International literature on prison effects on recidivism tends to find little evidence of specific deterrence. If anything, imprisonment seems more likely to increase than decrease rates of offending. The present study adds to this literature by examining imprisonment and recidivism in Finland, a nation characterized by an exceptionally moderate penal culture. It has been suggested that severe sanctions need to be imposed selectively in order for them to be effective. In this research, we estimated the impact of first imprisonment on recidivism in comparison with offenders sentenced to either suspended imprisonment or community service. Using data from government population registries, we controlled for a large number of legal and extra-legal confounding factors, including criminal history and socio-demographic characteristics. We found no evidence of reduced recidivism as a result of imprisonment. Instead, consistent with prior research, we find evidence of increased recidivism in certain offender categories. We conclude with a discussion of policy implications.  相似文献

The purpose of this study is to evaluate the deterrent effect of imprisonment. Using data on offenders convicted of felonies in 1993 in Jackson County (Kansas City), Missouri, we compare recidivism rates for offenders sentenced to prison with those for offenders placed on probation. We find no evidence that imprisonment reduces the likelihood of recidivism. Instead, we find compelling evidence that offenders who are sentenced to prison have higher rates of recidivism and recidivate more quickly than do offenders placed on probation. We also find persuasive evidence that imprisonment has a more pronounced criminogenic effect on drug offenders than on other types of offenders.  相似文献

Objectives

An enduring legacy of the 1980s “war on drugs” is the increased use of imprisonment for drug offenders. Advocates anticipated, in part, that prison is more effective than community sanctions in reducing recidivism. Despite the contribution of drug offender incarceration to prison growth nationally, and debates about whether this approach should be curtailed, only limited rigorous research exists that evaluates the effect of imprisonment on drug offender recidivism. To address this gap, this paper uses sentencing and recidivism data from a cohort of individuals convicted of felony drug offenses in Florida to examine the effect of imprisonment—as compared to community sanctions—on recidivism.

Methods

Regression discontinuity analyses are used. These minimize potential selection bias by exogenously assigning cases to conditions based on a rating variable and a cut-off score.

Results

Results indicate that prison has no effect on drug offenders’ rates of reconviction. This finding holds across a range of offender subgroups (racial and ethnic, gender, age, and prior criminal justice system involvement).

Conclusions

Imprisoning individuals convicted of marginally serious drug offenses—that is, those close to a cut-off score for being sent to prison—did not reduce subsequent offending. This finding suggests that curtailing the use of imprisonment for such individuals will not appreciably affect future criminal activity and may have the benefit of reducing correctional system costs.

Ex‐prisoners consistently manifest high rates of criminal recidivism and unemployment. Existing explanations for these poor outcomes emphasize the stigmatizing effects of imprisonment on prisoners seeking postrelease employment as well as the deleterious effects of imprisonment on prisoners’ attitudes and capabilities. However, these explanations must be distinguished from selection effects in the criminal sentencing process, which also could explain some or all of these poor outcomes. To distinguish between criminogenic and selection explanations for ex‐prisoners’ postrelease experience, I analyze data from a natural experiment in which criminal cases were assigned randomly to judges with sizable sentencing disparities. Using these exogenous sentencing disparities, I produce unbiased estimates of the causal effects of imprisonment on the life course. The results of this analysis suggest that selection effects could be sufficiently large to account for prisoners’ poor postrelease outcomes because judges with large sentencing disparities in their use of imprisonment had similarly high caseload unemployment and criminal recidivism rates.  相似文献

This paper expands and builds on newer avenues in research on gender and general strain theory (GST). I accomplish this by focusing on serious strains that are relevant for males and females, including externalizing and internalizing forms of negative emotions, and including multiple gendered deviant outcomes. Using the Add Health dataset, I find strong support for the impact of serious strains on both types of negative emotions and different forms of deviance for males and females. However, the experience of serious strain, emotionally and behaviorally, is gendered. Depressive symptoms are particularly important for all types of deviance by females. Including multiple types of deviant outcomes offers a fuller understanding of both similarities and differences by gender. These results support the utility of GST as a theory of deviance in general and support greater connections between GST, feminist theorizing, and the sociology of mental health.  相似文献

We studied a sample of reentering parolees in California in 2005–2006 to examine whether the social structural context of the census tract, as well as nearby tracts, along with the relative physical closeness of social service providers affects serious recidivism resulting in imprisonment. We found that a 1 standard deviation increase in the presence of nearby social service providers (within 2 miles) decreases the likelihood of recidivating 41 percent and that this protective effect was particularly strong for African American parolees. This protective effect was diminished by overtaxed services (as proxied by potential demand). We found that higher concentrated disadvantage and social disorder (as measured by bar and liquor store capacity) in the tract increases recidivism and that higher levels of disadvantage and disorder in nearby tracts increase recidivism. A 1 standard deviation increase in the concentrated disadvantage of the focal neighborhood and the surrounding neighborhoods increases the likelihood of recidivating by 26 percent. The findings suggest that the social context to which parolees return (both in their own neighborhood and in nearby neighborhoods), as well as the geographic accessibility of social service agencies, play important roles in their successful reintegration.  相似文献

