This paper is the first to investigate the relationship between hate groups and hate crime empirically. We do so using panel data for the U.S. states between 2002 and 2008. Contrary to conventional wisdom, we find little evidence that hate groups are associated with hate crime in the United States. We find somewhat stronger evidence that economic hardship may be related to hate crime. However, evidence for the potential importance of economic factors remains weak. Further, we find that demographic variables are not significantly related to hate crime in the United States. Our results leave the question of what factors may drive hate crime in America unresolved. But they cast doubt on the popular perception that hate groups are among them.  相似文献

The research reported here was a survey study exploring attitudes toward hate crime laws and possible causes of such attitudes. In a path model, which was supported by the data, it was found that the major factor determining acceptance or rejection of a hate crime law was whether or not homosexuals would be included as a protected group: those wanting inclusion supporting such a law, and those not wanting inclusion opposing such a law. Consistent with identity politics theory, the data-supported model further found that both social and economic liberals, and people who thought hate crimes created fear in other members of the victim's group, wanted homosexuals included in hate crime laws. Other findings, however, were inconsistent with the identity politics theory position that this movement was a united front. Other results from the data-supported model are also discussed and explanations are provided.  相似文献

Since the development of bias crime legislation over the past few decades, scholars have debated the merits of the legislation and questioned its enforcement.(1) In light of such concerns, this study presents characteristics of all cases prosecuted as bias crimes in a New Jersey county between 2001 and 2004 and applies the hate crime typology originally developed in 1993. Results show that, in this jurisdiction, the typology is an inadequate tool for classifying cases prosecuted as hate crimes. Approximately one third of the cases are unclassifiable according to the typology. Findings indicate that the typology is useful for understanding cases in which bias is the sole motivation but inadequate for application to the many cases in which bias is a peripheral motivation.  相似文献

Why are hate crime cases so rarely prosecuted? Most states and the federal government have hate crime laws on their books, yet available data indicate few prosecutions in most jurisdictions. Drawing on case files and interviews with police and prosecutors in one jurisdiction, three institutional impediments to hate crime prosecution are identified: evidentiary inflation, by which law enforcement uses a higher burden of proof than what is required by statute; loose coupling between police departments and prosecutors' offices; and cultural distance between law enforcement and victims. Findings also reveal that advocacy groups and media can successfully increase the visibility of cases and draw the attention of prosecutors. The findings align with aspects of legal endogeneity theory and enhance our understanding of the role of organizations in constructing the meaning of law. The results also help explain why some laws are rarely enforced, even when they have support from key personnel in an organization.  相似文献

We examined blame attribution as a moderator of perceptions of hate crimes against gay, African American, and transgender victims. Participants were 510 Texas jury panel members. Results of vignette-based crime scenarios showed that victim blame displayed significant negative, and perpetrator blame significant positive, effects on sentencing recommendations. Also as hypothesized, victim and perpetrator blame moderated the effect of support for hate crime legislation. Interaction patterns suggested that both types of blame attribution influence sentencing recommendations, but only for participants disagreeing with hate crime legislation. Three-way interactions with victim type also emerged, indicating that the effects of both types of blame attribution show particular influences when the victim is gay, as opposed to transgender or African American. Implications for attribution theory, hate crime policy, and jury selection are discussed.  相似文献

Male and female young adults provided responses to open-ended questions about hate crimes. Results indicated considerable variability in their definitions, with perceptions of hate crimes differing with regard to demographic characteristics of both victims and perceivers. Victims may experience hate crimes differently because of who they are, why they are victimized, and with whom they share their experiences. In a separate study, males and females each evaluated a scenario of a hate crime perpetrated upon a male or female victim. Whether the crime was described as motivated by racial or religious bigotry, heterosexism, or was ambiguous was systematically varied. The demographic status of the participant appeared to determine how disruptive they regarded the crime scenario, and the likelihood that they would report personal knowledge of a victim of a similar type of assault. None of the participants was likely to report knowledge of a victim of a heterosexist assault. Policy implications of results from both studies are discussed.  相似文献

Much of the existing research on hate crime focuses on the perspective of victims, while relatively little is known of the offenders. This study examines the prevalence of hate-motivated offending in the form of assaults and bullying, and variables that may explain some of the influences for such behaviour. It compares hate-motivated offenders to both non-offenders and offenders committing non-hate-motivated acts. Our data are based on a nationally representative youth survey collected in 2012 (n = 4,855) from Finnish students attending ninth grade (ages 15–16). It relies on three central theories in criminology: strain, social control and self-control theories. Frequent parental fighting, low parental supervision, low social control and male gender were significant factors in explaining hate crime offending. Our results suggest that the three criminological theories are relevant in the analysis of hate crime offending among Finnish youth.  相似文献

