获取基本医疗服务是公民保障生命健康的基本权利,应当通过法律加以明确,使之成为"拟制公共产品"。公共卫生服务与基本医疗服务是两种性质不同的服务,不宜用一部法律来统一规定,因此全国人大《基本医疗卫生保障法》的立法模式是不适宜的,应当单独出台《基本医疗服务法》。政府提供基本医疗服务的范围主要包括基本医疗保险、基本医疗救助、基本药物和基本诊疗项目、基本医疗服务体系和基本医疗设施、基本医疗服务人力。公民的医疗服务请求权可以通过诉讼救济,医疗服务请求诉讼的类型属于行政给付之诉。  相似文献

Under the public utilities franchise system, the executive branch may transfer the task of providing public utilities services for the common good to a private party. It should undertake to regulate and prevent the private party from pursuing its own interests to the detriment of public interest while discharging its duty under the public utilities franchise. Since any public interest must be enjoyed by all individuals, we can say that the obligations owed under administrative regulations aim at the ultimate goal of increasing individual welfare. In the public utilities franchise system, regulations of this kind can be divided into six different categories: maintaining and promoting necessary market competition, ensuring the continuity of public utilities services, ensuring non-discriminatory provision of public utilities services, ensuring the quality of public utilities services, ensuring reasonable charges for public utilities services, and ensuring the conservation of energy and protection of the environment while providing public utilities services. The absence of governmental regulation of the provision of public utilities and of reforms in such services in China has harmed both public interest and the rights and interests of consumers. Some of the problems caused include chaotic market access for public utilities, no guarantee of the sustainability of public utilities, the failure of the universality of public utilities, declining quality of public utilities, sharp rise in the prices of public utilities, insufficient regulations on the conservation of energy and environmental protection, and so on. In order to achieve the effective implementation of the administrative regulations and obligations therein with respect to public utilities and the maximization of public interest, the Chinese government should enhance its consciousness of regulating public utilities, improve the legal system to regulate public utilities, perfect the regulatory system for public utilities, and establish a system of liability to compensate for failures in regulation.  相似文献

在多元社会背景下,为了整合各种形态的特殊利益,代表公共利益的国家借助法律的形式,建立起一种法律秩序,使其对社会的控制和管理合法化。公共利益也表现出从法律外的抽象政治理念到具有实质内容法律概念的现代转向,公共利益法律化的主要内容在于寻求公共利益的确定法律内涵。从实体和程序两个角度探讨公共利益的法律化忽视了公共利益作为法律概念与非法律概念的区分。将公共利益视为一个不确定法律概念,围绕着其规范目的进行具体化研究是公共利益法律化的有效路径。因而,公共利益的法律化不应停留在立法对公共利益概念的表述,更应当完善确定公共利益法律内涵的法律界定模式。  相似文献

Abstract: This article will explore some of the legal and organisational challenges facing the various agencies involved in the delivery of criminal justice, in the UK, in adhering to the Equality Act 2006, Equality Duties and the forthcoming Single Equality Act (which, proposes a Single Equality Duty). We will consider the impact of these changes with reference to European legislation. Of particular interest will be the themes of effective implementation of the current Duties, equality of access and equality of outcome for both victims and offenders to appropriate services to tackle offending behaviour and the prevention of crime. This article will highlight issues surrounding impact assessment and the role of agency discretion and regulation. We offer some comments on future directions and the role of the regulatory bodies including the Equalities and Human Rights Commission (EHRC).  相似文献

公共利益的价值定位和公用事业的自然垄断等特性,使得市场竞争机制及以维护竞争为目标的反垄断法在公用事业领域难以充分发挥作用,而对公用事业进行法律干预又是必要的。实践证明,监管制度因其独特价值而成为法律干预公用事业的优选。但要实现监管的制度价值,法治尤为关键,即追求良性的监管依赖于完善的法律制度基础和可靠的法律促进机制。公用事业监管的法治化应包含"有理"、"有权"、"有限"、"有效"、"有责"等核心要素。公用事业改革的国际经验也证实了监管法治化的重要作用。  相似文献

公共法律服务体系建设现代化的核心问题是满足人民群众追求美好生活日益增长的法律服务需求,为实现共同富裕发展目标提供全方位的法治保障。现代公共法律服务体系建设的地方立法例中,均集中体现出对公共法律服务基本概念和调整范围的反思与分歧,为此亟待厘清公共法律服务应然规范构造理论,这是未来形成公共法律服务全国统一立法的法学理论基础。公共法律服务专门立法在整个公共法律服务规范体系中具有纲领性地位,公共法律服务体系建设改革实践不仅具备基本服务与非基本服务二元结构架构特征,而且越来越多地呈现出多元和多维架构的本质特征。现有二元规范构造理论已经不能全面解释和解构现有的公共法律服务体系建设实践发展的全样本和多维度、多元化样态,只有建构多元化的现代公共法律服务规范体系才能根本解决现有公共法律服务地方立法例实践及理论研究中出现的关于基本概念、规范类型、规范属性、调整方式、权利属性等诸多基本争议,从而确定公共法律服务的权利义务主体、事项范围、模式与程序、标准与评价指标、监督管理等主要体系建构的基本规范要素,进而归纳整合公共法律服务立法规范构造的本质特征,为将来形成区域协同一体化立法或全国统一立法提供立法规范要素的基本构造理论支撑。  相似文献

