Abstract

This article attempts to summarize the efforts that have been made during the 1970s in the search for an appropriate definition of international terrorism, its causes, and the measures to combat it. It evaluates these efforts in the context of the simultaneous interests in human rights. It advances some propositions as to how international terrorism could be seen from the perspectives of both social‐psychological theories of violence and Western legal practices. In conclusion, the relationship between the individual and the state is evaluated in the context of the present world order and its operative political and legal principles. Although this approach may not solve the problem of international terrorism by advancing any neat scheme of control which can be readily applied by anxious governmental law enforcement agencies, nor succeed in articulating a strategy for the respect of human rights by governments and individuals, it will hopefully generate some ideas about how justice can be rediscovered while searching for viable solutions for both international terrorism and human rights.  相似文献

Since 11 September 2001, terrorism has been a global security threat. One of the partners in the war on terrorism is Kenya. Considering Kenya"s recent experience with terrorist acts, their effects on its public psyche, and Kenya"s reactions to them in domestic and foreign policies, this study presents perceptions on terrorism from an exploratory survey in Kenya. Respondents feel most threatened not by terrorism but by AIDS and local criminals. Among terrorist acts, the most threatening include suicide terrorism, a plane crash, and stabbing attacks. Media reports on terrorism not only intensify feelings of anxiety and helplessness but also strengthen feelings for both peaceful and revengeful reactions. In order to prevent terrorist attacks, routine security checks, recognizing a Palestinian right to statehood, and intelligence collaboration with the CIA and Mosad are considered the most effective measures. Kenya"s commitment to the war on terrorism may be less a response to Kenyans" perceptions of terrorist threats than a policy to support the United States against terrorists in exchange for U.S. support against AIDS and for political stability, democracy, pluralism, and economic development.  相似文献

In law freedom from torture and ill-treatment is “absolute,” meaning that a state cannot infringe the right for purposes that would seem legitimate such as the protection of national security. However, with the growth in international terrorism, particularly suicide violence, should the freedom remain without limitation? This article considers legitimizing torture by reference to the “positive” legal obligation the right imposes on states to prevent harm to individuals by third parties such as terrorists. Assuming such a legal argument could be made out, it is questioned whether adopting such measures of interrogation would in fact outweigh the negative consequences that would inevitably follow from reversing accepted international standards for the protection of, say, detainees from ill-treatment in state custody.  相似文献

This article aims to challenge the dominant view that the expressions of terrorism since the last decade of the twentieth century are fundamentally new. It questions the new aspects of terrorism, such as the transnational nature of the perpetrators and their organizations, their religious inspiration and fanaticism, their use of weapons of mass destruction, and their indiscriminate targeting. It points out essential continuities with previous expressions of terrorist violence, such as the national and territorial focus of the new terrorists, their political motivations, their use of conventional‐ weaponry, and the symbolic targeting that is still aimed at achieving a surprise effect. The article calls for more thorough historical investigations in order to appreciate truly new aspects of terrorism.‐  相似文献

Abstract

The international spread of terrorism requires more careful study of its ability to influence the international order. Therefore, it is first of all necessary to distinguish the purposes for which terrorism is set up on the international level, also exactly assessing its actual transnational links. In this way, it will be possible to proceed toward a comparative analysis of terrorism in different regions of the international system. The purpose of such an analysis is to evaluate the influence that terrorism has, from the methodological standpoint, on the studies of the international system and, from the substantial standpoint, on the actual ability of terrorism to weaken that very system. Clarifying the implications of these aspects, the conclusion will be a reflection on the causal relationship that links terrorism and the international system; the former is a consequence of the nature of the latter, caused by the immobility of the international system, and hence by the blocked situation that faces anyone who wants to modify the international order.  相似文献

Since the late 1990s, Russia has been among the countries most painfully affected by terrorism and President Putin has shown little doubt and even much enthusiasm in joining the U.S.-led "war" against terrorism. Intertwined as they are, counterterrorism and Chechnya are still significantly different matters in Russian security policy, and this article aims at examining how the struggle against terrorism shapes essential features of Russia's foreign and domestic policies during Putin's first presidency. Internally, the struggle against terrorism provides for a sufficient mobilization of the dysfunctional society around the "mutant" regime that has consolidated its control over mid-term political agenda. Internationally, high-profile counterterrorism strategy has helped Russia to secure for itself a more prominent role than the sheer size of its "assets" would justify. This war is fundamentally not about victory; it is about many "collateral" benefits for the regime that Putin is presiding over.‐  相似文献

