Research Summary Business transactions have increasingly been crossing national borders, thereby presenting greater opportunities for white-collar crime and for the externalization of risk. The global economic crisis, resulting in part from the subprime mortgage scandal, is a prime example of this potential. To develop theoretical perspectives and practical interventions to prevent and respond to the global financial crisis, we consider similar issues of risk and white-collar crime associated with global transactions in electronic waste (E-waste). Policy Implications Smart (or responsive) regulation is a promising approach for addressing both E-waste and the current economic crisis. This response includes crime prevention, third-party- and self-regulation, and the threat of strong state intervention. Future research should explore the extent to which smart regulation reduces specific forms of white-collar crime and risk, as well as whether these interventions generalize to other transnational problems.  相似文献

General assessments refer to individuals’ overall judgment of their standing on broad dimensions that have special relevance for the explanation of crime, such as their overall bond to society or their prospects for success. These assessments are partly a function of the independent variables that are commonly considered in contemporary crime theories and quantitative research. But these standard etiological variables are far from fully determinative of general assessments because individuals differ in how they interpret, weigh, and combine their standing along these variables. The social–psychological factors that affect the subjective judgments underlying general assessments have yet to be theorized in any comprehensive, systematic manner. Nevertheless, we hypothesize that the incorporation of general assessments in models of offending will greatly enhance their explanatory power because these assessments are the most proximate, comprehensive, and personally relevant causes of crime. Moreover, we anticipate that once these assessments reach certain threshold levels, such as the view that bonds to society are severed irreparably or success is beyond reach, they result in a nonlinear jump in the frequency, seriousness, and duration of offending (i.e., chronic offending). A consideration of general assessments and their associated thresholds should therefore substantially improve efforts to explain crime.  相似文献

Much of the existing research on hate crime focuses on the perspective of victims, while relatively little is known of the offenders. This study examines the prevalence of hate-motivated offending in the form of assaults and bullying, and variables that may explain some of the influences for such behaviour. It compares hate-motivated offenders to both non-offenders and offenders committing non-hate-motivated acts. Our data are based on a nationally representative youth survey collected in 2012 (n = 4,855) from Finnish students attending ninth grade (ages 15–16). It relies on three central theories in criminology: strain, social control and self-control theories. Frequent parental fighting, low parental supervision, low social control and male gender were significant factors in explaining hate crime offending. Our results suggest that the three criminological theories are relevant in the analysis of hate crime offending among Finnish youth.  相似文献

Scientifically, little is known about white-collar crime in Switzerland or concern about white-collar crime and even less about how concerned bank employees are about this criminality. This article is based on a small opinion survey of Swiss bank employees and tries to explore perceptions of seriousness and concern about white-collar crime among people who, in their position, might have to face this issue regularly. Past assumptions on the public’s indifference towards white-collar crime seem not to be confirmed in this study as the results obtained demonstrate a greater sensitivity with respect to white-collar crime and especially towards crimes perpetrated by corporations. Even though Swiss bank employees do qualify white-collar offences as very serious acts, they are still more punitive with regard to ordinary crimes.  相似文献

A core proposition of Gottfredson and Hirschi's general theory of crime is that ineffective parenting fosters low self-control in children, which leads to delinquent conduct. Using a sample of 2,472 students, we examined the impact of attention deficit hyperactivity disorder (ADHD) on self-control and delinquency. The analysis revealed three main findings. First, low self-control was a strong predictor of both self-reported delinquency and self-reported arrests. Second, parental monitoring not only increased self-control, but had direct effects on both measures of delinquency. Third, the effects of ADHD on delinquency were largely through low self-control.  相似文献

Abstract

This paper argues that we should cease treating sexual offending as a problem best dealt with by psychology, medicine, or law. Sexual offending, like mental illness, alcoholism, or drug addiction, is a public health problem, one that is everyone's business. The paper first considers the traditional levels of prevention in public health: primary, secondary, and tertiary. The argument is made that most of our efforts have been directed to the tertiary level where they are least likely to be effective. Applications of the general public health model to sexual violence are considered. These include epidemiology, risk factor research, program evaluation, and dissemination of information on what works. Various methods for informing and educating the public about sexual violence are proposed. The paper concludes with suggestions on how harm can be minimised through the use of a public health approach.  相似文献