This paper looks at EU banks' use of public cloud computing services. It is based primarily on anonymised interviews with banks, cloud providers, advisers, and financial services regulators. The findings are presented in three parts. Part 1 explored the extent to which banks operating in the EU, including global banks, use public cloud computing services.Part 2 of this paper covers the main legal and regulatory issues that may affect banks' use of cloud services. It sets out how EU banking regulators have approached banks' use of cloud services and considers regulators' lack of cloud computing knowledge. The paper further considers how the regulation of outsourcing applies to banks' use of cloud services, including whether cloud computing constitutes “outsourcing”. It analyses the contentious issue of contractual audit rights for regulators as well as legal and practical issues around risk assessments, security, business continuity, concentration risk, bank resolution, and banking secrecy laws.Part 3 looks at the key contractual issues that arise between banks and cloud service providers, including data protection requirements, termination, service changes, and liability.All three parts of the paper can be accessed via Computer Law and Security Review's page on ScienceDirect at: http://www.sciencedirect.com/science/journal/02673649?sdc=2. Together with the increase in the number of public‐private contracts, recent years have seen a marked proliferation in public‐private arbitrations. This article explores the public interest implications which may arise in such arbitrations and examines how public‐private arbitration is treated under English law. We argue that, due to the lack of a developed administrative law sphere in England and the historical development of arbitration as an exclusively private mode of dispute resolution, the current legal framework of arbitration in England has developed around the private law paradigm of a commercial dispute involving private actors. This private law paradigm results in a conceptual and legal void in respect of how public interest is accounted for, and protected, in arbitrations involving public bodies under English law. Therefore, we suggest that English arbitration law needs to be amended to adequately protect the private interest in public‐private arbitration.  相似文献

公共财产的使用和支配秩序需要有一整套科学的法律制度加以规制,靠一部物权法规定国家所有权是无法妥善解决所有主要问题的。从德国法的理论和实践经验来看,有必要引入公法人制度来完善民事主体制度,实现公共财产支配秩序在主体和客体上的特定化,并利用公共物的制度衔接民法和公法,实现公共目的对于物之所有人、国家和公众的普遍约束,这样才能既有效实现和保护公共利益,又有效保障民事法律交往安全和财产秩序。  相似文献

Part 2 of this paper covered the main legal and regulatory issues that may affect banks' use of cloud services.Part 3 looks at the key contractual issues that arise in negotiations between banks and cloud service providers, including data protection requirements, complexities caused by the layering of cloud services, termination, service changes, and liability. 荷兰刑事司法受到了现代人权法律的深刻影响。在荷兰刑事诉讼过程中,诉讼权利保障主要依据国际性和地区性的人权条约以及相关国内法。荷兰刑事诉讼程序运作体现了对人权的真切关怀:荷兰签署加入了多部国际公约和欧洲区域公约,国际条约、欧洲人权法院的判例法都对荷兰刑事诉讼中的人权保障起到了重要作用。在国内法体系中,荷兰的《宪法》、《刑事诉讼法》以及其他法律也规定了刑事诉讼程序权利保障。荷兰的法院、检察机关组织运作体制和诉讼制度设计较为完备,保障了诉讼参与者在刑事诉讼程序中的权利。在刑事审前程序中,检察机关发挥了主导作用,但参与其问的侦查法官则对检察官和警察的侦查权形成了有效制衡。从刑事诉讼权利保障法律体系的整体而言,荷兰审前程序权利保障的体制属于适度的职权主义诉讼模式,而审判程序中的权利保障体制则兼采当事人主义和职权主义的混合式诉讼模式。  相似文献

Since April 2009 judicial reviews may be dealt with at regional centres and in Cardiff. This change significantly relaxed the hitherto highly centralised system of judicial review in England and Wales. The main aims were to improve access to public law redress by enabling cases to be listed and heard at the most appropriate regional location. Despite recognition of the need to improve regional access, fears exist that this reform will threaten the standing and authority of judicial review in this jurisdiction; that it will contribute to a fragmentation of judicial review and, in the regions, reduce the quality of public law adjudication, legal advice and representation. Drawing on an empirical study on the regional use of judicial review, this paper assesses these matters and considers the early effects of regionalisation on access to judicial review and the development of regional markets for legal services in public law.  相似文献

英国法传统上将仲裁员与仲裁当事人之间的法律关系视为合同关系。根据《德国仲裁法》,仲裁员合同是通过仲裁当事人与仲裁员之间的要约与承诺形成的。在排除公权力干预的前提下,对争议进行公正、有效的仲裁,也包括确保仲裁员的独立性和公正性不受仲裁员与双方仲裁当事人法律关系影响,是仲裁员、指定仲裁员的仲裁当事人以及对方当事人的共同利益诉求。仲裁员追求的经济利益,超出对方仲裁当事人所预期承担的部分的利益诉求,即便存在仲裁员与指定仲裁员的仲裁当事人之间的合意,也应当服从于对争议进行公正、有效仲裁的诉求。仅从合同法出发解释仲裁员与仲裁当事人法律关系将无法满足仲裁员和双方仲裁当事人在仲裁方面共同的关于仲裁公正、有效地进行以及取得恰当的经济利益的利益诉求。仲裁员与仲裁当事人之间的法律关系是一个复合的法律关系,包含了以提供仲裁服务为标的的合同法律关系和以作出仲裁裁决为标的的身份法律关系,前者的依据是以仲裁员为一方,以双方当事人为另一方的双方当事人合意,后者的依据是法律的相关规定。  相似文献
