Purpose

Critics of asset forfeiture claim that forfeiture laws create financial incentives that inappropriately influence police behavior. The present study examines the relationship between measures of the financial incentive and legal burdens for civil asset forfeiture on federal equitable sharing payments to local law enforcement to determine whether police behavior is affected by different statutory incentives for forfeiture activity.

Methods

Using LEMAS and DOJ forfeiture data, this study addresses some of the limitations of previous research by using a multi-year average for forfeiture activity, an improved measure of financial incentives for law enforcement, and multiple measures of statutory burdens to law enforcement to determine the impact of forfeiture laws on forfeiture activity.

Results

Consistent with anecdotal reports and limited prior research, findings indicate that agencies in jurisdictions with more restrictive state forfeiture laws receive more proceeds through federal equitable sharing.

Conclusions

Results suggest that state and local law enforcement agencies use federal equitable sharing to circumvent their own state forfeiture laws when state laws are more burdensome or less financially rewarding to these agencies, providing additional evidence that police operations are influenced by financial incentives.  相似文献

Scholarship focused on factors that influence police reporting has a long history in the literature. Yet we lack a complete understanding of how these factors differentially influence reporting by age.

Purpose

This paper aims to enhance our understanding of underreporting by investigating the relationship between reporting and age, and how this relationship differs by crime type. The study further investigates whether a variety of characteristics differentially influence reporting across the life course. Finally, the study asks how the nature of reporting varies by the victim's age.

Methods

National Crime Victimization Survey (NCVS) data were used to assess whether there are age-related differences in the factors influencing the rate and nature of police reporting.

Results

The findings suggest that the rate of reporting differs by crime type but that it generally increases throughout the life course. The influence of incident, victim, and offender characteristics on police reporting varies, not simply between juveniles and adults, but also between young and older adults. The proportion of incidents reported to police by the victim his/herself also continues to increase with age.

Conclusions

This suggests that disparities in police reporting cannot be reduced to juvenile-adult comparisons and should be studied across the full life course.  相似文献

Purpose

Conduct the first empirical intra-urban examination of community-level connections between street robbery and temperature. Examine whether community socioeconomic status (SES) and crime-relevant land uses strengthen or weaken the temperature impact. A theoretical framework relying on routine activity theory, crime pattern theory, and resident-based control dynamics organized predictions.

Data and methods

For Philadelphia census tracts (n = 381), monthly street robbery counts and temperature data for 36 consecutive months were combined with census and land use data, and analyzed with multilevel models.

Results

Community robbery counts were higher when temperatures were higher, and in lower SES communities. In support of previous work with property crime, but in contrast to previous work with assault, the effects of temperature were stronger in higher SES communities. In support of the integrated model, commercial land use prevalence and subway stations were associated with heightened temperature impacts on robbery.

Conclusions

Community-level fixed and random effects of temperature on urban robbery counts persist when controlling for land use and community structure; further, the random effects depend in part on both. There are implications for understanding indigenous guardianship or informal resident-based place management dynamics, and for planning seasonal police deployments.  相似文献

Purpose

Using a General Strain Theory (GST) framework, this study examines the role of various strains on officers’ organizational commitment to their agencies. In addition, the mediating effect of negative affect is investigated.

Methods

A total of 180 law enforcement personnel from multiple agencies in the Northern Kentucky area were surveyed.

Results

Two strains, the failure to achieve positively valued goals and the removal positively valued stimuli, significantly predicted greater negative affect. Negative affect did not serve as a mediating variable between strain and officers’ commitment to the department. The failure to achieve positively valued goals, the removal of positive stimuli, and the two measures of presentation of noxious stimuli all significantly and directly influenced an officer's commitment to the agency after controlling for negative affect.

Conclusions

GST is a viable theoretical framework in which to study organizational commitment among police officers as various strains have been shown to result in officers being less committed to their police agencies. Consequently, policies that attempt to alleviate those strains or stressors commonly faced by officers can increase the dedication and possibly the job performance of America's law enforcement officials.  相似文献

Purpose

Many studies have lent empirical support to the procedural justice model of police legitimacy; however, there has, as yet, not been widespread consideration of the potential impact of neighborhood- and community-level factors on people's perceptions of procedural justice or police legitimacy. The present study integrates the macro-level policing literature with the psychological-based procedural justice framework to uncover what effects, if any, the sociostructural environment has on procedural justice and police legitimacy.

