One of the more enduring observations in the study of death penalty support within the United States is the strong divide between Whites and Blacks. Whites show significantly higher levels of support for capital punishment than Blacks. This divide between Whites and Blacks appeared in all surveys, over time, and across a variety of methodological designs. Using data from three separate studies (two local surveys of venirepersons and the NORC-General Social Surveys), this study attempted to understand the basis for this divide. It examined racial differences in socioeconomic status, religion/religiosity, political ideology, positions on right-to-life and other social issues, fear of crime and victimization experience, experience with the criminal justice system, philosophies of punishment, and attribution styles. The findings revealed that the effect of race/ethnicity on capital punishment support continued to hold while controlling for the effects of nearly all of these “explanations.”  相似文献

Men have consistently shown significantly higher levels of support for capital punishment than women. This divide between males and females has appeared in nearly every survey, over time, and across a variety of methodological designs. Using data from the cumulative (1972-2002) data file for the National Opinion Research Center (NORC) General Social Surveys, this study attempted to understand the basis for this gender gap. It examined gender differences in socioeconomic status, gender inequality, gender socialization, religion/religiosity, political ideology, positions on right-to-life and other social issues, fear of crime and victimization experience, experience with the criminal justice system, philosophies of punishment, and attribution styles. The findings revealed that the effect of gender on capital punishment support continued to be robust despite controlling for the effects of all of these explanations.  相似文献

Like the United States, Russia is a large industrialized nation with high violence rates. Although its overall homicide rate is among the highest in the world, however, local rates of crime vary widely. Similarly, the level of social support provided by the state varies throughout Russia due to former Soviet policies, the differential pace of political and economic change, and the level of development. Relying upon recent criminological literature on social support theory, this study tested the hypotheses that areas with higher levels of social support will have lower homicide rates and that the effects of negative socioeconomic change on homicide rates will be moderated by levels of social support. Utilizing data from Russian regions (n = 78) and controlling for other structural covariates, negative binomial regression was employed to estimate the effects of social support on regional homicide rates. As expected, negative socioeconomic change was associated with higher homicide rates, but the results provided no support for direct or conditioning effects of social support on homicide. The findings are discussed in the context of Russia-specific conditions and of the meaning of these findings for recent research on social support and crime.  相似文献

This article considers the extent to which specific demographic and socioeconomic factors correlate with homicidal violence in the context of Mexico’s “war” on organized crime. We draw on Ciudad Juarez as a case study and social disorganization theory as an organizing framework. Social disorganization is expected to generate higher levels of homicidal violence. And while the evidence reveals several social disorganization factors associated with homicidal violence in Ciudad Juarez, not all relationships appear as predicted by the theory. Drawing on public census and crime data, our statistical assessment detects six significant variables (or risk factors) positively associated with homicidal violence in Ciudad Juarez between 2009 and 2010. Likewise, the assessment finds another six specific variables (or protective factors) that are negatively associated with above average homicide in the city between 2009 and 2010. The featured data and level of analysis do not conclusively demonstrate causation, nor was this the intent. Rather, we propose a baseline model for testing spatial-temporal dynamics of organized violence in multiple settings.  相似文献

Social support, institutional anomie, and macrolevel general strain perspectives have emerged as potentially important explanations of aggregate levels of crime. Drawing on insights from each of these perspectives in a cross‐national context, the analyses show that 1) our measure of social support is inversely related to homicide rates, 2) economic inequality also maintains a direct relationship with homicide rates, and 3) social support significantly interacts with economic inequality to influence homicide rates. The implications of the analysis for ongoing discourse concerning the integration of these criminological theories and the implications for the development of effective crime control policies are discussed.  相似文献

This article examines the relationship between experiencing the homicide of a family member, friend, or acquaintance and the likelihood of support for capital punishment. Homicide victims'family and friends are often portrayed as strong advocates of the death penalty. Yet, the effect of vicarious homicide victimization on support for capital punishment has never been systematically examined, and in fact, Donald Black's theory of law suggests an inverse relationship between the two variables. Using data from the 1988 General Social Survey, this research tests hypotheses derived from Black's theory regarding the relationship among social intimacy, cultural status, and the use of law in response to conflict. Multivariate logistic regression models suggest that the experience of personally knowing a homicide victim significantly affects one's likelihood of support for the death penalty, but the effect of vicarious victimization varies for black and white respondents. The empirical patterns indicate that in addition to race, religious orientation and gender also play important roles in determining the relationship between vicarious homicide victimization and support for the death penalty.  相似文献

