This article asks whether, in waging war in the Middle East, the Bush–Cheney Administration developed and executed a conspiracy comparable to the one for which Nazi leaders were tried, convicted, and executed at Nuremberg after World War II. To meet the Nuremberg standards, such a conspiracy must include efforts to subvert the constitutional order. Today, scholars refer to these actions as ‘state crimes against democracy’ (SCADs). After explicating the Nuremberg standards, the article applies them to the Bush–Cheney Administration's ‘war on terror’. The conclusion reached is that evidence of a SCAD-driven conspiracy is extensive and certainly adequate by the Nuremberg standards to warrant investigations and trials.  相似文献

Abstract

This paper analyses the Indian government's policy response to the Trade-related Intellectual Property Rights Agreement (trips) and examines the implications of this response for food security and farmers. trips has become one of the most controversial agreements of the wto. This is because of its wide and far-reaching mandate and its complex socioeconomic implications. It is argued that the changes made to the Indian Patents Act in response to trips will compromise the food sector and the rights of small farmers by conferring strong rights on upstream agents who produce proprietary agricultural inputs using biotechnology. Not only are these agents able to exert monopoly price control over agricultural inputs for 20 years, they also have the right to determine the conditions under which farmers and researchers use patented processes and products. The paper outlines policy options available to the Indian government to tighten the scope of patentability in the food sector.  相似文献

This paper examines 10 years of political transition in Cambodia. It is particularly relevant because Cambodia has just passed through a third stage of transition in the form of national grass roots elections to dilute elite power. The scope of the paper covers the three elections in the period 1991–2002 and is located in Dankwart Rustow’s transition theory. I conclude that while basic elements of the theory hold true, qualifications are required in relation to the length of the ‘acceptance’ phase for the elites, and the extent to which, even after 10 years, habitually normalised democratic processes are still unreliable at best, and violent at worst.  相似文献

Brazil is considered one of the more successful examples of democratic transition and consolidation in the developing world; and one of the fastest developing and emerging countries. This article contends that Brazil is not yet a fully established democracy, because it lacks the proper civilian checks and balances ensuring full authority over the armed forces, police and secret services. There are five main reasons for this: first, the Constitution does not provide a generalised guide for the institution of civilian oversight. Second, a change of cultural perceptions vis-à-vis the security sector entities is needed. Third, piecemeal rather than holistic or comprehensive legal and institutional transformation has occurred, with little civilian oversight of the armed forces. Fourth, the large structures still held by each of the armed forces require re-articulation and fundamental transformation. Finally, there is no fully fledged civil society participation in security sector life through the media and academia. These problems weaken democracy in Brazil. The course of democratisation in Brazil and the role the security sector played in the transition are examined before discussion of some of the more recent legal and political developments in the security sector, as part of the democratic consolidation. The conclusion presents insights from Brazil’s experience and lessons for states facing similar transition challenges.  相似文献

Our empirical research in India shows the poor and the non-poor report different motivations for voting. The poor say they turn out to vote because it is their right while the non-poor report they vote because they expect material benefits from the state, some kind of access to the state, or because voting is their civic duty. We attribute the different reasons for voting offered by the poor and non-poor to their different relationships with the state. Unlike the non-poor, the poor mostly report the state mistreats or ignores them yet makes every effort on Election Day to ensure they are treated equally. The recognition the state grants to the poor on Election Day leads them to view voting as a valued right, one that gives them a rare chance to associate with those who govern as equals. The evidence in this paper was drawn from 30 focus groups with a total of 445 participants and 150 open-ended interviews conducted across Maharashtra, Tamil Nadu, and Uttar Pradesh and three state and national-level surveys.  相似文献

The article explores the “fear of Islam” through a specific series of political debates about Islam and the future of the Greek-Orthodox national identity. The analysis is based on the method of qualitative content analysis, which makes use of thematic categories and draws on the proceedings of the Greek parliament. The main questions the article will try to address are: How have Greek political parties reacted to public demand for the construction of a mosque? What have been the rhetorical tropes they use? How have they capitalized on current and old fears about Islam? What have been the implications of this discourse on state policies toward Islam? Have there been any differences in this discourse over time? The analysis highlights the role of historical interpretations of Greek national identity and contemporary problems related to new waves of migration due to Greece’s place on the border with Turkey and with the broader Islamic world.  相似文献

