In order to help the parties in mediation address their interests, concerns, and responses to the conflict, the mediator must monitor and manage his or her own inner thoughts, emotions, and feelings throughout the process lest they negatively influence the outcomes of the mediation. Peer consultation offers one approach that can be used effectively to support the mediator's inquiry into practice dilemmas and invite self-knowing that benefits the mediator as well as the parties in the mediation. The effectiveness of a group consultation process, however, depends on the development of "a holding environment" that can provide a safe and confidential space within which such an inquiry can occur. The mediation process is improved when the mediator is able to sustain relational and emotional tension within herself and between the parties long enough for new understandings and actions to develop.  相似文献

Mediators generally avoid the issue of whether parties accept their individual share of responsibility for a conflict. But the results of this study demonstrate the important role that taking responsibility for the conflict can play to encourage the emergence of cooperation within the mediation process. In this article, the author first explores the role of responsibility within the context of various mediation approaches and styles. Next, he reports the results of a quantitative study that examined the attitudes of disputants involved in workplace conflict mediations. His results indicate that acceptance of responsibility can play a parodixical role in the mediation process: it seems to be effective only when both parties jointly acknowledge responsibility. When responsibility is acknowledged unilaterally, it seems to have a negative effect on the emergence of cooperation. Finally, the author proposes an intervention strategy for mediators that is designed to encourage the joint acceptance of responsibility and thus facilitate the emergence of cooperation in mediation.  相似文献

Evolutionary psychology offers a powerful framework for understanding the ultimate function of emotions, and that understanding can be applied usefully in the mediation context. In this article, we first introduce the relevant theoretical foundational assumptions of the evolutionary approach to emotions and then use anger and gratitude to illustrate the evolved functions and effects of emotions on cognition and behavior before exploring specific implications for mediation. We also discuss mediator strategies for leveraging anger and gratitude, as well as the potential for future research applying an evolutionary approach to understanding emotions in mediation.  相似文献

In this article, we review the mediation literature from the past decade, utilizing a cybernetic mediation paradigm to organize the material. In this paradigm, we note that the type of conflict, country, culture, and mediation institutions affect the mediation process. Within this process, the mediator and disputants interact with each other, attempting to reach their own goals. This interaction produces outcomes for the disputants, the mediators, and other parties. The literature — organized using this paradigm — indicates that mediation is frequently practiced in many venues; the literature also provides an exhaustive list of mediation goals, describes many mediation strategies, and reports manifold mediation outcomes. Unfortunately, the number of studies examining the relative effectiveness of specific strategies (e.g., pressing, relational, and analytic) seems insufficient. Few studies have used control groups or reported observations of mediator and disputants' behavior in actual mediations.  相似文献

This study explores the influence of hierarchical position on both mediation satisfaction and uncertainty about the mediation. As parties involved in hierarchical conflict typically behave differently and have different perceptions and experiences, we think it is most likely that hierarchical position will affect the mediation process and its outcomes. In this article, we investigate the influence of hierarchical position on both uncertainty about the mediation and satisfaction with the mediation and its potential moderating role on the relationship between uncertainty and satisfaction. To test our hypotheses, we use data from fifty real mediation cases dealing with hierarchical labor conflicts in the Netherlands. As expected, uncertainty has a stronger negative effect on subordinates' satisfaction with the mediation than it does on the supervisors who were involved in mediation. Implications for mediation theory and practice are discussed.  相似文献

What impact do failed mediated agreements have on subsequent mediation onset and success? The question of mediation onset and success is undoubtedly important, given that mediation is one of the international community’s preferred conflict management tools, but its voluntary nature leaves room for the conflict parties to (dis)agree to talks and possible settlements. Existing research suggests that previous mediation outcomes can affect subsequent mediation efforts positively or negatively – depending on the outcome in focus. This article argues that failed agreements – an outcome of mediation that has not been accounted for in existing literature – underscore the persistence of the commitment problem, and therefore the hazards of sharing private information. Consequently, the conflict parties question the utility of mediation, and the likelihood of subsequent mediation onset decreases. If subsequent talks take place despite the failed agreement, the conflict parties refrain from sharing private information, and reaching an agreement becomes thus less likely. Drawing on the Uppsala Conflict Data Program’s (UCDP) Managing Intrastate Conflict in Africa data set and the UCDP Peace Agreement data set, the results strongly underline the negative impact failed agreements have on subsequent mediation onset, and thereby show that agreement longevity is crucial not only for peace duration but also for leaving the door open to subsequent talks.  相似文献

We study mediation in international conflict as a process of strategic interaction among the two disputants and the (would-be) mediator. We develop a rational model that examines the choice, process, and outcome of mediation. We start with a conflict game of incomplete information played by rational players that examines the conditions under which disputants and would-be mediators would consider mediation a preferred strategy. The mediation game that follows models the mediator's choice of mediation strategy and the possible responses of the disputants offers. Finally, we explore the conditions under which a mediated solution emerges and the conditions under which mediation fails.

