In view of current events the question is discussed to what extent the risk of bioterrorism may be an issue relevant for forensic medicine also in Germany, although at present there seems to be no concrete threat. The cases which became known so far were either false alarms or foolish pranks (copycats), which have to be, and are indeed, prosecuted by the state (section 126 German Criminal Code). Since the publication of Edwin Sutherland's classical study, White Collar Crime, personality has been treated as completely irrelevant as a cause or as a correlating variable in studies of economic crime. This article questions that thesis. In an ongoing Swedish project studying economic crime in the areas of construction, engineering, and the music industry, 128 informants were interviewed regarding the personal character of the economic criminal compared to that of the law-abiding businessperson. Data were collected from five different regions in Sweden using the Big Five model, the personality model most often used within the field of personality research today. This article compares the results from the interviews with the few international studies that exist regarding economic crimes in these areas and common results are emphasized. It also presents nuanced analyses of the significance of personality in economic crime.  相似文献

The challenging events of the past year have forced those of us working in higher education to adapt our teaching practices to conform to the restrictions put in place. For many this has been an opportunity to take a fresh view of the way material has been delivered in the past, and critically reflect on how it might be delivered in the future. There has been an explosion of innovative ideas and the introduction of support networks such as ‘#RemoteForensicCSI’ to aid with sharing these new innovations and examples of good practice.However, the past year has also helped to highlight a lack of an established network that could support the teaching of forensic science in the UK. Teaching networks within the UK exist for related disciplines, such as the Royal Society of Chemistry’s Higher Education Chemistry Teaching Network, but no network focuses on the teaching challenges specific to forensic science. Such a network could help to address the gap in pedagogical research to help support more effective teaching and give learners the best opportunities possible. This would complement the work of the Chartered Society of Forensic Science including upholding accreditation standards and the existing Link Member Scheme, whilst providing an environment to specifically support the teaching of forensic science. Any network could also look to link with other networks internationally such as the Council of Forensic Science Educators in the USA and identify examples of good practice worldwide that could be used to enhance and inform forensic science teaching in the UK.The teaching of forensic science is multifaceted with a need to strike a balance between practical skills and theoretical knowledge. Like many vocational courses forensic science teaching staff have a diverse range of backgrounds, encompassing both academic and practitioner experience. This results in a range of experiences and approaches to teaching and delivery, creating a fantastic melting pot for ideas, but outlets for sharing these innovative approaches are limited. This article will highlight some of the pedagogical gaps within forensic science teaching and areas that we could learn from. Most importantly, it will issue a clarion call to those working in this area to push for a UK Forensic Teaching Network.  相似文献

Despite enhanced forensic collaborations between law enforcement agencies and universities, crime scene management remains a domain seen more as technical than scientific, largely carried out by sworn police officers qualified as scene of crime officers (SOCOs), confining forensic graduates to specialized expertise fields. Under such circumstances, we must ask ourselves why and how do we provide a generalised dedicated course to academic pupils who are not primarily intended to join such teams, excepting sometimes to assist them on a specialized field (explosion, arson, etc.)?Currently in Quebec, forensic graduates cannot join crime scene units attached to police forces, mainly because of unions, which argue about the need to be an experienced police officer before qualifying for a crime scene course.Based on the operational experience of the author, who created the foundational graduate forensic programme in Quebec, Canada, this paper will explain why such an academic course is still of high importance, its rationale within an academic curriculum, its goal and its implementation. Challenges are still to be considered, but selected feedback from students who understood that the aim of this course is distinct from their formal support disciplines, encourage such an approach.  相似文献

In rare penal cases, a defendant makes a claim that he or she was asleep at the time of an alleged crime. This article discusses a case of alleged sexsomnia where a man claimed that he had been asleep during a sexual encounter (rape) with a woman. The question that often arises during an investigation and in court is how complex a behaviour is someone able to perform and still be asleep? To assist the court in answering this question, forensic psychiatric experts may be appointed. But the experts were not present during the act and must therefore consider each case on the basis of the available information and existing research. This paper provides a brief overview of the research regarding sexsomnia. It will also discuss what kind of information is important to elaborate in these cases in order to clarify the premises for the experts’ conclusions to the court.  相似文献

This paper investigates whether computer forensic tools (CFTs) can extract complete and credible digital evidence from digital crime scenes in the presence of file system anti-forensic (AF) attacks. The study uses a well-established six stage forensic tool testing methodology based on black-box testing principles to carry out experiments that evaluate four leading CFTs for their potential to combat eleven different file system AF attacks. Results suggest that only a few AF attacks are identified by all the evaluated CFTs, while as most of the attacks considered by the study go unnoticed. These AF attacks exploit basic file system features, can be executed using simple tools, and even attack CFTs to accomplish their task. These results imply that evidences collected by CFTs in digital investigations are not complete and credible in the presence of AF attacks. The study suggests that practitioners and academicians should not absolutely rely on CFTs for evidence extraction from a digital crime scene, highlights the implications of doing so, and makes many recommendations in this regard. The study also points towards immediate and aggressive research efforts that are required in the area of computer forensics to address the pitfalls of CFTs.  相似文献

