The World Trade Organization (WTO) General Agreement on Trade in Services (GATS) and its Annex on Financial Services provide the international legal framework for the regulation of cross-border trade in financial services. This paper analyses the main provisions of the GATS that relate to regulatory transparency of trade in financial services. The GATS generally provides a flexible framework for states to negotiate liberalisation commitments while providing WTO members with autonomy to promote their regulatory objectives. The extent to which states, however, must adhere to GATS disciplines regarding transparent regulatory practices has become a source of policy debate. Although the WTO has played no role in setting financial regulatory standards, the transparency obligations of the GATS have important implications for how financial regulators can achieve their objectives. Moreover, GATS transparency obligations can potentially create disproportionate administrative costs for developing countries and thus undermine their financial sector development. The paper argues that the principles of regulatory transparency in the GATS should be interpreted in a way that favours regulatory discretion to achieve financial stability and other prudential objectives. In the post-Doha era, WTO members should attempt to clarify GATS transparency obligations in a way that promotes financial development and regulatory autonomy.  相似文献

Crop genetic diversity and poverty are linked: first, resource-poor farmers often maintain genetic diversity; and second, crop diversity, when properly valued by the market, has the potential to alleviate poverty. This article examines this supposition by drawing on three case studies of the intersection of the market with poverty and maize diversity in Mexico. These suggest that the bulk market for maize offers little room for maize landraces (local maize varieties known as criollo maize), in that it does not reward qualitative variation in maize grain and instead presents incentives that make planting ‘improved’ maize germplasm the rational economic choice for small-scale farmers. Meanwhile, attempts to add value to maize landraces via market differentiation have had varying success. Although there is potential for differentiated markets to contribute to successful business models and poverty alleviation, these cases exhibit trade-offs between product consistency, investment of labour and resources, and genetic-diversity conservation.  相似文献

This paper addresses the economic and political economy factors explaining why countries agree upon services commitments in regional trade agreements (RTAs) going beyond the General Agreement on Trade in Services (GATS), what we call the commitments gap. Using a unique dataset comprising of detailed schedules of services commitments disaggregated by sub-sectors and covering almost all countries that are members of a services RTA, we are able to quantify the extent to which geographical, systemic as well as economic and institutional factors correlate with a country’s pattern of RTA commitments that go further than commitments made at the WTO. Strong explanatory variables are asymmetries between negotiating partners and market size, together with endowments in mid-skilled labor and institutional governance. Whereas some of these forces are strongly positively associated with commitments made beyond GATS, others are significant determinants that correlate negatively with a country’s commitment patterns in RTAs. We also find strong differences between services industries providing evidence that not all economic and political economy factors are of equal importance for all services. For instance, financial and construction services often diverge significantly from our general pattern of explanations.  相似文献

Since the introduction of qualified majority voting, at least 58 labor regulations have been imposed by the European Community/Union. Three types of explanations are considered: i) the asymmetry of the EC budgetary process, ii) regulatory collusion and iii) the strategy of raising rivals’ costs. Collusion and the strategy of raising rivals’ costs are compared in a two-country game-theoretic model with international capital mobility. The empirical analysis shows that the transition to qualified majority voting was not preceded by a striking tendency of competitive national deregulation. In all cases in which a directive was contested, the UK was among the contestants. Various indices show that the UK has the least regulated labor market. More generally, the anti-regulation coalition also includes Ireland, the Scandinavian countries and the Netherlands. There are examples showing that if the coalition is too small to block the regulation, its members prefer not to record their dissent officially. In most investigated cases, the European labor regulation is more restrictive than most but not all prior national regulations. The empirical analysis demonstrates that the strategy of raising rivals’ costs plays an important role in EU labor regulation.

This article compares the role of brokers in mediating access to public services in India and Indonesia. Brokered state-citizen interaction is generally considered to be detrimental to democratic accountability and governance. Yet recent studies are emphasizing that brokers can also be empowering. Reconciling these contrasting assessments, I argue in this paper that the character of brokerage networks shapes the capacity of citizens to hold their politicians and bureaucrats to account. Employing over two years of ethnographic fieldwork in both India and Indonesia, I develop a comparative framework that compares brokerage networks in terms of their degree of fragmentation, institutionalization and levelling. In Indonesia the versatile and more state-centered nature of brokers networks plays into the hands of incumbents, while the fragmented and more levelled nature of India's brokerage networks strengthens democratic accountability. I use this comparison to advance the argument that the evolution of brokerage networks constitutes an important, yet little-noticed dimension of democratization processes. When citizens gain access to public services through networks that are fragmented, institutionalized and less marked by social hierarchies, politicians and bureaucrats face stronger pressures to perform.  相似文献