The credibility of the mediator—defined as the extent to which disputants believe the mediator's statements, threats, or promises and her ability to deliver the promised agreement—emerges as a key factor that drives the model. Each disputant has an assessment of the mediator's credibility. Broadly speaking, the more credible the mediator is perceived by the disputant, the more accepting the disputant will be of her offers. Yet, the mediator does not know how credible she is in the view of the disputants. This uncertainty affects the mediator's decision to intervene and her choice of strategies. We derive testable propositions from this model and test them on a dataset consisting of mediation efforts in international conflicts over the years 1945–1995. The findings generally support the propositions derived from the model, and we explore the theoretical and empirical implications of these findings.  相似文献

A close analysis of the film Chocolat discloses a new metaphor for the mediator — the mediator as cook. The use of this metaphor throughout the film suggests new insights about mediator style and practice. Specifically, the mediator–protagonist in Chocolat demonstrates that: (1) mediations need not be voluntary to be sound, (2) non-neutral, directive, evaluative mediators can be effective if they individualize their approaches to each disputant and dispute, and (3) effective approaches to mediation celebrate emotion and pleasure, contrary to many conflict resolution theorists who write about the importance of emotions, but do not privilege them in practice.  相似文献

This study extends the previous literature on actors' incentives in conflict management by examining how direct and indirect links between fighting parties influence the prospects for mediation onset from a social network perspective. The paper argues, contrary to existing research, that direct links, i.e., bilateral ties between warring parties, do not notably increase the likelihood of mediation. Rather, indirect links, i.e., ties that connect two states via one or more than one third party to each other, are more likely to determine whether a conflict sees mediation. Although direct links can indicate mutual interests, shared preferences, and decreased uncertainty between the warring parties, these ties either lose importance or become cut off when states enter a conflict. By contrast, indirect ties create a social network that involves outside parties in the dispute process, and indirect ties increase the exchange of information between belligerents and potential mediators and the chances that third parties will have a vital interest in intervention. My empirical analysis using conflict and social network data in 1946–1995 provides strong support for the theory.  相似文献

This paper examines the constitutive elements of the genre of melodrama and relates them to typical Western conflict stories. It demonstrates why a conflict narrative based on the genre of melodrama tends to work against the resolution of the conflict and proposes tragedy as a more constructive genre for a conflict narrative. The paper also discusses how the mediation situation itself can constrain the possible genres that can be constructed in the process and explores the implications of those constraints for people in conflict and for the mediators facilitating a resolution.  相似文献

This article introduces the "pseudo-reality" method of constructing and conducting conflict resolution training workshops. This method focuses on creating a backdrop against which participants engage in building negotiation and mediation skills using real-life events and facts — but only to the extent that these events and facts promote the learning process. By creating pseudo-reality, trainers can overcome strong preconceptions or biases that can interfere with the learning process while at the same time preserving the advantages of working within a familiar, realistic environment. This method is meant to be used when the main goal of a workshop is skill building rather than imparting substantive knowledge of a specific conflict. The article illustrates this method by describing its use at a workshop conducted recently in Cyprus, in which the Israeli–Palestinian conflict served as a backdrop for conflict resolution skill building. Finally, the article describes a model designed to help conflict resolution trainers create pseudo-reality in their own workshops.  相似文献

This paper develops a theoretical argument linking time and the timing of conflict management efforts to dispute duration. We test competing hypotheses on conflict data drawn from disputes in the post-1945 period. Our analysis demonstrates that the effects of mediation vary substantially over the course of a dispute. Specifically, we note that mediation has a curvilinear relationship with time and the ending of disputes. Mediation efforts that occur soon after disputes begin have the best chance of reducing expected future dispute duration. Following this initial period, subsequent mediation efforts lead to longer rather than shorter disputes. After a long period, mediation again leads to shorter rather than longer disputes. We also find that there should be consistency in the mediators used to manage a conflict rather than shifting personnel to interject new ideas.  相似文献

Given the centrality of emotion and emotional communication to conflict interaction, the lack of attention to emotion in mediation is particularly surprising. This essay suggests that mediation practice can—and should—be informed by the wealth of existing theory and research on emotion in the social sciences. The authors define emotion and argue the centrality of its place in conflict. They address issues germane to the cognitive, expressive, and physiological aspects of emotion and their relevance to mediation practice. Within each area, they discuss the implications of the emotional experience of the disputant and the emotional experience of the mediator.  相似文献