The incidence of adolescent offending has been shown to be different for young males and females. However, there is a lack of literature concerning adolescent female offenders, and despite research suggesting that personality factors may be linked with antisocial and criminal behaviour in adolescents and young adults; there have been a lack of studies investigating intra-sex personality differences in young female populations. The Millon Adolescent Clinical Inventory, a 160-item self-report personality measure, was administered to 26 non-offending and 28 offending adolescent females. It was found that the offending group was significantly less submissive, less conforming, more forceful, more oppositional and more likely to exhibit borderline personality traits than the control group. The offending group also had higher reported incidences of childhood abuse and family conflict, and were more prone to substance abuse, impulsive actions and suicide ideation. These initial findings suggest that personality differences may well exist between offending and non-offending adolescent females.  相似文献

The prevalence of attention deficit hyperactivity disorder (ADHD) among adult offenders is significantly higher than in the general population. Adults with ADHD often present with multiple psychiatric comorbidities. This study aims to characterise the comorbidities presented by adults with ADHD who have offended and also to investigate predictors of offending among this population. Seventy-three participants with a diagnosis of adult ADHD were divided into a group with a history of offending behaviour (n = 30) and a group of non-offenders (n = 43). Groups were compared on measures of ADHD symptoms, substance use and DSM-IV Axis I and Axis II disorders using the Millon Clinical Multiaxial Inventory – 3rd Edition. Major depression, cannabis use and childhood hyperactivity-impulsivity symptoms predicted offending. These findings indicate that adults with ADHD who have a history of offending behaviour are more likely to present with complex psychiatric needs.  相似文献

Developments in technology have changed the environment of crime, which, in some of its new forms, poses a serious threat to society. At the same time the technologies of crime control are being transformed. If criminology is to respond adequately to this changed environment, it must make radical changes in its mission, its theories and its methodologies, the collective result of which would be to make the discipline more directly relevant to crime control and prevention. This would enhance the effectiveness of these activities and would also open up new and exciting career opportunities for criminologists. If criminology does not change, it will become eclipsed by crime science and will find it increasingly hard to survive – even in the protected environment of universities.  相似文献

A test of social control theory was operated on a random sample of about 2000 juveniles aged 12 to 18 years. A second test was performed 2 years later on a subsample of the original one, taking into account changes in the life situation with respect to the family, school, work, leisure, peers, and some values connected with delinquency. Both self-report data and official data were collected. Using the HOMALS technique, scales were constructed of family integration (parental control, communication with parents, family activities, and family climate), school integration (liking school, commitment to school values, school performance, and social behavior), leisure and peers (nature and involvement in leisure activities, bravado), and some normative statements. Changes in social integration were measured over a period of 2 years and compared to the impact of official intervention in delinquency cases by police or prosecutor. On the basis of path analysis and a LISREL model, we were able to conclude that there was no impact of police or prosecutor intervention on later delinquency, but there appeared to be a strong and inverse relationship between changes in social integration, or the bond with society, and the frequency of offending.This article is based on two Dutch research reports, which have been published in English inJuvenile Delinquency in the Netherlands (Junger-Tas and Block, 1988).  相似文献

