This article examines the gap between Dutch judges and the public in terms of preferred severity of sentences. It focuses on one particular explanation usually given for the gap: the lack of case-specific, detailed information on the part of the general public. Findings from three studies are reported and combined: (a) a survey among a sample from the Dutch population (N = 2,127), (b) a sentencing experiment with judges in Dutch criminal courts (N = 180), and (c) a sentencing experiment, using the same case materials as with judges, but now with a sample from the Dutch population (N = 917). Results show that providing the public with detailed case information indeed reduces severity of sentences preferred. Moreover, those members of the public who were given short and unbalanced newspaper reports preferred much harsher sentences than did those who were given the full case files. However, despite such a reduction in punitiveness as a result of information, the public’s preferred sentences remain much more punitive than judges’ sentences pertaining to exactly the same case files.

Jan W. de Keijser   (1968) is senior researcher at the Netherlands Institute for the Study of Crime and Law Enforcement, in Leiden, the Netherlands. He graduated in political science and obtained his Ph.D. at Leiden University, examining judges’ sentencing decisions in relation to the functions and goals of punishment. Much of his recent research has been focused on the psychology of judicial decision making, factors influencing legitimacy of the criminal justice system, and public opinion on the justice system. Peter J. van Koppen   (1953) is senior researcher at the Netherlands Institute for the Study of Crime and Law Enforcement (NSCR) at Leiden, the Netherlands, and is professor of Law and Psychology at the departments of Law of Maastricht University and the Free University, Amsterdam. He is a psychologist. van Koppen is co-editor of Psychology, Crime, and Law and serves as President of the European Association of Psychology and Law. His research includes negotiation behaviour of attorneys in civil cases, recovered memories, geographic profiling of criminal behaviour, execution of court decisions, lie detection, judicial decision making and sentencing, police interrogations and false confessions, and value of forensic evidence. Henk Elffers   (1948) is senior researcher at the Netherlands Institute for the Study of Crime and Law Enforcement and professor of Psychology and Law at Antwerp University, Belgium. He graduated in mathematical statistics at the University of Amsterdam and obtained his Ph.D. in Psychology of Law at Erasmus University, Rotterdam, on a thesis on income tax evasion. Before his current position, he held various research appointments in Amsterdam (mathematics), Utrecht (geography), and Rotterdam (law and psychology). His research interests include spatial aspects of crime, rational choice theory of rule compliance, statistics in the courtroom, and relationship between judges and the general public.  相似文献

A significant part of the general public’s observations and image concerning the police comes through the mass media. It has been assumed that one factor affecting the level of trust is the way the media handles the police. This article describes the media uproar that arose in Finland in November 2013 about police misconduct, and its effects on the public trust in the police. Two hypotheses were tested in the study: (a) negative publicity always decreases trust, and so, too, in this case; and (b) a change in trust is affected by the public’s independent interpretation of the publicity battle, in which case criticism might also increase trust. The study materials comprise the news coverage concerning the uproar and four opinion surveys collected after it occurred. The first survey was conducted immediately after the press conference of the case in week 48/2013 and the other ones in three-week intervals. The results show that following the uproar, compared to the earlier results of the European Social Survey, trust in the police did not decrease—on the contrary, it increased slightly. Our results suggest that in this case a large part of the audience has taken, to use the term of Stuart Hall, the oppositional position when interpreting negative news about the police.  相似文献

The control of infectious diseases has traditionally fallen to public health and the clinical care of chronic diseases to private medicine. In New York City, however, the Department of Health and Mental Hygiene (DOHMH) has recently sought to expand its responsibilities in the oversight and management of chronic-disease care. In December 2005, in an effort to control epidemic rates of diabetes, the DOHMH began implementing a bold new plan for increased disease surveillance through electronic, laboratory-based reporting of A1C test results (a robust measure of blood-sugar levels). The controversy A1C reporting produced was relatively contained, but when Dr. Thomas Frieden, New York City health commissioner, called for the state to begin tracking viral loads and drug resistance among patients with HIV, both the medical community and a wider public took notice and have started to grapple with the meaning of expanded surveillance. In the context of the past century of medical surveillance in America, we analyze the current debates, focusing first on diabetes and then HIV. We identify the points of contention that arise from the city's proposed blend of public health surveillance, disease management, and quality improvement and suggest an approach to balancing the measures' perils and promises.  相似文献

