We present a case study illustrating the complexity of the process that determines how vigorously local police agencies enforce recent drunk-driving laws. Police enforcement practices are influenced most strongly by the play of local factors in a system of “games.” The local forces exerting greatest influence are 1) the local demand for drunk-driving enforcement, 2) the police leadership's priority for DUI enforcement, 3) the police leadership's capacity for command and control of the organization, and 4) the disposition of the local police culture regarding drunk driving and related work issues. In “Melville,” the study site, there is little external demand for drunk-driving enforcement, and police management tries to suppress it while making only symbolic gestures of support. Management's capacity to control street-level enforcement practices is limited, however, and a small cadre of officers generates a disproportionate number of arrests for personal financial gain (bounty), giving the department a much higher arrest rate than the department desires. Thus Melville's responsiveness to the state's drunk-driving law is not due to external political pressure or formal policy, but rather to the inability of local authorities to impose their will on street-level practices. Melville's case suggests that the degree to which police implement a new criminal law may be entirely independent of efforts to ensure political accountability and organizational control.  相似文献

The 43 police forces in England and Wales have made over 13 million arrests in the last decade. Yet, despite this high volume criminal justice system activity, and evidence of substantial health morbidity across the criminal justice pathway, mental health services in police custody have only been patchily developed, and the literature in this area is limited. Referrals (n = 1092) to a pilot mental health service operating across two police stations in a London borough were examined over an 18-month period in 2012/2013. The referred group had high levels of mental health and substance misuse problems (including acute mental illness, intoxication and withdrawal), self-harm, suicide risk and vulnerability (including intellectual disability), with some important gender differences. Although this work has limitations, the findings are broadly consistent with the small existing literature and they confirm the need for services that are sufficiently resourced to meet the presenting needs.  相似文献

Prior research has examined the consequences of one's police contact, but the consequences of vicarious police contact are not as well known. This study expands on labeling theory and the concept of “stickiness” by assessing whether a friend's arrest increases the likelihood of one's police contact. Using a sample of rural youth (N = 13,170), I find that a friend's arrest is associated with an increase in the likelihood of one's first arrest the next year after accounting for other predictors of police contact. Based on my theoretical framework, I interpret this finding as “guilt by association.” In addition, ending relationships with friends who have been arrested does not significantly impact this relationship. This study concludes that police contact may be harmful for a youth's social network and builds on the concept of stickiness by suggesting that stigma not only sticks from one individual to another but may also stay despite efforts to end one's association with the arrested individual. The study expands on preexisting research on the consequences of adolescent police contact by introducing a friend's police contact as a way in which an individual may be more likely to become involved in the justice system.  相似文献

This paper examines a series of reforms that followed the discovery of high-profile wrongful convictions in China since 2005. There have been two waves of criminal justice reforms to prevent future wrongful convictions and to improve China's criminal justice system more generally. But it will be suggested in this paper that China's responses are inadequate because they allow traditional police and judicial practices that will lead to future wrongful convictions to continue. Further reforms will be suggested. First, police interrogations should be fully recorded, and the entire recording should be played back at trial. Second, the role of the defense counsel should be expanded. The use of state secrets as evidence against the accused should be curtailed. The close cooperation between the police, procuratorates and judiciary in the criminal justice should be counteracted by the creation of an independent body to review all serious convictions. Finally, the Chinese criminal justice has proven itself not safe enough to allow the broad use of capital punishment as a punishment for non-violent offences and at the very least, the immediate execution of prisoners who lose their final appeal must be abolished.  相似文献

[Editor's note] The following is the text Sir Eric St. Johnston delivered before the members of the Wichita Crime Commission at their 24th Annual dinner meeting on October 19, 1977. Sir Eric St. Johnston is formerly of the Chief of Scotland Yard and Chief Inspector of Constabulary for England and Wales. Among others, he is a Knight of the Order of the Thistle, holder of the Commander Order of the British Empire, the Queen's Police Medal and the French Legion of Honour and Croix de Guerre. In his text, Sir Eric mentions various similarities and and dissimilarities regarding the police practices of two countries. He is of the opinion that there are a great deal of advantages in a centralized police system as contrasted to the American counterpart. This statement is similar to the Editor's assertion made some ten years ago. [Re: “Police Reorganization As A Deterrent to Crime,” Police, Vol. 12, No. 14, March-April, 1978, pp. 73–79. The research explores a new model of staff well-being across UK police custodial services (public and private). These services are unique for the fact that police sergeant custody officers are supported by detention officers who can be publicly or privately contracted, with the latter providing a heterogeneous mix never previously researched. The model informs a survey approach conducted across four English police forces. Drawing on a diverse literature which compares health and criminal justice professions, this study explores the possibility that private sector detention officers will report lower levels of emotional exhaustion and workplace stress and higher levels of personal accomplishment than their public sector counterparts. Multilevel analyses, supplemented by ANOVA and t tests, detected statistically significant differences for private sector detention officers regarding higher levels of emotional exhaustion and lower levels of personal accomplishment and workplace stress (with the stress result the only one in the predicted direction). However, results should be interpreted as sample specific linked to privately contracted detention officer disquiet with their then employer (since replaced). That said, the results provide a good exploration of the model’s utility together with important lessons for model and survey development in the future.  相似文献

