With the change and development of the concept of human rights, the thinking about the relationship between human rights and development is becoming more and more deeply. Under this background, the author profoundly realizes that both recognizing the economic development as the first priority like some developing countries do and considering the human rights to be the most important thing as most developed countries do are unilateral and harmful to the social progress. Human rights and development are interdependent and mutually promoting each other. This paper introduces the three main viewpoints of the relationship between human rights and development. Based on the changes of the attitudes of the UN and China to the relationship between human rights and development, this paper holds that though it is a great progress for the Chinese government to understand that human rights and development are interdependent, there are still lots of difficulties in realizing their mutually benefiting relationship in reality. These difficulties are due to the lack of professionals who enjoy good understandings of the rules for social development and are capable of practicing human rights theories. Therefore, the authors suggest that the promotion of human rights education is instrumental to the development and progress of human society.  相似文献

Given the dilemma facing legalization on environmental rights, it is necessary to re-examine the nature and function of environmental human rights under the theoretical system of basic rights. Its justification approach follows a logical chain from a rights-based approach to basic rights. The difficulty in legalizing environmental rights reflects the disputes over the basis for environmental law. Reconstructing the right-based approach in environmental law can justify the rights-oriented path to the environmental rule of law. The basic rights system with human rights as the core can explain the constitutional environmental human rights. As the basic rights not enumerated in the Constitution, the environmental human rights have such functions as the right of self-defense, the right to benefit, and institutional, organizational and procedural guarantees due to its dual nature of subjective right and objective law.  相似文献

The PAN Hongbin case raised to the academic circles the question of how to connect with the court proceedings after the People's Congress filed for review.The solution to this problem should focus on the functional positioning of China's recording and review system,whether it involves the specific rights of citizens in individual cases.From the actual situation in China,the development trend of the constitutional review systems in various countries in the world,and the attitudes of the National People's Congress and the academic circle,the protection of civil rights should be one of the functions of record review.According to the relevant provisions of the Legislative Law and the Law on the Supervision of Standing Committees of People's Congresses at Various Levels,our courts should construct a dual complementary mechanism for review requests from the Supreme People's Court and review recommendations from local people's courts at all levels in the litigation process.Meanwhile,according to the retrospective theory of the law,the filing review filed by the parties after the court 's lawsuit should be retroactive to the parties themselves,and the law should provide for a system to initiate retrial proceedings in this case to relieve the parties' rights.  相似文献

The contemporary Chinese human rights theory can be deciphered based on the people-centered concept. Putting people in the center is an approach to deve lopment,a concept of governance and a ruling orientation,and it is the idea shaping of the governing party,the ideological guideline for administrative organs and the principle of action for relevant personnel.The human rights system is thoughts,theories,systems and practice proposed by social groups and individuals to the social authority,especially the resource provider,around the basic demands for subsistence and development.Fundamentally speaking,the people-centered approach and the human rights system,though belonging to different political ethics and political philosophy fields,share many common points or similarities in their specific way of existence and operation process.Therefore,there is coherence between the people-centered approach and human rights,and there is systematic compatibility between the human rightsbased way of thinking and the people-centered governing concept.The two approaches share many commonalities in the implementation measures and actions,both requiring the integration of concepts,norms,systems and actions.The deciphering helps China to provide wisdom and marke contributions in enriching world human rights theories.  相似文献