Abstract

Although neuropsychological deficits have been linked to antisocial behavior, theories of crime have been slow to develop formal processes and predictions for neuropsychological deficits. One recently articulated theory, however, places emphasis on the influence of neuropsychological variation in the development of antisocial behavior. In her developmental taxonomy. Moffitt outlines a theory of antisocial behavior that rests on the presence of two groups of offenders: life-course persisters and adolescent-limiteds. Both groups occupy distinct etiologies for antisocial involvement and are believed to engage in different antisocial activities. One of the main differences between the two groups is the role that neuropsychological deficits play in the production of antisocial behavior. Moffitt hypothesizes that neuropsychological deficits are predictive of antisocial involvement for life-course persisters but not for adolescent-limiteds. Using data from the Philadelphia portion of the National Collaborative Perinatal Project, proxy measures of neuropsychological deficits are used to predict four different manifestations of life-course persistent offending. Results support Moffitt's hypothesis about the relationship between poor neuropsychological test scores and life-course persistent styles of offending.  相似文献

Control balance theory indicates that the control one exercises relative to the control one experiences, or the control balance ratio, should relate to specific forms of deviance. Control surpluses, or when control exercised is greater than control experienced, should relate to autonomous forms of deviance, whereas control deficits, or when control experienced is greater than control exercised, should relate to repressive forms of deviance. To date, control balance theory has been investigated empirically only to a limited extent, with mixed to supportive results. This paper presents an application of control balance theory to the autonomous deviant act of exploitation in a corporate crime context. Both control balance theory and the extant corporate crime literature offer impetus for such an investigation. Using data collected on working adults, the results support the key hypothesis that control surpluses rather than control deficits relate to exploitative acts in the corporate context. This finding holds with two control balance ratio measures, global and workplace‐specific. Future theoretical and empirical research directions are outlined.  相似文献

This article reports findings from a discourse analytic study which critically explored the language of mental health nurses, and detained sexual offenders, in relation to pornography in one high-security hospital. It recognised previous empirical investigation, and pro-feminist theorising, into mediated representations and male sexual violence, but situated the research process in a forensic nursing context. Decision-making about access to, or restriction of, commercial sexual literature, as a component of therapeutic intervention and offender management, reveals tensions between service-user rights and treatment goals. The aim was to access nurse and patient talk in a specific culture. Semi-structured interviews with eighteen nursing staff, and nine patients, were used to co-construct accounts of pornography, sexual offending, and treatment. Analysis and data collection were undertaken concurrently. Interviews were audio-taped and transcribed. Data was coded to identify theoretical/conceptual themes and sub-themes representing discursive repertoires. Attention was given to how textual variation positioned respondents in relation to each other and the institution. Findings suggested collective male talk textured the environment, promoted gendered inequality, marginalised female nurses, and undermined rehabilitation. Shared discourse enabled male staff and patients to relate to each other as men, while maintaining distance through constructions of otherness. Discussion focuses on discriminatory discursive-practices, where men's talk about pornography and sexual violence embodied gendered knowledge/experience and contributed to a toxic culture. Consideration is given to ways of resisting institutional impediments and promoting positive therapeutic relations.  相似文献

In the light of the rather low, empirical interest in the etiology of female crime and delinquency, this study presents and discusses some findings on aspects of control theory. The data are taken from Project Metropolitan, a longitudinal study of a Stockholm birth cohort comprising 15,117 cases (males and females) studied during a 30-year period. Of the females 791 cases or 11% acquired records of delinquency, drug use, or crime up to age 26. The delinquents were divided according to assumed seriousness and compared to the nondelinquents on two dimensions of the social bond called Attachment to school and Commitment to education. The results show, first, that delinquency varies with the strength of the social bond and, second, that the ability to predict future delinquency with knowledge of these aspects of the bond is limited, as the variance proportions accounted for are low. However, when comparing the explained variances to some well-known studies, we find that the differences are not so extensive.This paper is published in its complete form by the Project Metropolitan Research Report series, Department of Sociology, University of Stockholm, 1989. Most social control theorists do not consider definitions of delinquency problematic. Beginning with the assumption that crime is a unitary concept, researchers have combined a variety of non-normative items to create additive delinquency scales. Rarely is consideration given to whether the causes of crime differ for distinct types of criminal activity. Furthermore, the classic social control model doesnot predict that bonding variables operate differently for distinct age and gender categories. Consistent with the structuring perspective, the present research attempts to refine the social control model by specifying conditions under which the model predicts different forms of delinquency. This study examines social control theory using survey data from middle- and high-school students (N=2926). Logit regression analysis revealed that the model which best explains personal crime differs from the model which best explains property crime. Also, certain components of the model were more powerful predictors of criminal behavior for different age-gender groups. The importance of model specification is demonstrated and the implications for social control theory are discussed.  相似文献

