中国心理学史研究的继承与创新——兼论杨鑫辉教授的学术贡献

中国心理学史经过老一辈心理学家的精心浇灌,已经成为心理学百花园中的一朵亮丽的花朵。在众多浇灌者的身影中有一位不能忽视,这就是心理学家杨鑫辉先生。中国心理学史的发展必须解决好继承与创新的问题。具体地说,就是要以建立中国人自己的心理学体系为目标;研究者要有坚定的理论信仰与独立的研究立场;在研究中要注意"求真"与"求解"的良性互动;既要善于破"人蔽"也要善于破"己蔽";要将本土特色与国际视野相融合;研究者既要善于独立思考,又要有合作创新精神。杨鑫辉先生无疑在这些方面都为我们做出了表率,值得后继者学习。

全国人大常委会在宪法实施中的创制行为及其界限——以“辽宁贿选案”为例

“辽宁贿选案”发生后,该省人大常委会无法正常开会履职。对此,全国人大常委会决定成立辽宁省十二届人大七次会议筹备组,代行该省人大常委会的部分职权。这被认为是宪法上的创制性安排。全国人大常委会的创制超出了宪法文本,不是宪法解释行为,也不是宪法续造行为,而是宪法建造行为。政治主体在面对宪法僵局时主动实施宪法,建造出民主集中制原则的具体内容和人民代表大会制度的新内涵,有效解决僵局并发展宪法。这并非孤例。全国人大常委会还曾在“总理辞职案”中进行过创制。创制需要符合一定的条件,前提是出现了必须创制的环境、没有可直接适用的宪法规则,方法是按照法定程序作出政治选择,形式是发布决定而非立法。创制具有宪法法律界限和合理性界限。政治主体要选择恰当的宪法原则和制度进行创制,所创制的内容要符合比例原则。创制是全国人大常委会掌握的一种新宪法工具,表明我国宪法实施具有政治主体与宪法互动的特征。     

European Court of Justice rules on the protection of databases under the Database Directive (96/9/EC)

The European Court of Justice has ruled on the circumstances in which databases may be protected by the Database Directive. Creative podcasting as a tool for legal knowledge and skills development

ABSTRACT

This article draws on the authors’ experience of introducing a student-led legal podcast in their law school in September 2017 to explore creative podcasting’s potential as a tool of legal knowledge and skills development. Drawing on the authors’ observations as the coordinators of the podcast, as well as a survey conducted amongst student participants, it considers the value of creative podcasting as a means of enhancing legal knowledge, aiding skills development, and fostering a feeling of collaboration and community. The article also reflects on the practical challenges associated with running a project of this type outside the school’s curriculum, focusing particularly on the challenge of encouraging student buy-in.

“Do We Have LIFT-Off?” Social Media Marketing and Digital Performance at a British Arts Festival

ABSTRACT

Arts festivals have been explored through many lenses, but social media marketing and digital performance are less studied. The potential of social media networks in digital performance is exemplified by the London International Festival of Theatre (LIFT), which repositions social media technology as an enabler for audiences to co-produce digitally oriented performance. This article argues that the relationship between social media marketing and performance is more hybridized than often assumed, with performances forming a creative development loop from producer to audience through performative social media. Harnessing the creative potential of social media platforms via “digital staging” encourages audience insight into process as well as product.     

Women Behind the Scenes in the Performing Arts

Within Ireland, interest in strategically supporting young people's participation in the arts has increased. Additionally, awareness of the Internet's potential for promoting engagement with the arts has grown. Addressing national directives and local needs assessments, South Dublin County Council's Arts Office initiated NOISE South Dublin (http://www.noisesouthdublin.com), an interactive Web site based on Australia Council's NOISE project (http://www.noise.net), to promote the creative development of young people in the county. This article presents the practical challenges and potential of youth arts Web-based programs for harnessing the creative engagement of youth. It concludes that the Internet is only useful if it expands online engagement offline.

Diffusion as a Process of Creative Adoption

This paper elaborates an integrated framework for understanding diffusion as a process of creative adoptions in the business sector. Within the context of the economics of localized technological change, adoption is viewed as a complementary component of a broader process of adjusting the technology when unexpected events in the product and factor markets push firms towards a creative reaction. When the stock of adoptions exerts a suitable combined effect both on the gross profitability of adoption and on the costs of adoption, such that the net profitability of adoption and hence the rates of new adoption follow a quadratic path, the dynamics of creative adoption can engender a S-shaped diffusion process.
