世纪之交我国有组织犯罪的特点及趋势

有组织犯罪被联合国大会宣称为"全球性瘟疫",我国刑事立法已予以确认.本文从侦查学角度精要论述了世纪之交的特定历史时期我国有组织犯罪在犯罪主体、犯罪时间、犯罪地点、犯罪对象、犯罪手段方法等诸方面的特点,并在此基础上对其发展趋势作了理性分析.     

我国有组织犯罪的嬗变与法律制度的完善

有组织犯罪是历史、文化和社会的产物,从近代中国开始我国有组织犯罪经历了一个从有到无以及再生的嬗变过程。20世纪90年代以来,我国以黑恶势力为代表的有组织犯罪不仅死灰复燃而且发展势头凶猛,严重危害政治经济、社会稳定和人民群众安全感。自1997年《刑法》修订以来,我国已建立了基本的打击与预防有组织犯罪法律制度,但是还很不系统、不完整和不健全,远远不能满足扫黑除恶专项斗争和长效治理有组织犯罪的需要。当前我国扫黑除恶专项斗争应以贯彻《联合国打击跨国有组织犯罪公约》为契机,借鉴国内外立法的经验,通过制定专门的单行法律——《反有组织犯罪法》,完善打击与预防有组织犯罪的法律制度,确立扫黑除恶的常态化工作机制。制定《反有组织犯罪法》应坚持系统、科学、规范的原则,分别从法律术语、有组织犯罪集团及行为特征、体制机制和程序措施、预防手段、国际合作等方面健全我国打击与预防有组织犯罪法律制度。     

Stockholm Syndrome: Radical Islam and the European Response

This paper argues that too restrictive an understanding has governed both academic and popular analysis of the social, cultural, and political conflicts between the Western European majorities and their Islamic minorities. These conflicts are typically viewed through the prisms of majority racism and/or minority economic disadvantage. While such social facts are undoubtedly important, I argue that the ideology of radical Islamism must be taken seriously in any analysis of the problem. Thus, I do two things in this essay. I outline the elements in twentieth-century radical Islamic writings that relate to the relationship between (broadly understood) Islamic and Western civilization; I also offer an overview of the now long-lived situation of culture war in Western Europe that supports my argument that Islamic cultural pathology, more than European racism, is the chief causal factor. This is intended as a warning that “clash of civilization” and “Islamo-fascism” models, usually disparaged in the academy, must be taken quite seriously.     

刑法修正案(七)侵犯军用标志犯罪解读

针对侵犯军事标志犯罪现象,<刑法修正案(七)>对原刑法条文进行了修改,增设了新的犯罪,印非法生产、买卖武装部队制式服装罪、伪造、盗窃、买卖武装部队专用标志罪、非法提供、使用武装部队专用标志罪,它们都是选择性罪名.     

论赃物犯罪中的犯罪对象——以刑法修正案（六）为视角

刑法修正案(六)虽然对赃物犯罪的修订力度较大,不仅扩张了赃物犯罪的对象范围、行为方式的种类,而且加重了其法定刑的配置。但这次修订也并不尽如人意,赃物犯罪的对象是否仅限于有体物,不动产能否成为其犯罪对象,赃物是否仅限于经济价值之物,财产性利益可否成为赃物,赃物与相关财物的厘定等问题也没有较为明确的规定,因而探讨并厘清这些问题对于指导司法实践将有所裨益。

International financial and regulatory reform continues in 2014, building upon the burst of crisis‐induced institutional and regulatory reforms begun in 2008. In particular, the Financial Stability Board is an element and an agent of reform and this paradigm shift. The leap taken was and remains a predominantly technocratic central banking macroprudential narrative and process, controlled by this elite epistemic community. As the new regulatory normal evolves in 2014, it now does so at a slower pace, as the crisis appears to abate. Today elements of paradigm defence, maintenance and resilience are seen.
