Purpose

The taxometric method is introduced as a way of investigating the latent structure of key criminal justice constructs.

Methods

Besides describing the theory, rationale, and procedures behind taxometrics, the taxometric method is applied to Wolfgang, Figlio, and Sellin’s (1972) delinquency cohort data to illustrate how the procedure works.

Results

After defining latent structure, its relevance to criminal justice is explored and the four core principles of taxometric analysis are described: coherent cut kinetics, consistency testing, comparison curve analysis, and evidence-based procedures. Sample and indicator preconditions for taxometric analysis are discussed and empirically-verified procedures for taxometric analysis are outlined: mean above minus below a cut (MAMBAC: Meehl & Yonce, 1996), maximum covariance (MAXCOV: Meehl & Yonce, 1994), maximum eigenvalue (MAXEIG: Waller & Meehl, 1998), maximum slope (MAXSLOPE: Grove & Meehl, 1993), and latent mode factor analysis (L-Mode: Waller & Meehl, 1998).

Conclusions

The taxometric method provides an avenue by which the latent structure of important criminal justice constructs can be explored and criminal justice research can be advanced.  相似文献

Purpose

The current study examines significant variations in criminal achievement across sex offenders. To examine the “successful” sex offender, the study proposes a concept of achievement in sexual offending defined as the ability to maximise the payoffs of a crime opportunity while minimizing the costs.

Methods

The study is based on a sample of convicted adult male sex offenders using retrospective longitudinal data.

Results

The study findings show a wide variation in criminal achievement, a variation that is not correlated with the severity of sentences meted out or the actuarial risk scores obtained by these offenders. Those offenders who specialize in sex crimes were shown to be the most productive and least detected offenders. Two types of successful offenders emerge, the first relying on his conventional background in targeting a victim that can be repeatedly abused for a long period without detection. The second is a younger offender that is successful in the sense of being able to complete aggressions on multiple victims.

Conclusions

Results suggest that the successful sex offender is not “detected” once he enters the criminal justice system, nor is he handled in a way that may deter him from sexually reoffending in the future.  相似文献

Objective

In the late 19th and early 20th centuries, criminological efforts to prevent or reduce crime were centered on addressing presumed biological causes of crime. Most of these strategies involved calls for eugenics—proposals that today are considered unethical and morally reprehensible. Biologically-oriented criminology and crime control policies have re-emerged with new sophistication and attention to the importance of social context. Additionally, developmental crime prevention, with a special focus on biological/physiological risk factors in the early life course, has become influential in criminology. This paper examines the relevance of biology to modern day crime prevention.

Materials and methods

Narrative review of the theoretical and empirical literature of biology and developmental crime prevention.

Results

There are a growing number of developmental crime prevention programs that address biological risk factors for delinquency and later criminal offending. These programs are found in the family, school, and community domains. Evidence suggests that these programs can reduce crime.

Conclusions

While “biological crime prevention” as a separate field has not yet emerged, findings show that crime prevention programs can and do address biology in a sociologically sensitive manner—and these programs have shown significant impacts on crime.  相似文献

Background

Although prior criminal record and concurrent criminal charges constitute the main eligibility and aggravating circumstances used in capital sentencing, relatively little research has examined the criminal careers of offenders who are ultimately sentenced to death.

Materials and Methods

Using official criminal history data for 618 incarcerated male homicide offenders selected from 8 states—191 of whom were sentenced to death—the current study explored the criminal careers of offenders that received the most severe legal punishment.

Results

Poisson regression incidence rate ratio models indicated that multiple measures of prior criminal activity including contemporaneous and prior history of violence, prior incarceration, early onset of arrest, juvenile homicide offending, and juvenile child molestation were associated with subsequently being sentenced to death. Separate models for white, African American, and Hispanic males showed contrasting effects in their criminal careers and varying relationships between prior criminal career and current capital offending.

Conclusion

The current study adds to the literature on lifespan criminality by applying Poisson regression analyses and a criminal careers approach to study the most extreme offenders including those sentenced to death.  相似文献

Objective

Crime prevention has entered a new, more robust phase of research activity and holds greater relevance to policy and practice today than ever before. It stands as an important component of an overall strategy to reduce crime. This paper sets out a modest proposal for a new crime policy to help build a safer, more sustainable society.

Materials and methods

Narrative meta-review of the crime prevention literature.

