Supermax prisons have been advanced as means of controlling the “worst of the worst” and making prisons safer places to live and work. This research examined the effect of supermaxes on aggregate levels of violence in three prison systems using a multiple interrupted time series design. No support was found for the hypothesis that supermaxes reduce levels of inmate‐on‐inmate violence. Mixed support was found for the hypothesis that supermax increases staff safety: the implementation of a supermax had no effect on levels of inmate‐on‐staff assaults in Minnesota, temporarily increased staff injuries in Arizona, and reduced assaults against staff in Illinois.  相似文献

Since the early 1980s, supermax incarceration has emerged as a common feature of the American corrections landscape. This special type of high‐cost housing, which involves extended isolation with little programming or contact with others, remains largely unevaluated and is of interest for three reasons. First, the study of supermax housing offers a unique opportunity to understand the factors related to the successful reentry of offenders back into society. Second, it affords an opportunity to test the claims, many of which are grounded in mainstream criminological theory, that have been made about the putative effects of supermax confinement. Third, it provides an empirical touchstone that can help inform policy debates about the merits of such confinement. Examining data from the Florida Department of Corrections, we test competing hypotheses about the effects of supermax housing on 3‐year recidivism outcomes. We find evidence that supermax incarceration may increase violent recidivism but find no evidence of an effect of the duration of supermax incarceration or the recency of such incarceration to the time of release into society. We discuss the findings and their implications for theory, research, and policy.  相似文献

This article examines how increasingly punitive prison conditions, epitomized by the birth and spread of the supermax prison, developed in the United States. This analysis builds on a growing literature about the “new punitiveness” of U.S. punishment policy and its global proliferation. This article shifts the focus away from the policies that have led to increasing rates of incarceration, however, and toward the policies that have shaped the conditions of incarceration. Drawing on archival research and more than 30 oral history interviews with key informants, I examine the administrative and legislative processes that underwrote the supermax innovation in California in the 1980s. During California's late twentieth‐century prison‐building spree, prison administrators deployed multiple rhetorics of risk to extend their control over conditions of confinement in state prisons. As the state invested billions of dollars in prison building initiatives, legislators, who were focused primarily on building prisons faster, ceded authority over prison design and conditions to prison administrators. In the end, rather than implementing legislative policy, prison administrators initiated their own policies, institutionalizing a new form of “supermax” confinement, pushing at the limits of constitutionally acceptable practices.  相似文献

To outsiders, prisons vacillate between visions of regimented order and anarchic disorder. The place of rules in prison sits at the fulcrum between these two visions of regulation. Based on 131 qualitative interviews with correctional officers across four different prisons in western Canada, we examine how correctional officers understand and exercise discretion in prison. Our findings highlight how an officer's habitus shapes individual instances of discretionary decision‐making. We show how officers modify how they exercise discretion in light of their views on how incarcerated people, fellow officers, and supervisors will interpret their decisions. Although existing research often sees a correlation between “rule‐following” by incarcerated individuals and official statistics on such misdeeds, our data highlight that official statistics on rule violations do not easily represent the rate or frequency of such misbehavior. Instead, these numbers are highly discretionary organizational accomplishments. Our findings advance an appreciation for correctional officer discretion by focusing on the range of factors officers might contemplate in forward‐looking decisions about applying a rule and how they rationalize the nonenforcement of rules.  相似文献

This paper draws on in‐depth, qualitative interviews that examine individual experiences in two different legal contexts: deportation regimes and supermax prisons. Through putting these contexts and experiences into dialogue, we identify common legal processes of punishment experiences across both contexts. Specifically, the U.S. legal system re‐labels immigrants (as deportable noncitizens) and supermax prisoners (as dangerous gang offenders). This re‐labeling begins a process of othering, which ends in categorical exclusions for both immigrants and supermax prisoners. As individuals experience this categorical exclusion, they cross multiple borders and boundaries—often against their will—moving from prison to detention center to other countries beyond the U.S. border, and from isolation to prison to “free” society. In both cases, the state action that subjects experience as punishment is civil and, therefore, nominally not punitive. Ultimately, excluded individuals find themselves in a space of legal nonexistence. By examining these common processes and experiences, we argue that a new kind of subject is revealed: a disintegrating subject (as opposed to a juridical or disciplinary subject) whose exclusion reinforces the power of the state.  相似文献

