This article discusses the U.A.L.R. child protection mediation program as well as several other child protection mediation programs in order to examine what makes a program a continuing success. Child protection mediation programs have gone through a period of tremendous progress and growth over the past 20 years in the United States and Canada. Numerous studies have shown that child protection mediation helps families and courts by lowering the amount of time that children spend in foster care and the amount of costs for courts and agencies. Child protection mediation is an essential tool for juvenile courts and the families that have cases there. This article addresses the development of child protection mediation programs, their importance to juvenile courts, and some reasons that these programs succeed or fail. Although many of these programs have early accomplishments, they have not always been able to maintain their growth or to continue to exist. The U.A.L.R. Mediation Project has not sustained its early levels of cases or referrals from court for numerous reasons. Using the techniques of other thriving programs, we will attempt to restart and re-energize the program. It has been established that the people who have a role in the establishment of a program, the funding sources and especially the commitment of the parties to the program all have a significant long-term impact. This article points out how programs should begin and proceed if they are to be a long-term success.  相似文献

This article reviews the creation, development, and growth of child protection mediation (CPM) in the United States. Starting with a few pilot projects in the 1970s, CPM has grown throughout the country. The article traces child protection's development through the publication of the Resource Guidelines and Model Courts and then discusses what the necessary ingredients for a mediation program are. Mediation is then discussed from a judicial perspective. Barriers to mediation are listed, followed by a discussion of special issues that arise when developing and maintaining CPM programs. The article concludes with the observation that CPM is now recognized as a best practice by most judges and court improvement professionals and that it continues to grow.  相似文献

Consensus approaches to child protection decision making such as mediation and family group conferencing have become increasingly widespread since first initiated about 25 years ago. They address but are also constrained by paradoxes in the child protection system about commitments to protecting children and to family autonomy. In a series of surveys, interviews, and dialogues, mediation and conferencing researchers and practitioners discussed the key issues that face their work: clarity about purpose, system support, family empowerment, professional qualifications, and coordination among different types of consensus-building efforts. Consensus-based decision making in child protection will continue to expand and grow but will also continue to confront these challenges.  相似文献

After approximately 15 years of research on court-based dependency mediation programs, answers have emerged for many, but not all, of the questions that surround dependency mediation. This article explores what has been learned about court-based dependency mediation through research and what new and persisting questions remain. The article reviews empirical studies of child protection mediation. The topics considered include what we have learned about the organization and structure of mediation programs, what have we learned about settlement in mediation, and whether there are benefits to mediation beyond the mere fact that settlements are reached.  相似文献

Prisoner reentry constitutes one of the central criminal justice challenges confronting U.S. society. Coinciding with this emerging social problem has been increased policymaker interest in faith-based programs to improve outcomes for vulnerable populations, including released prisoners. Critical questions about the nature and effects of faith-based reentry programs remain largely unaddressed, however: (1) What is a “faith-based” program? (2) How does or could such a program reduce recidivism and improve other behavioral outcomes among released offenders? (3) What is the evidence concerning the impacts of faith-based reentry programs? (4) What are critical implementation issues that may affect the operations and impacts of such programs? This article examines each of these questions and identifies critical conceptual, theoretical, and research gaps in the literature. It highlights that the term “faith-based” is used inconsistently, that the precise causal relationship, if any, between various measures of faith and crime remains in question, and that few rigorous evaluations of faith-based reentry programs exist. It then discusses recommendations for improving knowledge and practice.  相似文献

Child protection professionals work in a multidisciplinary system in which the law and the family court play central roles and which collects an increasing amount of data. Yet we know little about what impact the law has on whether a child is removed by child protective services, is deemed neglected by a family court, or reunifies with a parent. Do state‐to‐state variations in child protection laws, or changes by individual states to their laws, lead to different outcomes for children and families? The dramatic variations in child welfare practice from one state to another suggest that legal variations do matter. Yet empirical research on these questions is scarce both because we collect too little data to measure all such issues, and, because we have failed to study the data we do have. This article is a plea for researchers to rectify that problem and for policymakers to improve data collection. Doing so would facilitate a more clear understanding of the law's effect on child protection outcomes and aid policymakers and advocates in identifying both promising and problematic practices and legal reforms.  相似文献

