改造:现代刑罚的迷误及其批判--兼及刑罚范式革命与制度变革的思考

本文从“改造”这一刑罚的中国经验出发,结合现代刑罚发展的历史,在修正国内流行的“刑罚进化论”的基础上,以改造刑为例,对现代刑罚制度与理论的迷误及其刑罚理性的谵妄与僭越,进行了具体的工具分析和价值批判;同时,借此分析与批判,本文最后将对于刑罚问题的认识引向关于“刑罚范式”革命的思考,提出了在“刑罚范式”的意义上,现代刑罚应从“国家vs罪犯”向“刑事债权人vs刑事债务人”进行转换,以此实现从“改造刑”到“契约刑”的刑罚制度变革,走向刑事法治的新境界。

Regulating Political Donations by Companies: Challenges and Misconceptions

This paper analyses the regulation of company political donations in the UK. It argues that UK policy makers have failed to understand the nature of company donors and, consequently, that the UK Companies Act 2006 requirement for shareholder consent for company donations is not an effective solution to concerns about company donors. To this end, the paper presents a comprehensive empirical analysis of company donations to show that the vast majority of donor companies are closely held or owner‐managed entities where shareholder consent rules are ineffective. The paper highlights particular concerns that arise with donation by such companies and argues for a more accurate understanding of company donations in order to formulate effective policy responses to concerns about the role of company donors.

票据背书法律规制之我见

流通是票据的生命,背书是票据流通的主要方式。我国票据法律法规对票据背书进行了较为具体和详细的规定,但也存在一定的问题。其未规定空白背书及背书涂销;关于背书的后手对直接前手背书真实性负责的规定含义不清;对期后背书效力的规定自相矛盾;对委托取款背书及质押背书的被背书人的再背书限制不明确;司法解释对质押背书时“质押”字样记载的效力的规定易生歧义等,均在一定程度上损害或阻碍了票据的流通,建议《票据法》予以修正。     

网络化管理:21世纪派出所规范化建设的思考

派出所网络化管理是打击新型刑事犯罪活动和派出所基础建设发展的要求。要根据派出所工作的范围和职责建设和派出所的管理网络。在建设过程中，应建立起恰当的网络模式，处理好一些问题，使网络建设形成系统工程，促进派出所的管理和全面规范化建设。     

Police Interviewing and Interrogation: A Self-Report Survey of Police Practices and Beliefs

By questionnaire, 631 police investigators reported on their interrogation beliefs and practices-the first such survey ever conducted. Overall, participants estimated that they were 77% accurate at truth and lie detection, that 81% of suspects waive Miranda rights, that the mean length of interrogation is 1.6 hours, and that they elicit self-incriminating statements from 68% of suspects, 4.78% from innocents. Overall, 81% felt that interrogations should be recorded. As for self-reported usage of various interrogation tactics, the most common were to physically isolate suspects, identify contradictions in suspects' accounts, establish rapport, confront suspects with evidence of their guilt, and appeal to self-interests. Results were discussed for their consistency with prior research, policy implications, and methodological shortcomings.     

Police Prosecutor and Police Prison: A Note on Summary Justice in Austria

The Austrian Administrative Code, designed to manage relatively minor violations, authorizes an extraordinary court that practices summary justice through a police prosecutor who can impose short sentences to a police prison. This paper concentrates on the use of this remarkable legal institution as a form of holding action that reduces delay between formal charges and final disposition in prosecution under criminal law.     

Establishment of a Juvenile Police Record:

According to the symbolic interactionist perspective, the juveniles who are most likely to have a police record of arrest are those who conform to police preconceptions about delinquent types, who are perceived as a threat to others, and who are most visible to the police. Several individual and peer group characteristics can serve as cues that youths are delinquent or that they pose a threat and can increase visibility. The present study uses a survey approach to determine the relative association of these individual and peer group characteristics with the establishment of a police record. The analysis reveals that in addition to delinquent activities, fitting the common image of a delinquent and dangerous person–that is, being a male in a predominantly, male, delinquent peer group–increases a youth's chances of arrest. Moreover, committing a high proportion of offenses with a group of peers, which results in high visibility, also increases the chances of arrest.     

德性：警察管理的新向度

加强对警察的管理必须从完善警察自身的素质方面下功夫,警察身上所内含的德性在警察管理的过程中蕴涵着重大的价值,应成为警察管理的又一新方向;警察德性建构的价值取向应是对人权的信仰、对法律的忠诚和对公正的维护;而警察管理中德性的养成则可以在他律和自律的逻辑中建构。
