大规模经济建设导致新中国产生的5 000多万工程性移民,历来是矛盾冲突的高发群体。开发性移民是现阶段中国工程性移民法的基本原则,但开发性移民理论与实践距法治境界仍有相当距离。补偿标准偏低、补偿范围较窄,安置方式难以保证移民生活水平不降低,后期扶持存在不具操作性和范围不足等,成为矛盾的焦点。应当改变以公权为基础构建起来的规则体系和规范实践,重构中国工程性移民法制体系。 相似文献

30年代经济大萧条时期,世界各国对外国移民的流入大都施加种种限制。半个多世纪后的今天,由于经济衰退,失业严重,西欧各国重又盛行这种限制性措施,其主要表现为: 一、对移民施加限制英国于1985年制订的移民规则,对非英籍居民的配偶施加了一些新的入境限制。英国1981年的国籍条例还特别规定,由外国父母生在英国的儿童,若在出生时其父母都没有在英国定居,则不能取得英国国籍。1979年11月1日生效的荷兰《外籍劳工就业法》规定,发放工作许可证如遇突破企业职工定员限额时,必须拒绝颁发此种工作许可证。 相似文献

各国制定移民法的宗旨为:通过立法对移民的规模、构成、素质以及经济能力进行调控,以达到为本国政治、经济和安全各项利益服务的目的。因此,各国移民法的共同特点是在体现迁徙自由和人道主义的国际法原则下,以最低成本吸引他国专业技术人才和资本,从而促进本国社会和经济的发展。其中,近年以美国、加拿大及其魁北克省为代表的投资移民立法就是这种趋势的典型反映。因此,笔者拟就北美国家关于投资移民的立法进行比较评析,同时研讨中国关于投资移民立法的前景。 相似文献

外国人在中国永久居留(中国绿卡)制度始于1985年《外国人出境入境管理法》,发展于2004年《外国人在中国永久居留审批管理办法》。该制度促进了中国的国际化,规范了外国人在中国永久居留审批管理工作,但是,由于我国对绿卡制、永久移民与国内社会和经济发展的关系等关键问题理解和把握有偏差,已经建立的制度存在着宏观架构、立法思路、具体制度设计等方面的问题。这些问题消耗了中国作为移民法后发国家的优势,阻碍了中国移民法实现跨越式发展,值得进行认真的批判性思考。 相似文献

Conflict and compromise have marked domestic immigration and asylum law in many countries. In examining whether these patterns will be replicated at the level of the EU, this article proposes an alternative method for analysing immigration law and its politics, framing them within the complex interaction of the interpretations by key actors of the imperatives of the State, the EU, and the legal sphere. An account of the functional, normative and polity legitimating imperatives, their specific manifestations in different spheres, and their interaction in the field of immigration and asylum is sketched. This politically-grounded analysis explains more clearly the structure of conflict and compromise that characterises this sphere, illuminates the judicial strategies in this field and enables us to speculate upon the probable future of EU immigration and asylum law. 相似文献

This paper argues that the Immigration Reform and Control Act of 1986 is a composite of contradictory measures. On one hand, employer sanctions are meant to curtail the employment of undocumented workers and preserve the U.S. labor market for legal residents and citizens; on the other hand, special foreign worker programs are designed to enhance the supply of immigrant workers. Abstract: An area of freedom, security and justice was created by the Treaty of Maastricht of 1991/1993. Immigration and asylum of third‐country nationals was inserted into Title IV EC by the Treaty of Amsterdam of 1997/1999. The European Council of Tampere of October 1999 provided a substantive input. The proposals of the European Commission cover almost all aspects of immigration and asylum and, in line with the Tampere conclusions, are oriented at the status of EU citizens. A common European migration and asylum policy has been realised at an astonishing speed, though some core instruments have not yet been adopted. During the negotiations the proposals have been watered down and thus provide only relatively low standards, in particular as regards access to employment, which is an important requisite for the integration of migrants. 相似文献

It is increasingly recognized that immigration laws affect immigrants' integration. Most recently there has been growing attention to how immigration enforcement affects families through forced separations caused by deportations and long‐term family separations across national borders stemming from unauthorized entry to the United States. However, beyond enforcement, there has been little systematic account of how other provisions of immigration law contribute to family separations. In this article we examine how four key provisions in immigration law, far from creating conditions for immigrant families to reunite, contribute to keeping families apart. As such, these provisions shape, in fundamental ways, the structure and composition of immigrant families. Relying on data from the American Community Survey and ethnographic interviews in Phoenix, Arizona, we find evidence consistent with the premise that immigration laws affect the formation, composition, and structure of immigrant families with potential long‐term consequences. 相似文献
