The recent work of Loïc Wacquant identified the emergence of the penal state as a core feature of the global expansion of neoliberalism and the neoliberal government urban marginality. Drawing on Wacquant’s theoretical and conceptual reflections, this article analyses the emergence of a Latin American form of penal statecraft. By taking an in-depth look at the increasing criminalization of urban marginality in contemporary Latin America as well as the related developments in the local prison system, the single most important institutional expression of the Latin American penal state, important commonalities and differences between the penal statecraft experiments throughout Latin America and the countries of the ‘developed world’ are highlighted.  相似文献

The historical study of the family started later in the “Third World” than in Europe and North America, and the link between colonialism and family structures in the colonized or formerly colonized countries has not been explored thoroughly. In this issue we have chosen examples from Africa, Latin America, and the Caribbean in part because the importance of people of African background in both continents provided a certain link. The main connection, though, was the fact that all examined cultures had to cope with Christian-European family norms and with the values of the colonizers. The aims, forms, and historical circumstances of the colonial situation were quite different in all the cases examined. When changing conditions made traditional kinship bonds less reliable or less workable, people turned to alternative institutions such as gynaegamy or gender groups. If there is one conclusion to be drawn from all the examined cases, it is that colonized societies had the ability to use a variety of family forms as they adjusted to new situations.  相似文献

The classic studies of the authoritarian personality imply that free‐and‐just societies would need a different kind of personality. Social structure and personality are interdependent. The whole is greater than the sum of the parts but the nature of the parts is not irrelevant. Without a truly utopian world, we have to guess at what such personalities would look like—an important, often neglected insight of Marx. So we look for hints in a less‐than‐perfect world. Towards that end novelists have offered, intentionally and unintentionally, certain indices or codes of the kind of personality necessary for a just world. Kazantzakis’ Zorba is one such hint, as seen in his autonomy, manifested most importantly in his anti‐nationalism. In Zorba we see that community is possible where he has become “free” (rejection of nationalism, etc.); it is not possible where he is not “free” (vis‐à‐vis women). The paradox is that the just society needs autonomous personalities. Crudely put, real human community might require personalities who do not need it.  相似文献

The aim of this study is to try andexplain the relationship between violenceand the changes taking place in socialspaces. Violence, in all its dimensions,has taken a central place in Latin Americansocial life and has become an almosttotally private issue. This implies aseries of spatial and socialtransformations in the cities. The neweffects of violence influence social andethnic segregation and seem to operate insimilar ways in different societies. Thismotivates a comparative analysis of thesecurity services situation in differentcountries. The study of confidence in the police in Latin America is rare, partially for lack of interest and partially for lack of reliable data. Social, economic, and political instability in those countries also contributes to the problem. Relying on data from the World Values Surveys 1995-1997, the current research proposed a theory of the police in transitional societies and reported the results of analyses of confidence in the police in nine countries of Latin America. The levels of confidence in the police in the nine Latin American nations were compared with that of the U.S. The inclusion of a heterogeneous set of control variables in the multivariate analysis yielded several consistent predictors of confidence in the police. Similar to the findings in the U.S., confidence in the police in Latin America was part of the broader attitude complex. Different from the findings in the U.S., confidence in the police was positively related to one's employment status and religiosity, and negatively to income.  相似文献

Since 1978, all countries in Latin America have either replaced or amended their constitutions. What explains the choice between these two substantively different means of constitutional transformation? This article argues that constitutions are replaced when they fail to work as governance structures or when their design prevents competing political interests from accommodating to changing environments. According to this perspective, constitutions are likely to be replaced when constitutional crises are frequent, when political actors lack the capacity to implement changes by means of amendments or judicial interpretation, or when the constitutional regime has a power‐concentrating design. It is further argued that the frequency of amendments depends both on the length and detail of the constitution and on the interaction between the rigidity of the amendment procedure and the fragmentation of the party system. The article provides statistical evidence to support these arguments and discusses the normative implications of the analysis.  相似文献

Recent observers have noted the frequently voiced complaint of prison guards that they have too little influence on decisions about the operations and goals of prisons. This lack of influence, moreover, is thought to be associated with such work-related attitudes as job satisfaction, role strain, and alienation. Yet, it is unclear from previous analyses whether this complaint (1) is based solely on the actual amount of control guards believe they have, (2) arises from a perceived disparity between their amount of control and that held by prisoners and administrators, or (3) reflects a felt discrepancy between the guards' actual and ideal amounts of control in the prison. The present study examined survey data from four prisons to quantify the guards' perceptions of the prison control structure and to assess the relative contributions of the perceived amount, distribution, and discrepancy between actual and ideal control for guards to the work-related attitudes of job satisfaction, role strain, and alienation. The results indicated that guards perceive the total amount of control in the prison as finite, that they desire an increase in their own level of control commensurate with the decrease they desire in the prisoners' amount of control, and that the perceived amount, distribution, and discrepancy between guards' actual and ideal control have a significant effect on guards' work-related attitudes.  相似文献

ABSTRACT

The last two decades turned Latin America into one of the most violent regions in the world. While previously, violence in the region has predominantly been associated with state repression and military dictatorships, the “new violence” that emerged since the mid-1990s is predominantly criminal. Related research has been mostly problem-driven, implying that the focus has been on how to improve security governance in the region. The multiple ways in which governance itself is both shaped by as well as contributing to the pervasiveness of this “new violence,” has remained uncharted. This article offers an analytical framework, inspired by the literature on governance, for assessing this issue. To this end, it highlights different modes and instances of governance with, by, and through crime (and violence) in the region. In doing so, the article offers a contextualization for this special issue as well as an overarching analytical framework for the individual contributions.  相似文献

Much has been written in the English-speaking world on the topic of sex trafficking, but little is known about what researchers elsewhere have produced on this topic. An exhaustive literature search was conducted to locate publications on this topic from Latin America. A total of 74 publications were located and put through a systematic content analysis. Four main discernible patterns were noticed: (1) the vast majority of the publications were produced by individuals affiliated with international or non-government organisations; (2) the production of trafficking-related literature sharply declined after 2007; (3) of the small number of studies involving empirical data, most were qualitative in nature; and (4) the literature was primarily focused on the sexual exploitation of children. The discourse on sex trafficking in Latin America appeared to be dominated by advocacy groups. There were few scholarly articles, suggesting limited attention from the academic community. Despite limited empirical data, many Spanish-speaking authors made claims on the nature and extent of sex trafficking, with articles citing one another as source of evidence. This review finds a great need for the involvement of the academic community and for dispassionate and empirically grounded research on sex trafficking.  相似文献

The majority of prisoners are drawn from deprived circumstances with a range of health and social needs. The current focus within ‘prison health’ does not, and cannot, given its predominant medical model, adequately address the current health and well-being needs of offenders. Adopting a social model of health is more likely to address the wide range of health issues faced by offenders and thus lead to better rehabilitation outcomes. At the same time, broader action at governmental level is required to address the social determinants of health (poverty, unemployment and educational attainment) that marginalise populations and increase the likelihood of criminal activities. Within prison, there is more that can be done to promote prisoners’ health if a move away from a solely curative, medical model is facilitated, towards a preventive perspective designed to promote positive health. Here, we use the Ottawa Charter for health promotion to frame public health and health promotion within prisons and to set out a challenging agenda that would make health a priority for everyone, not just ‘health’ staff, within the prison setting. A series of outcomes under each of the five action areas of the Charter offers a plan of action, showing how each can improve health. We also go further than the Ottawa Charter, to comment on how the values of emancipatory health promotion need to permeate prison health discourse, along with the concept of salutogenesis.  相似文献
