In the 1990s, states enacted a plethora of new “get tough” laws targeting sex crime. These included extending the death penalty—a punishment typically reserved for murderers—to convicted sex offenders. Little attention, however, has been given to explaining why these tougher responses emerged and, in particular, whether the public supported extending the use of the death penalty to sex offenders. The goal of this paper was to examine whether public perceptions about executing sex offenders accorded with the punitive shift in policy and, more broadly, to contribute to scholarship on the death penalty. To this end, this paper examined data from a 1991 national public opinion poll, conducted just prior to the punitive shift in sex crime policies. The study found that views about executing sex offenders depended heavily on whether the victim was a child, that support for executing sex offenders was substantially lower than for executing murderers, and that few social and demographic divides differentially predicted support for executing sex offenders versus murderers. With increasing frequency, forensic psychiatrists are called upon to evaluate sex offenders for the courts and criminal justice system. While many clinicians have observed that denial of paraphilia is common in sex offenders, few studies have examined whether this population has severe psychopathology other than paraphilia. Similarly, little is known about whether sex offenders minimize or deny symptoms of psychopathology when undergoing psychiatric evaluations. To study these questions, the authors administered the Minnesota Multiphasic Personality Inventory (MMPI) to 36 sex offenders, comparing the degree to which they minimized or denied psychopathology, dividing subjects among two dimensions: (a) whether they admitted to, or denied, paraphilia, and (b) whether or not they faced legal charges for sex offense. Results indicated that, first, patients who denied paraphilia were significantly more likely to minimize psychopathology than were those who admitted to paraphilia (P less than 0.05); second, patients who faced no legal charges showed significantly more psychopathology than did those who faced charges (P less than 0.05); and third, the most frequent forms of psychopathology were antisocial attitudes, depressive features, somatization, and thought disorder. These findings suggest that many sex offenders may experience, and deny, widespread and severe psychiatric symptoms in addition to their sexual disorders.  相似文献

Sex composition of groups has been theorized in organizational sociology and found in prior work to structure female and male members’ behaviors and experiences. Peer group and gang literature similarly finds that the sex gap in offending varies across groups of differing sex ratios. Drawing on this and other research linking gang membership, offending, and victimization, we examine whether sex composition of gangs is linked to sex differences in offending in this sample, further assess whether sex composition similarly structures females’ and males’ victimization experiences, and if so, why. Self-report data from gang members in a multi-site, longitudinal study of 3,820 youths are employed. Results support previous findings about variations in member delinquency by both sex and sex composition of the gang and also indicate parallel variations in members’ victimization. These results are further considered within the context of facilitating effects such as gender dynamics, gang characteristics, and normative orientation.  相似文献

At precisely the same time that gay and lesbian activists were securing marriage rights for same‐sex couples nationwide, courts and “tough on crime” state legislatures were devising new ways to regulate sex. Despite recent estimates that over 750,000 Americans are registered sex offenders, few sexuality scholars have examined the growth of punitive policies regulating sex offenders. In this article, I draw on a unique set of data on the population of sex offenders in the United States to analyze: (1) whether recent trends in sex offender registration mirror those of corrections more generally, and (2) whether these policies disproportionally impact racial minorities. Findings reveal that sex offender registries grew dramatically between 2005 and 2013; that this growth is out of step with concurrent trends in corrections; and that black communities are disproportionately impacted. I conclude by considering whether these data reveal a new mode of “governing through crime” specifically targeting sex.