This article explores access to primary health care (PHC) services and associated factors in Pakistan. Data were collected from 302 respondents. The findings revealed that women accessed PHC services more than men due to their greater health needs. However, a large proportion of both genders did not access any PHC services. Besides general weaknesses, gender-related barriers were found in basic health unit locations, distance, transport, staff availability, income, service hours, and service organisation, confirming gender issues in access to PHC services. Policymakers are recommended to take measures to improve access to PHC services through the formulation of gender-responsive policies and strategies.  相似文献

The proliferation of NGOs, particularly in developing countries over the last five decades, has prompted debates on the extent to which NGO services have been able to match the priorities of disadvantaged groups such as low castes and ethnic groups in Nepal. This paper explores the development priorities of villagers from a village in Nepal (Thecho), and their views regarding the match between services offered by NGOs and those priorities. The article examines the World Trade Organization (WTO) Appellate Body's ruling in US—Gambling that United States (US) prohibitions on the foreign supply of gambling and betting services via the internet to consumers in the US violated US market access commitments under Article XVI of the General Agreement on Trade in Services (GATS). The article reviews the main arguments criticising the decision and suggests that these views are (i) misguided because they rely excessively on a textual approach to interpreting Article XVI market access commitments, and (ii) lead to results that do not conform with the common intentions of the negotiating parties. The article argues for an approach that relies primarily on examining the facts of each case and the context in which WTO Members' commitments are negotiated. This approach also emphasises the importance of WTO Members making clear and precise market access commitments. In the author's view, the Appellate Body ruling adds more clarity to how GATS market access commitments will be interpreted in the future and, in doing so, facilitates market access negotiations and the making of additional commitments by WTO Members.  相似文献

Abstract

There is an increasing growth in access to the Internet among youth, gained largely through cell phones, computer laboratories on campuses, home connections, and connections on personal computers. Also, the availability of social software tools for webpage creation, blogging, and creating and sharing multimedia content has made content creation relatively accessible. But are the youth using these tools effectively? What are the levels of digital skills among this population? This study investigates digital skills among South African university students. Through a survey conducted at ten universities, and two skill experiments conducted at two universities, this study explores the pattern of perceived skills and actual skills, to examine current trends of digital skills among the students. The findings reveal that forms of Internet access, the cost of access, social stratification, and inequalities have implications for the patterns of digital skills, with content creation being a challenge for many youth.  相似文献

Putnam's metaphor of a two‐level game that state representatives play when they face the dual constraints of international bargaining and domestic pressures has been applied across different political systems. This paper argues that it is important to take into account differences in state structures and political processes in the study of international negotiations. That state structures and processes are important has become a common theme in current research on foreign policy, decision making, and international conflict. Building on this literature, this study involves a meta‐analysis of existing case studies of two‐level games. The previously completed cases provide evidence of variation in the characteristics of two‐level games. Independent measures of the institutional structures of the states involved in the set of case studies are collected from the POLITY III dataset. Hypotheses on how differences in state structures might influence the characteristics of two‐level bargaining are then examined. The study finds that differences in state structures do influence the dynamics of two‐level games. Some of the results support the conventional wisdom on this relationship, while other results suggest counter‐intuitive insights. A framework conceptualizing state characteristics at three levels is proposed for future research.  相似文献

Much recent international press coverage of Spain's difficulties portrays a country rapidly approaching political, economic and social meltdown. Its economy is contracting, its unemployment rate is at unprecedented levels and its sovereign risk premium hovers at apparently unsustainable levels. Spain will undoubtedly require external financial help from its European partners, as well as more time and flexibility to achieve its fiscal targets. But it also has a number of strengths that are too often overlooked. Spending cuts and structural reforms are proceeding at a lively pace, unit labour costs are falling significantly, and exports and productivity are on the rise. The concept of security sector reform has introduced the idea that the security sector is a legitimate recipient of donor assistance, but cooperation with intelligence services remains problematic. They are principally seen as a subject for reform rather than a contributor to it. I argue that intelligence services can reduce institutional inertia in the security sector, contribute to the rejection of outdated risks and the identification of new ones, and underpin the process of reform. To do so they require careful management and effective oversight. I propose a new definition of intelligence and a new distinction between intelligence and security that aim to capture the potential contribution of intelligence services to security sector reform.  相似文献

Abstract

This paper analyses the interaction of domestic political elites and external donors against the backdrop of Mozambique’s decentralisation process. The empirical research at national and local levels supports the hypothesis that informal power structures influence the dynamics of this interaction. Consequently, this contributes to an outcome of externally induced democratisation different to what was intended by external actors. The decentralisation process has been utilised by ruling domestic elites for political purposes. Donors have rather focused on the technical side and ignored this informal dimension. By analysing the diverging objectives and perceptions of external and internal actors, as well as the instrumentalisation of formal democratic structures, it becomes clear, that the ‘informal has to be seen as normal’. At a theoretical level, the analysis contributes to elite-oriented approaches of post-conflict democratisation by adding ‘the informal’ as an additional factor for the dynamics of external-internal interaction. At a policy level, external actors need to take more into account informal power structures and their ambivalence for state-building and democratisation.  相似文献