The Israeli “service work” law of 1987 enables a court to commute prison sentences of up to 6 months to service work in the community. This paper examines the correctional effectiveness of this new sanction by comparing the rate of recidivism (over a period of 14 months) among 407 offenders sentenced to service work to that of 950 comparable offenders sentenced to imprisonment. As the research design is quasi-experimental, an adjustment for confounders is carried out using the propensity score (PS) methodology. The estimation of the odds ratio of recidivism with respect to sanction comprises two steps: (a) the PS, which is the conditional probability of assignment to a particular sanction given a set of confounders, is estimated by a logistic model; and (b) the conditional probability of recidivism, given the PS and other covariates, is estimated by a second model. The findings indicate that before an adjustment for the systematic differences between the two sanctions was carried out, the odds for recidivism among prisoners were 2.4 times higher than the odds for service workers. After the adjustment, the odds ratio was reduced to 1.7. This estimate indicates that the service work sanction has a considerable correctional effect. The need to address additional criteria for the effectiveness of service work (e.g., net-widening) is emphasized.  相似文献

Prisoners' forecasts of post-release success may have implications for how they respond to imprisonment, release, and parole decisions. We examined sentenced US and UK prisoners' forecasts of recidivism, and how well UK prisoners believed they would fare compared to the average other prisoner. In both samples, forecasts of recidivism were unrealistically optimistic when compared to official statistics on recidivism. UK prisoners also demonstrated a self-enhancement bias by forecasting that they were less likely to re-offend than other prisoners. Prisoners' forecasts of recidivism were predicted by only a few of the pre-prison, in-prison, and post-prison factors that have been shown to be associated with actual recidivism. We discuss the implications of these findings and propose avenues for future research.  相似文献

As part of the penal code revised in 1969, the Federal Republic of Germany increased its reliance on fines, including the introduction of day-fines, in lieu of short-term imprisonment for minor offenses. The previous trend toward the use of fines was accelerated by the requirement that courts order imprisonment only in exceptional cases. Traffic cases were particularly affected. The qualities of the offense and the absence of previous offenses, rather than an individualized study of the offender, continued to be the dominant criterium influencing the choice of a fine. The chief effect of day fines was higher amounts applied to the more affluent defendants; the amount of the fine appeared to have no effect on subsequent recidivism. For first offenders, fines were superior to imprisonment in avoiding reconviction. Day-fines were no more effective (but not less effective) than imprisonment in the instance of traffic offenses. Fines were superior to other sanctions for petty property offenders but not for career thieves.  相似文献

In an attempt to better understand sexual offenders, this study with the aid of a genogram utilizing a grounded theory approach examined the experiences of three generations of incarcerated sexual offenders. The offenders in this study described experiences characterizing a continuum of failure to control their own criminal offences and perpetuity of their chronic conduct despite its serious consequences including imprisonment. One implication of those findings is that some incarcerated chronic sexual offenders possess a predisposition towards a sexual addiction and accordingly, a biological inheritance and environmental factors contribute to their conduct. Therefore, it is recommended for correctional systems including supervisory care that mandatory treatment within a medical model of confinement as opposed to a punitive model be established in order to curve recidivism and victimization levels. A longitudinal study should be conducted consisting of family members who are violent sexual offenders.  相似文献

OBJECTIVE: The purpose of this study is to determine demographical characteristics leading to crime recidivism and define anger levels and anger expression manners for those who re-commit crime. METHOD: All the literate inmates in Izmit Closed Penitentiary were included in this cross-sectional study. The prisoners were asked to respond to State-Trait Anger Expression Inventory. Their socio-demographic data were collected and a questionnaire was given to them to determine their state of imprisonment, sentence, nature of the crime in which they were involved, their criminal history, their relationship with inmates and prison staff and substance and alcohol use. RESULTS: Of the 438 prisoners, 302 (68.9%) responded to the questionnaires. Crime recidivism among the study cohort was observed to be 37.4%. Mean trait anger, anger out and anger in scores were significantly higher in prisoners with criminal recidivism in comparison with those who did not have prior criminal records. However, mean anger control scores for prisoners with or without criminal recidivism were similar. Unemployment, education level completed at secondary school or below, having committed a crime under the influence of alcohol or narcotics, having been involved in prison fights, having resisted police officers, caused damage in their vicinity when angry and violent crimes were all found to be possible causes of criminal recidivism. Educational level completed at secondary school or below, getting into fights with other prisoners, unemployment and resisting police officers were determined to be the strongest indicators to predict criminal recidivism when all variables were considered according to a logistic regression model. CONCLUSION: It can be proposed that those who have problems with officials or hostile towards others constitute a risk group for criminal recidivism. If prisoners with criminal recidivism can be helped to identify and control their anger, their risk of committing a new crime can be minimised.  相似文献