This article looks at the European Communities’ efforts against terrorism in the 1970s. It argues that in spite of the high ambitions to improve European legal integration, the attempts to develop an antiterrorism agreement were quite obviously a failure. Although the Dublin Agreement was adopted in 1979 after cumbersome and lengthy negotiations, it fell short of showing the member states’ unity and resolve to fight terrorism, and it never entered into force. The tedious negotiations drained the member states’ energy and willingness to such an extent that no other steps toward judicial integration or antiterrorism treaties were taken.  相似文献

This article examines the significance of emerging international interdependency and how it may influence the teaching of Public Affairs/Administration (PA) in the next decade. Postwar demand for international courses is described along with a different set of contemporary factors that is internationalizing traditionally domestic sectors of society. The growing importance of policy issues such as international trade and economic competition, immigration, and terrorism is examined along with the possible effect on education. The potential roles of public administrators are also outlined and recommendations are made for ways in which the PA community can assess its response to an internationalized policy environment.  相似文献

For Al Qaeda, intelligence is a critical operational resource. Its vigorous collection, scrutiny, and dissemination within the organization have proven fundamental to its capacity to engage in carefully crafted acts of terrorism. In addition to its operational utility, intelligence fulfills a range of other functions, including an ability to contribute to Al Qaeda's symbolic goals and elevate the confidence of operatives and leadership alike. Ultimately, however, Al Qaeda's collection and use of detailed intelligence reveals a capacity to calculate the consequences of alternative courses of action, thereby helping to dispel notions of an irrationality or fanaticism in which decision making is somehow removed from reality.  相似文献

In the late twentieth century, the United States' federal government responded to the threat of terrorism by passing a wide range of counterterrorist laws. The vigor that accompanied these initiatives echoed at a state level where, virtually unnoticed, states passed similar legislation. This article examines state measures in three areas: the funding of foreign terrorist organizations, the use or threatened use of weapons of mass destruction, and definitions of terrorist activity. While these statutes, as a legal matter, may not violate any specific federal provisions or constitutional prohibitions, they raise important questions about federal supremacy in foreign affairs and the constitutional protections afforded citizens. More significantly, as a policy concern, these provisions threaten America's ability to speak in one voice, introducing divisions into the domestic realm and diminishing the ability of the federal government to negotiate with foreign states and organizations. They also mask an appropriate role for the states in fighting terrorism. Both the policy implications and legal considerations suggest that such measures may ultimately undermine America's ability to counter the terrorist threat.  相似文献

State‐sponsored terrorism is a form of coercion, backed up by the threat and use of violence, to achieve political ends. These terrorist tactics also involve signaling of intentions and responses between the terrorist sponsor and those whom it targets. Accordingly this study examines Iranian state sponsorship of anti‐U.S. terrorism in the period of 1980–1990 as an example of political communication aimed at manipulating U.S. policy through the threat and use of violence. Official Iranian media are quantitatively content‐analyzed to demonstrate their systematic use of threat‐projections as warnings and indications to the U.S. in this period.  相似文献

The use of terrorism as a strategy for obtaining political goals by non-state actors persists in the international system, despite attempts by states to counter the phenomenon. This article explores the resurgent threat posed to British security by dissident Irish republicans in order to illustrate the limited utility of terrorism as a strategy in the current sociopolitical context. Therefore, it has three objectives: First, it explains how strategic theory can aid in constructing a conceptual framework for explaining the persistence of terrorism, in general, and dissident republican violence, in particular. Second, it examines the dissident threat in light of the general failure of “armed struggle” to achieve republican goals in Irish politics. It is argued here that dissident republicans have confused “means” with “ends” and that this, ultimately, demonstrates the futility of their violence. Finally, the article suggests ways of tackling the dissident republican variant of terrorism.  相似文献

