有组织犯罪被联合国大会宣称为"全球性瘟疫",我国刑事立法已予以确认.本文从侦查学角度精要论述了世纪之交的特定历史时期我国有组织犯罪在犯罪主体、犯罪时间、犯罪地点、犯罪对象、犯罪手段方法等诸方面的特点,并在此基础上对其发展趋势作了理性分析.  相似文献

有组织犯罪是历史、文化和社会的产物,从近代中国开始我国有组织犯罪经历了一个从有到无以及再生的嬗变过程。20世纪90年代以来,我国以黑恶势力为代表的有组织犯罪不仅死灰复燃而且发展势头凶猛,严重危害政治经济、社会稳定和人民群众安全感。自1997年《刑法》修订以来,我国已建立了基本的打击与预防有组织犯罪法律制度,但是还很不系统、不完整和不健全,远远不能满足扫黑除恶专项斗争和长效治理有组织犯罪的需要。当前我国扫黑除恶专项斗争应以贯彻《联合国打击跨国有组织犯罪公约》为契机,借鉴国内外立法的经验,通过制定专门的单行法律——《反有组织犯罪法》,完善打击与预防有组织犯罪的法律制度,确立扫黑除恶的常态化工作机制。制定《反有组织犯罪法》应坚持系统、科学、规范的原则,分别从法律术语、有组织犯罪集团及行为特征、体制机制和程序措施、预防手段、国际合作等方面健全我国打击与预防有组织犯罪法律制度。  相似文献

This paper argues that too restrictive an understanding has governed both academic and popular analysis of the social, cultural, and political conflicts between the Western European majorities and their Islamic minorities. These conflicts are typically viewed through the prisms of majority racism and/or minority economic disadvantage. While such social facts are undoubtedly important, I argue that the ideology of radical Islamism must be taken seriously in any analysis of the problem. Thus, I do two things in this essay. I outline the elements in twentieth-century radical Islamic writings that relate to the relationship between (broadly understood) Islamic and Western civilization; I also offer an overview of the now long-lived situation of culture war in Western Europe that supports my argument that Islamic cultural pathology, more than European racism, is the chief causal factor. This is intended as a warning that “clash of civilization” and “Islamo-fascism” models, usually disparaged in the academy, must be taken quite seriously.  相似文献

It has recently been suggested that philosophy – in particular, epistemology – has a contribution to make to the analysis of criminal and military intelligence. The present article pursues this suggestion, taking three phenomena that have recently been studied by philosophers, and showing that they have important implications for the gathering and sharing of intelligence, and for the use of intelligence in the determining ofstrategy. The phenomena discussed are: (1) Simpson's Paradox, (2) the distinction between resiliency and reliability of data, and (3) the Causal Markov Condition.  相似文献

刑法修正案(六)虽然对赃物犯罪的修订力度较大,不仅扩张了赃物犯罪的对象范围、行为方式的种类,而且加重了其法定刑的配置。但这次修订也并不尽如人意,赃物犯罪的对象是否仅限于有体物,不动产能否成为其犯罪对象,赃物是否仅限于经济价值之物,财产性利益可否成为赃物,赃物与相关财物的厘定等问题也没有较为明确的规定,因而探讨并厘清这些问题对于指导司法实践将有所裨益。  相似文献

Little is known of the history, structure and operations of the Italian intelligence services in the Mediterranean and the Middle East. The challenge brought by Fascist Italy to the security of the British and French imperial systems is at the heart of this article, which sets out to assess not only the imperial dimension of Fascist intelligence but also the response provided by Britain's and France's colonial authorities to Mussolini's ambitions in the Mediterranean and the Middle East. An examination of British and French intelligence archival material sheds new light upon perceptions of power and threat afforded by British and French policy-makers keen to maintain political control over their colonial and client states. The paper suggests that despite comprising a multitude of competing agencies, the Fascist services could rely on the work of motivated individuals and on the support of Italian diplomatic representatives overseas. Their ability to establish relations – although short-lived – with Arab nationalist leaders and their intense activities in British colonies, protectorates and mandates generated concern within the British Foreign and Colonial Offices. Meanwhile, poor intelligence coordination and assessment coupled with misguided assumptions about the nature of Arab nationalism hindered Britain's response to the challenge mounted by Mussolini's regime.  相似文献

This paper explores political drivers and policy process of the reform of the framework for Artificial Intelligence regulation and governance in the European Union (EU). Since 2017, the EU has been developing an integrated policy to tighten control and to ensure consumer protection and fundamental rights. This policy reform is theoretically interesting, raising the question of which conceptual approaches better explain it, and it is also empirically relevant, addressing the link between risk regulation and digital market integration in Europe. This paper explores the policy reform mainly by using two case study methods—process tracing and congruence procedure—using a variety of primary and secondary sources. It evaluates the analytical leverage of three theoretical frameworks and a set of derived testable hypotheses concerning the co-evolution of global economic competition, institutional structure, and policy preferences of domestic actors in shaping incremental approach to AI regulation in the EU. It is argued that all three are key drivers shaping the reform and explain the various stages of the policymaking process, namely problem definition, agenda-setting, and decision-making, as well as the main features of the outcome.
