The criminal justice system in Israel provides probation services to Arab and Jewish offenders. In adult probation, the administrative structure is integrated, but the probation officers are of the same ethnicity as the offenders. Previous research in the juvenile courts has uncovered a tendency toward harsher recommendations for Arab delinquents in presentence reports. The present study examines both recommendations and dispositions for a sample of 208 young adult offenders. With severity of instant offense and prior record controlled the findings indicate that Arab defendants are less likely to be recommended for probation, less likely to be granted probation, and more likely to be sent to prison when not granted probation. The Arab probation officers' more conservative recommendations may reflect their identification with the Arab community at the expense of traditional casework values. This inequality is amplified by the sentencing practices of the courts.  相似文献

Risk-screening instruments have become quite popular in assisting probation officers in determining the level of supervision which their clients should receive while they serve their sentence in the community. This study compares the outcome of probation officers' classifications with predictions of likelihood of success derived from four risk-screening instruments. The results indicate that probation officers' predictions were better than two of the risk-screening instruments, were as accurate as another, and not as accurate as the fourth in determining the probability that the probationer would successfully complete the terms of probation. The findings of this study are discussed in terms of the cost issue involved in classifying offenders for probation supervision.  相似文献

Abstract

At the end of 2002, the number of women probationers was substantially higher than the number of women inmates. However, much less is known about women probationers than women inmates. We surveyed and interviewed probation officers to examine their perceptions about the special needs of women probationers and explored officers' experiences with women probationers. Probation officers believe women and men on probation have different needs and therefore require different supervision strategies. Results suggest that the multiple problems and challenges female clients present to their officers, and the greater emotionality they express in their interactions with officers, often place considerable demands on officers' time, energy and skills.  相似文献

Objectives

This study was an attempt to replicate the findings from an earlier experimental evaluation of a probation officer training program by Bonta et al. (Criminal Justice and Behavior, 38: 1127–1148, 2011). An experimental design was used with an improvement in the random assignment of clients and was tested with a sample of probation officers from a new jurisdiction.

Methods

Probation officers from the Canadian province of Alberta were randomly assigned to training or probation-as-usual. Officer behavior was measured by audio recordings of supervision sessions and recidivism was defined as a new conviction within 2 years of the initial recording. Attrition resulted in 27 probation officers submitting audio recordings of supervision sessions over a 6-month period (15 in the experimental group and 12 in the control). There were 160 recordings of 81 probationers submitted.

Results

The audio recordings showed inconsistent changes in officer behavior and no differences in recidivism between the clients of the experimental and control probation officers. However, the use of cognitive techniques by the probation officers was associated with a longer time to recidivism. In addition, by 10 months, more than half of the trained officers stopped their involvement in ongoing professional development activities.

Conclusion

Although the study failed to replicate the major findings reported by Bonta et al., it did highlight the importance of cognitive techniques in officer training. The results are interpreted with respect to the replication literature and the difficulties inherent in direct and conceptual replications especially in real-world settings.

The Philadelphia Low-Intensity Community Supervision Experiment provides evidence on the effects of lowering the intensity of community supervision with low-risk offenders in an urban, US county community corrections agency. Using a random forests forecasting model for serious crime based on Berk et al. Journal of the Royal Statistical Society, Series A, 172(Part 1), 191–211, 2009, 1,559 low-risk offenders were identified and randomly assigned to either standard or reduced frequency of mandatory office visits. Treatment as assigned was substantially delivered at 4.5 probation visits per year versus 2.4, for as long as offenders remained on active probation or parole. In a one-year follow-up for all cases, outcomes examined were the prevalence, frequency, seriousness and time-to-failure of arrests for new crimes committed after random assignment was implemented. No significant differences (p = .05) in outcomes were found between standard and low-intensity groups. Non-significant differences for offense seriousness favored the low-intensity group. We conclude that lower-intensity supervision at the tested level of dosage can allow fewer officers to supervise low-risk offenders in the community without evidence of increased volume or seriousness of crime.  相似文献

The aim of this article is to report some of the qualitative findings generated from a recent research on probation in Hong Kong. It explores subjective views and experiences of probation supervision from the young adult offender's point of view. Recently there was an increasing emphasis on probation research and improvement, thereby identifying what works or otherwise in rehabilitating offenders and reducing their re-offending. Nonetheless, the role of offenders was largely neglected as service recipients or ‘customers’ in commenting on the usefulness of a penal measure. Offenders are excluded from being asked for their opinions as citizens. Conversely, this study allowed probationers to talk about their experiences of probation supervision in Hong Kong in semi-structured interviews. Their first-hand accounts indicated that probationers had much to contribute to the evaluation process and their voices should be heard by practitioners and policymakers in order to improve probation practice.  相似文献

