Australian research on the impact of separation and divorce on children and their families has consistently shown that although separation is a stressful event in the lives of families, the long-term prospects for these families is encouraging. A number of issues arising from the research presented in this article warrant closer consideration by decision makers, court administrators, and professionals dealing with disputing families. First, programs aimed at reducing conflict and assisting families to deal with the emotional impact of separation need to be given priority. Second, there is sufficient indication to suggest that poverty as a result of separation and divorce has a debilitating effect on women and children. Third, in dealing with disputes over custody and access, care needs to be taken to respect the needs of individual children. Finally, high conflict in a family postseparation should be a warning to pay particular attention to the potential harm of applying joint custody and frequent access presumptions.  相似文献

This article objectively reviews the effects of divorce on the financial well-being of families. Women and children suffer disparities in income, but the differences are not as great as publicized in other studies and diminish with remarriage. The absence of marriage, not the presence of divorce, is the major cause of poverty for women.  相似文献

A survey was conducted to assess the content coverage of more than 100 divorce education programs for parents in North America. Fifty-six percent of the programs were mandatory for at least some categories of divorcing parents. Results showed that the most intensively covered topics involved the effects of divorce on children and the benefits of parental cooperation. Moderate coverage was devoted to skills acquisition, such as conflict management and parenting, and to the effects of divorce on parents. Minimal coverage was devoted to "nuts and bolts" and legal issues. The results are discussed in terms of issues likely to emerge as a result of this content coverage.  相似文献

It has been suggested that a new system be developed for handling family problems, such as divorce and child protection—a system that would replace the adversarial court system. The author suggests going one step further: an alternative system that would take divorce out of a dispute resolution frame. The Danish system is described as an example of an administrative approach to divorce.  相似文献

This study investigates the impact of ethnic origin on the attribution of criminal offenses to faces seen in portrait photographs. The underlying hypothesis is that ethnic stereotypes are a result of the way people perceive themselves and other groups (that is, the relation of in-groups to outgroups) and that ethnic stereotypes directly affect a person's readiness to attribute particular offenses to given portraits. Thus, this study explores cross-ethnic and intra-ethnic offense attribution.  相似文献

This study examined the relationship between spousal consensus on the decision to divorce and mediation outcome. Based largely on clinical experience and deductive reasoning, the conceptual literature has held that low consensus is negatively related to success in divorce mediation. To empirically explore this relationship, 72 families beginning court-ordered divorce mediation were asked whether they agreed that divorce was the best way out of their problems. Statistical analysis of their responses as they related to the outcome of mediation did not support the conceptual literature. No significant relationship was found between spousal consensus on the divorce decision and mediation outcome, a finding which agrees with the limited empirical research. This indicated that mediation is more tolerant of spousal nonconsensus than had been assumed in the divorce mediation literature.  相似文献

“I was walking down the boulevard one day with my sister who was down for a week's holiday. She said off the cuff ‘When are you going to get divorced?’ I said ‘I don't know.’ Seeing a solicitor's office, I said ‘ I'll pop in here’—just the job, just like going in the shop for a loaf of bread. So I sees the receptionist. She said ‘ I'll see if he can see you straight away.’ Well, he gave me an interview straight away. Within an hour everything was done. He told me to bring all the gen I could in a couple of weeks time, which I did and then we got on with the job.”  相似文献

This article presents two checklists (Child-Related Agreements and Spousal-Related Agreements) that facilitate professionals who assist couples in accomplishing the multiple tasks of divorce and separation. These two checklists have been and are being used in several court settings and in private mediation practices.  相似文献