The relatively small body of prior research investigating whether the sex composition of juries impacts sentencing decisions has produced equivocal results. Exploring this topic further, the current study used a large sample of capital cases from North Carolina (n = 675) to examine (a) whether jury sex composition predicted jury capital punishment sentencing decisions; and (b) whether there were different models of sentencing for male-majority, equal male-female, and female-majority juries. When we controlled for a number of legal and extralegal factors, our findings indicated that jury sex composition was independently related to sentencing outcomes. Specifically, equal male-female juries were significantly more likely and female-majority juries were significantly less likely to choose the death penalty versus a sentence of life in prison. In addition, different models (predictors) of sentencing were revealed for each of the jury sex compositions. Implications for future research and policy are discussed.  相似文献

We employ a rational choice framework to understand the conditions under which sex traffickers allow their victims access to telecommunications devices while under their control. We posit that sex traffickers are rational actors who make calculated decisions regarding whether to allow their victims access to the Internet and cell phones. We hypothesize that sex traffickers allow younger victims and those they did not defraud in the recruitment process greater access to telecommunications devices because these decisions maximize their payoffs with minimal risk. However, we hypothesize that younger victims’ access to telecommunications devices is conditional on whether they have been defrauded in recruitment. In order to test these hypotheses, we deployed a survey to 115 victims of sex trafficking in the United States to learn about how they were recruited by their sex trafficker and the level of access they had to technology while under their sex trafficker's control. We find support for all of our hypotheses. The results have serious implications for criminal justice policy and practice.  相似文献

Abstract: This study examines whether sex determination based on morphological traits in the os coxae is impacted by racial quantitative variation. Nineteen traits were evaluated independently by two observers in 876 os coxae. Chi‐square test was used on a random sample of 400 individuals to assess whether the distribution of correct sex assessment varied for white and black individuals based on each trait individually and all 19 traits collectively, as well as on inter‐observer agreement in correct sex assessment. Results indicate that accuracy of sex assessment varied between white and black individuals in certain individual traits; however, accuracy was not impacted when all traits were considered together. Furthermore, traits that showed significant variation in correct sex assessment between races generally were not related to size, but instead were “discrete.” Finally, analyses of inter‐observer variation suggest that disparities in sex assessment for some traits may be related to differences in trait interpretation between observers rather than morphological dissimilarities between races.  相似文献

Abstract

Previous research has suggested that sex offenders are deficient in several areas of emotional functioning such as empathy, emotional perception, emotional management and interpersonal functioning. It is unclear, however, whether sex offenders display a general deficit in emotional functioning or whether their emotional deficits are specific to the circumstances in which offences occur. The present study aimed to provide a broad assessment of the emotional functioning of sex offenders by assessing their emotional intelligence (EI) using an abilities-based emotional intelligence test. Nineteen sex offenders, 18 non-sex offending prisoners and 19 controls were administered the Perception, Assimilation and Management branch subtests from the Mayer Salovey Caruso Emotional Intelligence Test (MSCEIT). The results indicated that the sex offenders were not significantly different than the control group, as assessed by these three branches of the MSCEIT. The results lend support to the suggestion that the emotional deficits displayed by sex offenders may be offence-specific. Implications for the use of the MSCEIT in sex offending populations and the role of EI in relapse prevention programmes are discussed.  相似文献

The ability to identify whether a female has been pregnant or has given birth has significant implications for forensic investigations and bioarcheological research. The meaning of “scars of parturition,” their causes, and their significance are a matter of contention, with a substantial literature of re‐evaluations and tests of the relationship between pelvic scarring and parity. The aim of this study was to use meta‐analytic techniques (the methodological approach) to test whether pelvic scarring, namely dorsal pubic pitting and the preauricular groove, is a predictor of parity and sex. Meta‐analyses indicated that neither dorsal pubic pitting nor the preauricular groove are predictors of parity status, while dorsal pubic pitting is a moderate predictor of sex. A weak relationship between dorsal pubic pitting and parity was identified, but this is believed to be a product of the moderate relationship with sex. This calls into question whether any causal relationship between parity and pelvic scarring exists.  相似文献

