The combined application of the four spectrometric techniques UV, IR, NMR and MS is an important analytical tool for the identification of the increasing number of potential poisons with which the analysts in the fields of forensic sciences and toxicology are confronted. Some of the contributions of these techniques to toxicological analyses are reviewed and illustrated by a few examples. Furthermore, the incorporation of the four methods into the analytical scheme, the requirements with respect to quantity and purity of the unkown substances, as well as the different possibilities for the combination of separation and identification techniques are outlined.  相似文献

The synthesis of isoheroin is presented with the analytical data (mass spectroscopy [MS], nuclear magnetic resonance [NMR], infrared spectroscopy [IR], and gas liquid chromatography [GLC]) for this compound. Recently, a sample containing cyclopropylfentanyl was analyzed at this laboratory. Cyclopropylfentanyl began to appear in the United States' illicit drug markets in 2017. Unfortunately, cyclopropylfentanyl presents an analytical challenge due to its mass spectrum being almost identical to that of crotonylfentanyl. There are two possible isomers of crotonylfentanyl, Z- and E- crotonylfentanyl. In order to provide sufficient analytical data to distinguish the two isomers of crotonylfentanyl and cyclopropylfentanyl, crotonylfentanyl was synthesized and fully characterized. Each isomer was analyzed via nuclear magnetic resonance spectroscopy, gas chromatography–mass spectrometry, and Fourier transform infrared spectroscopy. During the synthesis of crotonylfentanyl, an unknown compound was formed. The identification of this compound and the analytical characterization of the two isomers of crotonylfentanyl are presented. Through the comparison of these compounds, it was confirmed that cyclopropylfentanyl can be differentiated from crotonylfentanyl.  相似文献

Quality assurance is a pre-requisite for operational forensic genetic laboratories and professional organisations such as ENFSI, SWGDAM or ISFG. These organisations provide guidelines/recommendations for the methods used (both for analysis and evaluation), and for reporting. Aspects regarding analyses will generally be found in the accreditation scope, contrary to evaluation. Moreover, proficiency testing on how to evaluate and report results is still in its infancy. This is problematic as the quality of forensic science services for the administration of justice crucially depends on how results are evaluated and conveyed.In this paper, we use examples of written and oral statements to illustrate how accreditation could improve and ensure that guidelines on interpretation are properly implemented, reviewed and maintained. We underline the need for certifying and validating the knowledge of the experts in that specific field. Indeed, analytical techniques have for many years been the focus of accreditation, rather than the soundness and logic of communication of the value of the results obtained with these techniques. It is now time for a shift and to provide means that ensure that forensic scientists’ conclusions are as justifiable as their analytical methods.  相似文献

National security planners have begun to look beyond reactive, tactical cyber defense to proactive, strategic cyber defense, which may include international military deterrence. The incredible power of nuclear weapons gave birth to deterrence, a military strategy in which the purpose of armies shifted from winning wars to preventing them. Although cyber attacks per se do not compare to a nuclear explosion, they do pose a serious and increasing threat to international security. Real-world examples suggest that cyber warfare will play a lead role in future international conflicts. This article examines the two deterrence strategies available to nation-states (denial and punishment) and their three basic requirements (capability, communication, and credibility) in the light of cyber warfare. It also explores whether the two most challenging aspects of cyber attacks – attribution and asymmetry – will make cyber attack deterrence an impossible task.  相似文献

Dynamic systems simulation analysis is an analytical technique that allows for the modeling of complex, nonlinear systems. While this technique is currently not widely used in the social sciences or in criminal justice planning, the author argues that more attention should be given to these models in criminal justice. These models can be used in a variety of ways—to gain greater insight into processes of system change, to track the development of specific system populations (e.g., drug offenders, elderly offenders), and to estimate projected system growth and change over a variety of legislative and policy scenarios—making them useful tools for theoretical development and policy evaluation, as well as more pragmatic considerations such as program, facilities, and overall system planning. When drugging related offences are cited, most people think of sexual assault. However, the law covers any crime committed whilst the complainant is under the influence of alcohol or drugs i.e. the use of a drug to modify a person's behaviour for criminal gain. The case types encountered include robbery, blackmail and of course sexual offences.Hair analysis for drugs is now well established in Forensic Toxicology. Its use as an analytical tool in workplace testing, post-mortem toxicology and criminal cases is expanding both in the UK and worldwide, and it is now widely accepted as an alternative or complimentary matrix for these cases. This paper will provide a brief overview of hair testing in cases of Drug Facilitated Crime stressing the importance of timely sample collection. Its usefulness in cases of this type will be highlighted through case examples.  相似文献

