this article shows that populism can be strengthened if it is coupled with producerism, that is, a discourse that divides society into productive and parasitic groups. Around 800 political cartoons from three Serbian newspapers are analysed. The common theme that emerges is the opposition of the blue-collar worker to the parasitic political functionary.  相似文献

This article examines the role of the inter-generational memory of the Second World War (WWII) in identity formation and political mobilization. An existing explanation in the ethnic-conflict literature is that strategic political leaders play a crucial role in constructing and mobilizing ethnic identities. However, based on 114 open-ended interviews with individuals born in Serbia, Bosnia and Herzegovina, and Croatia, conducted in Serbia during 2008–2011, nearly a third of the respondents make spontaneous references to WWII in their statements, usually drawing parallels between the cycle of violence in the 1990s and that in the 1940s. The question this article asks, then, is why some respondents make references to WWII spontaneously while others do not. It is argued that inter-generational narratives of past cycles of violence also constitute a process of identity formation, in addition to, or apart from, other processes of identity formation. The respondents mention WWII violence in the context of the 1990s events because they “recognize” elements, such as symbols, discourse or patterns of violence, similar to those in the inter-generational narratives and interpret them as warning signs. Hence, individuals who had previously been exposed to inter-generational narratives may be subsequently more susceptible to political mobilization efforts.  相似文献

Identity has been treated in relevant literature predominantly as a dynamic, fluid, multidimensional, and ongoing process. Currently, identity is viewed as a process, as something achieved, and as a product of social relations. Scholars have acknowledged that members of minorities and diasporas can have very complex multiple identities, which are both dependent on social context and changeable over time. This article explores the national and ethnic identifications of Slovaks living in Serbia. Its main objective is to examine how the members of the Slovak diaspora identify themselves and what kind of national and ethnic awareness and pride they hold. As well, this paper explores their opinions and attitudes on language and cultural identity. This study used a web-based survey and basic statistics. The results of the explorative study indicate that members of the Slovak diaspora living in Serbia have multiple identities that coexist, do not conflict, and vary in their importance for respondents. Distinct national and ethnic identifications are perceived in different ways and have divergent emotional intensities. This study proposes further research on the importance of civic and ethnic values and on different perceptions of identity, citizenship, length of residency, and minority rights for collective identifications of minorities and/or diasporas.  相似文献

Football (soccer) provides a useful prism for analysis of the long transition of the Serbian state and society since 1991. To a striking extent, the world of professional football and the attendant phenomena of financial corruption and football hooliganism have informed both the dissolution of the former Yugoslavia and the current concerted attempt to create a “European Serbia.” During the 1990s, football in Serbia to a significant extent became synonymous with organized crime and the criminalization of the Serbian state. Since 2000, the persistent phenomena of crime, violent hooliganism and lethargic reforms have mirrored the difficult and halting transition of the post-Milo?evi? state. Although recent events highlight the reluctance of the Serbian authorities to confront these problems, both government and sports officials are coming to see reform of Serbian football as a key element of the establishment of the rule of law.  相似文献

投资争端解决机制是《海峡两岸投资保障和促进协议》(简称《两岸投资协议》)中体现两岸特色的重要制度创新之一。相较于传统双边投资协议中的投资争端解决机制而言,两岸投资争端解决机制除了引入两岸私人投资争端解决方式,还规定了投资者与投资所在地一方投资争端的协调、协处和调解等多元化机制,实现了单方规定的协议化和国际实践的两岸化,从而有效降低了两岸投资争端的“泛政治化”风险。未来,应进一步完善两岸投资补偿争端的调解程序,确保调解协议的法律约束力和执行力。  相似文献

Since 1999, the post-Communist states have seen a series of attempts to overthrow semi-authoritarian governments, with the successful attempts known as the “colored revolutions.” However, not all such attempts have succeeded. This paper seeks to explain the variation in outcomes. Most accounts have focused on the development of grass-roots activist movements. The central argument here is that elites, and in particular security services, play a much more significant role in these revolutions than has generally been appreciated. This hypothesis is elaborated through a threshold model of protest, in which the central question is whether protests achieve a “tipping point” that makes them continue to grow larger until success is inevitable. The actions of elites, it is argued, play a decisive role in whether mass protests reach a tipping point. The argument is examined through a paired comparison of two failed attempts to overthrow governments through street protests (Serbia 1996–1997 and Ukraine 2001) with two successful cases (Serbia 1999 and Ukraine 2004). By studying cases with variation on the dependent variable, this paper seeks to improve the empirical and methodological basis of research on post-communist revolutions.  相似文献

