In chapter 6 of Attempts, Gideon Yaffe defends the thesis that it is ??possible to attempt crimes of negligence?? (2010, p. 173). I am persuaded that he is right about this, provided that ??attempt crimes of negligence?? is read as (potentially misleading) shorthand for ??attempt to bring it about that we commit crimes of negligence.?? But I find certain parts of his defense unpersuasive. My discussion of those parts of his argument motivates the following thesis: Not only can one attempt to bring it about that one commits a crime of negligence, but the attempt can be successful as well.  相似文献

Three studies used the symbolic theory of history and identity to examine the impact of social representations of the 1986 EDSA I ??People Power?? revolution on participation in subsequent protest social movements in the Philippines. Study 1 found that in 4 state universities scattered across the archipelago of the Philippines, the first EDSA revolution was nominated as the most important event in Filipino history, and formed part of a narrative moving from authoritarian to democratic rule. Study 2 employed a mixed convenience sample of university students and adults to show that a measure of historical fatalism, or cynicism about the ability of EDSA I to produce lasting social change together with low identification with the social movement predicted lack of passive behavioral participation in the social movement that overthrew President Estrada in the EDSA II revolution. The importance of removing Estrada (derived from an expectancy?Cvalue/cost?C-benefit analysis formulation) was the best predictor of active behavioral participation. Study 3 showed that historical fatalism was the best predictor of behavioral intentions to actively participate in an attempt to overthrow Estrada??s successor President Arroyo, whereas anger was the best predictor of passive behavioral intentions among university students. Results suggest an exhaustion of goodwill from Filipinos, who no longer believe that People Power can force positive change against endemic corruption in national governance.  相似文献

This paper investigates the technological orientation of firms and universities and their propensity to have knowledge and technology transfer (KTT) activities. This study looks at the technological potential for KTT and how it is used, emphasizing differences between smaller and larger firms. To this end we collected information about the technology activities of firms (patent statistics) and the technology activities of universities. Furthermore, we used survey data on technology transfer activities. We combined the three datasets and found??especially for smaller firms??that great technology proximity fosters transfer activities with different universities (case 1). The same is true if proximity is low and expertise is considerable at universities in the respective technology field (case 2). In both cases additional transfer potential exists. In the second case firms engage in transfer activities in order to update and modify their knowledge base and as a consequence improve ??competitiveness?? in certain technology fields. Furthermore, firms show a tendency to diversify their contacts with universities in order to avoid knowledge lock-in.  相似文献

The withdrawl of Federal funds in a number of social service programs and state and local government budgets calls for an upsurge in volunteerism. Since August 1978, a Technical Volunteer Service (TVS) has been doing just that at one of the nation’s largest Federal laboratories. As measured by service to the community, acceptance by laboratory management, and satisfaction for the volunteers, this program has been an outstanding success. The time is ripe to transfer this program to other Federal laboratories, universities and industry. This paper describes the program and offers practical suggestions for its transfer to other organizations.  相似文献

Gideon Yaffe??s ??subjectivism about attempts?? rest on the Transfer Principle: ??If a particular form of conduct is legitimately criminalized, then the attempt to engage in that form of conduct is also legitimately criminalized.?? From the perspective of a moral concern with culpability, this principle seems to get to the heart of the matter: the true essence of what is wrong with attempting to commit a crime. Unfortunately, Yaffe??s argument for the Transfer Principle is based on an equivocation and therefore logically unsound. The moral core of the Principle is still sound, but we can??t tell from Yaffe??s book how far that principle would take us in the criminal law.  相似文献

