Feminist theory needs a constructivist account of biological sex for at least two reasons. The first is that as long as female and male are the only two sexes that are taken for granted, being cisgender, heterosexual, and preferably a parent will be the norm, and being intersexed, transgender, bi- or homosexual, infertile or voluntarily childless will be deemed failure. The second is the fact that, usually, sex and gender come together in the way that is expected, i.e. the fact that most females are women and most males are men needs to be explained. This paper provides a constructivist theory of sex, which is that the sex categories depend on norms of reproduction. I argue that, because the sex categories are defined according to the two functions or causal roles in reproduction, and biological function is a teleological concept involving purposes, goals, and values, female and male are normative categories. As there are no norms or values in nature, normative categories are social constructions; hence, female and male are not natural but social categories. Once we understand that biological normativity is social, biological norms of heterosexuality, fertility, and so on are no longer incontestable. In addition, as many gender norms also concern reproduction—socially mediated reproduction—this simple theory of sex explains the common confluence of sex and gender.  相似文献

Drawing on feminist labour law and political economy literature, I argue that it is crucial to interrogate the personal and territorial scope of labour. After discussing the “commodification” of care, global care chains, and body work, I claim that the territorial scope of labour law must be expanded beyond that nation state to include transnational processes. I use the idea of social reproduction both to illustrate and to examine some of the recurring regulatory dilemmas that plague labour markets. I argue that unpaid care and domestic work performed in the household, typically by women, troubles the personal scope of labour law. I use the example of this specific type of personal service relation to illustrate my claim that the jurisdiction of labour law is historical and contingent, rather than conceptual and universal. I conclude by identifying some of the implications of redrawing the territorial and personal scope of labour law in light of feminist understandings of social reproduction.  相似文献

In this article, I use a Marxist feminist methodology to map the organisation of migrant sex workers’ socially reproductive paid and unpaid labour in one city and country of arrival, London, UK. I argue that unfree and ‘free’ (sexual) labour exists on a continuum of capitalist relations of (re)production, which are gendered, racialised, and legal. It is within these relations that various actors implement, and migrant sex workers contest, unfree labour practices not limited to the most extreme forms. My analysis reveals that many migrant sex workers have very limited ‘freedom’. This is in stark contrast to the classical liberal claim of sex worker rights activists and academics that the vast majority of migrant sex workers are free, and therefore not coerced, exploited or trafficked. I then consider whether the emerging labour approach to trafficking could help achieve ‘freedom’ for migrant sex workers. Advocates argue that anti-trafficking efforts must, and can, be refocused on extending minimum labour and social protections to all vulnerable workers. I argue that this approach is disconnected from material interests and history. Rather, migrant sex workers, sex worker rights activists, and all migrant and citizen workers and activists globally must collectively organise against ‘labour unfreedom’ and hence for meaningful control over their labour and lives.  相似文献

From the feminist ‘sex wars’ of the 1980s to the queer theory and politics of the 1990s, debates about the politics of sexuality have been at the forefront of contemporary theoretical, social, and political demands. This article seeks to intervene in these debates by challenging the terms through which they have been defined. Investigating the importance of ‘sex positivity’ and transgression as conceptual features of feminist and queer discourses, this essay calls for a new focus on the political and material effects of pro-sexuality.  相似文献

This article presents insights from a research project on sex work that took place in the Caribbean region during 1997–8. First it briefly summarizes common themes in historical and contemporary studies of sex work in the region, then describes the aims, methodology, and main trends of the project. It pays particular attention to the differences between definitions and experiences of sex work by female and male sex workers and of male and female sex tourists, as well as describing conditions in the Caribbean sex trade. Finally the article identifies some implications of the complexity in the region that were uncovered through the research project for feminist theorizing about sex work.  相似文献

North American writer Joan Didion’s eloquent testimonial speaks to the significance of storytelling in our lives. Personal storiesmake our lives meaningful. Part of this is because our stories, wittingly or not, become the means through which we fashion our identities for listeners. Or, as scholars from many disciplines have argued, identity and selfhoodare narrative accomplishments. In this formulation, an individual constructs a sense of self by telling stories or “personal narratives,” which describe “the evolution of an individual life over time and in social context” (Maynes et al. in Telling stories: the use of personal narratives in the social sciences and in history. Cornell University Press, Ithaca, 2008, 2). While personal narratives contain unique autobiographical elements, the logics of storytelling and the values and beliefs of a particular time and place also influence the kinds of stories people tell. As feminist historian Mary Jo Maynes and her coauthors argue: “The stories that people tell about their lives are never simply individual, but are told in historically specific times and settings and draw on the rules and models in circulation that govern how story elements link together in narrative logics” (2008, 2). Put another way, even the most idiosyncratic story is always in some way social: what narrators decide to tell is often guided by the expectations of audiences (real or imagined); the conventions of various genres (such as life history or autobiography); as well as the broader cultural narratives located in particular historical times and places. In this light, personal narratives at once provide evidence of a storyteller’s viewpoint and experiences as well as the social and cultural milieu in which they live.  相似文献