Research in organizational psychology has consistently demonstrated that employee perceptions of organizational justice have significant effects on employee attitudes, perceptions, and behaviors. Similar studies utilizing the organizational justice model in policing have also noted these effects, including the relationship of justice perceptions with officer attitudes toward the public. Recent theoretical developments in policing contend that the association between internal perceptions of justice and external attitudes may be the result of organizational and supervisory practices that ‘trickle-down’ into the police-community relationship. This paper explores this association by assessing the effects of officer perceptions of organizational justice on officer trust in the public. A sample of patrol division police officers were surveyed using measures taken from the organizational justice literature and Mayer, Davis, and Schoorman’s model of organizational trust. Results show a strong relationship between perceptions of organizational justice and trust in the public even when other relevant predictors are controlled.  相似文献

Examining the evolution of British and Australian policing, this comparative review of the literature considers the historical underpinnings of policing in these two countries and the impact of community legitimacy derived from the early concepts of policing by consent. Using the August 2011 disorder in Britain as a lens, this paper considers whether, in striving to maintain community confidence, undue emphasis is placed on the police's public image at the expense of community safety. Examining the path of policing reform, the impact of bureaucracy on policing and the evolving debate surrounding police performance, this review suggests that, while largely delivering on the ideal of an ethical and strong police force, a preoccupation with self-image may in fact result in tarnishing the very thing British and Australian police forces strive to achieve – their standing with the public. This paper advocates for a more realistic goal of gaining public respect rather than affection in order to achieve the difficult balance between maintaining trust and respect as an approachable, ethical entity providing firm, confident policing in this ever-evolving, modern society.  相似文献

Small arms must be considered as a public health problem, but quantifying the public health impact of small arms is difficult and studies are sparse in areas of conflict. This study considers the remote cross border area between Kenya and Uganda where pastoral conflict in the form of cattle raiding with the use of small arms has escalated in recent years, and where health facilities are scarce. Hospitals and clinics in Karamoja, Uganda, and West Pokot, Kenya were visited by the author, to collect any available data on small arms injuries. Interviews with hospital staff helped to provide further insight into the statistics. Statistics showed that most injuries were sustained during raiding, though worrying incidences of injury among noncombatants and young children were found. Many serious injuries and limb fractures were documented, likely to have some long-term implications for pain, growth, disability, and livelihood. Deaths and injuries are likely to be significantly underestimated by the statistics, due to problems of transport, insecurity, deaths prior to arrival, admission fees for some facilities, and fear of reporting injuries due to the criminal element. Police statistics support this conclusion. The situation appeared to be worse in Uganda as opposed to Kenya, but cooperation between the two countries is needed since pastoralists readily cross the borders both to raid and to attend clinics and hospitals.

R&D managers at 50 firms who have formal relations with two research universities in Stockholm are interviewed about their rationales for collaboration. Drawing on this material, a distinctive typology of rationales for establishing cooperative relations is presented. While the typology demonstrates a considerable breadth of interaction rationales, rationales related to innovation, in terms of invented or improved products or processes, are found to be the main drivers for interaction. Based on this framework, we analyse which rationales for interaction are consistent with public rationales for supporting university-industry relationships. Public co-funding that allow firms to influence (part of) the academic agenda is identified as a particularly interesting case that requires further theoretical attention.  相似文献

The purpose of this study was to examine the efficacy of social control and social support policies associated with conservative and liberal political ideologies with respect to violent crime in large U.S. cities during the 1990s. Eighty-five cities with populations of 150,000+ were included in the analysis; these cities accounted for fifty-two million urban area residents of the U.S. The use of the two-way, fixed-effect panel data method of statistical analysis enabled the authors to assess the relationship between change in local government expenditures for police and court services (social control) and expenditures on community development and park/recreation (support policy) and corresponding changes in crime rates documented within these cities. The findings indicated that expenditure on both police services and community development initiatives had significantly suppressive effects on crime in these cities during the period of the 1990s. It appeared that both conservative and liberal policies had their merits as effective countermeasures to crime.  相似文献

The Advanced Technology Program (ATP) collected a unique source of data from highly innovative firms beginning in 1993. These data follow the OECD’s guidelines for collecting innovation data and provide important insights for understanding the innovation process within firms. Although the data are not representative of the population of firms, there is sufficient number of firms in the dataset to test hypotheses and to provide a starting point for calls for innovation metrics. Because of the confidential nature of the data, ATP worked with the National Opinion Research Center (NORC) to create a Data Enclave so that researchers could remotely access the ATP data in a secure environment. To initiate the use of ATP data in the Data Enclave, the ATP program funded researchers to undertake research projects that use ATP data. Other organizations have joined the Data Enclave, including the Department of Agriculture and the Kauffman Foundation.