Purpose. The present study explored the public's attitude towards errors in police officers’ detection of deception. Based on findings on trust in the police after responses to terrorist threats, we predicted a positive influence of a correct credibility assessment and of a risk‐averse response bias of police officers on public's trust. Methods. A general population sample (N= 151) read a hypothetical scenario concerning a credibility judgment and indicated their trust in the officers making the judgment. Decision outcome was manipulated by varying the four outcomes of a signal‐detection task, namely, Hit, Miss, False Alarm, and Correct Rejection. Results. In line with findings on trust in the police following responses to terrorist threats, people trusted police officers more if they judged the credibility of a suspect correctly. Moreover, officers who disbelieved the suspect's statement were trusted more than officers who believed, independently of outcome correctness. Furthermore, this effect was moderated by individual differences in error weighting. Conclusions. In sum, these findings indicate that lie‐biased credibility judgments made by police officers are supported by the public and increase their trust in the police. In addition, the present findings suggest that an asymmetrical weighting of judgment errors is a relevant factor in explaining the development of and attitude towards lie bias.  相似文献

Although community responses to the problem of intimate partner violence typically focus on increasing and improving policing and social services, few studies have examined the relationship among police force size, social service providers, and women's safety at home. To address this issue, we use data from the National Crime Victimization Survey to examine patterns of intimate partner violence for 40 metropolitan statistical areas (MSAs) over a 16‐year period (1989–2004). We analyze the data using three‐level multilevel models, with individual respondents (N = 487,166) nested within years, nested within MSAs. Net of other important individual and contextual factors, the results show that women's likelihood of victimization is significantly lower in MSAs that employ more sworn officers per capita, whereas the states’ mandatory arrest laws are not found to have significant independent effects. Above and beyond the effects of police force size, we also find a significant negative relationship between the size of the social service workforce and intimate partner violence. Future research should develop collaborative data collection efforts to examine the specific activities of police and social service workers in dealing with intimate partner violence so that the mechanisms underlying these significant relationships can be understood more clearly.  相似文献

Resilient organised crime groups survive and prosper despite law enforcement activity, criminal competition and market forces. Corrupt police networks, like any other crime network, must contain resiliency characteristics if they are to continue operation and avoid being closed down through detection and arrest of their members. This paper examines the resilience of a large corrupt police network, namely The Joke which operated in the Australian state of Queensland for a number of decades. The paper uses social network analysis tools to determine the resilient characteristics of the network. This paper also assumes that these characteristics will be different to those of mainstream organised crime groups because the police network operates within an established policing agency rather than as an independent entity hiding within the broader community.  相似文献

The Supreme Court's decision in Pacific Bell Telephone Co. v. linkLine Communications, Inc. removed an important tool from competition regulators’ arsenals. Not only did the Court express skepticism about the existence of a price squeeze cause of action, but it also applied the economically mismatched predatory pricing test to price squeeze cases. Unfortunately, the lack of clarity on linkLine's reach also caused significant confusion in the lower courts. Examining these issues, this article clarifies the distinction between price squeeze and predatory pricing claims, and argues that the second step of the predatory pricing test, probability of recoupment, is inappropriate for price squeeze cases and should either be dropped from the test or replaced with a presumption of recoupment.  相似文献

This review of 12 studies examines both the types of community and professional services that abused women most frequently contact, and how useful and effective the women perceive those services to be. These studies show that police, social service agencies, clergy, crisis lines, physicians, psychotherapists, women's groups, and lawyers are the sources of assistance abused women most frequently contact. However, the studies reveal that some of these services are not necessarily perceived as very useful or effective. Women tend to contact different services depending on the type of abuse suffered. Abused women report that crisis lines, women's groups, social workers, psychotherapists, and physicians are helpful most of the time for all types of abuse, and that police officers, lawyers, and clergy are not helpful in most types of abuse. Results of this review suggest the need for education of professionals and community service providers in understanding needs of abused women.  相似文献

This study examines the role of sociodemographic factors and violence characteristics in influencing women's reporting behaviors and types of police intervention received in response to intimate partner violence (IPV) in Canada. A subset of female respondents to Canada's 1999 General Social Survey who experienced physical or sexual IPV by a male perpetrator and who had contact with the police as a result of the violence was used for this analysis (n = 383). Findings suggest significant racial, economic, and social variations in women's motivation for self-reporting violence to the police as well as in the types of law enforcement interventions administered by police in response to reports of IPV. Abstract

