In this conceptual article, we explore mechanisms of conflict management in European Union (EU) regulatory policy‐making. We build on J.G. March's distinction between aggregation and transformation as the two strategic options to deal with inconsistent preferences or identities that are at the source of social conflict. While this distinction is helpful in mapping conflict management mechanisms, the rigid association of these two options with the rival paradigms of rationalism and constructivism respectively has led political scientists to neglect conflict management strategies that work at the edges of aggregation and transformation. We show the potential of these latter strategies as intelligent ‘in‐action’ hybrids that emerge from ground‐level policy‐making praxis of actors navigating a complex institutional and policy environment. Specifically, we discuss five strategies: issue‐based aggregation; arena‐based aggregation (arena‐shifting and arena‐creation); socialization; re‐framing; and proceduralization, their underlying mechanisms and related scope conditions. The theoretical implications of this discussion lead us towards ‘strategic constructivism’. In the conflict management mechanisms that are of most interest, norms and ideational structures matter, but they are related to strategic actors who draw on and orchestrate ‘ideas’ in pursuit of political goals.  相似文献

This article examines the reasons behind the dramatic decline in military budgets in Argentina under democratic rule. These trends were unexpected, given the, political power the armed forces of that country have wielded in the past. Here it is argued that within the democratic state, there were institutional arrangements that enabled civilian decision makers to trim defense expenditures, despite opposition from the military. The two key institutional traits were found to be the concentration of authority and the autonomy of decision-makers from outside pressures. Because budgetmaking was centered within a well-insulated civilian-run ministry, fiscal planners working at the behest of the president were able to design and implement budgets they wanted, over and above the objections of military officers, and without interference from other branches of government. Ethiopia experienced a critical juncture in 1991 with the defeat of the military dictatorship, opening up the possibilities of a new political order. Since then the country underwent social engineering and institutional transformation emerging as a leading reformist state under hegemonic-party rule with high institutional state capacity but also a concentration, and even personalisation, of decision-making power. This approximates to a path of ‘authoritarian institutionalisation’. This article argues that Ethiopia’s institutional trajectory can be explained by the nature of coalition politics in the formative years of transition, specifically the extent to which credible challengers were excluded from transitional processes. The strategy of excluding Pan-Ethiopian parties and sideling the Oromo Liberation Front (OLF) set the country on the path of establishing a hegemonic rule by the Ethiopian People’s Revolutionary Democratic Front (EPRDF). Sustaining hegemonic rule entailed fending off threats from excluded groups in the 1990s but which coalesced into a strong electoral performance in the 2005 elections in whose aftermath the ruling party embarked on aggressive pursuit of state-directed development for political legitimation.  相似文献

The article examines how the structure of party systems, that is, effective number of political actors, electoral volatility, and shares of dominant party votes and seats, affect the initiation and direction of electoral reform in post-communist democracies. Based on a dataset of electoral rule changes in post-communist democracies from 1992 to 2008, we analyze the frequency and direction of reforms over time. The findings reveal that the frequency of reforms declines with successive electoral cycles but not to the degree suggested by theories of institutional inertia. Countries with high levels of voter volatility are more likely to engage in reforms; however, the findings in this article demonstrate that politicians react to volatility by inconsistently choosing between permissive and restrictive responses.  相似文献

Abstract

The effectiveness of the public hearing as a participatory instrument has been debated. This paper argues that evaluation of the public hearing could be improved by an interpretive and institutional analysis. Introducing four major recent public hearings, this comparative study assesses the development and use of public hearing in China's governmental price making. It concludes that the public hearing should be viewed as a type of participatory institution. Its effectiveness relies on other institutional factors and on whether it can evoke values of citizenship, due process and deliberation. Constrained by China's political and social institutions, current Chinese price hearings are framed on the basis of consumer rights rather than citizen rights. The public hearing is perhaps the oldest and most widely used technique for citizens to participate in governmental decision making in western countries (Checkoway, B. The politics of public hearing. J. Appl. Behav. Sci. 1981, 17(4), 566–583), but it is not a popular topic theme at present. While the public hearing originally emerged for the purpose of due process in trial‐type or quasi‐judicial rule making, it has become an important citizen participation instrument since the 1960s and 1970s (Ibid. and Cole, R.L.; Caputo, D.A. The public hearing as an effective citizen participation mechanism: a case study of the general revenue sharing program. Am. Polit. Sci. Rev. 1984, 78(2), 404–416), especially to make public policy responsive to those disadvantaged. In contrast, the public hearing was not in place until the late 1990s in China, but it has become a top issue theme since 2000. This paper aims to assess the development and use of public hearings in China from a comparative perspective: is it effective for citizens to participate? If not, will it work in the future? How does the institutional context affect the operation, effectiveness and symbolism of public hearings in China? The paper also sheds lights on how to use interpretive and institutional analysis for the evaluation of public hearings in general.  相似文献