Previous research revealed gender and racial differences in offender preferences for prison compared to alternative sanctions, in the amount of an alternative sanction offenders would serve to avoid prison, and in the severity ranking of criminal sanctions. Nevertheless, opinions of officers who supervised those clients have all but been ignored. In this study, this literature was extended by comparing perceptions of Kentucky probation and parole officers regarding the amount of alternative sanctions that offenders would serve to avoid one year of imprisonment to perceptions of the offenders whom they supervised regarding the same topic. Based on analysis of data from an electronic survey of approximately 230 probation and parole officers and approximately 600 probationers and parolees, results suggested that there were significant differences in “exchange rates” of officers when compared to those of offenders. Justifications for these findings and their implications for correctional policy and practice are discussed.  相似文献

Electronic monitoring strategies are being used increasingly for sex offenders across the United States. Despite this increased use, few researchers have considered the broader implications for probation and parole officers when these tools are used. In this study, attention was given to how the use of electronic monitoring for sex offenders is related to supervision goals, work load, the use of other supervision strategies, and state level policies. Findings showed significant differences in several areas. The conclusion focuses on community corrections policy implications.  相似文献

Introduction     
Abstract

To date, no published research has examined the role played by race and ethnicity in revocation decision-making, despite the fact that revocation of community supervision is a source of substantial admissions to prison. Using a large cohort of subjects sentenced to felony probation in a large south central state, we conduct main and indirect effects analyses to test the hypothesis that odds of revocation will be highest for those offenders who are young, male, black or Hispanic, and unemployed. Results coincide with outcomes of recent studies that focus on the interaction of race, age and gender: That harsher penalties attach to individuals who are young, male, and black. In most analyses, Hispanics fared no differently than whites. A further finding is the discounted value of employment for young black males, who received harsher treatment than unemployed white counterparts. The article identifies several directions for investigation of the low value assigned to employment by this group of offenders.  相似文献

PurposeA successful community re-entry is a step toward desistance from sex offending. The re-entry phase is critical because it can trigger dynamic risk factors that can lead to a re-offense. In that context, community risk management is seen as pivotal to moderate the impact of community re-entry and associated stressors. The current study, therefore, examines the dynamic factors associated with a successful community re-entry, taking into account the type of community supervision offenders were subjected to.MethodologyThis prospective longitudinal study is based on a quasi-experimental research design where offenders (n = 169) were subjected to different types of community supervision (intensive supervision versus regular probation services). Community re-entry outcomes were assessed through the presence of technical violations and/or a new criminal offence.FindingsCox proportional hazards showed that offenders with negative community re-entry outcomes were younger, at-risk of sexual violence, under intensive community supervision, and had more negative social influences and self-regulation deficits. Of importance, intensive community supervision significantly moderated the impact of negative social influences but negatively impacted those with self-regulation deficits.ConclusionsThe study provides evidence that dynamic risk factors are important during re-entry and may operate differently under different supervisory conditions.  相似文献

Data from New Jersey were used to examine the effectiveness of felony probation. Examination of more than 2,000 burglars, robbers, and controlled substance offenders placed on probation in 1976–1977 showed that their recidivism at three, four, and approximately 10 years after sentencing ranged from approximately one-third to more than half arrested and about 10 percent imprisoned. Prior convictions, type of offense, age, race, the Greenwood prediction device, use of heroin, and employment were statistically significant correlates of recidivism. The major conclusion is that probation is an acceptable sentencing alternative for some felony offenders in some states but that recidivism rates can be alarmingly high for particular categories of offenders. In addition, probation officials should devote some attention to the needs of probationers in such problem areas as employment and drug abuse.  相似文献

The purpose of this study was to assess traumatic stress and burnout in probation officers who work with criminal offenders. Adult probation officers from five departments in three states (Arizona, California, and Texas) participated in this study (N?=?309). Officers completed several survey instruments including the Impact of Events Scale-Revised (Weiss & Marmar, 1997), the Compassion Satisfaction/Fatigue Self-Test for Helpers (Steed & Bicknell, 2001), and the Probation Personal Impact Scale (PPI). The results indicated officers who reported violent and sexual recidivism on their caseloads, offender suicide, and threats and/or assaults in the line of duty scored significantly higher on measures of traumatic stress and burnout than officers who did not experience these caseload events. Assessments, education, training, and stress management programs are discussed as options to mitigate negative impacts, enhance the resiliency of officers, and improve the quality of evidence-based practices.  相似文献

Juvenile probation work comprises a mixture of repressive and empowering strategies, since probation officers need to control young offenders' conduct and at the same time help the offender to take responsibility and live life within the margins of society. This ambiguous nature of juvenile probation work may confuse the communication between probation officers and juveniles. Interviews with offenders of Moroccan origin and their probation officers in the Netherlands show that both parties are unhappy with the mutual communication. According to the youngsters, a restrictive policy is inevitable but might be more effective if this would go together with an empowering approach. Interactional analysis of the conversations shows that the lack of juvenile participation is caused by professional conversational dominance, as seen in topic control, poor role clarification, and a cross-examining style of the conversations.  相似文献