In 1997, the Office of Child Support Enforcement initiated the State Child Access and Visitation (AV) Grant Program, which involves annual awards of $10 million to states to promote the development of programs to alleviate access problems. Telephone interviews with 970 parents who used mediation, parent education, and supervised visitation programs funded by AV grants in nine states revealed that the programs are reaching diverse groups of parents including many low-income, non-White, and unmarried parents who receive no other type of access assistance. The programs also appear to be achieving the major objectives posited for them by the federal government. One-third to one-half of noncustodial parents in every program type reported that parent–child contact increased following program participation, with supervised visitation users who typically had the lowest levels of parent–child contact reporting a significant increase in the number of days of contact. A review of child support records for 173 program users in three states revealed that child support payments increased among participants following program participation, especially for never-married parents who paid a significantly higher proportion of what they owed. These findings are similar to results reported in a five-state study of mediation programs funded by AV grants that was conducted by the Office of the Inspector General. However, both studies have some serious limitations, including low response rates and the absence of a nontreatment comparison group.  相似文献

In recent years, mediation has become a device used to settle disputes in the area of child protection. The first legislatively based child protection mediation program in Canada was implemented in the province of Nova Scotia in 1993. This program has been criticized for not safeguarding children from neglect and abuse, for redundancy with respect to settlements offered by child protection workers, for its nonuse of child protection workers as mediators, and for power imbalances between negotiating parties. It has also suffered from a low number of referrals to mediation. The Nova Scotia experience emphasizes the need to gain support not only from child protection agency leadership but also from frontline staff to create a stable and beneficial mediation program. Even in light of the complications with respect to child protection mediation in Nova Scotia, there is a growing interest and implementation of mediation programs throughout Canada.  相似文献

One of the greatest challenges that parents face in child protection mediation (CPM) is to voice their concerns and negotiate on a relatively equal basis with the other mediation participants. This article considers how imbalances of power, limited confidentiality protection, and the personal problems that bring parents into the child protection process can limit a parent's ability to exercise self-determination in mediation and offers guidance for mediators seeking to conduct CPM in a manner that effectively empowers parents to meaningfully and collaboratively participate in mediation.  相似文献

This has been a big year for privacy with so much going on within the EU regarding reform of data protection. What are the implications of reform here and what are the issues that concern us about the proposed new data protection regime contained in the proposed Regulation? We hear a lot about the ‘right to be forgotten’. How is that possible in the digital age within the online world? And what can be done about the big players who stand charged with the erosion of privacy viz Facebook, Google, Skype & YouTube etc? How can the law keep up with technological change when the latter is moving so fast e.g. with RFID, Cloud and social networking? To what extent can data breach notification, net neutrality and privacy impact assessment help and how should the law approach issues of liability and criminality in relation to privacy? What is the state of play too in the relationship between privacy policy and state surveillance and, given its implications for privacy, what obligations should governments adopt in response to cybersecurity regulation and data management? Is there a place for privacy self-regulation and if so in what respects and how effective are the Information Commissioners who often complain of being under resourced? In reviewing the way privacy law has emerged do we now need a completely new approach to the whole issue? Has the law crept into its present form simply by default? Do we need some new thinking now that reflects the fact that law is only one dimension in the battle for privacy? If so what are the other factors we need to recognise?  相似文献

Several child protection conflict resolution program directors and researchers talked about how best to initiate a networking effort for their field. In September 2007, their conversations culminated in a Think Tank in Columbus, Ohio. This was a collaboration of judges, program directors, researchers, and representatives from national organizations that work in child protection. Participants felt this was a successful effort and that the meeting provided networking opportunities and many provocative discussions. In order to facilitate a meeting that would be meaningful for the Think Tank participants, input was solicited from as many constituent groups as possible. Surveys and interviews were completed in the summer of 2007, which shed light on themes that were ripe for discussion and improvement. This article details the survey and interview results and includes some brief comments from the Think Tank itself. Thoughts about future research in child protection conflict resolution are also provided.  相似文献

Family group conferencing (FGC) and child protection mediation maximize family engagement in child welfare cases by prioritizing families' roles in discussions and decisions. This article examines how FGC helps professionals to focus on family and community strengths, encourages family engagement, and provides targeted case plans for families and timely, permanent placements for children. It explores how courts and agencies use these interventions to empower families to contribute to resolutions in ways that are not possible in traditional litigation processes. These complementary processes help children and families by providing forums where families are allowed to make informed choices and take an active role in creating plans for their future.  相似文献

This article describes, and explains the rationales for, the establishment of an innovative program in which a law school and two social services agencies are collaborating in a mediation clinic that uses the transformative model of mediation to serve clients in cases that seem ideally suited to benefit from this approach to practice—so-called "PINS" (persons in need of supervision) cases involving conflict within families, between parents and their adolescent children. The article first describes the evolution of the PINS system and the changing views of its purpose, especially in New York State. It then offers a brief introduction to the unique features of the transformative approach to mediation and explains why that approach in particular is likely to mesh with current understandings of the needs of the families involved in these cases. Finally, the article describes the innovative "Family Solutions Program" and how it uses transformative mediation to help these families and suggests that experience of this program shows how use of the transformative model, in particular, could be valuable not only for clinical education but also for effective volunteer training and supervision in mediation programs generally.  相似文献