This survey scans the English language research on prisons published since the appearance of Becker's (1968) seminal piece. After first describing the economic nature of prison and parole, issues concerning comparative institutional analysis and organizational design are discussed, including the role of private prisons. Empirical evidence on production functions for prisons, recidivism and offender rehabilitation programs is reviewed. A brief overview of policy issues and suggestions for future research concludes the survey.  相似文献

Prison officials have historically been afforded considerable discretion to administer sanctions designed to maintain order and security within a prison. Such discretion can generate disparate treatment of offender groups, but few studies have investigated whether sanction disparities exist within prisons, despite considerable research on sanctioning decisions made by other criminal justice actors. We use data collected from a nationally representative sample of inmates housed in state operated confinement facilities to examine potential influences of prison officials’ decisions to impose one type of sanction—disciplinary segregation. Multi-level analyses reveal that both legally relevant criteria such as prior misconduct history and extralegal factors such as age and holding a prison job affected whether an inmate was placed in disciplinary segregation for a rule violation. Also, prisons in which a greater proportion of the inmate population is involved in prison work and prisons with a higher density of inmates classified minimum-security use disciplinary segregation less frequently.  相似文献

Abstract

This research presents the voices of women inmates on health care services in prisons. Foucault's discourse analysis as a means of bringing to the surface restrained voices provides the theoretical basis for this study. The research is based on face-to-face interviews of fifty-six women inmates to understand better the role gender plays in prison health care delivery. The results show that women are willing to discuss only physical ailments and are reluctant to speak about mental health care or HIV. While women benefit from health care services in prison, they still feel that a female-oriented approach to health care in general will improve the services tremendously. This approach is not dictated by the “difference” in the ailments between men and women, but by the “difference” in the way men and women encounter health care providers and illnesses.  相似文献

By applying a renewal theory model to data from the Australian Prisons Census, we estimate the number of remand receptions at prisons and the mean and median remand times served by prisoners during the period 1982–1990. We conclude that despite the general increases in court delays, and despite a large increase in the remand reception rate between 1982 and 1990, remand times have been largely unaffected, with the median remand time for 1990 being 1.7 weeks. Comparisons are made with official figures for various states and with figures for Canada and England/Wales.  相似文献

ABSTRACT

Women have worked as corrections officers (COs) in some adult male prisons in most states for the past two decades. However, the degree of acceptance of women COs and the perception of women officers' job performance by men officers have varied greatly. This study was based on the results of a survey of men and women officers working in men's prisons in a midwestern state. Comparisons of the officers' responses about women's acceptance, safety, and perceived job performance revealed some significant gender differences. The results indicated that while women faced some resistance among men officers, it was not to the extent suggested by previous research studies, and the resistance came primarily from more experienced men officers. Women officers were confident of their ability to work effectively in men's prisons. The resistance to women that persists among some men officers is likely to provide an obstacle for women seeking opportunities for advancement and promotion in adult male prisons.  相似文献

Despite the growth in and debate about super-maximum security housing, there exist few studies of inmates’ experiences or placement in supermax incarceration. The lack of research on this new type of confinement assumes particular salience given criticisms that such confinement is excessive, that placement in it is arbitrary, and that it may have adverse effects on reentry into society. The goal of this article was to inform efforts to understand how supermax housing is used and to contribute to policy debates about this housing. To this end, it used data from the Florida Department of Corrections to investigate several dimensions of the supermax experience. These included the frequency of placement into supermax confinement, the duration of time spent in such confinement, and the timing of it relative to reentry back into society. In addition, the article explored factors, especially behavioral indicators, that may contribute to decisions to place inmates in supermaxes. The article concludes by discussing the study's findings and implications for research and policy.  相似文献

Research Summary: Private prisons incarcerate 5.3% of the sentenced, adult population in the United States. The present study presents selected results from a 1999 survey of administrators who monitored private prisons in the United States (or U.S. territories). Among the findings of interest, the private sector experienced significant problems with staff turnover, escapes, and drug use. Where possible, private prison operations were compared with those of the Federal Bureau of Prisons. Policy Implications: Given the issues raised here with public safety, public sector agencies contracting for private prisons need to develop incentives or other means to ensure that private sector operators retain experienced custody staff.  相似文献

