自然法、家庭伦理和女权主义?——《安提戈涅》重新解读及其方法论意义

西方学者对于古希腊著名悲剧《安提戈涅》的法理学或法理学意义的解释在当代中国较有影响的大致有三种,但都有缺憾,且在其中也显现出中国学者在方法论上存在的问题。反对本质主义,坚持语境化进路来解读文本,关注细节,进行多视角的理解和反思,将会避免借助第二手资料做出一种教义化的概括。同时,关注不同文化或学术视角和思路之间的紧张关系亦可在阐释学意义上拓展我们的视野。     

适度打击 合法控制——警棍适度控制犯罪嫌疑人反抗方法探析

警棍是执法机关依法配备和使用的专用警械,警察在执法行动中,可以依法使用警棍对犯罪嫌疑人实施武力控制,针对犯罪嫌疑人对抗的三种状态,提出了以相应武力控制犯罪嫌疑人对抗的三种方法:制服法、致伤法、致命(或致残)法。并在控制犯罪嫌疑人时时要注意警棍的适度使用与合法性。     

Dumping of victims in walls

A case is described in which a 58-year-old woman was shot and then dumped in a wall. She was immured under the staircase in the basement of a residential house by the offender, who was acting alone. The body was not found until 8 months later. The victim had been reported missing by members of her family. The cool environment delayed the onset of putrefactive changes so that it was not difficult to conduct forensic pathologic investigations into the bullet wound, with traces of gunpowder residue found on the victim's head. The way in which the offense was committed did not provide any indication of diminished responsibility on the part of the 27-year-old offender, which was reflected in the judicial consequences.     

On Migration Trends within the USSR

Recent years have seen a marked expansion of research into migration, which influences significantly the entire broad life of our society. The magnitude and direction of migrational flows, the composition of migrants, the geographical focuses of population exodus and influx are studied. The data of the 1970 census have been rather widely used in the study of migrational problems. Nevertheless, a number of problems in the diverse aspects of population migration have received little study.     

宪政视域下的党内民主

党内民主具有丰富的内涵,从宪政视角来看,就是在宪法法律框架内,全体党员都有权按照民主的程序和形式,平等地直接或间接地决定党内一切重大事务。将党内民主纳入宪政视野,对于巩固执政党的地位、建设法治国家都具有十分重要的意义,因此在宪政视域下加强党内民主建设,就要坚持和改善党的领导制度、保障党员主体地位和民主权利并进一步健全和完善党内民主的制度体系。     

Reform from within: the Grendon example

In Salduz v Turkey (27 November 2008, No. 36391/02), the Grand Chamber of the European Court of Human Rights (ECtHR) stated:

...in order for the right to a fair trial to remain sufficiently ‘practical and effective’… Article 6 § 1 requires that, as a rule, access to a lawyer should be provided as from the first interrogation of a suspect by the police, unless it is demonstrated in the light of the particular circumstances of each case that there are compelling reasons to restrict this right…The rights of the defence will in principle be irretrievably prejudiced when incriminating statements made during police interrogation without access to a lawyer are used for a conviction.

Online protection of the child within Europe

This article discusses the online protection available to children and young people within Europe. Children and young people are significant users of information technology and they must be able and comfortable to safely use this technology. The European Union and the Council of Europe have been at the vanguard of attempts to regulate the information society in order to protect young netizens.     

Studies on asphyxia: on the changes of the alveolar walls of rats in the hypoxic state

The morphological changes of the alveolar wall of adult rats in the hypoxic state were studied by light and electron microscopy. The remarkable findings were the appearance of a large amount of lamellar, lattice- and thread-like structures together with a massive homogeneous substance on the surface of the alveoli which seemed to be closely connected with each other and with the surface of the cells lining the alveolus, especially in the 5%-group. The appearance of the above-mentioned structures with the homogeneous substance is considered to be the reaction of lung tissue to the decreased content of oxygen in the inhaled gas.     

论古玩交易中的法律适用

古玩交易方兴未艾，纠纷颇多，其行规与法律规定多有不合之处。古玩交易的主体、标的、目的与普通交易相比均具特殊性，具有专业性、非消费性、投机性的特点。有鉴于此，应将古玩交易的具体、特殊情形适用于抽象的法律，在意思表示错误中应考虑到交易主体的过失，有选择的适用欺诈规则，以此达到行规与法律的协调，实现公平，为古玩交易市场的健康有序发展提供保障。