3rd party intervention in interstate conflict is a common strategy for mitigating conflict and obtaining a final agreement. However, not all mediations are successful, leading to the development of a rich literature on the mechanisms which decrease the probability of failure in a 3rd-party intervention. Within this literature, some studies examine how a mediator’ behavior and incentives affect the result of the mediation. Virtually all these studies assume that the mediator is virtuous such that peace is the most desired outcome of a conflict for her. However, this study challenges this assumption and contends that a mediator can gain benefit from the conflict between disputants. If this benefit is adequately large to overcome the benefits of peace, then the mediator has enough incentive not to conduct the mediation toward a peaceful outcome. We develop a signaling game model to study this issue formally and test the proposed hypothesis empirically.  相似文献

Key mediation attributes, such as mediating actors, the strategy they choose, and previous mediation experiences, are widely thought to influence the nature of a conflict management outcome. But how and when these features shape outcomes is not a straightforward matter, and a standard analysis of these factors does not lead to their widely anticipated results. Why? We develop a new analytical framework that argues that a dispute's intensity alters the conflict management processes. Furthermore, in order to observe this variation, we also need to expand the traditional, dichotomous notion of conflict management outcomes (success or failure) to include a fuller range of observed results. Using the most recent International Conflict Management data set and our new analytical framework, we analyze the effect on conflict management outcome of mediator (a) identity, (b) strategy and (c) history. We find that directive strategies and international mediators are effective in resolving high intensity conflicts, procedural strategies and regional mediators are effective in resolving low intensity conflicts, and that mediation history always affects resolution. Our results have implications for both the study and practice of international dispute mediation.  相似文献

Although insurgencies may begin their rebellions with expressed desires for outcomes unacceptable to opposing governments, the desired insurgent outcomes sometimes undergo modification, creating conditions that can make governments more amenable to external mediation. In certain separatist conflicts, the likelihood of external mediation increases when the political redefinition of the state insisted upon by the insurgents undergoes a revision, from secession to self‐determination, understood as a variant of autonomy. In the same vein, although it may not happen concurrently, insurgent movements become more amenable to external mediation if and when opposing governments revise the preferred conflict outcome from a military defeat of the insurgents to a containment of the movement. These two developments can serve as objective referents helping external parties to identify a ripe moment in the conflict and initiate mediation. But the implementation of an agreement ending separatist conflict may not occur if the government fails to submit the proposed territorial bounds of autonomy to prior review by constituents. Potential spoilers among government constituents should be identified and recruited to participate in the negotiations so that the likelihood of agreement rejection is reduced. In some states, however, the legal mechanisms and political opportunities for constituents to act as spoilers do not exist.  相似文献

How does the globalization of production affect interstate behavior? While scholars have paid significant attention to the effect of global value chains on trade and political economy, there has been substantially less focus on the interaction between globalized production and conflict behavior. However, the changing economic landscape has the potential to alter the decision calculus of leaders on a variety of issues, including conflict mediation. In this research note, I argue that when deciding how to allocate scarce mediation resources, major powers pay attention to the position of potential beneficiaries in the global production network. In particular, among states involved in intrastate conflicts, those that are more heavily involved in the production and sale of intermediate inputs are more likely to receive mediation from major powers. I test this argument using data on intermediate trade and civil war mediation between 1991 and 2011. The results of the analysis are consistent with the theory, suggesting that major powers are more likely to provide mediation for producers of intermediate goods, but not for consumers.  相似文献

Weak mediators normally need to borrow leverage from more powerful players to provide efficient mediation. This situation requires strong co-operation between the weak mediator and more powerful actors or coalitions involved in a peace process. But what if this co-operation fails? This analysis demonstrates how lack of productive co-operation with the United States negatively affected Norway’s 9-year-long attempt to mediate in the conflict between the Sri Lankan government and the Liberation Tigers of Tamil Eelam between 2000 and 2009. More specifically, it explores how the United States views on terrorism in the aftermath of the terrorist attacks on 11 September 2001 limited Norway’s room for diplomatic manoeuvre. Based on a unique set of classified sources from the Norwegian Ministry of Foreign Affairs and interviews with key actors, the analysis demonstrates how diverging perceptions of a conflict can make mediation painfully challenging.  相似文献

International diplomacy, to the extent it is effective, should not only prevent escalation of low‐intensity conflict, but should also facilitate de‐escalation. This article focuses on the short‐term effects of managing low‐intensity civil wars through third‐party mediation. Specifically, we compare the efficacy of third party‐mediated direct (face‐to‐face) and indirect talks in low‐intensity civil wars from 1993 to 2004 using the Managing Intrastate Low‐Intensity Conflict data set. We argue that a focus on short‐term success is valid because of the relationship among mediation, short‐term success, humanitarian aid access, and peacebuilding. We also assess the roles of mediator identity, mediation strategy (behavior focus versus incompatibility focus), peace agreements, war type, per capita gross domestic product, level of democracy, and conflict duration. Our overarching finding is that direct forms of mediation in which all parties meet face to face were the most likely to yield short‐term success in the sample of civil wars that we analyzed.  相似文献
