Developing countries increasingly participate in transgovernmental networks of global regulatory governance, but they do so in different ways. This article aims to provide an explanation for this variation for two of the major emerging powers in the world economy, Brazil and China, in their transition toward more active players in the global competition regime. Distinguishing between bilateral and multilateral transgovernmental networks and examining the domestic factors conditioning the transition of their national competition agencies from rule-takers to rule-promoters or rule-makers through these networks, the article makes theoretical contributions to the linkage between transgovernmentalism and the regulatory state. I argue that differing political needs and the incomplete process of regulatory state formation push domestic agencies to join transgovernmental networks, with a need for greater legitimacy steering the Brazilian regulators to multilateral networks and facilitating their transition from rule-takers to rule-promoters. The Chinese agencies' primary need for expertise rather than legitimacy, by contrast, led them to pursue technical assistance and cooperation via bilateral relationships. The Chinese approach has slowed its transition from rule-taker to rule-promoter where its norms and practices are aligned with the established powers. Such approach will further impede its transition into a global rule-maker in areas of competition law and policy where China's preferences diverge.  相似文献

Despite the continuous risk posed by transnational militancy to Chinese interests in Pakistan, China and Pakistan have improved their cooperation on matters of security and economy in recent years. While transnational militancy in a state dyad is known to increase the potential for conflict, it may also spur interstate cooperation on counter-militancy operations under certain conditions. This article examines the sources of the increase in Sino-Pakistani cooperation in fighting transnational militancy. Pakistan was in the early 2000s the country where the Chinese experienced most militant attacks resulting in the cancellation of Chinese projects in Pakistan despite the dyad’s professed all-weather friendship. More than a decade later, the Chinese are back with a prospected $62 billion in investments in the China–Pakistan economic corridor (CPEC). This overarching incentive has altered the challenge of transnational militancy to their mutual relations from a mostly negative, to a more constructive one requiring costly cooperation. In a quest to secure a continuing relationship in a hazardous landscape, the state dyad is attempting to roll out a concerted security strategy involving the army, navy, paramilitary forces and private security companies. A mix of domestic policies of both states, their foreign policies and the nature of threat posed by the militants facilitates this cooperation.  相似文献

This article investigates the role of transgovernmental networks of national regulators in addressing collective action problems endemic to international cooperation. In contrast to recent work on transgovernmental actors, which emphasizes such networks as alternatives to more traditional international institutions, we examine the synergistic interaction between the two. Building on the broader premise that patterns of “dual delegation” above and below the nation‐state enhance the coordinating role of networks of national agencies in two‐level international governance, the article examines the formal incorporation of transgovernmental networks into European Union (EU) policymaking. The focus on authoritative rule‐making adds a crucial dimension to the landscape of EU governance innovations while connecting to the broader study of transgovernmental networks in international governance. The article develops an analytical framework that maps these incorporated networks across different sectors in terms of function, emergence, and effectiveness. Two case studies of data privacy and energy market regulation are presented to apply and illustrate the insights of this mapping.  相似文献

How has the international community responded to humanitarian crises after the end of the Cold War? While optimistic ideational perspectives on global governance stress the importance of humanitarian norms and argue that humanitarian crises have been increasingly addressed, more skeptical realist accounts point to material interests and maintain that these responses have remained highly selective. In empirical terms, however, we know very little about the actual extent of selectivity since, so far, the international community’s reaction to humanitarian crises has not been systematically examined. This article addresses this gap by empirically examining the extent and the nature of the selectivity of humanitarian crises. To do so, the most severe humanitarian crises in the post-Cold War era are identified and examined for whether and how the international community responded. This study considers different modes of crisis response (ranging from inaction to military intervention) and different actors (including states, international institutions, and nonstate actors), yielding a more precise picture of the alleged “selectivity gap” and a number of theoretical implications for contemporary global security governance.  相似文献