Methods

Hierarchical linear modeling integrates census and survey data within a single, mid-sized city.

Results

Concentrated disadvantage exerted a marginally-significant impact on procedural justice, and on police legitimacy while controlling for procedural justice. Procedural justice remained the strongest predictor of legitimacy, even when accounting for macro-level characteristics.

Conclusions

The effect of procedural justice on police legitimacy appears to be robust against the deleterious impacts of concentrated disadvantage. This has implications for procedural justice research, theory, and policing.  相似文献

Purpose

The present study tests the hypothesis that regime nature as a structural characteristic explains variations in public confidence in the police.

Methods

Combining five sources of data from 50 nations with 69,309 respondents, the current article extends the extant research by using hierarchical logistic regression analyses with ample sample sizes at both levels to test the hypothesis with a series of control variables.

Findings

In addition to the largely consistent findings from the individual-level predictors, the results show that that there is a U-shaper convex curvilinear relationship between the levels of democracy and confidence in the police. Residents in long-term stable authoritarian regimes as well as in long-term stable democracies display elevated levels of confidence in the police, whereas short-term or unstable authoritarian nations and nations in democratic transition have the lowest level of confidence in the police. Besides, confidence in the police is higher among citizens in nations with more government efficiency and is lower among residents of countries with higher homicide rates.

Conclusion

Regime nature is important in understanding confidence in the police. In addition, governments should make more efforts to promote their efficiency in order to win citizens’ support and they are expected to reduce homicide rates.  相似文献

Purpose

Theories of procedural justice have facilitated the development of a process-based approach to policing which emphasizes the fairness of the manner in which the police exercise their discretion. The study examines whether procedurally fair behavior by the police affects two types of citizen behavior during encounters: citizen disrespect toward the police and citizen noncompliance with police requests.

Methods

This study uses data from systematic social observations of police-citizen encounters to examine procedural justice factors on citizen behavior. Because of the reciprocal nature of police-citizen interactions, an instrumental variable is used in the statistical analysis to help address the causal relationship between police force and citizen disrespect.

Results

The statistical analyses find limited support for procedural justice factors. Two types of procedurally fair behavior by the police, police demeanor and their consideration of citizen voice, are significant in reducing citizen disrespect and noncompliance, respectively.

Conclusion

Procedural justice factors have limited and inconsistent impacts on the two types of citizen behavior, and future research should address the limitations of this study and evaluate process-based policing with more data from social observations of police-citizen encounters.  相似文献

Purpose

This study examined how a specific shift system was associated with stress, sleep and health among police officers. Moreover, this study investigated whether gender moderated the association between shift work and stress, sleep and health. Additional analyses were performed to find out how stress and shift work interact in explaining sleep and health.

Methods

The findings are based on a cross-sectional survey. A written questionnaire was sent to all employees of a local police force. 460 police officers (M = 40.67 years, SD = 9.66; 25.2% females) volunteered to take part in the study. 251 subjects were shift workers (54.6%). Police officers filled in a series of validated instruments assessing stress (TICS), perceived health (SF-12, somatic complaints, health care use) and sleep (ISI, PSQI).

Results

Shift work was associated with increased social stress, work discontent and sleep complaints. In turn, shift workers reported decreased use of primary health care. Moreover, stress was associated with increased sleep complaints and lower scores in perceived health. The interplay between stress and shift work did not produce any significant effects.

Conclusions

Workforce health promotion should make attempts to reduce chronic stress, while occupational health physicians should emphasize the diagnosis of undetected sleep disorders.  相似文献

Purpose

Gang membership has been linked in a number of prior studies with inmate misconduct; known gang members are more prone than non-gang members to act violently behind bars. Theories of intergroup conflict suggest, however, there is reason to expect that broader within-prison gang dynamics, not just gang membership alone, are associated with the incidence of violence.

Methods

We collected data on inmates from a large southern state and estimated multilevel models of inmate-on-inmate violence. Included in our models were a variety of common individual-level correlates of violent misconduct, among them gang membership. Substantive prison-level correlates included the percentage of gang members and “gang integration,” the latter being a measure of gang heterogeneity.

Results

We found a modest association between both gang variables and inmate-on-inmate violence, with gang integration being the most significant of the two.