Settling cases poses a challenging task for the mediator. Most disputes are hotly contested by both parties or they would not have progressed to the point of entering the court arena or mediation. Yet, despite differences in the nature of their cases, the organization of each program we have studied, and the style of mediation predominating in each, striking similarities exist in the techniques used by the mediators to settle cases. Observation of over 40 different mediators in 175 mediation sessions in three programs suggests that in order to do the job which they are charged with accomplishing—bringing mediation cases to settlement— mediators develop a repertoire of strategies employing a variety of sources of power. Mediator strategies fall into four principal categories: presentation of self and the program, control of the process of mediation, control of the substantive issues in mediation, and activation of commitments and norms. Mediators empower themselves by claiming authority for themselves, their task, or the program based upon values external to the immediate situation, or manipulate the immediate situation so that settlement is more rather than less likely. Based upon their differential use of these strategies, mediator styles fall along a continuum between two types: bargaining and therapy. Mediation seems to range between a bargaining process conducted in the shadow of the court to a communication process which resembles therapy in its focus upon exploring and enunciating feelings .  相似文献

What kinds of family structures emerge after a couple relationship is formed? How are obligations perceived towards the family of origin and the family of the partner? How are obligations perceived towards the older generation and towards children? How are conflicts of interest approached or resolved? How are the obligations arising from these personal relationships affected by gender, ethnicity, culture and religion? This paper reports some findings from a qualitative study of 39 men and women aged 25–40 which investigates the social context for the legal regulation of couple relationships; whether marriage, cohabitation or civil partnerships.  相似文献

The adoption of a single EU currency market raises questions about how individual country mortgage policies are likely to affect the gains that can be realized from this larger market. We use an option pricing model to provide some perspective on this issue. We address questions such as how does the risk exposure of a mortgage guarantee program in one country compare with those in other countries? What kind of effects do any such differences or varying legal restrictions on lender recourse have? Do the programs help complete financial markets? That is, are the programs structured as unsubsidized financial intermediaries which help allocate risks? Or, are the programs essentially wards of the state which encourage risk taking? In short, we aim to provide a simple, tractable way to think about how individual country policies affect the ability to exploit the potential offered by the larger market. Our conclusions are three. First, when correctly structured, mortgage default insurance can be expected to reduce non-price rationing at an actuarially fair price. It follows that to the extent that such programs lead to more complete markets without subsidies they are also more efficient than are the many schemes now used which rely on subsidies to address mortgage market incompleteness. Second, considerable care must be exercised in the development of such instruments. In a number of countries the pricing policies do not appear to be prudent. The program terms imply either that regulators often expect a much safer economic environment than seems likely, or, alternatively, the programs have been conveying either unbudgeted subsidies or incurring contingent liabilities. Such liabilities have already been realized in Sweden, and the current exposure in the Netherlands as well as with the restructured program in Sweden, appear to be large. Finally, we find that the potential geographical risk diversification provided by the single currency market can be expected to reduce mortgage rates and improve risk allocation. However, legal, fiscal, and regulatory issues with respect to credit risk limit the ability to exploit this larger market.  相似文献

The Child Protection Mediation Program in Cook County, Illinois is the result of a collaborative effort on the part of the court, its stakeholders, and the attorneys involved in child protection cases. Child protection mediation empowers families and includes parents in many decisions impacting their children. It also helps judges to move children's cases through the legal system more rapidly and in a more efficient and humane manner. This results in children achieving more timely permanency. The program is sustained in part due to frequent outreach to, and input from, the program's consumers. These help to ensure that the program is meeting the diverse needs of the court, the families, and the professionals involved in the cases.  相似文献

There are more than three million reports of abuse and neglect each year. Some children may enter the court system while others will voluntarily or by court order enter a mediation program. What these children have in common is these youths are often removed from their home and placed in foster or institutional care without ever expressing their wishes or concerns. This Note advocates for the adoption of model standards drafted to ensure universal and meaningful child participation. The Model Standards are set forth in detail and accompanied by useful tips on their implementation. Through the course of this Note, the benefits of child participation are outlined, as are the reasons most often given for denying children the opportunity to meaningfully participate. The Note concludes with an explanation of how the benefits derived from implementing these standards far outweigh any potential negative side effects.  相似文献