Results

The central features include: ensuring that the highest quality scientific research is at center stage in the policy-making process; overcoming the “short-termism” politics of the day; and striking a greater balance between crime prevention and crime control. Both simulation studies and experiences in Washington State show that early prevention can reduce crime, save money, and reduce the need for costly incarceration.

Conclusions

Quality criminological research should be used to strike a policy balance between crime prevention and crime control.  相似文献

Purpose

Despite the increased use of teen courts for first time, non-violent juvenile offenders, there has been little research examining the decision-making processes regarding which offenders are best suited for this type of intervention. The Teen Court Peer Influence Scale (TCPIS) was developed to assist juvenile justice officials in making these determinations. The purpose of the present research is to determine the predictive validity of the TCPIS.

Methods

The TCPIS was administered to a nonprobability sample of teen court participants in Florida (N = 404) between September 2006 and February 2007. Dependent measures for the validity analysis were developed from the Youth Self-administered Questionnaire and included social bonds, prosocial attitudes, delinquent peer associations, positive perceptions of teen court, and perceived delinquency.

Results

All hypotheses were supported with the TCPIS global score accounting for a significant amount of variance among each of the delinquency measures strengthening the predictive validity of the measure.

Conclusions

These preliminary findings are positive regarding the predictive validity of the TCPIS. With additional research, the TCPIS could be a useful tool for decision-makers regarding which juvenile offenders are the best fit for teen court diversion programs.  相似文献

Purpose

Many studies have lent empirical support to the procedural justice model of police legitimacy; however, there has, as yet, not been widespread consideration of the potential impact of neighborhood- and community-level factors on people's perceptions of procedural justice or police legitimacy. The present study integrates the macro-level policing literature with the psychological-based procedural justice framework to uncover what effects, if any, the sociostructural environment has on procedural justice and police legitimacy.

Methods

Hierarchical linear modeling integrates census and survey data within a single, mid-sized city.

Results

Concentrated disadvantage exerted a marginally-significant impact on procedural justice, and on police legitimacy while controlling for procedural justice. Procedural justice remained the strongest predictor of legitimacy, even when accounting for macro-level characteristics.

Conclusions

The effect of procedural justice on police legitimacy appears to be robust against the deleterious impacts of concentrated disadvantage. This has implications for procedural justice research, theory, and policing.  相似文献

Purpose

This research fulfills a void in offender mobility discourse. Metropolitan socioeconomic and spatial structure, defined in crime pattern theory as the urban backcloth, plays a significant role in shaping travel behavior; and yet, current analysis of offender mobility continues to favor individual characteristics to account for travel range.

Methods

Using a large sample of juveniles, both delinquent and at-risk youth (N = 2,552), this study compared the predictive utility of individual characteristics against indicators of urban backcloth.

Results

Delinquent youth were found to be more sensitive to the environmental conditions exerted by community-level socioeconomic characteristics than their at-risk counterparts. However, two factors—intercity hierarchical structure and motor vehicle access—accounted for travel variability among all youth.

Conclusions

Offending behavior must be examined within the context of a dynamic environmental context formed by the metropolitan socioeconomic and spatial structure. Delinquents constitute an identifiable subgroup of youth.  相似文献

Purpose

Procedural justice and police legitimacy have been recognized as important antecedents to people's willingness to cooperate with police officers and obey the law. What existing literature lacks, however, is a thorough psychometric examination of procedural justice and police legitimacy with respect to convergent and discriminant validity.

Methods

The present study employs confirmatory factor analysis to examine convergent and discriminant validity and ordinary least squares regression to assess whether revised scales operate similarly to ones used in past research.

Results

Results suggest that the legitimacy construct is not internally consistent and that one of its subscales loads with the procedural justice items to form a single scale composed of both procedural justice and legitimacy items. Regression analyses indicate that the modified measures operate similarly to traditional ones.

Conclusion

It is urged that researchers pursue the theoretical and empirical development of procedural justice and police legitimacy in order to further the study of the normative model of policing.  相似文献

Purpose

Assessments of ongoing fiscal restructuring of juvenile justice system processes and the impact such restructuring has on juvenile incarceration rates are limited. When impacts of fiscal restructuring efforts have been assessed, researchers have focused on systemic, macro level changes in incarceration rates but avoided more focused, micro level impacts. This study fills this knowledge gap by examining the recent implementation of the Redeploy Illinois program in two pilot sites. In the Redeploy Illinois program, financial incentives were provided to select counties to develop community based alternatives to incarceration. The goal was to alleviate over reliance on state funded residential facilities for evaluation and confinement purposes.