The ninth chapter of the Ha?savil??sa of the Gujarati ?aiva author Ha?sami??hu (born 1738 ad) argues that P??tañjalayoga, conceived of as a conflation of A?????gayoga and Ha?hayoga, cannot be valid soteriology. P??tañjalayoga is presented as a paradoxical and painful attempt to achieve quiescence by forcibly eliminating karma. Ha?sami??hu, conversely, views ??euphoria?? (ull??sa) as a prerequisite for liberation, and therefore advocates a painless method of R??jayoga. This is taught as a ?aiva form of the R??sal??l?? involving transgressive substances and behaviour. A frame story establishes Ha?sami??hu??s authority to teach such practices by revealing his secret identity as Ha?sa, a favored companion of ?iva who incarnates for a single life to promulgate esoteric teachings. The purity of this R??sal??l?? is defended by challenging the validity of a conventional morality that seeks to portray it as abhorrent.  相似文献

Incarcerated fathers (N?=?185) in a maximum security prison were interviewed about their relationship with their children and their perceptions of social support. The OLS regression on social support included the inmates?? perception of the father-child relationship and other factors (demographic, sentence, child-related, and program participation). Results indicate the fathers?? perception of the relationship with their children made a positive contribution to their appraisal of social support from all sources. ??Other?? program participation and being African American were related to the fathers?? perception of social support from others. Recommendations include using social support strategies in pre-release and post-release programs.  相似文献

This article examines some social scientific issues relating to the operation and evaluation of crime prevention through mass media programs. It is argued that the efficacy of such programs is dependent upon the successful application of several empirically based communication principles. In addition, the attempt is made to analyze several general problems concerning the meaning and measurement of program success. Issues relating to both the operation and the evaluation of crime prevention through mass media programs are discussed in terms of their practical implications for public policy.  相似文献

This paper outlines China??s progress in developing endogenous capacity for knowledge diffusion and commercialization in the higher education sector. Despite a promising start in the 1980s and early 1990s, academic technology transfer has not kept pace with rapid growth of the country??s overall technological endeavors. But there is evidence of institutional evolution in that university-industry linkages are moving from more hierarchical and rigid forms established under the centrally planned economy into more flexible and market-based arrangements. After probing what underscores the stalling of universities?? new found mission, the paper offers layered policy suggestions on what can be done to overcome the conundrum.  相似文献

This paper analyses behavioural additionality of subsidies by regional and EU framework programme public funding granted to business enterprises in terms of the ??instalment?? of research cooperation between industry and science. Acknowledging their specificities in terms of research orientation, research scale, and management of research, the science component is divided in universities and public research centres. Drawing on firm level data provided by the OECD bi-annual business R&D surveys of 2004 and 2006 for Belgium, the main result is that funding by regional governments fosters the instalment of industry-science research cooperation. However, this positive effect is limited to the case of cooperation with public research centres (and not with universities). The prerequisite of commercialisation of research in the case of funding by regional governments could explain this. Public funding provided by the EU framework programme did not exert an impact on the instalment of industry-science cooperation, neither with universities nor with public research centres. This could be due the fact that EU funding is targeted at firms that are already cooperating and does not favour the set-up of new cooperation.  相似文献

This article discusses the U.A.L.R. child protection mediation program as well as several other child protection mediation programs in order to examine what makes a program a continuing success. Child protection mediation programs have gone through a period of tremendous progress and growth over the past 20 years in the United States and Canada. Numerous studies have shown that child protection mediation helps families and courts by lowering the amount of time that children spend in foster care and the amount of costs for courts and agencies. Child protection mediation is an essential tool for juvenile courts and the families that have cases there. This article addresses the development of child protection mediation programs, their importance to juvenile courts, and some reasons that these programs succeed or fail. Although many of these programs have early accomplishments, they have not always been able to maintain their growth or to continue to exist. The U.A.L.R. Mediation Project has not sustained its early levels of cases or referrals from court for numerous reasons. Using the techniques of other thriving programs, we will attempt to restart and re-energize the program. It has been established that the people who have a role in the establishment of a program, the funding sources and especially the commitment of the parties to the program all have a significant long-term impact. This article points out how programs should begin and proceed if they are to be a long-term success.  相似文献

Objectives

Investigate the degree and nature of influence that researchers have in police crime prevention programs and whether a high degree of influence is associated with biased reporting of results.