Based on a lecture to policy makers in Brazil, this essay explores lessons that developing nations can learn from US experiences in the fight against violence and crime. A brief summary of trends in crime, criminal justice policy, and criminal punishment in the US over the past four decades is followed by an evaluation of the dominant imprisonment strategy of the 1970s through 1990s. It is argued that benefits of the massive increase in criminal punishment have been few and that costs have been excessive in terms of material, human, and social capital. Nonetheless, the American experience provides inspiration when we consider the broader societal potential for social organization: values and norms; self-interest and involvement in legitimate exchange networks; mobilization of social capital; and diverse mechanisms of social control. These concepts are explained, and specific institutions and mechanisms to control violence and crime are explored under each of them. A proper test of the deterrent effect of the death penalty must consider capital homicides. However, the criterion variable in most investigations has been total homicides—most of which bear no legal or theoretical relationship to capital punishment. To address this fundamental data problem, this investigation used Federal Bureau of Investigation data for 1976–1987 to examine the relationship between capital punishment and felony murder, the most common type of capital homicide. We conducted time series analyses of monthly felony murder rates, the frequency of executions, and the amount and type of television coverage of executions over the period. The analyses revealed occasional departures (for vehicle theft and narcotics killings) from the null hypotheses. However, on balance, and in line with the vast majority of capital punishment studies, this investigation found no consistent evidence that executions and the television coverage they receive are associated significantly with rates for total, index, or different types of felony murder.  相似文献

Japan has long been recognized for its low rates of violent crime, rates that usually seem to be declining. The most common explanation for postwar rates links unique cultural characteristics to a system of exceptionally effective informal social controls that, at the macro level, suggest low levels of social disorganization. Other common explanations include low levels of economic stress, a small proportion of young males and a criminal justice system that delivers a high certainty of punishment. In this paper we test these four explanations for Japanese trends using both an annual time‐series national analysis (1951 to 2000) and a pooled cross‐sectional time‐series analysis of the 47 Japanese prefectures from 1955 to 2000 (at 5‐year intervals). The results from the two analyses are largely congruent. They show that measures of economic stress, certainty of punishment and age structure are–compared to common social disorganization measures–more consistent predictors of Japanese postwar violent crime trends. Our results suggest that the remarkable strength of the postwar Japanese economy may play a larger role in explaining Japanese violent crime rates than is usually recognized.  相似文献

School corporal punishment is associated with many negative outcomes. This research explores the antecedents to the practice and prevalence of school corporal punishment. A series of regression models indicated that two variables were significant predictors of a state’s practice of school corporal punishment: rate of evangelical Protestant adherents and social capital. A path analysis indicated that these two variables significantly predicted the rate of school corporal punishment in practicing states. The path analysis also revealed a significant and negative relationship between rate of evangelical Protestant adherents and social capital, but no relationship between rate of mainstream Protestant adherents and social capital. A mediation analysis indicated that social capital serves as a mediating variable between evangelical Protestantism and rate of school corporal punishment. Practical and theoretical implications are discussed.  相似文献

In the early 1960s, 15% of Finnish homicide offenders committed suicide after the crime. In 1998–2000, this ratio was 6%. The downward trend was due to the increase in non-suicidal homicide, as well as to a substantial decrease in the general homicide-suicide rate. Over the time span, the rate of suicidal homicide offenders per 100,000 population was halved. The decrease took place in the two most significant homicide-suicide types (that is, those of intimate-partner homicides and parent-child killings) and, within these crime types, in crimes committed by men. The present article describes the prevalence and trend of homicide-suicide in Finland, and examines the socio-economic correlates of this phenomenon. The findings indicate that the percentage and the rate of homicide-suicide have been consistently highest among middle classes and lowest among the unemployed and working classes. Victim-offender relationship, stressful life events, and alcohol consumption are discussed as explanations for this stable social difference.  相似文献

ABSTRACT

The purpose of the article is to provide an overview to the trends in crime and crime control in Finland and Sweden during the past 150 years, systematically comparing the two countries. The secondary objective of the study is to introduce a Nordic data collection project aiming to compile coherent comparative criminal justice time series from the early nineteenth century to the present, and to present the first collection of data, the Finnish justice statistics 1842–2015. The study examines the long-term development of homicide, assault, rape, defamation, prison population, and penal severity. Historical statistics provide opportunities to examine the crime trends and the society’s responses to them keeping in mind that the statistics do not necessarily reflect changes in total criminality. As such, the study does not provide conclusive explanations on the development of crime and punishment but rather opens new questions to be answered in future research.  相似文献

Combining data from police statistics and crime victim surveys, this article analyses the evolution of crime in Western Europe from 1988 to 2007. The results show that there is no general drop in crime. Property offences and homicide have been decreasing since the mid 1990s, while violent and drug offences have increased during the period under study. These trends highlight the limits of the explanations to the crime drop in the United States, which are based on the premise of a correlation in the evolution of all offences. The drop in property offences seems related to changes in the socioeconomic situation in Europe as well as to increases in security measures in households, and the reinforcement of private security. The increase in violent offences can be explained by the combination of several factors, including changes in youth’s free time provoked by the development of the Internet, changing demographics, and the rise of episodic heavy alcohol consumption and street gangs.  相似文献