Conclusions

Gang membership is an important correlate of inmate violence, but attention to broader prison gang dynamics is clearly necessary. We discuss the implications of this finding for theories of inmate violence.  相似文献

Purpose

This study examines whether a problem-oriented approach used by police in Cincinnati, Ohio called the Crash Analysis Reduction Strategy (CARS) corresponded with a change in the number of traffic crashes that resulted in injuries after implementation onset. Under the CARS model, police developed tactics that focused on targeting high-risk driving behaviors, impaired drivers, and crash hotspot locations within the city.

Methods

Using a two-phase strategy we first assess local impact by examining injury-related traffic crash patterns at targeted locations. Second, we examine whether traffic crashes that resulted in injuries in Cincinnati significantly diverged relative to similar outcomes across a number of comparison sites.

Results

Difference-in-difference negative binomial regression analyses indicates that traffic crashes were significantly lower in Cincinnati - down roughly 5.7% to 10.3% in the post-intervention period - when contrasted with comparison sites.

Conclusions

Our findings suggest that comprehensive problem solving approaches can significantly reduce the risk of life changing events such as automobile crashes that result in injuries beyond traditional policing efforts that explicitly focus on crime and violence.  相似文献

Purpose

This article examines employment practices of criminal justice agencies within state and federal court decisions that have interpreted sex discrimination claims under Title VII of the 1964 Civil Rights Act.

Methods

After collecting and analyzing appellate court cases through the LEXIS-NEXIS and WESTLAW databases, the article examines lower state and federal court decisions that have been applied by the U.S. Supreme Court to criminal justice workplaces.

Results

The findings show that employment practices are valid if the employer can demonstrate: first, the disputed discriminatory action is based on considerations not solely dependent on the plaintiff's gender; and second, such considerations are more than mere pretext, making them justifiable under the circumstances.

Conclusions

Courts have considered a wide range of employer practices in both law enforcement and corrections agencies at various stages of the employment process, such as hiring, assignment of duties, promotion, discipline, and termination. Title VII is violated when the employers’ adverse employment action is motivated by discriminatory intent and is based on gender stereotypes. Even so, employment actions are legal when employers prove their employment actions are not based on sex stereotypes, but are either business-related or justified by “legitimate,” “important,” or “compelling” interests.  相似文献

Purpose

Procedural justice and police legitimacy have been recognized as important antecedents to people's willingness to cooperate with police officers and obey the law. What existing literature lacks, however, is a thorough psychometric examination of procedural justice and police legitimacy with respect to convergent and discriminant validity.

Methods

The present study employs confirmatory factor analysis to examine convergent and discriminant validity and ordinary least squares regression to assess whether revised scales operate similarly to ones used in past research.

Results

Results suggest that the legitimacy construct is not internally consistent and that one of its subscales loads with the procedural justice items to form a single scale composed of both procedural justice and legitimacy items. Regression analyses indicate that the modified measures operate similarly to traditional ones.

Conclusion

It is urged that researchers pursue the theoretical and empirical development of procedural justice and police legitimacy in order to further the study of the normative model of policing.  相似文献

Purpose

Existing research on criminal justice contact data has not adequately examined the quality of self-reported timing data, has produced discrepant findings on validity as it relates to demographics, and is limited in its assessment of data quality using a life event calendar method. The study described in this article assessed the validity of self-reported contacts with the criminal justice system gathered using a life event calendar with a sample of incarcerated men.

Methods

Self-reports of criminal justice contacts (i.e., arrests, jail terms, prison terms) were obtained from over 700 incarcerated men using a structured life-event calendar method. Similarly, data were collected from the inmate's official records for the same events. These reports served as an external criterion for the self-reports.

Results

Results indicated a significant degree of reporting errors for arrests using the life event calendar approach with better reporting for jail and prison terms. Additionally, individuals with the highest number of previous arrests had the greatest recall difficulties.

Conclusions

Recall of arrest presents a difficult recall task. The life event calendar method should either be modified to improve recall of specific events for criminological samples or used instead to capture information on more general and extended events.  相似文献

Purpose

A prominent explanation of why certain groups of people fear crime more than others focuses on physical and social vulnerability. Some researchers have argued that physical vulnerability characteristics (e.g., gender, age, health) are more important in determining one's fear of crime while others have argued that social vulnerability characteristics (e.g., race and socioeconomic status) are more important.

Methods

We test the independence of the physical and social vulnerability characteristics through a nationally representative sample of Americans. Using a multilevel path modeling approach, we examine whether the physical or the social vulnerability explanation is more powerful in its explanation, or whether a combination of both vulnerabilities explains fear of crime.