Recent trends of mass‐level euroscepticism seriously challenge Deutsch's transactionalist theory that increased transnational interactions trigger support for further political integration. While transnational interactions have indeed proliferated, public support for European integration has diminished. This article aims to solve this puzzle by arguing that transnational interaction is highly stratified across society. Its impact on EU support therefore only applies to a small portion of the public. The rest of the population not only fails to be prompted to support the integration process, but may see it as a threat to their realm. This is even more the case as, parallel to European integration, global trends of integration create tensions in national societies. The following hypotheses are proposed: first, the more transnational an individual, the less she or he is prone to be eurosceptical; and second, this effect is more pronounced in countries that are more globalised. A multilevel ordinal logit analysis of survey data from the 2006 Eurobarometer wave 65.1 confirms these hypotheses.  相似文献

This article studies the securitization of transnational crime by the Association of Southeast Asian Nations (ASEAN) since 1996–97. It first introduces transnational crime as a criminal matter before positioning it within the international security debate through an elaboration of the Copenhagen School and its securitization theory. It then examines whether transnational crime has been articulated in security terms in the ASEAN rhetoric. The article demonstrates that the member states have made statements in which they make claims about security in the context of crime. Yet, there is little evidence that this has encouraged regional policy-makers to adopt common security responses. ASEAN has failed to implement joint actions due to domestic circumstances but also because of its own consensus model and resistance to institutional reforms. Finally, the article suggests that the problem of transnational crime could be dealt with more effectively if it was approached primarily as a criminal matter rather than as a security issue.  相似文献

We investigate the informal bilateral transgovernmental relations between equivalent ministries of EU member states during the preparation of the Intergovernmental Conference 1996. Starting point of this analysis is the hypothesis of a growing importance of transnational and transgovernmental relations as a cause and a result of European integration. Whereas these proclaimed tendencies have been extensively researched with regard to economic interdependencies and transnational relations of societal actors, networks of the administrative and bureaucratic elites have been rather neglected. Applying diverse concepts of network analysis, we identify the hitherto latent informal network structures of the governments. The overall configuration can be described as a mixture of a centre-periphery structure and cohesive blocks. The gradual center-periphery structure consists of a “triumvirate” of the powerful member states (Germany — France — Great Britain) and smaller states, and is characterized by a clear north-south dimension. The costs of informal coordination are mainly borne by the large member states as well as by “brokers” (Austria, BeNeLux, Finland, Sweden).  相似文献

Abstract

Despite the efforts of the past decade, maritime piracy remains of international concern today. Countries need to cooperate actively at both the regional and international levels to eradicate the problem effectively. In particular, the nature of the threat in the Asia-Pacific region suggests that coastal states – countries that possess sovereignty over the pirate-infested waters but lack the law-enforcement resources – have to turn to resource-rich extra-regional powers for assistance. Unfortunately, cooperation between such disparate countries has traditionally been impeded by sovereignty sensitivities, as best exemplified by Malaysia's and Indonesia's hostile responses to the United States' Regional Maritime Security Initiative in 2003. Faced with this apparent dilemma, a new phenomenon has emerged. National coast guard agencies, instead of their military naval counterparts, have become attractive alternatives for promoting international cooperation against non-traditional security threats, such as maritime piracy. Spearheaded by the Japanese Coast Guard (JCG), coast guards from various countries have imparted training expertise, conducted joint exercises, hosted low-publicity multilateral meetings, and even transferred security equipment across international borders. Together they have succeeded in promoting cooperation without arousing the sovereignty sensitivities often associated with such cooperation. This article analyzes the evolution of coast guard cooperation in Asia, highlighting in particular the Japanese Coast Guard's success in this endeavor. With the general alignment of regional and global power interests in Southeast Asia, coast guard agencies hold promise for extra-regional powers wishing to help eradicate maritime piracy in the region.  相似文献

The twenty-first century's security environment has triggered a phenomenon of ‘proliferation’ of intelligence and security cooperation, both domestically and internationally. After the ousting of the communist regime (whose intelligence system served the regime) in 1989, Romania embarked upon democratic reform of its new intelligence system (including strengthening cooperation), to better tackle the current security challenges. This has been a rather onerous process, yet worthwhile: Romania's intelligence is presently cooperating well with national and international partners, to counter national, regional, and global security threats. This paper assesses Romania's efforts in developing intelligence cooperation, after the demise of the communist regime.  相似文献