Methods

Meta-analytic inquiry of experimental and quasi-experimental studies (n?=?42), drawn from four Campbell Collaboration systematic reviews of leading police crime prevention strategies: problem-oriented policing, ??hot spots?? policing, ??pulling levers?? policing, and street-level drug enforcement.

Results

Larger program effects are not associated with studies with higher involvement on the part of the evaluator (e.g., assisting in strategy design, monitoring implementation, overcoming implementation problems).

Conclusions

This study does not find support for the cynical view, which holds that researchers have a personal stake in the program or are pressured to report positive results. Importantly, the evaluator??s involvement in the implementation of the program may be a necessary condition of successfully executed police experiments in complex field settings.  相似文献

This paper focuses on the success and failure of anti-corruption initiatives; focusing mainly on those in developing countries. Through a review of extant evidence, it finds a very mixed picture within which there is widespread failure; albeit sometimes only partial failure. As a result, anti-corruption as a field can struggle to gain attention and resources among competing development initiatives. In reviewing that field we find that, while some progress has been made ?C for example in integrating risk assessments into programs and in learning from political economy analysis ?C there is little actual focus on the ??missing middle??: the interventions themselves and how they can be made to work better. In analyzing those interventions, we argue that projects mostly fail because of over-large ??design-reality gaps??; that is, too great a mismatch between the expectations built into their design as compared to on-the-ground realities in the context of their implementation. Successful initiatives find ways to minimize or close these gaps. Effective design and implementation processes enable gap closure and improve the likelihood of success.  相似文献

There is increasing concern over the behaviour and accountability of international personnel, including CIVPOL contingents, deployed in peace-keeping and peace-building missions throughout the world. From the point of view of local populations the ??internationals?? are typically perceived to be ??above the law??. This is directly related to the fact that under status of forces or mission agreements (SOFAs or SOMAs) they are exempt from local host state jurisdiction. There are also significant practical problems in gathering and presenting evidence for disciplinary or criminal proceedings in their home states. This paper will analyse these problems in detail, based on a study of some recent European Union and international missions and suggest how a more co-operative home and host state approach to monitoring, investigation and adjudication of alleged misconduct might achieve more effective accountability and thus contribute to the overall success of CIVPOL missions.  相似文献

This paper investigates government subsidy games for private sector research and development (R&D) in a two-country two-firm intra-industry trade model. Two funding structures are compared: ??cost sharing?? vs. ??reward for performance.?? Both the theoretical evidence and the results of a Monte Carlo simulation suggest that cost sharing is associated with higher social surplus and quality improvement because it prompts the firm to do more R&D. In a cost sharing program government and firm R&D are always complements. In the reward for performance program government and firm R&D may be complements, but are usually substitutes. In the Monte Carlo results the average firm contribution to R&D expenditure is actually negative with a reward for performance funding structure??raising the question of whether it might be construed as corporate welfare. Finally, the paper characterizes funding priorities for both structures in the case when subsidy dollars are scarce and when they are not.  相似文献

Several recent cases judged by the Court of Justice of the European Communities (the Court) have raised interesting issues related to the possibility for operators of food chains to use national quality signs to indicate territory of origin, which are different from the regulatory European ??Protected Geographical Indications??. The various attempts by France (a list of quality signs), Germany (??Markenqualit?t aus deutschen Landen?? sign) and Belgium (??Walloon?? sign) have all been condemned as protectionist policies contradicting the free movement of goods in the European Market. These national quality signs can be seen as attempt to defend the viability of specific kinds of activities (involving small enterprises) in specific places (rural areas). These cases are a good illustration of the difficulties that a Member State of the European Communities (Member State) faces in trying to protect its traditional activities and/or rural areas in a way that is compatible with free markets. The paper analyses the recent court decisions underlining economic aspects such as information delivery and the cost of alternative protection mechanisms for these activities. We highlight in particular the collective trademarks and the kind of intellectual property right they form by the economic theory of clubs, and make some comparisons with protected geographical indications.  相似文献

