Since the attacks of September 11th, 2001, terrorism has experienced a prominence in discourse across the U.S. The representations of terrorists and terrorism by the news media and politi have contributed to the edifice of terrorism as a moral panic. This treatise examines the social effects that have or may occur due to the social construction of a moral panic of terrorism. The thematic frame is situated within Cohens stages of a moral panic. We offer an analysis of the medias depiction and coverage of acts of terrorism, and legislative, political and legal responses in the form of social and cultural changes occurring from the creation of a moral panic. In addition, we offer an analysis of the states vested interest in the social construction of this panic, leading to increased levels of fear, targeted at the general publics consciousness. This article concludes that the presentation of terrorism and terrorists by the media and politi have contributed to unnecessary levels of panic and fear, misguided public consciousness, and the development of legislation creating negative social ramifications yet be seen.  相似文献

The University of Pennsylvania study of delinquency in a Philadelphia birth cohort has been described byNewsweek as perhaps the most influential piece of criminal justice research in the last decade (March 23, 1981). Many have construed the findings as showing that, if imprisonment were focused on the minority of offenders with especially bad prognoses, the rate of crime could be reduced substantially. But others have taken the opposite view that the cohort data, far from endorsing such a selective incapacitation strategy, might actually provide strong evidence that such an approach is futile. Through some further analyses of the Philadelphia data, we attempt to clarify their policy implications.  相似文献

Once popular state-centred political frameworks, while declining in popularity on many normative agendas, nevertheless continue to guide how we think about and examine policing. Early studies into the private policing phenomenon have thereby focused upon the formal paid private security sector, a set of agencies which do not depart too radically in appearance from traditional public police services. More recent empirical studies have yielded data inconsistent with the established conceptual frameworks. Theorists have been assembling these data into alternate ways of thinking about collective life, which may have profound implications for the ways in which to choose to govern in the future. Further research addressing developments in networked nodal governance may be suggestive of progressive alternatives.  相似文献

The paper probes the deep structure of perceptions of AIDS and the ensuing public policy trends. AIDS has become the latest symbol indexing 20th century conflicts over the family and sexuality and recapitulates some features of early debates over contraception and the control of sexually transmitted diseases. From 1981 to 1983, public talk about AIDS was virtually taboo. Since 1983, the massive proliferation of AIDS discourse has led to the development of an official story common in the press and clear in the presumptions underlying recent state policies in the United States, Canada, and the United Kingdom. These policies have favored state control of sexual speech and education, as well as control of people blamed for HIV infection, while community-based groups have sought to empower people to affirm their sexuality while avoiding viral transmission.  相似文献

This article offers a re-reading of Goodrichs essay, Law in the Courts of Love. My contention here is that the idiom of love that Goodrich provides us with in this essay cannot address the complexity of sexuality and sexual politics that inhabit our contemporary technoscientific culture. In so doing, I will juxtapose his essay with Laven Berlant and Michael Warners essay, Public Sex. This article will be divided into three sections. In the first section, I will evaluate and review Goodrichs genealogical approach to law and the image of justice that arises out of his approach. The second section will be a re-reading of Goodrichs Law in the Courts of Love through feminist and technoscientific discourses. Its aim is to problematise and re-think not only the idiom of feminine justice that Goodrich offers, but also to question the presuppositions upon which his work is based, primary presuppositions surrounding issues of privacy, sexuality and sexuated rights. Finally, in the third section I will conclude by suggesting that the re-figuration of justice necessitates a re-figuration of the relationship that law has with time and space.  相似文献

Two experiments were conducted in which 176 listeners heard male and female objectively defined high- and low-recognition voices and then attempted to identify these voices from a voice parade containing 20 distractors after either 10, 40, 100, or 130 minutes (experiment 1), or 10 minutes, one day, seven days, or 14 days (experiment 2). In experiment 1 delay had no overall effect, although further analysis revealed that the shortest delay did produce better performance than all other delay conditions. Further, high-recognition voices were better identified than low-recognition voices. In experiment 2 delay had an overall effect, with the shortest delay interval again being significantly better than all other conditions, which did not differ among themselves. High- and low-recognition voices, however, did not exhibit a statistically significant difference, although these two factors entered into a marginally significant interaction. Theoretical speculation and forensic implications were drawn.This research was funded by the British Home Office, research grant no. Since the suicide—homicide of 53 members of the Order of the Solar Temple in 1994 and the gas attempt by Aum Shinrikyo in Tokyo's subway in 1995, a number of European states have decided to fight against sects. France and Belgium are in the forefront of this battle. Both countries have set up official observatories of sects and state agencies involving various ministries to combat them. Preventive policies targeting sects are being carried out. In Belgium, the Anthroposophic Society, a philosophical movement listed as 1 of 189 sects suspected of being dangerous, has sued one federal entity that printed unfounded accusations against their movement in a widely distributed brochure against sects. The same Anthoposophic Society has also petitioned the Court of Arbitration to have the law establishing an observatory of sects annuled. This report deals with both legal actions.  相似文献

