A recent federal district court decision found that the New York City Police Department engaged in unconstitutional policing. Officers stopped millions of minority young men over the span of several years. Most of those stopped were innocent of any wrongdoing. This article uses qualitative and quantitative research methods to investigate these inequities, examining the views of both the police and those who were stopped. The authors find that pressure on officers emanating from headquarters was responsible for much of the illegal behavior by lower‐level officers. Additionally, youth in minority neighborhoods felt mistreated by the police; this led to distrust in the police. The authors suggest solutions to ameliorate this painful episode in police practice. The article concludes with specific recommendations such as reducing management pressure on officers and police developing community partnerships.  相似文献

Differences in managerial expertise and political incentives associated with local government form may affect local government spending levels as well as the allocation of resources. This paper explores the latter possibility by estimating how the distribution of resources in council-manager and mayor-council municipalities responds to a positive fiscal shock resulting from the abolition of a municipality's court. We find that court abolition has a distinct effect on the allocation of resources in council-manager and mayor-council governments. As expected, mayor-council municipalities allocate the marginal dollar to policing. However, council-manager municipalities react to court closure by reducing police expenditures over the long-term.  相似文献

This study estimates the impact of the discretionary Edward Byrne Memorial State and Local Law Enforcement Assistance Program (EBMGP) on drug arrests and crime. The 1986 and 1988 Anti‐Drug Abuse Act allocated federal funds to state and local municipalities to combat illicit drug use and violent crime associated with drug sales and trafficking. The results show that the implementation of the EBMGP resulted in an increase in police hiring, an increase in drug sales arrest rates for Blacks and Whites, and a decrease in total crime. Nonetheless, Black‐White racial disparity in the drug sales arrest rate still significantly increases by approximately 1 for every 1,000 Black residents. Our findings highlight the role of federal crime control policies in state and local policing. Although, the EBMGP was a color‐blind policy initiative, it was not race neutral in its implementation.  相似文献

While British policing has an unparalleled worldwide reputation for excellence, its system of governance has not been formally examined for almost fifty years. Known as the tripartite system, giving overlapping but compatible powers and duties to the Home Secretary, to local Police Authorities and to Chief Officers of Police, it is now long overdue for reconsideration and adjustment. More than one political party is suggesting significant reform but only of individual parts of the system. Given other issues concerning the police, particularly the number of United Kingdom forces and the fixation with the number of police officers as an indication of political success, there is now an urgent need for agreement that policing in Britain should have a holistic and cross‐party re‐examination, possibly but not necessarily in the form of a Royal Commission.  相似文献

The municipal zoning process in the United States has come under increasing attack as a tool to create and maintain suburban socioeconomic homogeneity by mandating sprawl‐producing single‐family detached houses at the expense of less costly townhouses, apartments, and mobile homes. Beginning in the 1970s, the Supreme Courts of the neighboring states of Pennsylvania and New Jersey addressed municipal exclusionary zoning in different ways: Pennsylvania empowered residential developers to compel municipalities practicing exclusionary zoning to authorize market‐rate development of all types of housing, while developer empowerment in New Jersey was conditioned upon inclusion of low‐ and moderate‐income units. Using aerial survey and housing census data over a 20‐year period, this article finds that outcomes by housing type over a 20‐year period in Pennsylvania municipalities around Philadelphia were more diverse than those in adjacent New Jersey municipalities. © 2004 by the Association for Public Policy Analysis and Management.  相似文献

Abstract

Nowhere is the chasm between the races more apparent than in the physical division of metropolitan areas between inner‐city poverty and suburban affluence. Thus far, public policy efforts to introduce metropolitan perspectives into local land use regulations have been unsuccessful. The series of New Jersey Mount Laurel decisions lays out a possible path for introducing comprehensive regional planning by deploying the constitutional power of state courts. Relying on the allied professions of economics and city planning, the New Jersey Supreme Court eliminated the legal barriers to affordable housing in the suburbs.

Questions have been raised over courts’ ability to reform local government powers, but many traditional objections to the effectiveness of judicial reform seem to have been overcome in the New Jersey litigations and legislations. State courts can play an indispensable role in solving regional land use problems if they secure the support of community leadership groups.  相似文献

Police officers influence the British policy process through their representative organizations. One of the main ways in which this is achieved is through police domination of the definition of certain sorts of issues at the central governmental level. This definition also occurs at the local level. Analysis of the location of the police as an interest group in the structure of the British state suggests how the politics of policing might be understood. Five issues relating to the police policies towards behaviour -street assaults, 'rural public disorder'. rape, battered women and racially motivated assaults - illustrate how the police define issues and affect the policy process. The debates about police 'politicization' and accountability should be set in the context of the relationship between political structure, issue definition and the political agenda.  相似文献

Studies of local law enforcement actions toward immigrants show that while some cities engage in enforcement, many others do not. The extent and determinants of enforcement have been assessed, but these studies have not evaluated the full range of practices, including welcoming practices, toward immigrants. This article introduces the concept of “welcomeness,” develops a framework for measuring it, and, using a nationwide survey of local police departments, examines how widely departments are welcoming (or unwelcoming) to immigrants. The data show that many police departments have consciously and deliberately developed practices intended to foster positive relationships between the police and immigrants and to encourage immigrants to call the police for assistance.