Methods

Agency data were analyzed using qualitative methods to examine the effects of this change.

Results

Results of this study demonstrated that counties participating in the pilot test of the Redeploy Illinois program were able to reduce their levels of juvenile commitment to the state. Peoria County exceeded their reduction benchmark for all but two years, and St. Clair County well exceed their reduction benchmark for all full calendar years subsequent to implementation.

Conclusions

Findings are consistent with the limited literature exploring fiscal restructuring efforts designed to reduce county levels juvenile commitments.  相似文献

Objectives

The Norwegian Mental Health Care Act allows use of coercion under certain conditions. Even though the current practice has been criticized, little empirical data exist about the attitudes towards compulsory mental health care.

Method

This study used Q-methodology to identify prototypical attitudes and to test possible differences of attitudes between groups of stakeholders towards the use of coercion in mental health care. Sixty-two respondents who represented six groups with different roles in mental health care participated: former patients, relatives of psychiatric patients, members of supervisory commissions, psychiatrists, other physicians, and lawyers.The participants were asked to assess the degree to which they agreed on 30 statements concerning use of coercion for the mentally ill.

Results

Three factors that in a meaningful way express different attitudes towards the question were found. The most widely shared attitude stated that a trusting relationship between patient and therapist is more important than the right to have an attorney. This attitude gives partial support to the present Mental Health Care Act. However, the second most common attitude argues that involuntary hospitalization, if necessary, should be decided in a court and not by the hospital doctor.

Conclusions

Differences in attitude could partly be explained by the respondents' role in mental health care. Both psychiatrists and “somatic” physicians expressed more agreement with the present legislation than the other stakeholders. The findings may have implications for the legal protection of mental health care patients.  相似文献

Purpose

The purpose of this systematic literature review is to assess the effectiveness of substance abuse treatment on alcohol and marijuana use for juvenile offenders based on existing quasi-experimental and experimental research. Additionally, a secondary aim is to compare the effects of individual-based interventions to family-based interventions.

Methods

A systematic search of literature and electronic databases through 2010 generated five experimental or quasi-experimental studies that assessed alcohol outcomes for juvenile offenders and five experimental or quasi-experimental studies that assessed marijuana outcomes for juvenile offenders.

Results

Overall, substance abuse treatment appears to have a small to moderate effect on alcohol and marijuana reduction for juvenile offenders. Interventions that showed the most promise were Multisystemic Therapy, Multidimensional Treatment Foster Care, Teaching Family, and Life Skills Training. Individual-based interventions and family-based interventions had similar small to moderate effects on alcohol and marijuana use.

Conclusion

This review highlights several promising interventions for this high-risk population; however, further rigorous study is desperately needed to provide a better understanding of what works best in reducing substance use among juvenile offenders.  相似文献

Purpose

Gang membership has been linked in a number of prior studies with inmate misconduct; known gang members are more prone than non-gang members to act violently behind bars. Theories of intergroup conflict suggest, however, there is reason to expect that broader within-prison gang dynamics, not just gang membership alone, are associated with the incidence of violence.

Methods

We collected data on inmates from a large southern state and estimated multilevel models of inmate-on-inmate violence. Included in our models were a variety of common individual-level correlates of violent misconduct, among them gang membership. Substantive prison-level correlates included the percentage of gang members and “gang integration,” the latter being a measure of gang heterogeneity.

Results

We found a modest association between both gang variables and inmate-on-inmate violence, with gang integration being the most significant of the two.

Conclusions

Gang membership is an important correlate of inmate violence, but attention to broader prison gang dynamics is clearly necessary. We discuss the implications of this finding for theories of inmate violence.  相似文献

Objective

Research demonstrates that punitive approaches to DWI employed by the judiciary have failed to significantly reduce recidivism. However, little is known about the deterrent effects of administrative and diversion sanctions. We examine whether such sanctions deter first-time DWI offenders.