Abstract

This article presents a study of the ‘wars of words’ among selected parties involved in the Syrian conflict. Based on a combination of content analysis and critical discourse analysis (CDA), it examines actors’ discourses within the United Nations Security Council (2011–2015), the global arena of confrontation and international legitimisation of armed actions. Here, it investigates their instrumentalisation of the word ‘terrorism’ and the war on terror narrative, and it explores the dynamics of discursive (de)legitimisation of the use of violence in Syria. The article shows how parties instrumentalised this narrative to criminalise their enemies while legitimising their own violent actions. By doing this, the paper also offers a broader reflection on the global narrative on terrorism, and its different reception and instrumentalisation by core and peripheral actors.  相似文献

This article attempts to contribute to and advance the growing literature on social network analysis and terrorism studies, through a social network analysis of the Jemaah Islamiyah cell that was responsible for the Bali bombings in 2002. In doing so, the article endeavors to provide a potential framework for the intelligence analysis of terrorist cells. Such a framework will assist in (1) understanding the communication and structure of such cells and (2) assist in predicting the likely outcomes of terrorist cells when employed in real-time intelligence analysis.  相似文献

While much of the focus of terrorism research is on successful terrorist attacks, the most significant lessons for terrorism prevention may come from examination of terrorist plots and attacks that do not succeed. This article analyzes 176 terrorist plots against American targets that have been thwarted or otherwise failed during the past 25 years. It considers what kinds of intelligence and security measures are most useful in counterterrorism, and argues that the conventional wisdom about why intelligence fails—because analysts and agencies are unable to “connect the dots”—is wrong. Most plots, especially domestic terrorist plots, are not foiled through imaginative analysis, but through conventional law enforcement efforts and aggressive domestic intelligence collection that reveal to authorities just what the plotters are up to.  相似文献

Abstract

That terrorism presents scholars and policymakers alike with new challenges is well documented. But the fact that transnational terrorism and societal responses to it have also placed new demands on those who teach international affairs in the undergraduate classroom is less widely discussed. This article identifies a basic set of educational objectives for teaching about terrorism as well as materials and methods for achieving those objectives with a reasonable degree of success. Through a discussion of the uses of library research exercises, films, role playing and simulation, and values clarification approaches, the article provides a scheme for educating a nucleus of future citizens who will better understand the policy and value choices confronting them in a world beset by terrorism.  相似文献

Targeted killing has become an increasingly prevalent tactic employed by states in their efforts to counter terrorism. Despite its widespread use, the criteria for targeted killing permissibility have remained vague. This article identifies and evaluates the circumstances under which targeted killings can be considered permissible and looks at on-the-ground implementation by Israel and the United States. While both Israel and the United States may have largely adhered to the laws of armed conflict, in practice, discrepancies in implementation exist. This is primarily due to the ambiguity of the “distinction” and “proportionality” principles, two key legal and moral criteria that need further clarification.  相似文献

This article argues that, while there have always been good reasons for striving for a universally agreed definition of terrorism, there are further reasons for doing so in the post 9/11 environment, notwithstanding the formidable challenges that confront such an endeavour. Arguing that the essence of terrorism lies in its intent to generate a psychological impact beyond the immediate victims, it will propose three preliminary assumptions: that there is no such thing as an act of violence that is in and of itself inherently terrorist, that terrorism is best conceptualized as a particular method of political violence rather than defined as inherent to any particular ideology or perpetrator, and that non-civilians and combatants can also be victims of terrorism. Beginning in June of 2000 Chechen terrorists have carried out twenty-eight acts of suicide terrorism acts including two mass hostage taking operations combined with suicide terrorism (Beslan and Nord Ost). This paper reports the findings from psychological autopsies (interviews with close family members and friends) of thirty-four (out of 112 total) of these human bombers as well as augmenting them with material from hostage interviews from Beslan and Nord-Ost. The authors analyze the phenomena on the levels of the organization, individual, society and in terms of ideology and compare findings from other arenas also involving suicide terrorism. The main findings are that a lethal mix occurs when individuals in Chechnya are vulnerable to self recruitment into suicide terrorism due to traumatic experiences and feeling a duty to revenge and this vulnerability is combined with exposure to groups that recruit and equip suicide terrorists with both an ideology and the means to explode themselves. The ideology supporting Chechen suicide terrorism is very similar to the global jihadist ideology but remains more nationalist in its goals. It functions for the bombers much like short lived psychological first aid—answering their posttraumatic concerns in a way that shortly leads to their deaths. Unlike the Palestinian case, there is little social support for suicide terrorism in Chechnya.  相似文献