Research Summary
Concern has been expressed that prisoner radicalization poses a high probability threat to the safety of the United States. Although the threat of terrorist acts planned in prison is known to be above zero because of a nearly executed terrorist plot hatched in a state prison, the central finding of this research is that the actual probability is modest. The reasons for a modest probability are fourfold: Order and stability in U.S. prisons were achieved during the buildup period, prison officials successfully implemented efforts to counter the "importation" of radicalism, correctional leadership infused antiradicalization into their agencies, and inmates' low levels of education decreased the appeals of terrorism.
Policy Implications
The prison environment permits a great deal of information to be collected on the activities and, more difficult to detect, planned activities of inmates after they are released. This environment requires the attentive observation of staff, collection of information from inmates, and efforts at different levels of a correctional agency to assemble, collate, and assess information; much of it is likely to be false and some will be vital.  相似文献

One of the results of Western capitalism has been the increasing pressure for the privatization of the criminal justice system. Although there has long been private or nonprofit involvement in corrections, a newer response has been to turn entire prisons over to private enterprise, or to pay private prisons to house state or federal inmates. Progressively, then, inmates once completely devalued as social junk are being valued as commodities to be sought after. This paper attempts to discuss a series of issues around private prisons. As we can only look at several issues in one paper, we shall concentrate our attention on construction, operating costs, accountability and broader ethical questions. Many observers describe prison subcultures as inherently and irredeemably antisocial. Research directly ties prison subcultures to violence, gang membership, and poor reintegration. In extreme cases, research has also suggested that prison subcultures contribute to incarcerated people joining radical groups or embracing violent extremist beliefs. These claims, however, ignore key differences in the larger cultural and social context of prisons. We examine the relationship between prison subcultures and prison radicalization based on semistructured qualitative interviews with 148 incarcerated men and 131 correctional officers from four western Canadian prisons. We outline several imported features of the prison subculture that make incarcerated people resilient to radicalized and extremist messaging. These features include 1) national cultural imaginaries; 2) the racial profile of a prison, including racial sorting or a lack thereof; and 3) how radicalization allowed incarcerated men and correctional officers to act outside the otherwise agreed-to subcultural rules. Our research findings stress the importance of contemplating broader sociocultural influences when trying to understand the relationship between radicalization and prison dynamics and politics.  相似文献

This paper presents the results of a national survey of parenting programs in women's prisons. Parenting programs may be defined as those programs that specifically address the woman's role as mother and attempt to facilitate her performance of that role, and/or aid in the development of parental skills. These programs range from parenting classes of a few hours to nurseries where imprisoned women and their infants can live together during the term of imprisonment. Female prisoners have extensive trauma histories and complex treatment needs that contribute to their criminality, yet trauma screening and treatment is not widespread in prisons. This article examines qualitative data gathered from face-to-face interviews with 31 female offenders in Canadian prisons. Using a grounded theory approach we demonstrate an unmet need for trauma-specific services for female offenders. These services go beyond trauma-informed practice and treat the psychological and behavioral sequelae of trauma exposure (e.g., mental illness and addictions) to facilitate recovery. The findings suggest that women in prison want and need specific treatment for trauma exposure. Integrating trauma-specific services involves a cultural shift within the prison environment that might be achieved by positioning trauma within the risk–need–responsivity model as an additional risk factor for criminality. Although counter to the public health perspective that trauma is a health concern, it is a way to ensure that trauma becomes part of the battery of care in corrections so that the needs of traumatized women are addressed while they are in custody. This was a unique opportunity to learn about what women would like to help deal with their experiences of trauma.  相似文献

Because inmate rehabilitation efforts are influenced by prison staff, Pennsylvania’s Department of Corrections recently began collecting survey data from corrections staff about their attitudes and beliefs for treatment programming. The present analysis focused on staff tenure, or length of time employed in a corrections field, and its effects on support for inmate rehabilitation. Overall, findings from bivariate analyses clearly showed that staff with 16 years or more of service expressed less apathy and demonstrated a treatment orientation perspective toward inmate rehabilitation. Findings from multivariate analyses showed that respondent characteristics including tenure and job category were stronger predictors of staff apathy and a treatment orientation perspective than were environmental factors associated with the prisons. Policy implications will be discussed.  相似文献