Further integration of the public value literature with other strands of literature within Public Administration necessitates a more specific classification of public values. This article applies a typology linked to organizational design principles, because this is useful for empirical public administration studies. Based on an existing typology of modes of governance, we develop a classification and test it empirically, using survey data from a study of the values of 501 public managers. We distinguish among seven value dimensions (the public at large, rule abidance, balancing interests, budget keeping, efficient supply, professionalism, and user focus), and we find systematic differences between organizations at different levels and with different tasks, indicating that the classification is fruitful. Our goal is to enable more precise analyses of value conflicts and improve the integration between the public value literature and other parts of the Public Administration discipline.  相似文献

Following an ambiguous constitutional compromise for democratization, the territorial decentralization of the Spanish state developed by means of political party competition, exchanges, and bargaining. Hence, the so-called state of autonomies was characterized as “non-institutional federalism” [Colomer, Josep M. 1998. “The Spanish ‘State of Autonomies’: Non-institutional Federalism.” West European Politics 21 (4): 40–52]. In the most recent period, competition and instability have intensified. New developments include, on one side, attempts at recentralizating the state and, on the other side, demands and mobilizations for Catexit, that is, the independence of Catalonia from Spain, which resulted in sustained inter-territorial conflict. This article addresses these recent changes with a focus on the relations between the Spanish and the Catalan governments. The political changes were analyzed as a result of opportunities and incentives offered by a loose institutional framework and the subsequent competitive strategies of extreme party leaders.  相似文献

This case study takes the rise and fall of licence fee indexation within German public service regulation as an example and traces mechanisms of re‐politicization of independent regulatory agencies (IRAs). According to the evidence, agency contestation is likely when: (1) administrative cultures result in incoherencies in institutional design; (2) IRAs deal with redistribution; (3) conflicts about principles of regulation persist; (4) IRAs pursue one particular regulatory ideology; (5) controversial regulatory output is highly visible; and (6) affected interests are not given a say. The article points to the relevance of new regulatory technologies that are likely to embody regulatory bias. Moreover, it seems that successful contestation of IRAs requires the conjunction of escalating factors. Nevertheless, such contestation might not result in a return to old modes of command and control.  相似文献

Scholars' criticism of transparency in public–private partnerships (PPPs) often focuses on ‘external’ transparency, that is, the extent to which internal information is visible to the outside world. However, to achieve external transparency, internal transparency – the availability and inferability of information for the public procurer and the private party – is crucial. In this article we analyse input, process, and output transparency from three different perspectives (institutional, cognitive, and strategic) in four PPPs in the Netherlands. We conclude that input transparency is high, but process and output transparency less so. Moreover, output transparency has gained importance in PPPs. Whether this is problematic depends on the PPPs' institutional environment. In some partnerships the desired output is uncontested and predetermined by clear standards in the institutional environment, whereas other PPPs deal with contested output norms, decreasing the partnerships' transparency. These results nuance the current debate on the lack of transparency in PPPs.  相似文献

Academics, policy‐makers and practitioners are increasingly interested in the contribution that effective management of knowledge across organizational and professional boundaries can make to improved public services. Examining knowledge sharing within the context of the UK NHS, we ground our investigation in neo‐institutional organizational sociology. We highlight the influence of regulatory, normative and cultural‐cognitive aspects of institutions operating in the health care field on the boundaries that impede knowledge sharing. We illustrate how institutional isomorphic processes facilitate convergence within groups of organizations and occupations subject to the same institutional pressures, but, by the same token, inhibit convergence across different organizational and occupational groupings. In short, the development of a learning organization, where knowledge is shared freely across boundaries, will be difficult to realize.  相似文献

This article investigates the role of ‘competition’ within Best Value (BV) and compares it with that of Compulsory Competitive Tendering (CCT). Utilising results of a survey of BV lead officers, the article reveals that ‘competition’ is not being used as widely as may have been expected. However, in terms of outcomes, services subject to BV seem to be at least as likely to be provided externally as would have been the case under CCT. Further analysis also considers the impact that party political control and service type have on the use and outcomes of competition.  相似文献