While international governance may improve the legitimacy of its policies by producing better outputs, it reduces legitimacy on the input side as decisions are taken further away from the citizens. This article examines transnational parliamentary assemblies and assesses whether they might add legitimacy to decision-making beyond the state. While the parliamentary route to legitimacy is often belittled within the realm of international relations, many such assemblies already exist. The study gives an overview of such assemblies and compares the European Parliament, the Nordic Council and the Baltic Sea Parliamentary Conference in detail. They represent three types of transnational parliamentary assemblies: parliament, assembly and conference. The article reaches the conclusion that a parliament can further democratic legitimacy in supranational contexts, whereas assemblies can provide additional legitimacy to processes of international cooperation. The conference type does not fulfil the criteria set for democratic legitimacy.  相似文献

This article examines state responses to the changing global economy, by exploring the growth of state international economic activities, variations in these activities, factors promoting and limiting state involvement in international affairs, and implications of these trends for the implementation of state economic development policies. Global economic competition, a changing domestic political and economic landscape, the modernization of state government, and increasingly open international markets have inspired states to increase their international activities. Consequently, dramatic growth in state international activities has occurred in the fields of trade promotion and economic development. Yet, state and local involvement in international affairs has not been universally accepted nor consistently funded.  相似文献

This article assesses the recent trend of cooperation among antagonistic private actors that results in the creation and implementation of issue-specific transnational norms and rules and the subsequent shift from public to private forms of governance. Many political scientists agree that authority also exists outside of formal political structures. Private actors increasingly begin to make their own rules and standards that acquire authority beyond the international system. This observation is often referred to as private transnational governance as opposed to public or international governance. Although the concept of private governance gains prominence in academic debates, it is not clear how private governance on the global scale is constructed and maintained or what specific or general conditions are necessary for private governance to emerge. Based on the review of common theoretical propositions, this article develops an integrated model along which the necessary conditions for the emergence of private governance can be assessed and understood. As most research has hitherto focused on institutionalized cooperation between business actors (self-regulation), this article takes a closer look at those transnational systems of rule that result out of the enhanced cooperation between profit and nonprofit actors (coregulation).  相似文献

Much academic work on governance in recent years has explored responses that states have made to sectors of the economy, usually historically well rooted nationally, that have been subject to globalizing pressures. Less work exists on responses that are being made to new parts of the economy emerging outside the nation state with inherently global characteristics. The Internet—and specifically its naming and addressing system—provides an example of how the state has aimed to assert public interest governance authority in a system initially absent of its influence. This article explores the nature and consequences of this activity in the process contributing to the study of the Internet and governance. Working within the limitations but also the opportunities created by policy norms developed at the global level, the article finds that the state has been instrumental in the development of novel public–private governance systems for Internet country code Top-Level Domains.  相似文献

This report communicates findings on the management techniques devised to cope with the effects of transnationalism in Northern Europe. The most important aspect of this collective policy coordination effort is extensive and intensive interactions among governmental elites across national boundaries. Recently, an effort has been made to increase central, cabinet control of these trans‐Nordic activities. The national bureaucracies remain the most crucial actors while the regional officials have an influence on outcomes to the extent that they can mobilise political commitments or transgovernmental coalitions.  相似文献

‘Non-traditional security’ (NTS) is prominently featured in the agenda of the Association of Southeast Asian Nations (ASEAN) and other ASEAN-led institutions in the Asia-Pacific. ‘NTS’ brings together a series transnational and non-military security threats that are considered common among regional states, urgent for them to attend to, and non-sensitive all at the same time. This a priori makes it a self-evident focus of attempts to bring regional security cooperation ‘to a higher plane’. However, this paper reveals that the uncontroversial character of NTS is overestimated, by shedding light on the co-existence of divergent – and potentially contradictory – interpretations of its meaning and implications in ASEAN and the wider region. In a context where ASEAN's relevance to the pursuit of regional security is increasingly being measured against its (in)ability to provide a coherent approach to security challenges that affect the region, the contested nature of NTS has important implications for the grouping's resilience in the twenty-first century.  相似文献