The goal of this study was to assess the effect of a brief motivation enhancing intervention (MEI) on criminal recidivism. This was a multi-site, cluster-randomized clinical trial in six addiction probation offices. We randomized 73 probation officers (37 to intervention, 36 to control) and followed 220 substance-abusing repeat offenders that were allocated to them (111 intervention, 109 control). We report three measures of recidivism rate (self-report, police records, and combination of either of the two) and time to re-offending (police records) during a 12-month follow-up period. The proportion of re-offending and time to re-offending was not significantly different between offenders that received supervision plus intervention and those that received supervision-as-usual (SAU, no intervention). Our findings provide no evidence that supervision plus a brief MEI is more effective than SAU.  相似文献

As part of a larger study of probation workload and workforce challenges in one southeastern state, this study reports the results from a statewide survey of probation officers’ experiences supervising probationers with mental illness. A total of 615 officers responded to closed- and open-ended questions about the challenges and barriers to supervising offenders with mental illness, and the responses of officers from rural versus urban settings were compared. Officers reported that probationers with mental illness are difficult to supervise and supervision challenges are exacerbated by a scarcity of mental health and substance abuse treatment resources, limited social support, and a lack of employment opportunities for this population of probationers. Officers report unique and similar challenges across rural and urban settings. This study contributes to our understanding of the challenges of supervising probationers with mental illness and informs practice, policy and research at the interface of the criminal justice and mental health systems.  相似文献

This study examines the perceptions of girls held by juvenile probation officers, psychologists, and others involved in juvenile court decision making. Through qualitative analysis of girls' probation case files and indepth interviews with juvenile probation officers, we discuss the social construction of gender, race, culture, and class. Our findings suggest that in an environment marked by scarce resources, gender and racial/ethnic stereotypes leave girls few options for treatment and services in the juvenile court. Some probation officers expressed distaste for working with girls and had little understanding of culturally or gender-specific programming. Others were frustrated by the lack of programming options for girls in the state. Based on our findings, we question whether the current ideology or structure of juvenile probation can nurture a holistic approach to justice for girls.  相似文献

This study of the effects that supervision has on offenders in Denmark is based on the opinions of the offenders themselves. The special methodological problems of a study of this kind are discussed. Most clients say they benefit from supervision and many feel that supervision helps them in trying to live a law-abiding life. This surprising finding is explained primarily by the position of supervision as an extension of the common social security system, which often cannot cope with multi-problem offenders. The study, furthermore, underlines a basic but mostly disregarded condition for achieving success in helping and treating offenders: the relationship between offender and helper.  相似文献

When offenders are asked to explain their crimes, they typically portray themselves as decent people despite their wrongdoings. To be effective at managing the stigma of crime, motivational accounts must be believable to the social audience. Thus, variation in patterns of accounts is likely due to the social position of the actors. Here we examine whether gender constrains the way individuals describe their crimes by analyzing the motivational accounts of male and female white collar offenders. Results show that while men and women both elicit justifications when discussing their crimes, they do differ in the frequency with which they call forth specific accounts and in the rhetorical nature of these accounts. When accounting for their crime, white collar offenders draw on gendered themes to align their actions with cultural expectations of masculinity and femininity. These findings suggest that gender does constrain the accounts that are available to white collar offenders.  相似文献

Objectives. For the past 20–25 years the assessment of the outcomes of probation supervision and its associated variants has relied upon officially recorded offending as the chief determinant of ‘success’ and ‘failure’. A recent assessment of the impact of accredited programmes aimed at reducing offending called for reconviction rates to be supplemented with other outcome measures to give a more accurate picture of treatment effectiveness. Methods. Self‐reports of offending are one such alternative outcome measure, and this paper responds to recent calls for developments in this field. This paper throws further light on the frequency of offending by probationers during their probation orders, the extent to which their officers knew of this offending and the relationship between self‐reported offending and subsequent convictions. Results. The data suggest that about a half of the probationers committed at least one offence during the time they were on probation and that about a third of the probationers reported that they had committed more than four offences during this same time. In the main, probation officers reports mirrored the reports gained from the probationers. Generally speaking, the relationship between self‐reported offending and officially recorded convictions was also very close. However, this varied by the offences/convictions under consideration. Conclusion. There were slightly more probationers found guilty of property offences than had admitted to such offending during their interviews. The explanation for this appeared to have been deliberate concealment on the part of the probationer, rather than recall failure.  相似文献

While examination of probation violations is common in the literature, probationers who abscond from community supervision have rarely been examined. These violators are circumventing justice and may pose a serious risk to public safety. This article compares the characteristics of absconders to those of offenders who successfully completed probation and offenders revoked from probation because of other violations. Absconders and revoked probationers generally presented the least favorable risk profiles, but did not differ significantly from one another on probation conditions, “stakes in conformity,” or prior felonies—although revoked probationers had more misdemeanors and a younger age of onset for officially recorded crime. Combined with the violation behaviors of absconders while on probation, these similarities suggest a strong chance of being revoked to prison had absconders remained under supervision. Employment, recorded address changes, and lower supervision burden on offenders were among the best predictors of successfully completing probation versus absconding.  相似文献
