USING A JURY SIMULATION AS A CLASSROOM EXERCISE

The authors' empirical research project considers the effects of differences in actual legal rules on jury decisions and, concurrently, gives business students the opportunity to participate in a realistic jury experience. The project uses actual trial evidence to produce a videotaped simulated trial presentation thereby insuring that the testimony, legal arguments, jury instructions and facts are realistic. To date, approximately 2,000 business students have participated in the simulation, under the supervision of 13 different Academy members at 11 different universities. This article describes the project and its curricular benefits within the context of an introductory course in law.     

A JURY OF PEERS

The frequent inquiries received at our Chicago offices about juvenile juries prompted us to allot some space to it here. To date the National Council has taken no position on their use. A study done in 1965 by the National Council on Crime and Delinquency of eighteen teen-age juries showed many of the claims made on behalf of the teen-age jury—for example, that it gives a teen-ager “a fair trial by a jury of his peers”—are dubious. “The juvenile jury lacks legal foundation and signifies a de facto surrender of judicial authority and responsibility. No substantial evidence was found to support the assertion that the teen-age jury reduces juvenile delinquency and youth crime. The procedure perpetuates the archaic and unsound practice of jury sentencing long abandoned, even for criminal cases, in all but a few states.”     

A JURY DEMONSTRATION

In teaching classes in The Legal Environment of Business or Introduction to Law about the role of the jury in the civil or criminal case, instructors may find it helpful to conduct a voir dire demonstration to introduce students to the mecahnics of the jury selection. Instructors may find the following jury demonstration useful in engaging the interest of the class and teaching them about this area of law.

SOCIAL CLASS AS A FACTOR AFFECTING JUDICIAL DISPOSITION Defendants Charged with Criminal Homosexual Acts

This article examines the proposition that criminal defendants from lower social classes receive more severe judicial disposition than do criminal defendants from hgher social classes Evidence from cases involving prosecution for felonious homosexual acts does not lend much support to the proposition that there is social class bias in judicial disposition of criminal cases. Several models are discussed which might be used to orient future research into how courts handle criminal cases.     

SPARE THE CHILD AND HIT THE POCKET: TOWARD A JURISPRUDENCE ON DOMESTIC ABUSE AS A QUANTUM FACTOR IN FINANCIAL OUTCOMES ON RELATIONSHIP BREAKDOWN

Should domestic abuse, rightly condemned so often by the family courts, be a factor in the financial outcome on relationship breakdown? If so, how should it be taken into account? As a pure factor of economic loss? As part of either negative contribution by one or the greater positive contribution by the other? Only if exceptional violence? Or as part of society's condemnation of domestic abuse? What difference is there between abuse which has a direct financial impact, for example, on future earning or needs and abuse which has no obvious outward financial impact? If there were to be any compensatory element, how does this fit in with other quantum factors? This article looks at developments on this issue in a number of countries, to share lessons learned, consider some of the problems of introducing abuse as a quantum factor, and start to consider a jurisprudence on when it is and is not appropriate as a factor, with a view to encouraging a wider debate.     

PRECOCIOUS ROLE ENTRY AS A MEDIATING FACTOR IN WOMEN'S METHAMPHETAMINE USE: IMPLICATIONS FOR LIFE‐COURSE AND PATHWAYS RESEARCH*

Precocious adoption of adult roles and responsibilities at an early age often has been linked to substance abuse and criminal behavior. Yet, much of the existing research suggests that early offending behaviors induce precocious movement into adulthood; less attention has focused on the way in which early adoption of adult roles and responsibilities might itself contribute to the onset of offending. In the following article, we examine the cumulative impact of early transitions into adult roles and responsibilities on the onset of methamphetamine (MA) use. Through inductive analyses of interviews with women methamphetamine users, we identified a range of adult roles and responsibilities that women described as facilitating their initiation into MA use, including family caretaking, motherhood, independent living, and peer and romantic associations with adults. Such findings have theoretical implications for both life‐course perspectives and feminist pathways research. They highlight the importance of attending to the timing and sequencing of experiences as well as highlight the gendered nature of these processes.     

DETERMINING THE EFFECTIVE REPRESENTATION OF A CHILD IN OUR LEGAL SYSTEM

This note addresses the process by which lawyers must determine their role and responsibilities with regard to a child-client. The authors engage in an analysis of current standards, such as AAML, ABA, Fordham Conference. and Jean Koh Peters, by employing a case study.which was modeled after an actual case that was being handled by the Hofstra University School of Law Child Advocacy Clinic. The case study is then applied to the four current standards and to the ethical standards proposed by The Model Rules of Professional Conduct and the Quebec Bar Association's findings.     

CROSS-NATIONAL VARIATION IN HOMICIDES: IS RACE A FACTOR?

J. P. Rushton has done research indicating that predominantly black nations have higher rates of violent crime than predominantly white nations, which have higher rates than predominantly Asian nations. He attributes these differences to constitutional, inheritable factors on which the races vary. This article discusses the numerous problems with Rushton's use of international crime data and analysis, foremost of which are his use of one-way analysis of variance and lack of consideration of other causes of variation. Regression analysis-including dummy race variables and other relevant explanatory variables-indicates no significant association between race and cross-national homicide rates, the best and probably only valid indicator of cross-national variation in violent crime. This is the case whether reanalyzing Rush-ton's data or analyzing properly adjusted, inspected, and selected homicide rates.     

BANK-FIRM RELATIONSHIP AS A STRATEGIC COMMITMENT IN A DUOPOLISTIC ENVIRONMENT

By using a three-stage game, this paper shows that an investmentin the banking sector may commit a duopolistic firm to a moreaggressive output stance. This aggressiveness is translatedby an outward shift in the firm's reaction function, thus increasingits own output and decreasing its rival's output. While it isindividually beneficial for a firm to invest in a banking business,both firms taken together in a duopoly industry are made worse-offby such an investment, because they produce too much. Firmsare caught in a financial version of the prisoner's dilemma.     

INTERPARENTAL CONFLICT AS A RISK FACTOR FOR CHILD MALADJUSTMENT: Implications for the Development of Prevention Programs

This article reviews research on the effects of interparental conflict on children and examines its implications for divorce education programs designed to reduce conflict after divorce. Basic research indicates that prevention programs for parents will be most effective in fostering children's adaptation to divorce if they can reduce the level of destructive conflict that children are exposed to, foster good parent–child relationships, and keep children from being caught in the middle of parental tensions and disagreements. Programs for children are likely to be most helpful if they help children learn ways to cope with situations in which they feel pressured to side with one parent against the other and avoid feeling responsible for parental problems. Although psycho-educational programs are widely available and often court-mandated, evaluation studies are rare and support for their efficacy is mixed.     

THE REASSURANCE FACTOR IN POLICE PATROL

In addition to its more obvious functions, police patrol also has the function of citizen reassurance-providing feelings of safety that a citizen experiences when he knows that a police officer or patrol car is nearby. Since this function is highly related to both visibility and awareness, it is svggested that in locations of both cognitive centrality and high density, fixed posts be established that would both serve the reassurance function and provide another communication link between the police and the public. Recent studies by Milgram. Sommer, Hall, and Lynch have all contributed to our understanding of what Milgram calls “the congnitive map of the city,” and this concept can be utilized in the pursuit of safety.