This article examines the politics of place in relation to legal mobilization by the anti-nuclear movement. It examines two case examples – citizens' weapons inspections and civil disobedience strategies – which have involved the movement drawing upon the law in particular spatial contexts. The article begins by examining a number of factors which have been employed in recent social movement literature to explain strategy choice, including ideology, resources, political and legal opportunity, and framing. It then proceeds to argue that the issues of scale, space, and place play an important role in relation to framing by the movement in the two case examples. Both can be seen to involve scalar reframing, with the movement attempting to resist localizing tendencies and to replace them with a global frame. Both also involve an attempt to reframe the issue of nuclear weapons away from the contested frame of the past (unilateral disarmament) towards the more universal and widely accepted frame of international law.  相似文献

This paper applies a Gramscian analytical framework to scrutinise the judicial decision-making process. Based on two distinct research projects, the article explores how, on one hand judges in criminal courts can be identified as part of the bureaucratic machinery of the state, as ‘technicians of repression’; whereas, on the other hand, human rights judges can be distinguished as providing ‘moral and intellectual leadership’ in their production and reproduction of certain values. Some of the key questions this article seeks to answer are: What is the role of hegemony in the judicial decision-making process? To what extent are legal actors both ‘technicians of repression’ and ‘moral and intellectual leaders’? This paper uses examples from empirical research conducted at courts in Argentina and at the European and Inter-American Courts of Human Rights to identify and explore this dual role of judges as both repressive technicians and moral and intellectual leaders in neo-liberal capitalist societies.  相似文献

Mitochondrial DNA (mtDNA) analysis of forensic samples typically is performed when the quantity and quality of DNA are insufficient for nuclear DNA analysis or when maternal relatives may be the only reference source. Many of the steps required in the analytical process are both lengthy and labor intensive. Therefore, improvements in the process that reduce labor without compromising the quality of the data are desirable. The current procedure requires purification of the amplicons by centrifugal filtration after PCR and prior to cycle sequencing. Because this method requires several manipulations to perform, alternate cleanup procedures were investigated. These include the use of 1) Qiagen QlAquick PCR Purification columns, 2) Concert Rapid PCR Purification columns, and 3) ExoSAP-IT reagent. When the yield of purified amplicons, quality of the sequence profile, and ease of assay were evaluated, the use of ExoSAP-IT reagent for post-amplification purification was chosen to replace the filtration method.  相似文献

Siting contested infrastructure such as repositories for nuclear waste very often faces strong local resistance. One major reason for this opposition may arise because siting processes do not appropriately consider fairness issues such as transparency, the availability of options, or the sufficient involvement of concerned and affected people. The aim of this study was to analyze people’s concerns related to justice in siting nuclear waste. Besides procedural aspects, both distributive justice and outcome valence are considered important and therefore the “total fairness model” by T?rnblom and Vermunt (Soc Justice Res 12:39–64, 1999) was used as a framework. In three quasi-experimental studies (N 1 = 53; N 2 = 56; N 3 = 83) applying conjoint analysis, respondents ranked 11 vignettes with the three attributes procedural justice, distributional justice, and outcome valence. Each vignette represents a realistic scenario of a site selection process for the disposal of nuclear waste in Switzerland. All the three studies yield a consistent result: vignettes representing a situation with a fair process are top-ranked by respondents; situations with negative outcome valence are ranked lowest; distributive issues turned out to be of minor importance. We conclude that procedural fairness should be given more attention in any kind of contested infrastructure siting and that real-world examples like the one discussed here can inform justice research.  相似文献