Results

Results suggest that the two explanations are interdependent to some degree; with the direct effects of social vulnerability being most tied to physical indicators of vulnerability through indirect effects. To a lesser degree, the direct effects of physical vulnerability are also tied to fear of crime indirectly through indicators of social vulnerability.

Conclusions

Purpose

Disproportionate minority contact during traffic stops has been a consistent source of commentary and study in recent years. While various theoretical perspectives have been employed to explain these empirical findings, the differential offending hypotheses has been largely ignored as a viable alternative explanation. Building on existing empirical evidence regarding criminal offending patterns and driving patterns, we examined the veracity of this explanation using data from an observational study of urban driving behavior.

Methods

Data were collected using an observational methodology in an urban environment. These data were then used to estimate various regression models and test the differential offending hypothesis.

Results

Analytic models indicated that Black drivers speed more frequently and engage in more severe speeding compared to White drivers, net of controls.

Conclusions

The findings suggest that citizen risk for specific police behavior is partially attributable to differential behavior prior to the encounter. These results mirror the findings of previous research in other geographic locations using different methodologies; thus, contributing to the conclusion that understanding officer decision-making and behavior requires consideration of other factors beyond a citizen's race.  相似文献

Purpose

To explore the extent to which patterns of police misconduct, particularly residual career length (RCL) and residual number of offenses (RNO), change over time in theoretically expected ways, and to determine whether such career features can adequately predict future misconduct when compared to traditional Early Intervention (EI) system criteria.

Methods

This study employs retrospective, longitudinal data gathered for a large cohort of police officers followed for a significant portion of their career and uses personnel complaints as the primary indicator of police misconduct.

Results

Distributions of RCL and RNO are presented according to 4 criteria: year of experience, complaint number, time since the last complaint, and onset of first complaint. There was a decline in RCL and RNO with experience and onset of first complaint. While RCL declined by complaint number, RNO remained steady. This is also true of time since last complaint. Risk scores derived from RCL and RNO were moderately predictive of future misconduct, but fared better than those derived from standard EI system criteria.

Conclusion

EI systems do not adequately predict future misconduct, but there appears to be value in taking a broader view of complaint patterns of officers as a way of increasing predicative validity.  相似文献

Introduction

Although in the past sexual abuse was perceived as an issue connected only with males the contemporary literature is placing increasing emphasis on the role of female sexual perpetrators. There is still disagreement about the definition of sexual abuse, the frequency that it occurs and the characteristics of the women that are sexual abusers.

Methods

Thorough research of the main databases (MEDLINE and PsycInfo), for case reviews and studies along with restriction on European and North American literature, is due to perceived culture differences. Further investigation for relevant studies through web search engines such as Google, locates agencies and organizations that are interested and connected to sexual abuse issues.

Results

Distinction between sexual offense and sexual abuse has as a result difference in the characteristics of female sexual perpetrators. They are mainly young (age up to 36 years old), friends or relatives of the victim, using more persuasion and psychological coercion and legally charged in a lesser extent compared with male abusers. However the psychological consequences for the victim can be more severe.

Conclusion

A unanimous view of what is female sexual abuse is difficult to reach. Often it is under reported, unrecognized or considered ethically more acceptable than male abuse. It is also connected with an increased self-report of history of sexual abuse of the perpetrators. A typology of female sexual abusers should be developed. Treatments focusing on different psychological interventions along with prevention and public awareness can be a powerful tool in reduction of sexual abuse perpetrated by females.  相似文献

Purpose

The current study examines significant variations in criminal achievement across sex offenders. To examine the “successful” sex offender, the study proposes a concept of achievement in sexual offending defined as the ability to maximise the payoffs of a crime opportunity while minimizing the costs.

Methods

The study is based on a sample of convicted adult male sex offenders using retrospective longitudinal data.

Results

The study findings show a wide variation in criminal achievement, a variation that is not correlated with the severity of sentences meted out or the actuarial risk scores obtained by these offenders. Those offenders who specialize in sex crimes were shown to be the most productive and least detected offenders. Two types of successful offenders emerge, the first relying on his conventional background in targeting a victim that can be repeatedly abused for a long period without detection. The second is a younger offender that is successful in the sense of being able to complete aggressions on multiple victims.

Conclusions

Results suggest that the successful sex offender is not “detected” once he enters the criminal justice system, nor is he handled in a way that may deter him from sexually reoffending in the future.  相似文献