Methods

We grouped combinations of administrative, judicial, and diversion sanctions routinely employed in the state of Maryland for processing drivers arrested for DWI into one of eight mutually exclusive disposition sequences. We applied this classification to Maryland drivers who had been licensed in the state and had precisely one DWI on their record prior to January 1, 1999. We then used a proportional hazards model to estimate the probability of remaining free of a new DWI during a 6-year period (January 1, 1999 - December 31, 2004) as a function of the disposition of the index violation, and of selected factors that could affect that probability.

Results

Drivers with a prior DWI were at relatively high risk of recidivating regardless of how they were sanctioned. Those who received administrative and alternative sanctions had a risk of recidivating similar to that of drivers who were convicted.

Conclusion

All dispositions sequences, not just convictions, indicate that first-time DWI offenders are at high risk of recidivating.  相似文献

Purpose

Theories of procedural justice have facilitated the development of a process-based approach to policing which emphasizes the fairness of the manner in which the police exercise their discretion. The study examines whether procedurally fair behavior by the police affects two types of citizen behavior during encounters: citizen disrespect toward the police and citizen noncompliance with police requests.

Methods

This study uses data from systematic social observations of police-citizen encounters to examine procedural justice factors on citizen behavior. Because of the reciprocal nature of police-citizen interactions, an instrumental variable is used in the statistical analysis to help address the causal relationship between police force and citizen disrespect.

Results

The statistical analyses find limited support for procedural justice factors. Two types of procedurally fair behavior by the police, police demeanor and their consideration of citizen voice, are significant in reducing citizen disrespect and noncompliance, respectively.

Conclusion

Procedural justice factors have limited and inconsistent impacts on the two types of citizen behavior, and future research should address the limitations of this study and evaluate process-based policing with more data from social observations of police-citizen encounters.  相似文献

Purpose

Extant scholarship has examined pornography's putative link to the commission of sex crime. Yet, virtually no research speaks to whether an offender's exposure to pornography during many different stages of life elevates the violence of a sex offense. The current study addresses this gap.

Methods

Using retrospective longitudinal data, we systematically investigate the effect of offender pornography exposure during adolescence, adulthood, and immediately prior to the offense on the level of physical injury as well as the extent of humiliation experienced by sex crime victims.

Results

Findings indicate that adolescent exposure was a significant predictor of the elevation of violence—it increased the extent of victim humiliation. Results also suggest a tempering, or cathartic effect of pornography—using pornography just prior to the offense was correlated with reduced victim physical injury. No effects, however, were observed for adult pornography exposure.

Conclusion

Pornography use may differentially influence offenders’ propensity to harm or degrade victims over the life course.  相似文献

Purpose

Tests of social support theory have relied on aggregate crime rates as the outcome of interest, but such a focus ignores the potentially important macro-level processes and effects on individual-level behavior We thus perform the first multi-level investigation of social support theory.

Methods

Multilevel modeling is used to explore whether the two varieties of county-level social support - the presence of charitable organizations and AFDC expenditures - are associated with recidivism in a sample of Florida prison releasees.

Results

Results show that while social support explains little variation in individual-level recidivism, a combination of private and public social support may reduce the likelihood of reconviction for drug offenses.

Conclusion

Findings provide mixed evidence for the prospect that social support—whether governmental or nongovernmental—is associated with recidivism among recently-released inmates.  相似文献

Purpose

In light of the mounting research on the “new punitiveness”, an important but largely unanswered question is the extent to which a country's penal policies and punitive sentiments are actually reflected in prisoners’ experiences. The aim of the current study is to examine how prisoners perceive correctional officers’ behavior in English and in Dutch prisons.

Methods

A cross-sectional design was used, in which we conducted semi-structured interviews with 25 Dutch prisoners incarcerated in England and 25 English prisoners incarcerated in the Netherlands. The interview schedule covered a number of topics addressing divergent aspects of life in prison, including staff-prisoner relationships.

Results

In English prisons, despite the ostensible efforts to improve prison life, the attitude is more confrontational, staff-prisoner relationships are more detached, and staff members seem more unresponsive and more inclined to punish. In Dutch prisons, where responsibilization and a market orientation have supposedly replaced rehabilitation, staff is perceived as more helpful and fair, and interactions with Dutch staff are more informal and less authoritarian.

Conclusions

These findings suggest that penal policy and increasingly punitive sentiments in society are not necessarily mirrored in the practice of prisons, and concomitantly, in prisoners’ perceptions of correctional officers’ behavior.  相似文献
