宗教是古代国际法的重要渊源之一,在东、西方的国际法遗迹中均有所反映。现代国际法的一些原则、规则,如“条约信守”和战争法规则等,曾在不同程度上受到宗教教义、组织、学说等因素的启示、促进。宗教中蕴涵的某些伦理道德如“和平”、“互惠”,对未来国际法的完善具有积极价值。  相似文献

出家就是抛弃世俗社会的行为规则,采用灵修世界的行为规则。民法是为世俗的国民制定的,原则上不适用于出家人,他们有自己的身份法。无论是天主教还是汉传佛教,莫不如此。此等法限制出家人的民事权利能力,由此完成世俗社会与灵修世界的区隔。所以,公民的权利能力一律平等的规定是错误的,因为出家人的权利能力受到了限制。这种限制是他们自愿承受的,所以,权利能力不得放弃的命题也是错误的。  相似文献

Sarah Gordon's The Spirit of the Law: Religious Voices and the Constitution in Modern America (2010) details the advent, beginning in the 1940s, of a “new constitutional world” pertaining to the religion clauses. By focusing on case studies, Gordon's narrative history shows the emergence, maturation, and waning of a rich historical moment in which religiously motivated popular constitutionalists had a profound impact on how the Constitution was technically interpreted by the courts. Shifting perspectives from history to ethnography, the essay synthesizes Gordon's stories to yield an anatomy of “religious” popular constitutionalism as it appears in Gordon's book and conjectures at what it might look like if we left court records behind.  相似文献

作为共同调整人类社会的规范,法律与宗教存在着千丝万缕、多个向度的联系。从目的指向来看,法律与宗教都关心人类生存的方式与意义;从思想和制度角度来看,法律中的许多思想和制度都发源于宗教和宗教规范;从西方法治建设的演进历程来看,西方法治的形成得益于人们从内心真正信仰宗教权威与规范的传统;从功能上来看,法律和宗教都有凝聚和调试社会等功能,共同成为维系社会的纽带。当下中国,深刻认识宗教与法律的多向度关系之于落实依法治国以及正确应对宗教社会问题都具有重大的意义。  相似文献

Each source is seen as vital due to its ability to compensate for the shortcomings of the other two sources. How are international law firms faring in China? Drawing on 2013 data, this article presents the first comprehensive overview of the field, including information about the global mix of players and variation in market niche. Three variables—years present in China, global strategy, and level of localization—help explain why some China practices grow bigger than others. Overall, however, there is a great deal of convergence on one business model: an outpost office with a median size of eleven lawyers responsible for under 5 percent of worldwide revenue. The common experience of stagnation following market entry illustrates the strength of hype, the constraints of partnership, and the persistent power of the Chinese state to shape the legal services market. At the same time, the rarity of market exit reflects perceptions that a China presence is a valuable symbol of global commitment and a worthwhile bet on future growth.  相似文献

A substantial scholarship has studied the extent to which states across the political and geographic spectrums rely on legal, bureaucratic, and judicial institutions to govern religion. However, a deeper inquiry into the mechanisms through which regulation occurs has yet been achieved. This article foregrounds conversion, understood as mobility between social groups in which belief and sincerity may figure but is not reducible to either, to observe these dynamics. Through an analysis of Egyptian jurisprudence on the right to change religion as well as interviews with complainants and litigators, the article challenges widespread assumptions about who and what constitute the regulatory field. It also shows how religious difference is produced in the legal‐bureaucratic encounter. By accounting for institutions that are not typically considered part of the regulatory field nor thought to be bound by the strictures of legal positivism, this article further occasions a rethinking of the public–private distinction within critiques of secularism.  相似文献

This article presents a paradox in the thought of Edith Stein betweenher attitudes in relation to the state/law problem and her vision ofreligion. I seek to explain the paradox through the study of the Theoryof the State and Sovereignty. In this regard, basing herself onclassical authors, Edith Stein disagrees with the great jurists of hertime who did not always recognise the priority of the concept ofsovereignty. The examination of the relationship between the State andlaw breaks new ground within her phenomenological position, by, on theone hand, defending a strong concept of sovereignty of the State seen asa legal a priori while on the other hand stating that the State doesn'trelate to spiritual values. This leads us to propose a particular viewof the semiotic processes relevant to the relation between law/stateand religion, illuminating the semantic-pragmatic factors which promptedStein towards the above contradiction.  相似文献

The fate of the rule of law in fragile states rests in religious politics. Three defining periods of Somali politics illustrate this argument. First is the authoritarian regime of Mohamed Siad Barre in Somalia (1969–1991). This dictatorship used religion to rule by law. The regime executed religious leaders for disagreeing with the government's interpretation of Islam. Second is the rise of Islamic courts in Mogadishu, Somalia's capital city (1991–2007). The Islamic courts apprehended criminals, expelled warlords, and provided spaces for Somalis to resolve disputes peacefully. Third is the breakaway of Somaliland (1991–present). Somaliland has advanced Islamic legal principles to build peace and constitutional law. Taken together, these three periods demonstrate how religious politics transform law and society.  相似文献

Semiotics provides the tools for studying the process of decoding law, one of the most important tasks in the daily work of courts. The semiotic review of juridical interpretation and gap filling concludes that in juridical and semiotic methodology the same question—how a norm is interpreted—is answered from different perspectives. According to the semiotic model proposed in the current paper, juridical interpretation can be structured into three levels: intra-, inter- and supranormative sign-process. For legal theory semiotics can highlight the similarities in the interpretation of norms and gaps. In gap filling the iconic, indexical and symbolic relations compensate for the missing of intranormative semiosis. The applicability of the proposed model is tested on an example of case law. Semiotic investigation of the judgements of Supreme Court of Estonia and European Court of Human Rights shows that semiotics gives a well structured picture of the juridical interpretation process.  相似文献

超出世俗理性主义的法史研究模式,重建古代中国法律与宗教的真实联系,颇有必要。古代法官的司法经验中附着于城隍神身上的“神迹”不完全是神道设教的虚构,而可能是真实的个案。城隍神作为正义守护神的构成原理具有四个部分:儒法合流的理性主义法律体制不足以解决法律全面实施的难题;神道设教的传统国策可以发挥神灵震慑的作用;只有在城隍神的法庭上才可能实现远比国法所能企及的更大的正义,就是使一个人对其生前死后一切行为负责的因果报应正义;源源不断的报应故事使神迹和神明建立起了因果联系。还原正义守护神的构成原理有助于理解为什么与宗教疏离的法律会失灵。  相似文献