Every state investigates child maltreatment reports. Some states use a lower standard of proof of some credible evidence (or similar terms) to substantiate cases after investigation. Other state legislatures prescribe a higher standard of preponderance of the evidence. Legislatures use these terms of art as a matter of policy to control the risk of false-positive errors. A lower rate of substantiation should follow from a higher standard of proof. There was no statistically significant difference in the percent of substantiated and the percent of unsubstantiated cases in the two groups of states. If state policy to reduce the false-positive error rate is to be effective, something more is required than simply manipulating the verbal formula in legislation.  相似文献

So-called three strikes and you're out sentencing laws for criminal offenders have proliferated in the United States. The laws vary considerably in their definitions of what constitutes a strike. This paper adapts the classic Poisson process model of criminal offending to investigate how varying sentence lengths and definitions of what constitutes a strike affect the effectiveness and cost-effectiveness of these sentencing laws. In particular, it asks whether, by using different definitions for the first, second, and third strikes or different sentence lengths, one can make the resulting incarceration more efficient in the sense of incapacitating more crimes per cell-year served.  相似文献

Retributivism is commonly taken as an alternative to a consequentialist justification of punishment. It has recently been suggested, however, that retributivism can be recast as a consequentialist theory. This suggestion is shown to be untenable. The temptation to advance it is traced to an intrinsic good claim prominent in retributive thinking. This claim is examined, and is argued to be of little help in coping with the difficulties besetting the retributive theory, as well as clashing with a desert claim equally central to that theory.  相似文献

Recent proposals by the G7 (and Russia) to clamp down on terrorists and terrorism do not define that which is prohibited. Instead, a threat is communicated which in turn allows, among other things, greater attention to be paid officially to camouflage charities and terrorist use of the Internet. Nevertheless, it is somewhat of a truism to note that terrorist violence is ultimately defined or characterized, for purposes of legal prohibition, within a highly politicized atmosphere. Starting with a short summary of anti-terrorist codification efforts made this century, this article examines some of the security interests cited by governments today in their respective struggles against terrorism. More specifically, it is argued that individual perceptions of personal and societal threat are heightened unnecessarily not only by a constant stream of governmental anti-terrorist rhetoric, but further, by an awareness of official and unofficial methods of anti-terrorist surveillance, and the use to which the information so obtained can be put.  相似文献

Considerable attention in the popular and professional literature has focused on the relative costs and benefits of using public protectionist versus civil libertarian models of social control. In this article, we develop statistical analogs of these models to predict violent behavior among samples of defendants found incompetent to stand trial in New York State. The societal and personal costs (errors of prediction) of each model are compared and their implications for clinical practice and social policy are discussed.This research was supported in part by PHS Grant MH 20367 from the NIMH Center for Studies of Crime and Delinquency. This paper considers the growing appeals to the idea of community in criminal justice policy and the involvement of actual communities in criminal justice initiatives. It draws on a completed two year research study of a number of community-based crime prevention initiatives in the South East of England. The paper considers the nature of community to which appeals are made in criminal justice discourse and policies, the contribution of community to the practices of social order and the nature of community representation and participation in crime prevention initiatives. It is argued that appeals to community in crime prevention, and crime control more generally, embody shifts in what constitutes the legitimate responsibilities of individuals, collectivities and the state. This has a number of implications, the first of which is a redrawing of the cost of policing and security services. Additionally, there is an associated shift in blame for failure. Finally, actual community involvement in crime control gives rise to new structures and forms of local governance that evoke key questions about the regulation of social relations, the nature of conflict resolution, citizenship, democracy and social justice.  相似文献

This paper considers the role of reciprocity rules in various strategic settings. After distinguishing four typical categories of social interaction, the paper examines three forms of reciprocity constraints. An ideal rule of perfect incentive alignment (structural reciprocity) serves as a benchmark for the analysis of a golden rule of reciprocity, characterized by a mechanical linking of one player's strategy to that of the other player; and a silver rule of stochastic reciprocity, characterized by a probabilistic symmetry in the relationship between the players.  相似文献