A recent National Research Council (NRC) report (2011) recommends that universities must craft policies and allocate resources to enable more university startups because some university technologies will never be commercialized unless licensed to a startup. However, the creation of university startups requires personnel skills and programs not typically associated with an university Office of Technology Transfer (OTT). Estimates show that 75 % of university inventions are not licensed at all. The conclusions of this study include university policies to turn some them to fuel university startups. Carefully selected case studies of three contrasting universities reveal patterns of successful startup policies and performance. MIT’s case is an example of long-term success, the University of Colorado’s case is an example of medium-term success, and Auburn University’s case is an example of a new-comer to the scene. Lessons from the case studies include: the need for very early evaluation of all inventions for their startup potential, the need for pre-license seed funds through proof-of-concept programs to advance early-stage inventions to the next stage, and the need for OTT personnel skilled in enabling startups. NSF’s recent I-Corps program invests heavily in the training of potential enablers and entrepreneurs for commercializing university inventions. Based on the findings of this study, I-Corps must also invest in pre-license proof-of-concept programs to advance early-stage university inventions closer to the market. Implementing the conclusions of this study would also accomplish the recommendations of the 2011 NRC report cited above.  相似文献

Increasingly more research has examined the creation of university spin-off firms as are seen as an important source of regional and national economic growth. However little is known about the factors influencing the formation of university spin-off in Asian countries, especially in Korea. This paper contributes to the literature on academic entrepreneurship by deepening our understanding on determinant factors of university spin-off in the case of Korea. We investigate organizational and institutional factors highlighted in the literature as influencing the creation of university spin-off companies. The Korean government has implemented the INNOPOLIS Research Institute Spin-off (IRIS) program to enable universities to create new firms within special research and development (R&D) zones to commercialize public R&D output. The capability of universities to establish new firms through the program varies; consequently, this study utilized 122 universities from 2013 to 2015 to analyze determinant factors that affect university spin-offs. Panel logit and negative binomial analysis results indicate that university location has the highest positive influence on IRIS. Government-sponsored funding has a negative impact; however, the likelihood that universities create spin-offs and the number of IRIS firms are positively and significantly affected by publications, patents, research funding, and number of university spin-offs.  相似文献

Today??s society is often claimed to be the ??knowledge society??. Knowledge transfer plays a pivotal role in the whole economic system, influencing innovation management in its very core. This study deals with one of the barriers that might hamper knowledge transfer: The Not-Invented-Here Syndrome (NIH). Until now, this phenomenon was mainly analyzed in an industrial context. However, as the universities play an increasingly important role in the knowledge society, the time seems ripe to analyze this barrier of knowledge transfer in an academic context. This paper examines the influence of the research discipline, the scientific output, the attitude towards basic science and the project experience on NIH by analyzing a sample of 166 Austrian professors from the fields of physics and engineering. While we cannot find a significant impact of the first two aspects, we can demonstrate that the latter two do have a significant influence on NIH. Summing up, this study supports results from the existing literature on NIH and sheds light on new aspects providing deeper insights into the comprehension of this complex phenomenon.  相似文献

Chinese university patenting has gained importance in recent years. Using a comprehensive dataset of university patents by 155 leading Chinese universities from 1991 to 2009, our study pursues two objectives: First, we analyze the quantity and quality of patents filed by leading Chinese universities. Second, we analyze the role of subsidy programs with regard to university patenting in China. With regard to the first objective, our results show that university patents witnessed rapid growth in terms of quantity while patent quality did not increase to a similar degree. Regarding the second objective, we find that a subsidy program to promote research excellence at selected universities is a significant driver of patent quantity and quality. In contrast, a subsidy program that decreases the costs of patent applications seems to enhance patent quantity but not patent quality. We conclude that innovation policies which aim to stimulate patents of higher quality should focus primarily on increasing university R&D, and to a lesser extent on decreasing the costs of university patenting.  相似文献