This article examines the impact of six administrative practices on the use of deadly force by police officers in American cities with a population greater than 50,000. Generally, departmental policies demonstrate little association with the frequency of shooting incidents per police officer, or in the number of incidents resulting in fatalities or injuries. It does appear that police departments which issue more traditional sidearms tend to experience fewer incidents than departments which issue heavier firearms. This same lack of association between administrative practices and the use of deadly force is discovered when controlling for city population size arid state legal codes. Notwithstanding that some of the relationships are in the expected direction, their lack of statistical significance suggests that the use of deadly force has its antecedents in sources other than the administrative policies of local police departments.  相似文献

Diverse societies present different challenges for police forces that have to gain the trust and legitimacy of minorities. Police forces must develop the ability to engage with diversity and overcome their own biases and prejudices in order to better serve minorities. Police reforms, however, may fail to address the challenge successfully if core problems are not clearly identified. In such a case, reforms may be misdirected and fail to achieve the desired results. This paper, based on a study of the Arab minority in Israel, suggests a bottom-up approach that concentrates on identifying the attitudes of minority groups as the basis for any reform plan. A survey was conducted among Arab citizens to identify general attitudes, perceptions of over-policing and under-policing and assessment of three potential reforms; recruitment of minority members into the police, community involvement in policing, and cultural training for police officers.  相似文献

Several U.S. states have supplemented traditional judicial review of local land-use regulation with a state affordable housing appeals system (SAHAS). Empirical evidence indicates that a SAHAS can increase the proportion of housing that is affordable to low- and moderate-income households. But some scholars have suggested that an effective SAHAS will ultimately backfire, by producing incentives to prohibit market-rate development, thereby rendering a state’s housing stock less affordable overall. We test this “backfire” hypothesis with a longitudinal comparison of single-family housing development from 1980 through 2007 in municipalities located in adjacent areas of Connecticut (which adopted a SAHAS in 1989) and New York State (which did not have a SAHAS during the study period). Contrary to the predictions of the backfire hypothesis, our fixed effects regression indicates that Connecticut's SAHAS was associated with increased single-family development relative to the New York State jurisdictions in our sample. This result suggests that a SAHAS can increase below-market rate and mixed-income development without impeding market-rate development.  相似文献

This article examines levels of policing services, focusing on an assessment of resources and their measurement for municipalities. Two measures of policing levels assess the reliability of the findings across alternative measurements. Social and institutional characteristics are explored to evaluate alternative explanations in policing efforts. The article presents four decades of census data for municipalities in metropolitan areas. The central finding is that unequal levels of policing are prevalent across American municipalities. An additional finding is that social and institutional contexts affect policing, based on a pooled time‐series analysis of municipal governments. Although its main contribution is to local public economies research, the research also integrates the social and institutional literatures to identify factors in the allocation of resources to policing.  相似文献

Accreditation, long used to signal quality among hospitals and universities, has been available to police, fire, and public works departments since the late 1980s. For public service departments, accreditation is a voluntary process that demands significant organizational resources without a guaranteed outcome. Why would city officials devote scarce resources to such an endeavor? Two explanations are examined. First, accreditation may be a rational response to a history of trouble or the potential for future crisis. Second, municipalities may use accreditation to build a reputation for professional administration of public services. Data from approximately 1,000 small, mostly rural municipalities in Illinois, New Hampshire, and Wisconsin address local choices on production and contracting arrangements for a wide range of services. The results suggest that the use of both for‐profit contractors and cooperative agreements with other governments correlate negatively with population size. Small municipalities are less likely to use competitive bidding processes, compare costs between production options, or report that privatization produces savings. Median income, rural geography, and ideology show statistically significant associations with contracting decisions. Respondents generally consider themselves “satisfied” with services provided by contract, although satisfaction levels are lower than those associated with self‐provision of the same services. Citizen satisfaction associated with services delivered by other governments is lower than those provided by private contractors, suggesting that no trade‐off in service quality is directly attributable to for‐profit contractors.  相似文献

Program budgeting has been in use for 30 years. It has had a checkered history, being considered alternately a great advancement or an unworkable system. Little has been written about the consequences for the organization that has adopted it. This study was undertaken concerning local government across the State of Victoria, Australia. A questionnaire was sent to all municipalities. There was a 60 percent response rate. Results show that information generated by planning programming budgeting (PPB) is used for decision making but in a limited way. The proposition that PPB will have an impact on the operations of councils is only partially supported.  相似文献

On January 13, 1978, after nearly 30 years of public service, Burtell Jefferson became the first African American to serve as chief of the Metropolitan Police Department of Washington, D.C.