A number of studies have considered whether the race of a police officer influences police decision-making processes. The current study assesses whether a police chief's race influences perceptions about the Mirandawarnings. Police chiefs from the Commonwealth of Virginia completed questionnaires assessing various aspects about the Mirandawarnings when the fate of the warnings was to be determined by the Supreme Court. Results suggest that race only moderately influenced chiefs' perceptions. Implications are provided.  相似文献

Niederhoffer, following Durkheim, proposed a linear causal model to explain police anomia. Using data from an availability sample of New York City police, he breaks into the chain of variables at frustration and terminates the analysis with cynicism measured by a twenty-item scale. This study replicates Niederhoffer's research with a population of urban police, examines the nature and incidence of cynicism, and tests the relationships between various indices of frustration, cynicism, and anomia. Contrary to Niederhoffer's expectations, cynicism is not prevalent among police outside New York City; cynicism my be described adequately only with reference to three dimensions; most indices of frustration do not significantly correlate with two subscales of cynicism; and cynicism does not intervene in the relationships between a number of independent variables and anornh. An alternate model based on Merton's conceptualization of anomin as the result of a discrepancy in cultural values and institutionalized means for attaining such goals was tested. It was found that perceived means-goals discrepancy vis-à-vis legal norms and goals intervened in the relationships between rank and anomia and years on force and anomia.  相似文献

Ten years ago we developed a model of demand inducement in the physician services market and explored the properties of that model. We found that predictions concerning physicians' prices, workloads, and income were ambiguous and in many cases were consistent with those derived from a standard monopoly pricing model. Spurred in part by our work, numerous empirical studies of the demand inducement model have been conducted. These studies found little evidence of demand inducement for primary care physician services. Demand inducement may exist in the market for surgical services, but its extent is less than previously estimated. We disagree with those who say that physicians generate demand to avoid price controls and that national health care spending is proportional to the number of physicians; the evidence does not support these arguments. Substantial uncertainty may surround the physician's choice of diagnosis and treatment mode. However, this does not imply a breakdown of the agency relationship. In this paper we extend our earlier model of demand inducement to include variations in the quantity of services (which was previously assumed to be less than socially ideal). Using the model, we conclude that the major objection to government price setting is not that physicians will get around the controls by inducing demand; rather, price controls result in a quantity and quality of physicians' services that is not ideal and may be inferior to those provided in an unregulated monopoly.  相似文献

Research Summary In 1989, the U.S. Supreme Court held that determinations about the constitutional appropriateness of police force usage—deadly or not—must be “judged from the perspective of a reasonable officer on the scene, rather than with the 20/20 vision of hindsight.” Although the Court's ruling established a clear standard for judging officers' actions (i.e., the perspective of a reasonable police officer on the scene), we know little about the sorts of factors that might frame the perspective of reasonable police officers during situations in which they apply force. This article presents the results of a study that examined 80 police officers' detailed accounts of how they perceived what transpired during 113 incidents in which they shot citizens. Respondents reported experiencing a wide range of sensory distortions, with the vast majority of officers reporting two or more distinct sorts. This study takes these findings as a point of departure to expand our understanding of what constitutes a reasonable officer's perspective during the tense, uncertain moments during which he or she makes the decision to employ deadly force. Policy Implications Given that officers are likely to experience multiple distortions during shootings, the findings have implications for civilian and police oversight policies. In particular, those responsible for reviewing police shooting incidents should take into consideration that officers' behavior will not always be based on the objective reality of what is occurring at the time they decide to pull the trigger, but rather an altered conception of it. Such an understanding is crucial to improving the image of police in certain communities and positively impacting citizen trust of, and satisfaction with, the police.  相似文献

Although the conventional wisdom holds that increasing the number of minority officers will enhance residents' perceptions of police and the criminal justice system, further systematic investigation of this hypothesis may be needed. Building on the group‐position thesis, the representative bureaucracy theory, and prior research, this study investigates whether perceived minority police presence within residents' neighborhoods affects residents' perceptions of criminal injustice, whether this effect is more pronounced for minority residents and in minority neighborhoods, and whether perceived minority police presence has a stronger effect on perceptions of criminal injustice for minority residents in more integrated and white neighborhoods than minority residents in minority neighborhoods. Analyses of data collected from Los Angeles, CA, show that residents perceive a lower level of criminal injustice when they report that officers in their neighborhoods are not white‐dominated, and this finding is not dependent on the respondent's race/ethnicity or the racial/ethnic composition of the neighborhood. In addition, perceived minority police presence seems to have a weak to no effect on residents' perceptions of criminal injustice for Hispanic communities. We discuss these findings and their implications for theory, research, and policy.  相似文献

Abstract

In the present experiment the effects of physical effort on police officers' aggression and perception in simulates shooting incidents were investigated. Based upon Kahneman's (1973) variable-allocation capacity model it was hypothesized that physical effort will result in a decease in aggression towards aggressive offenders. Based upon Kahneman's model and Easterbrook's (1959) Cue-Utilization-Hypothesis it was further expected that this decrease in aggression will be caused by an incorrect judgement of the aggression of aggressive offenders (and not by an impaired perception).