Critical scholars and investigative journalists have developed a significant body of evidence demonstrating how US democracy assistance programmes undermine left and centre-left governments in Latin America. This article draws upon original research to examine how democracy promotion has sought to stabilise neoliberal polyarchy in Peru, a longtime regional ally of the US. It contributes to a neo-Gramsican theorisation of democracy programmes by examining how ‘soft’ tactics have contributed to the state's efforts at creating an inclusive neoliberal social order, a project which has ultimately failed. Particular attention is paid to the way in which US programmes were configured and carried out to respond to the rise of the ‘anti-systemic’ Peruvian nationalist party of Ollanta Humala, who won the recent presidential elections in June 2011.  相似文献

This article discusses anti-war and anti-nationalism activism that took place in Serbia and, particularly, in Belgrade during the 1990s. It analyzes anti-war activism as aiming to combat collective states of denial. Based on fieldwork research conducted in 2004–05, and particularly on an analysis of interviews conducted with anti-war activists in Belgrade, this text closely analyzes the nuanced voices and approaches to activism against war among Serbia's civil society in the 1990s. The article highlights the difference between anti-war and anti-regime activism, as well as the generation gap when considering the wars of the 1990s and their legacy. Finally, this text emphasizes the role of Women in Black as the leading anti-war group in Serbia, and examines their feminist street activism which introduced new practices of protest and political engagement in Belgrade's public sphere.  相似文献

The approval (2003) and enforcement (2005) of a smoking ban in Italy have been viewed by many as an unexpectedly successful example of policy change. The present paper, by applying a processualist approach, concentrates on two policy cycles between 2000 and 2005. These had opposing outcomes: an incomplete decisional stage and an authoritative decision, enforced two years later. Through the analysis of the different phases of agenda setting, alternative specification and decision making, we have compared the quality of participation of policy entrepreneurs in the two cycles, their political strategies and, in these, the relevance of issue image. The case allows us to direct the attention of scholars and practitioners to an early phase of the policy implementation process – which we have named "transition to practice". This, managed with political strategy, might have strongly contributed to the final successful policy outcome.  相似文献

Much social commentary has fixated on the theme of “democracy vs. efficiency,” but observers have directed attention at modes of decision-making alternative to the usual bipolar foci. Gaenslen takes the latter tack in suggesting a third mode, and this note at once shares in his intent while seeing problems with his approach. Specifically, this note outlines a fourth mode for decision-making, based on the “laboratory approach to organization development”; it sketches some of its underlying theory and practice; and the narrative details a number of ways in which the demands of economic efficiency and political democracy can be met with substantial mutuality by learning designs consistent with the laboratory approach.  相似文献

It is tempting to “internationalize the curriculum” in professional graduate programs by adding courses and units that deal with strategies to improve the international competitive position of the United States. The study considers three strategies for dealing more credibly with international and global issues. The more difficult and challenging are those that attempt to incorporate multi- and interdisciplinary activities. The study describes several topics with global implications that would benefit from interdisciplinary study. In the meantime, the traditional perspective of Public Administration is not very relevant to global concerns because of the close connection to nation-states and hierarchical organizations. There are, however, a number of trends in the field that could enhance its ability to contribute to a global perspective such as a growing attention to new institutional arrangements, more emphasis on consultations rather than regulatory controls, and more interest in the role of managers.  相似文献

The Polish response to the crisis that escalated across Europe in 2015, banning refugees from crossing its borders, has been one of the least welcoming in Europe. Poland has been reprimanded by the EU for its lack of solidarity with other countries that accepted refugees. The government’s response was that it does indeed welcome refugees as long as they are not Muslims, since letting Muslim refugees in would be a security risk. The figure of the Muslim terrorist posing as a refugee has become a key trope through which xenophobic nationalist politics have been employed. In this sense, Poland can be seen to be drawing particular inspiration from the Eurosceptic politics of Orbán’s Hungary while also reflecting a broader European trend towards Islamophobia in countries such as France, Germany, Sweden or the UK. This article maps responses to refugees from key public actors. It focuses on how three key players in the Polish public sphere—the Catholic Church, the State and civil society actors—responded to the looming perspective of welcoming refugees to Poland. The paper argues that the Polish response to the so-called refugee crisis should be analysed as subtext to a broader political change in the country towards nationalism that has as its goal to push out all foreign ‘invasion’. Mobilised within this are new and old manifestations of racism, suggesting that Poland’s long history of racial Othering and exclusion has not been sufficiently accounted for.  相似文献

Utilizing appropriations data, this article analyzes the mid-year budget amendment process in Georgia. Economic factors are found to account for a sustained pattern of budget expansion from one year to the next between 1977 and 1986. Revenue estimating practices are found to contribute to mid-year increases in state agency appropriations. Patterns of agency success in the mid-year budget amendment are found to be associated with success in the previous mid-year amendment. The article concludes that legislators, the executive, and executive branch agencies have come to regard the mid-year budget amendment as a regular part of the state's budgetary process.  相似文献