Nowadays, forensic age estimation takes an important role in worldwide forensic and medico-legal institutes that are solicited by judicial or administrative authorities for providing an expert report on the age of individuals. The authorities’ ultimate issue of interest is often the probability that the person is younger or older than a given age threshold, which is usually the age of majority. Such information is fundamental for deciding whether a person being judged falls under the legal category of an adult. This is a decision that may have important consequences for the individual, depending on the legal framework in which the decision is made. The aim of this paper is to introduce a normative approach for assisting the authority in the decision-making process given knowledge from available findings reported by means of probabilities. The normative approach proposed here has been acknowledged in the forensic framework, and represents a promising structure for reasoning that can support the decision-making process in forensic age estimation. The paper introduces the fundamental elements of decision theory applied to the specific case of age estimation, and provides some examples to illustrate its practical application.  相似文献

Since the inception of Web 2.0, instant messaging, e-mailing, and social networking have emerged as cheap and efficient means of communication over the Web. As a result, a number of communication platforms like Digsby have been developed by various research groups to facilitate access to multiple e-mail, instant messaging, and social networking sites using a single credential. Although such platforms are advantageous for end-users, they present new challenges to digital forensic examiners because of their illegitimate use by anti-social elements. To identify digital artifacts from Digsby log data, an examiner is assumed to have knowledge of the whereabouts of Digsby traces before starting an investigation process. This paper proposes a design for a user-friendly GUI-based forensic tool, DigLA, which provides a unified platform for analyzing Digsby log data at different levels of granularity. DigLA is also equipped with password decryption methods for both machine-specific and portable installation versions of Digsby. By considering Windows registry and Digsby log files as dynamic sources of evidence, specifically when Digsby has been used to commit a cyber crime, this paper presents a systematic approach to analyzing Digsby log data. It also presents an approach to analyzing RAM and swap files to collect relevant traces, specifically the login credentials of Digsby and IM users. An expected insider attack from a server security perspective is also studied and discussed in this paper.  相似文献

De Clérambault's syndrome (erotomania) has invariably been regarded as a female disorder (with male victims); however, a number of recent reports describe male patients with the disorder, especially in violence-prone male offender populations. Seven cases are presented of violence-prone men suffering from the disorder, including Hinckley and Poddar. The syndrome is discussed from a nosological point of view and in terms of its impact on competency to stand trial. Psychiatrists should be aware that the syndrome is not a rarity among men, as previously thought, and that proper diagnosis and management are essential in view of the clinical course of the disorder and the potential for violence when the patient's "love" is persistently unrequited by the delusional love object.  相似文献

A survey was done of 307 alleged victims of sexual violence reported to the police departments in Greater Aarhus, Denmark, in 1999-2004. The legal disposition was ascertained and related to victim and assault characteristics together with the forensic medical and laboratory findings. The police pressed charges in more than half of the cases and 11% turned out to be false allegations. Nineteen percent of all cases ended with sentencing of the defendant. Sperm was detected in 35% of the examined and analysed cases, and in 46% consumption of alcohol prior to the assault was reported. Information in the forensic report regarding injury documentation, intoxication, and detection of sperm and DNA match between victim and alleged assailant did not aid in the prosecution of the case. Severe coercion used by the assailant increased the likelihood of conviction. Intoxication estimation and sperm detection suffered from low sensitivity compared with laboratory analyses. Results suggest the need for new research and optimising the sexual assault examination protocol to strengthen the legal impact of forensic evidence.  相似文献

In Singapore, families play an important role caring for mentally disordered offenders. They are particularly important in cases where courts oblige psychiatric assessment, because they provide corroborating information not otherwise volunteered. However, their attendance is generally low. Our quality improvement project sought to increase caregiver attendance at outpatient visits. We followed WHO guidelines for quality improvement, determined the root cause of poor attendance, and devised three Plan–Do–Study–Act cycles over six weeks in late 2013. We followed their impact for 12 months. Case managers and medical social workers implemented three strategies to address issues of poor communication and awareness, which led to poor attendance. Prior to our project, caregivers attended 47% of outpatient visits. Following the implementation of our strategies, rates rose to 70%, sustained over the 12 following months. The entire case management department adopted our strategies. Simple changes to standard operating procedures improved the rate of caregiver attendance at follow-up appointments.  相似文献