This article discusses anti-war and anti-nationalism activism that took place in Serbia and, particularly, in Belgrade during the 1990s. It analyzes anti-war activism as aiming to combat collective states of denial. Based on fieldwork research conducted in 2004–05, and particularly on an analysis of interviews conducted with anti-war activists in Belgrade, this text closely analyzes the nuanced voices and approaches to activism against war among Serbia's civil society in the 1990s. The article highlights the difference between anti-war and anti-regime activism, as well as the generation gap when considering the wars of the 1990s and their legacy. Finally, this text emphasizes the role of Women in Black as the leading anti-war group in Serbia, and examines their feminist street activism which introduced new practices of protest and political engagement in Belgrade's public sphere.  相似文献

The article examines the relationship between NGOs and the general public in Serbia, Bosnia & Herzegovina, and Macedonia. This relationship is often perceived as troubled. Focus group findings, however, suggest that ordinary people's attitudes towards local NGOs are rather more nuanced and that quite a few people would like to join an NGO themselves, if given an opportunity. NGOs should therefore make more effort to tap into this potential, by providing more and better information about their activities available to the general public and by being more inclusive, thus enhancing both NGO legitimacy and future sustainability in the region.  相似文献

Youth have played an important role in mobilizing support for democratic revolutions during elections that have facilitated regime change. In Serbia (2000), Georgia (2003) and Ukraine (2004) youth led the way in organizing democratic coalitions among hitherto warring opposition parties that the authorities had successfully divided and ruled over. In the three countries used as case studies, youth dominated civil society and election monitoring NGOs. The article outlines a five fold framework and discusses the issues that help understand the role of youth in democratic revolutions as well as those essential conditions that lead to success. Regime change only proved successful during certain time period, in our case electoral revolutions when the authorities were at their weakest. Organization of youth groups led to the creation of Otpor (Serbia), Kmara (Georgia) and Pora (Ukraine) and provided the youth movements with structure and purpose. The training of these organized youth NGOs became a third important condition for success and often was undertaken with Western technical and financial assistance. The choice of strategies to be employed during elections was an important fourth feature. In the three country case studies, discussed in this article, the response of the authorities proved to be ineffective, weak and counter-productive.  相似文献

This research seeks to understand influences on local government integrity development as a control of corruption. Using survey data from public managers in local governments in The Netherlands, Serbia, Montenegro, and the United States, we examined three main areas: integrity policy, leadership, and organizational ethical climate. An important finding was that integrity policy comes from an indirect leadership effect that remains focused on a structural response as the primary source of ethical reasoning more than normative control. Clarity of decisions, consistency in the process of decision-making, and support for anticorruption efforts can be enhanced with a balanced approach to corruption control.  相似文献

The article provides an analysis of the determinants of the success of transitions to democracy based on a combination of qualitative comparative analysis of Poland, the Czech Republic, Slovakia, Hungary, Slovenia, Croatia, Bosnia & Herzegovina, Serbia, Montenegro and Macedonia; and hierarchical clustering. The key finding is that one can reveal configurations of several factors which jointly determine either continuous or disrupted transitions to democracy.  相似文献

This article examines the reform of the Serbian intelligence agencies since the fall of Slobodan Milo?evi? and argues that they are important actors in democratisation, with a powerful capacity to influence and frustrate the reform process. However, the Serbian experience demonstrates that the role of intelligence agencies in democratisation is complex. In Serbia, governance of the intelligence sector has been characterised neither by a simple maximisation of civil power over the agencies themselves, nor by outright resistance to change by inherently compromised, authoritarian-era structures. Instead, the role and reform of Serbia's intelligence agencies since 2000 has been closely integrated with developments in the political sphere, and has exhibited considerable continuity with past practice.  相似文献

Based on extensive field research in the Democratic Republic of the Congo (DR Congo), this article elucidates the logics, processes and readings surrounding certain ‘extra-military’ practices enacted by the Congolese army, namely the processing of various types of disputes between civilians. Exceeding the boundaries of the domain of ‘public security’, such activities are commonly categorised as ‘corruption’. Yet such labelling, founded on a supposed clear-cut public–private divide, obscures the underlying processes and logics, in particular the fact that these practices are located on a blurred public–private spectrum and result from both civilian demand and military imposition. Furthermore, popular readings of military involvement in civilian disputes are highly ambiguous, simultaneously representing it as ‘abnormal’ and ‘harmful’, and normalising it as ‘making sense’ – reflecting the militarised institutional environment and the weakness of civilian authorities in the eastern DR Congo. Strengthening these authorities will be vital for reducing this practice, which has an enkindling effect on the dynamics of conflict and violence.  相似文献