Sociology of organizations scholars have long recognized sex and gender as key features shaping interactional dynamics within groups, and several recent qualitative studies suggest that sex composition of gangs helps shape the gang experience for both boys and girls. Quantitatively, we add to this scant literature by testing competing hypotheses from the theories of Kanter, Blau, and Blalock, and examining whether youth gangs' sex composition influences members' characterizations of their gangs and their individual participation in delinquency. Our findings suggest that sex composition, independent of sex itself, is important in shaping the norms and activities of gangs and their members.  相似文献

Sex is one of the most robust predictors of self-control, with a consistent finding that girls score higher on a variety of measures of self-control. In this research, we investigate three possible reasons for why this is true: first, we examine whether current predictors of self-control mediate the effect of sex on self-control, second, we examine whether sex moderates the effect of current predictors on self-control and third, we examine the possibility that the causes of self-control are gendered, necessitating different causal models for boys and girls. Using data from the Children of the National Longitudinal Survey of Youth79, we assess three, related questions: Is the sex effect on self-control mediated by current predictors of self-control? Does sex moderate the effects of current predictors of self-control? Does the causal model predicting self-control differ for boys and girls? We find that the sex effect on self-control is robust; does not moderate the etiology of self-control; and although partially mediated by etiological variables, remains a significant predictor of self-control. We also find that current predictors do a poor job of explaining girls’ acquisition of self-control, suggesting a gendered etiology of self-control.  相似文献

Abstract

The advent of the internet has facilitated a dramatic increase in the number of individuals accessing and possessing child pornography and a corresponding increase in referrals for assessment and treatment. Questions remain regarding whether child pornography possessors are more similar to or different from other types of sex offenders, and whether or not assessment and treatment protocols for contact and non-contact sex offenders are applied appropriately to child pornography offenders. The present study compared 50 child pornography offenders, 45 non-contact sex offenders and 101 contact child molesters. The results indicated that the three groups were more similar than different; however, child pornography offenders were distinguished by greater academic and vocational achievement, fewer childhood behaviour problems and by select relational variables. Purpose

Research has examined pornography use on the extent of offending. However, virtually no work has tested whether other sex industry experiences affect sex crime. By extension, the cumulative effect of these exposures is unknown. Social learning theory predicts that exposure should amplify offending. Separately, the developmental perspective highlights that the timing of exposure matters.

Methods

Drawing on retrospective longitudinal data, we first test whether exposure during adolescence is associated with a younger age of onset; we also examine whether adulthood exposure is linked with greater frequency of offending.

Results

Findings indicate that most types of adolescent exposures as well as total exposures were related to an earlier age of onset. Exposure during adulthood was also associated with an overall increase in sex offending, but effects were dependent on “type.”

Conclusion

There are nuances in the effect of sex industry exposure on offending patterns. Implications of results are discussed.  相似文献

In the sex trafficking literature, the term ??trafficker?? is often used to refer to all the various actors who are involved in the business of transnational sex work. It thus includes those who recruit women in the source countries; those who transport victims across international borders; and those who manage and exploit the women in the various commercial sex venues in the destination countries. In this paper, we will look at some of the people who fall into these categories of being ??traffickers.?? Our goal is to better understand the many people who are facilitating transnational commercial sex. We will explore their background characteristics, the reasons for their involvement in sex trafficking, their roles and functions in the business, and the nature of their relationships with the women who sell sex. We will also discuss the issue of whether, and to what extent, organized crime groups are involved as traffickers in the transnational sex trade. Our discussion is drawn from face-to-face interviews with commercial sex workers, and with sex ring operators and a variety of government officials.  相似文献