Experiment 1 was a Japanese replication of the studies reported by Messicket al. (1985) and Liebrandet al. (1986). Subjects were asked to write down fair or unfair behaviors that they or others did, giving as many examples as possible in 5 min. As in the previous studies, the subjects began more fair behaviors with the word I than with others. Likewise, they began more unfair behaviors with the word others than with I. In Experiment 2, 80 examples of behaviors (40 fair and 40 unfair) were selected randomly from the results of Experiment 1. The difference between the number of frequent behaviors sorted into the fair/I category and that sorted into the unfair/I category was greater than that between the number of behaviors sorted into the fair/others and that sorted to be unfair/others. Salient behaviors were more likely to be sorted into the category of unfair than into fair, and more likely to be sorted into others than I. On the whole, the egocentric bias of fairness was confirmed in Japan as well as in the Netherlands and the United States. However, in both experiments, gender differences were found; women, compared to men, recalled more others' behavior than their own and were likely to attribute fair and/or unfair behavior to others rather than to themselves.  相似文献

This paper gives the author's impressions on the following aspects of justice: desert, equity, equality, need, and intergenerational equity. The author concludes that these different aspects cannot be reconciled but instead must be compromised. An example of such a compromise is provided by a discussion of welfare reform. The author claims that rights are correlative with duties, and that asserting the former has little meaning without specifying the latter. He then discusses justice toward groups rather than individuals. He proposes that maintaining cultural variety in the presence of a homogeneous superculture is a major problem of the contemporary world. The paper concludes with a discussion of various forms of power, particularly the integrative power that people acquire over each other by virtue of ties of loyalty and identity.  相似文献

This essay offers both a critique of the theory and practice of criminology and an alternative programme via a sketch of a cultural criminology utilising cultural and literary analysis. The first part of the essay calls for the problematisation of the issues of value and representation in the criminological project and offers a competing account of the theoretical basis of the project of criminology based upon a cultural politics of difference and the ethics of radical alterity. The second part of the essay is a demonstration of how this theoretical basis might operate in practice through a cultural criminological reading of Maurice Blanchot's novelThe Most High (1948, 1996). This novel is an account of the relationship between language and transgression in a totalitarian society at the end of history. An alteration in the discursive practices of the criminological project premised upon a competing theoretical perspective suggests that criminology (specifically the relation between law and transgression, deviancy and regulation) can become an important element in explanations regarding the organisation and disorganisation of contemporary urban culture utilising the strengths of its prior application (specifically narratology) and abandoning its fear of culture.  相似文献

This paper examines the development of the doctrine that restricts testation to competent persons, and the use of expert testimony in implementing that doctrine. Since 1870 the leading articulation of this doctrine has been Lord Cockburn's Rule, which among other things requires that the testator knew the natural objects of his bounty at the time the will was made. The facultative theory of mind underlying Lord Cockburn's Rule is consistent with the contemporary, functional approach to competency to make medical decisions taken by the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research. Where expert testimony, based on training in the behavioral sciences, takes a functional approach to discovering the nature of the testator's values regarding other persons, it can assist the trier of fact significantly more than the lay opinion testimony which many courts have preferred in questions of testamentary competency. The concern of commentators that courts make false attributions of testamentary competency out of a perceived need to protect the family would be lessened, and the freedom of testation promoted, if courts directed their attention, through the kind of expert testimony proposed, to the testator's psychological family, instead of the persons identified as family members in intestacy statutes.The author wishes to thank Professors John Monahan, Roberta A. This concept paper emerged from a Law and Human Behavior (LHB) Workshop, that was called by the journal's Editor, Richard Wiener, and held at St. Louis University on March 19–21, 1999. This workshop, which brought together 22 scholars and researchers in legal psychology, was part of James Ogloff's Presidential Initiative Project for the American Psychology/Law Society, and was supported by St. Louis University and an NSF grant. Prior to our arrival, each participant answered queries from the Editor about LHB and the field of psychology and law, and each was asked to offer five topics that were underrepresented in the journal or that we would like to see addressed in future issues. At the workshop, we were assigned to small groups, and the authors of this paper constituted one such group. The charge for all groups was to develop plans for encouraging submissions in areas of psycholegal scholarship that continue to be infrequent topics of investigation, and then to develop a concept paper. The direction our group took is captured by our title, Everyday Life and Legal Values, and within this paper we explicate the topic, identify a number of underrepresented research areas, suggest some research paradigms for investigating them, and present this within a perspectival directions frame that ties established lines of research to the newer ones we propose.  相似文献