Nearly two hours after the September 11 terrorist attacks, a hate crime was committed against the Islamic Cultural Center in Eugene, Oregon. Rather than following the conventional criminal justice process, the director of the center and his wife chose to engage in a process of restorative dialogue with other community members and the offender himself. This case study of moving from hatred to healing occurred in the larger context of restorative justice, a movement that is now developing in many hundreds of communities in more than 17 countries. Social workers committed to community practice have played an active role in this reform movement, which has developed over the past two decades.  相似文献

The introduction of legalized gambling into a community has generated a great deal of hubris regarding concomitant criminality. While Las Vegas has long been synonymous with organized crime, the recent focus has been on the connection between traditional crime and legalized gambling. The conventional wisdom among opponents of this new source of revenue is that casinos attract many undesirables to the community, thereby increasing crime and social disorganization. Routine activities theory would suggest that with increased numbers of tourists, more opportunities for crime will exist. To test this proposition, the frequency of crime before and after the introduction of legalized gambling in Biloxi, Mississippi was examined. Larcey-theft and motor vehicle theft were the only categories of crime to show statistically significant change. Robbery and aggravated assault increased, while murder and rape declined, although the change was not statistically significant for any category of violent crime.  相似文献

The debate on organized crime has shifted from the question of “myth or reality?” to efforts to come to an assessment of the nature and extent of organized crime. This paper discusses the possibilities and limits of such an endeavor in the case of Germany. A meaningful assessment requires linking the concept of organized crime to clearly defined empirical referents, having a thorough understanding of their dynamics and interrelations, and obtaining valid and reliable data. It is argued that these requirements cannot be met given the present paucity in theory and data. From the available aggregate data contained in the official crime statistics and annual situation reports on organized crime drawn up by the federal police agency BKA no overall trends are discernible. Where trends are identifiable, they mostly pertain not to patterns of criminal cooperation but to contextual factors. In contrast, the analysis of individual cases may serve to shed some light on the situation of organized crime, provided they are put in perspective with a differentiated conceptualization. A four-fold typology of criminal networks based on differences in the social embeddedness of criminal actors suggests that the seriousness of the problem may depend on the likelihood of the manipulation of relevant decision-making processes. Germany is not characterized by alliances between underworld and upperworld, but the existence of criminal networks within the upperworld gives grounds for concern.  相似文献

This review provides an opportunity to assess the current state of gang research and suggest directions for its future. There has been a dramatic increase in research on gangs, gang members, and gang behavior since the early 1990s, making this review especially timely. We use Short’s three-level framework of explanation to organize the findings of prior research, focusing on individual-, micro-, and macro-level research. Attention is focused on the findings of such research, but we also examine theoretical and methodological developments as well. Drawing from Short and life-course research, we introduce a cross-level temporal framework to guide future directions in gang research.  相似文献

Agents may commit a crime twice. The act is inefficient so that the agents are to be deterred. Even if an agent is law abiding, she may still commit the act accidentally. The agents are wealth constrained. The government seeks to minimize the probability of apprehension. If the benefit from the crime is small, the optimal sanction scheme is decreasing in the number of offenses. By contrast, if the benefit is large, sanctions are increasing in the number of offenses. The purpose of this study is to examine citizens’ fear of crime based on the neighborhood in which they live. Integrating individual characteristics, citizens’ perceptions, and neighborhood structure provides a more complete perspective on understanding fear. Individuals were asked to report on proximate level of fear, social cohesion, neighborhood disorder and level of police/citizen satisfaction. Neighborhood structure emerged as a predictor of citizen's fear even after controlling for race, age, gender and education. Results indicated that perceived disorder neighborhood structure was strongly associated with citizens’ fear of crime. Considering individual characteristics, perceptions of disorder, and neighborhood context simultaneously provides an opportunity to develop a more comprehensive understanding of fear and policies to reduce fear.  相似文献

Criminologists tend to study crimes that include active behaviors by offenders. Much less attention is given to inaction - or crimes that are defined by the absence of behaviors. A number of different crimes of omission, however, are included within state statutes. In recent times, a great deal of legislative attention has been directed towards whether Good Samaritan laws should be developed- laws that require bystanders to help those who are imperiled. This article describes a pilot study involving a survey of 134 “bystanders” to determine their attitudes about helping and their support for laws mandating that bystanders help crime victims. Results show that the sample overwhelmingly indicated that they would help others themselves, but there was mixed support for laws requiring that individuals help those in need. Support for Bad Samaritan laws was related to age and education. Implications are provided.  相似文献