Although Megan's Law was passed more than 10 years ago, very little is known as to whether it reduces sex offender recidivism significantly. Using a retrospective quasi‐experimental design, we examine whether community notification has a deterrent effect by comparing the recidivism rates of 155 level 3 (“high public risk”) sex offenders released from Minnesota prisons between 1997 and 2002 who were subject to broad notification with two separate control groups who were not. The first control group (referred to as the prenotification group) contained 125 sex offenders released between 1990 and 1996 (the 7 years preceding the implementation of the Community Notification Act) who likely would have been subject to broad community notification had the law been in effect at the time of their release. The second control group (referred to as the non‐notification group) was composed of 155 offenders (37 level 1 and 118 level 2) released between 1997 and 2002 who were not subject to broad community notification. The results from the Cox proportional hazards models reveal that broad community notification significantly reduced the risk of time to a sex reoffense (rearrest, reconviction, and reincarceration) compared with both control groups. The findings were mixed, however, for both non‐sex and general reoffending. Whereas broad community notification significantly reduced the risk of timing to both non‐sex and general recidivism compared with the prenotification group, no such effects were found in the non‐notification group analyses. We discuss the implications of these results and attempt to explain why Megan's Law seems to reduce sex offense recidivism in Minnesota.  相似文献

There is some debate about whether sex offenders are similar to non-sex offenders. It is known that sex and non-sex offenders are heterogeneous groups. Comparative studies must take this heterogeneity into account. Based on an aggregated database, a study was conducted among adjudicated juvenile (sex) offenders. The sample consisted of juvenile male sex and non-sex offenders who had been subjected to a psychological assessment at the request of the judge or district attorney. The central question focused on the differences between juvenile sex offenders, in particular rapists and sexual assaulters (n = 57), child molesters (n = 55), and non-sex offenders: violent (n = 85) and nonviolent offenders (n = 80). The results demonstrated that sex offenders differ from non-sex offenders with regard to demographic characteristics, problem behavior, and personality traits. This paper tests theoretical arguments that suggest court actors hold gendered views of sex offenders that result in a gender gap in sex offender punishment, where women who commit sexual offenses are treated more leniently than their male counterparts. We test this argument with precision matching analyses using 15 years of data on all felony sex offenders sentenced in a single state. Results indicate that gender disparities in sex offender sentencing exist and are pervasive across sex offense types. Specifically, male sex offenders are more likely to be sentenced to prison, and given longer terms, than female sex offenders. Findings are similar across sex offense severity and whether the offense involved a minor victim. These findings suggest that female sex offenders are treated more leniently than their matched male counterparts, even in instances of more serious sex offenses and those involving minor victims. Findings support theoretical arguments that contend that court decision-making is influenced by legally-irrelevant characteristics and raise questions about the source of gendered views of sex offenders and their effects on punishment approaches. Findings also raise questions about the virtue of get-tough sentencing policies that provide leeway for such dramatic variation across different groups of people.  相似文献

In this study, attention was given to how demographic, victimization, and community-level factors contribute to the belief that sex offenders can be rehabilitated. A survey was conducted with 746 residents of Norfolk and Virginia Beach, Virginia. A vast majority of the sample thought it was impossible to rehabilitate sex offenders, and a sizeable proportion of respondents indicated that they did not know whether sex offenders could be rehabilitated. Results showed that very few factors predicted attitudes about rehabilitating sex offenders. The implications call for expanded efforts to educate the public about sex offenders, as well as strategies for strengthening support for rehabilitation. In particular, it is argued that more attention should be given to identifying the punitive aspects of rehabilitation and increasing awareness about treatment strategies among policymakers. The authors also call for reconceptualizing rehabilitation so the concept is driven by practical matters rather than politics.  相似文献

Abstract

The study seeks to determine (1) whether the crime seriousness ranking hierarchy identified by Rossi et al. in 1974 persists and (2) whether intra-group agreement on the relative ordering of crimes exists within a Mexican American sample stratified by age and sex. A self-administered survey questionnaire surveyed a sample of 525 college students and 426 parents. Respondents were asked to rank 20 crime offenses according to perceived seriousness. The analyses indicate that the older cohort of respondents is more conservative than the college students and that female students have lower tolerance for crime than their male counterparts. Among Mexican Americans, significant generational and sex differences exist in how serious certain behaviors are perceived.  相似文献