Summary In this article I have attempted to theorize the relations of reproduction in a manner that makes their operation in history more apparent. Using an historical materialist analysis, I have diverged from previous analysis by situating reproduction in the base and positing a co-determinative relation between production and reproduction. I have argued that due to the distinctly different dynamic of reproduction, its longer completion time and its political subordination in class societies, we must pursue different research strategies than those used to illustrate the impact of production on reproduction. This article serves only to give the broadest outline of concerns and questions to focus upon in developing new strategies. As such it suggests that the ubiquity of patriarchy and its preservation, even in the face of structural contradictions with production, provide a starting place for such inquiry. To this end I have developed a model of the modes of reproduction in order to rediscover reproduction in history, its dynamic and its interaction with production.This perspective permits us to reanalyze old rules and customs previously understood exclusively as rules of production (e.g., rules of inheritance and property, certain labour and welfare laws), and discover within them the impact of the reproductive as well as the productive imperative. The model emphasizes the inextricable connection between production and reproduction at the same time that it calls attention to the distinctiveness of their dynamics. Dynamics which, because of their distinctiveness, do not automatically guarantee balance between the two spheres. Hence the continuous necessity for socially engineering this balance, a necessity requiring even more intervention as the two spheres become structurally more alienated.  相似文献

The “rational choice” framework, with its focus on risks and rewards, is often used to explain corporate criminality. In this paper, we build on this framework by integrating the notion of “desire‐for‐control.” Although common to many psychologists, the desire‐for‐control, or the general wish to be in control over everyday life events, has not been examined for its relevance in understanding criminal activity generally, or within corporate offending in particular. After demonstrating the importance of desire‐for‐control in the corporate context, we use data from a sample of managers and MBA students to examine the extent to which desire‐for‐control relates to rational‐choice considerations and corporate criminal decision‐making. Results suggest that desire‐for‐control (1) influences the interpretation of rational‐choice considerations and (2) is positively related to corporate criminality even after controlling for a number of important situational‐ and individual‐level factors. Implications for future theoretical and empirical research are addressed.  相似文献

This article draws attention to the systematic and organised criminal acts committed by legitimate enterprises and professionals, focusing on accounting fraud. Firstly, the extent and consequences of false accounting are considered, then a theoretical framework is outlined which focuses on structural issues commonly found in financial scandals around the world. The Gokal/BCCI fraud is summarised as a case study offering insights into the motives and modi operandi of accounting frauds. The analysis centres on theoretical and practical lessons to be learned from this case, which is placed in the context of evidence from other frauds in Europe and the USA. The article points to the importance of strains and pressures perpetrators are subject to, the rationalisations they use, the organisational culture and anomie. Crimes of the powerful (i.e. corporations, elites, organized crime groups, states, white collar criminals, etc.) have numerous devastating effects. That is why, over the centuries, some philosophers and political theorists - and more recently some constitutional experts, and selected social scientists - have proposed and analyzed the best ways to deter, minimize, prevent, regulate, and hereafter control large powerful interests. Not all powerful actors, however, are equally dangerous nor does this threat remain constant. Moreover, not all methods of control work for all entities. In order to better understand this process, one must determine a number of things including: which powerful actor is currently the most dangerous/harmful, where controls do not exist and/or do not function well, and which controls work best and in which particular setting. To achieve this goal, scholarship in diverse fields need to be integrated, with specific reference to the challenges and problems that have arisen and the solutions that have been proposed. To this end, this article develops a parsimonious but dynamic and heuristic model, consisting of a number of interconnected factors, to depict the process of controlling crimes by the powerful.  相似文献