We address the high variability in sex offender recidivism rates by examining several of the critical methodological differences that underlie this variability. We used a dataset on 251 sex offenders (136 rapists and 115 child molesters) who were discharged over a 25-year period to examine changes in recidivism as a function of changes in dispositional definition of reoffense (e.g., arrest or conviction), changes in the domain of criminal offenses that are considered, and changes in the length of exposure time. The data indicate that: (a) both rapists and child molesters remain at risk to reoffend long after their discharge, in some cases 15–20 years after discharge; (b) there was a marked underestimation of recidivism when calculating a simple proportion (%) consisting of those who were known to have reoffended during the follow-up period, and (c) there was a marked underestimation of recidivism when the criterion was based on conviction or imprisonment. Forensic, clinical and policy implications of this high variability are discussed.  相似文献

The “get-tough” era of punishment led to exponential growth in the rate of incarceration in the United States. Recent reviews of the literature indicate, however, that limited rigorous research exists examining the effect of imprisonment on the likelihood of future offending. As a result, scholars have called for assessment of this relationship, while using methodologies that can better account for selection effects. This study addresses these calls directly by applying regression discontinuity, a methodology well suited to account for selection bias, on a cohort of felony offenders in Florida. Results suggest that prison, as compared to non-incarcerative sanctions, has no appreciable impact on recidivism. Although no differential effects surfaced across race/ethnicity, the analyses indicated that imprisonment exerts a differential effect by gender with the effect being more criminogenic among males than females.  相似文献

This longitudinal study examined the role of empathy in predicting recidivism among young adult offenders. During their prison terms, 748 male offenders between the ages of 15 and 28 were administered the interpersonal reactivity index (IRI; Davis, 1980). Official criminal records were used to determine general as well as violent recidivism during the (on average) five years following release from prison. Cox regression models of reoffense rates were calculated using IRI scales as explanatory variables while controlling for age, socioeconomic status, duration of imprisonment, and intelligence. The global empathy score and the subscales of perspective taking and empathic fantasy, but neither empathic concern nor personal distress, contributed to the prediction of recidivism. Furthermore, empathy did not contribute significantly to the prediction of violent reoffending. However, comparing offenders whose index crimes were violent versus nonviolent, violent offenders scored lower on the IRI and recidivated more often with a violent offence than did nonviolent offenders.  相似文献

Female imprisonment rates have increased proportionately more than male imprisonment rates over recent decades. There are substantial race differences in women’s rates, as is the case for men. Yet, there has been little quantitative research on the correlates of women’s imprisonment using data over time, or on potential race differences in those correlates. The present research analyzes data on black and nonblack female imprisonment rates in the 50 states for the period 1981–2003. The analyses are guided substantively by existing research on race, social threat and criminal punishment, and theory and research on the penal-welfare hypothesis. The study uses bivariate-response multilevel modeling to simultaneously examine the factors associated with black and nonblack women’s imprisonment rates. The results show that black female imprisonment rates increase when the concentration of African Americans in metropolitan areas and poverty rates grow, whereas nonblack female imprisonment rates are unaffected by poverty rates and actually decrease when African American populations become more concentrated in metro areas. Both black and nonblack women’s imprisonment rates increase when welfare spending declines. The results are consistent with social threat perspectives and the penal-welfare hypotheses.  相似文献

Rule violations offer insights to inmate reactions to penal confinement and to the official control system. Japanese prisons are of special significance because of the diversion of convicted offenders when feasible. American critics of community corrections have argued that heavy diversion would impose only the most intransigent criminals on prisons. By the sociocultural standards of Japan, diversion has had that consequence for its prisons. Official data provide the opportunity to examine a system of rule enforcement under those circumstances, including the relationship with inmate recidivism and the length of imprisonment.  相似文献

It is well established that the disproportionate imprisonment rates for indigenous peoples surpass that of non‐indigenous peoples. What is troubling is the alarming statistic that indicates that the rate of apprehension, prosecution and recidivism of indigenous women surpasses that of not only non‐indigenous peoples but also male indigenous peoples. This article proposes a court setting for domestic violence that incorporates therapeutic jurisprudence as an appropriate vehicle for the recognition of an indigenous law system as the answer to this problem. The model proposed comprises two components; a specialized Domestic Violence Court underpinned by the doctrine of therapeutic jurisprudence and the implementation of an indigenous legal system such as tikanga Maori.  相似文献