Research Summary Economists have recently reexamined the “capital punishment deters homicide” thesis using modern econometric methods, with most studies reporting robust deterrent effects. The current study revisits this controversial question using annual state panel data from 1977 to 2006. Employing well‐known econometric procedures for panel data analysis, our results provide no empirical support for the argument that the existence or application of the death penalty deters prospective offenders from committing homicide. Policy Implications Although policymakers and the public can continue to base support for use of the death penalty on retribution, religion, or other justifications, defending its use based solely on its deterrent effect is contrary to the evidence presented here. At a minimum, policymakers should refrain from justifying its use by claiming that it is a deterrent to homicide and should consider less costly, more effective ways of addressing crime.  相似文献

This work contributes to a growing body of literature by analyzing patterns of capital punishment sentencing in Louisiana during the post-Furman era. The specific focus of the study was to determine whether patterns of discrimination by race continue to persist. A logit model was utilized with data consisting of 504 cases of homicide eligible for capital punishment, fifty-three of which had been assigned the death penalty. Results indicated that a pattern of discrimination by race of victim, but not by race of offender, existed, even when a number of legal and extra-legal factors were controlled. In addition, an effect for sex of the victim was noted. Another pattern found, that of capriciousness, is also discussed.  相似文献

In this article the author uses a review of Welsh S. White'sThe Death Penalty in the Nineties as a framework for analyzing recent trends in the United States Supreme Court's death penalty jurisprudence. Since 1976 the Supreme Court has upheld the constitutionality of capital punishment at least in part on the notion that the death penalty serves the useful social purpose of retribution. This article, however, contends that it is imperative to distinguish between retribution and vengeance as rationales for criminal punishment. Modern retributive theory calls for punishments to be guided by considerations of proportionality, fairness, and equality. Vengeance-based punishments, on the other hand, are aimed at satisfying the victim's and society's desire for retaliation and are not limited by the retributive principle that punishment must be proportionate to the severity of the crime and the moral blameworthiness of the offender. The article analyzes recent Supreme Court decisions that are not examined inThe Death Penalty in the Nineties-decisions that allow the introduction of victim-impact evidence into capital sentencing proceedings and permit the death penalty to be imposed on 16-year-old offenders, mentally retarded defendants, and those who neither kill nor intend to kill. These decisions, it is argued, demonstrate that the contemporary Court has bestowed judicial approval on vengeance as an acceptable justification for capital punishment.  相似文献

China's criminal justice system has, for decades, been consistently notorious as one of the world's most punitive. Recent reform of the nation's decades‐long harsh criminal justice policy to instead balance severity with greater leniency has given reformist‐minded judges and legal experts some cause for optimism. However, it has also created a judicial dilemma in determining how to apply this more lenient ethos in sentencing some capital crimes. This is particularly the case for the capital crime of transporting drugs, which is the focus of this article. This article reveals how reform can be achieved through skillful legal maneuvering for a crime category that is caught between two contesting views of the social benefits of punishment.  相似文献

在我国短时间内废除死刑并不现实,当务之急是规范死刑适用。抢劫犯罪的死刑主要适用于致人重伤、死亡的抢劫犯罪和其他情节极为恶劣的抢劫犯罪。在认定主要刑事责任人时应全面考察罪中、罪后、罪前等多方面情节。自首、立功等法定从宽处罚情节一般只及一罪;"先杀后抢"、"先抢后杀"的宣告刑应基本一致;在抢劫犯罪中一般不存在被害人有过错的情形;"赔偿免死"的前提是犯罪分子真诚悔罪。酌定从宽情节的适用亟待规范。  相似文献

Matricide is an infrequent form of homicide. This paper is to present a case of matricide with typical characteristics of the act but interesting particularities as well. The perpetrator was a 43-year-old man, respected member of his community, with over compliant characteristics, eagerness in serving people and caring his parents, good social adaptation before and after the crime. He abandoned his family and work in order to better serve his old, disabled but over demanding mother who frequently insulted and humiliated him. Suddenly he came to a state of "mental confusion" and strangled her. After the crime, the perpetrator manifested the symptoms of a bipolar disorder and also received the diagnosis of dependant personality disorder. Years later, he presented again a crisis of escalating aggressive urge for which he was hospitalized. Many people and associations of his hometown actively demanded the minimal possible punishment for him. The case is discussed especially concerning: a) hypotheses about the aetiopathogeny of the act, b) the constant support provided to the perpetrator by his family and social environment.  相似文献