As crises grow more transnational in origin and effect, managing them effectively will require international cooperation. This article explores the dilemmas inherent to producing common crisis management capacities across national governments. Drawing on the literature related to "international public goods," the article builds an approach for understanding these dilemmas through the lens of collective action and the perverse incentives associated therein. The article applies this approach to cooperation in Europe on an issue that typifies the transnational crisis—the spread of communicable disease—and highlights obstacles to European Union ambitions to build a robust system for disease surveillance and control. Having isolated the obstacles, the article then identifies solutions to facilitate cooperation toward more effectively producing the good in question.  相似文献

This article takes a new approach to international regulatory cooperation by developing a concept of the depth of cooperation, jurisdictional integration. A dataset of international competition policy agreements is compiled and ranked against an ordinal index of the depth of de jure cooperation in enforcing competition policies. There has been both a deepening and broadening of de jure cooperation over time. Statistical analysis finds that common membership of the Organisation for Economic Co‐operation and Development is a strong predictor of the depth of agreements to cooperate in enforcing competition policies; that we can be confident that the depth of agreements is low when signatories' substantive competition laws are dissimilar; and that the depth of de jure cooperation is a strong predictor of whether an agreement is “intergovernmental” or “transgovernmental.” The article puts forward a new way to map and measure international regulatory cooperation, and a new variable for use in research on its causes and consequences.  相似文献

This article analyses the key features and origins of three variants of transnational capitalism emerging in Central-Eastern Europe: a neoliberal type in the Baltic states, an embedded neoliberal type in the Visegrád states, and a neocorporatist type in Slovenia. These regimes are characterised by their institutions and performances in marketisation, industrial transformation, social inclusion, and macroeconomic stability. Explanations for regime diversity are developed at two levels. First, it is argued that the legacies of the past, and their perceptions as either threats or assets to these countries' future, have had deep impact on regime types. Legacies and initial choices were no less crucial for the degree of democratic inclusion, and the different patterns of protest and patience on the paths towards the new regimes. Second, the article demonstrates the importance of transnational influences in industrial transformation and social inclusion.  相似文献

Governments are increasingly turning to new modes of governance to induce nonstate actors to voluntarily take responsibility for societal problems. Using the concept of responsibilization as a theoretical lens, this article analyzes changes in road safety governance in Sweden. How, why, and to whom has the responsibility for road safety been attributed in Swedish policymaking, and how have state authorities engaged in processes of responsibilization during its implementation? The results show a shift in attribution of responsibility from individual road users to a broad set of so-called system designers, based on moral, causal, and preventive rationales. Responsibilization both occurs within the state apparatus and is imposed by state authorities on nonstate actors using soft governance measures. Responsibilization provides a fruitful theoretical lens for governance studies by identifying shifts in responsibility (including deresponsibilization), explicating normative/ethical underpinnings of new governance modes, and helping to open the “black box” of the state.  相似文献

Conclusions The HIV/AIDS pandemic, now well into its third decade and spreading in states as diverse as Belarus, Ukraine, Indonesia, and Papua New Guinea, has shown us that we truly are sharing an interconnected world. As we struggle to deal with both ongoing and emerging threats to public health, and to reach just balances of the rights of individuals and communities, it is critically important not to lose sight of the many states where neither the rights of citizens nor the well-being of the community drive policy. Secretive, rights-violating regimes make poor global citizens in a world where new threats can emerge from obscure corners of the world (like occupational exposures in the butchering of masked palm civets or chimpanzees) and spread fast and far. The mishandling of public health threats in such states may be due to incompetence, malfeasance, official denial, censorship of science, bureaucratic inertia, or the desire not to lose face on the global stage. This is true for state failure in an array of other arenas, including economics and development. But public health failures are likely to have effects beyond state borders, and to affect us all. And this may be reason for some hope: outbreaks like SARS cast a bright light on ineffective responses, and may be one more reason for the citizens of the world who live in free societies to be concerned over the fate of those who do not.  相似文献