The aim of this paper is to analyse the organizational model of one of the most successful European radical left parties, the Greek Coalition of the Radical Left (SYRIZA). Our goal is to analyse SYRIZA's organizational transition from the electoral arena to the government (2015). Our main finding is that SYRIZA started as a socially-oriented organization led by an oligarchic dominant coalition and converted itself into a political party, characterized by a prevailing role of the party in public office/party government. Both the institutional environment and the party organization's first configuration have had an impact on this change.  相似文献

Regulatory reforms labelled ‘Better Regulation’ are a prominent item on the political agendas of most advanced democracies and the European Union. Governments adopt Better Regulation measures to strengthen their democratic legitimacy and increase their regulatory and economic effectiveness. Notwithstanding their rhetorical appeal, their design and implementation are susceptible to high levels of political contestation. We therefore ask: are there systematic differences in stakeholders’ demands for what Better Regulation should achieve? What explains these differences? We argue that conflict over Better Regulation is rooted in what stakeholders prefer as a regulatory system of governance. Stakeholders demand reforms that lead to one of the following three scenarios: deregulation, technocratic or participatory policy‐making. We examine stakeholders’ demands expressed in the EU. We find that national authorities responsible for coordinating Better Regulation and cross‐sectoral business organizations support deregulatory and technocratic reforms. Business and public interest organizations are equally supportive of strengthening participatory policy‐making.  相似文献

While the Soviet Union imploded in the midst of its attempt to reform itself, more than a decade later China stands as a testament to the resilience of Communist rule. I suggest that one reason China has been able to stave off a regime collapse is that Chinese leaders have sought to learn from the collapse of the Soviet Union and are seeking to adjust their policies to buttress their political power. I present evidence in support of this position including statements of political leaders and party insiders, internal government documents, and Chinese scholarship on the Soviet collapse.  相似文献

Increased complexity in the world of public management has resulted in the growth of networks of actors who, operating interdependently, co‐produce public services. Much of the prior networking literature conflates structure (the network) with behaviour (networking). Based on this concern we analyse the managerial networking practices of over 1,000 officers in English local government. We find extensive networking activity amongst three groups of officers and show that corporate officers, chief officers and service managers develop logical patterns of interaction among network nodes and initiation that reflect their level of management. We conclude that where you are in the organizational hierarchy matters for networking behaviour and discuss the implications of these findings for future research.  相似文献

This two‐part article analyses the attempts to reform the socialist financial system in China by diversifying financial assets and introducing capital markets. The approach used is that of political economy, in the sense of elucidating the interplay between political and economic interests, actors and issues in the reform process.

Part I discusses the issue of bonds by governments and enterprises. Although the reform era has seen gradual progress towards something resembling a bond ‘market’ in terms of a diversification of bond types and growing competition between bond issues, there is no evidence that this has improved allocative efficiency in the economy. Rather, bonds have functioned as one instrument in a complex struggle for resources between political, institutional and economic actors in the context of a continuing ‘shortage economy’. This competitive system falls far short of a true ‘market'; rather it embodies powerful systemic factors reflecting the basic structural and institutional features of a semi‐reformed socialist economy.

One of these systemic factors is the institution of social ownership of the means of production which has been called into question by the emergence of shares and share markets, a process we discuss in Part II. Share issues have in the event been economically unimportant but politically important since they challenge the ideological and institutional underpinnings of a ‘socialist’ economy. The key to the future of this form of financial liberalisation depends not merely on further progress in complementary areas of economic reform policy, but also on a resolution of these fundamental political issues.  相似文献

ABSTRACT

Indonesia presents an extremely rare quasi-experimental research case: the constitutional reforms and the transition to full presidentialism have effected a presidentialization of political parties that is largely in line with the changes predicted by the model of Samuels and Shugart [2010. Presidents, parties and prime ministers: How separation of powers affects party organization and behaviour. Cambridge: Cambridge University Press]. Especially the rise of the new president and his difficult relationship with his own party are testimony to this. But a closer look reveals that the model has to be adapted to Indonesian politics. Presidents have tools to forge grand coalitions and to overcome the dualism to an extent. The size and history of political parties as well as wider socio-economic changes, that is an increasing oligarchization of party organization, have to be considered. Moreover, highly personalized vehicle parties serving the interests of a presidential candidate have emerged. It follows that institutional and structural incentives combined have produced a party system consisting of different party types.  相似文献