The accompanying paper in this issue describes work conducted during a collaborative effort to identify the victims of a mass disaster that occurred on the 19th of April 1993 near Waco, Texas. The DNA identification programme was also used partly as an exercise to further investigate the robustness and reliability of a recently developed STR quadruplex. The preceding paper provides details of the loci used and also deals with efforts to assess the applicability of STR profiling and its suitability for forensic investigations of this nature. In this paper, we present the results obtained from 61 Waco bodies. Using reference blood samples and family trees 26 positive identifications were made using a ‘paternity style’ analytical approach. Worked examples, representing a range of casework situations, are used to illustrate the kind of approach taken in interpretation of the data and highlight factors which affected its success. Additionally, we report on the successful application of a PCR-based gender test to 24 of the Waco bodies.  相似文献

In this address, I revisit the micro–macro problem in criminology, arguing for an “analytical criminology” that takes an integrated approach to the micro–macro problem. I begin by contrasting an integrated methodological‐individualist approach with traditional holist and individualist approaches. An integrated approach considers the concept of emergence and tackles the difficult problem of specifying causal mechanisms by which interactions among individuals produce social organizational outcomes. After presenting a few examples of micro–macro transitions relevant to criminology, I discuss research programs in sociology and economics that focus on these issues. I then discuss the implications of social interaction effects for making causal inferences about crime and for making crime policy recommendations.  相似文献

More often than not, restorative justice is said to take roots in Indigenous practices. In fact, Indigenous and other traditional mechanisms of justice are often described as examples of restorative justice practices. In New Zealand, the government equates the Mãori approach to doing justice with family group conferences (FGC); a restorative justice mechanism which it claims embodies Mãori values and preferences. This article contends, however, that the type of ‘justice’ embodied in customary mechanisms, has often been taken out of context, and rendered universal and ahistorical through its representation as restorative justice mechanisms. Using fieldwork evidence, an analytical comparison between principles of restorative practices, New Zealand’s FGCs and the Mãori approach to justice was conducted. It concludes that this tendency to equate restorative justice with Indigenous approaches to law and justice is harmful and dangerous for it risks rendering the scholarship homogenizing and universalizing restorative justice, to the detriment of local preferences and practices.  相似文献

在我国核电大发展的背景下,核安全许可制度对于确保安全前提下的核能利用具有重要意义。我国通过各种层级的法律法规初步建立了由核设施许可、核活动许可、核物质许可、核活动从业资质许可构成的核安全许可制度体系。面对核安全监管的紧迫需求,我国还需从核安全许可立法体系和管理体制两方面对核安全许可制度进行完善。正在制定中的《核安全法》应发挥核安全基本法的作用,对现有的核安全许可进行统筹安排。  相似文献

Two synthetic cannabinoids have been identified, during a survey, as new adulterants; they might have been intended to be used as ingredients for smart drugs. The characterization of these compounds has been made by gas chromatography–mass spectrometry (GC–MS), Orbitrap high resolution mass spectrometry (HRMS) and nuclear magnetic resonance (NMR), leading to the identification of WIN48098, a compound disclosed as a new adulterant in herbal and powder products, and AM679, identified in Italy for the first time.Taking into account the high number of synthetic cannabinoids seized during the last year in Italy, how quickly they appear on the illegal market and the rapidity required for analytical results, a method was developed for the simultaneous quantitation of several synthetic cannabinoids, using gas chromatography–flame ionization detection (GC–FID).  相似文献

Most narcotics‐related cases in the United States involve Cannabis sativa. Material is typically identified based on the cystolithic hairs on the leaves and with chemical tests to identify of the presence of cannabinoids. Suspect seeds are germinated into a viable plant so that morphological and chemical tests can be conducted. Seed germination, however, causes undue analytical delays. DNA analyses that involve the chloroplast and nuclear genomes have been developed for identification of C. sativa materials, but they require several nanograms of template DNA. Using the trnL 3′ exon‐trnF intragenic spacer regions within the C. sativa chloroplast, we have developed a real‐time quantitative PCR assay that is capable of identifying picogram amounts of chloroplast DNA for species determination of suspected C. sativa material. This assay provides forensic science laboratories with a quick and reliable method to identify an unknown sample as C. sativa.  相似文献
