In February 2007 the National Council of Juvenile and Family Court Judges and the Association of Family and Conciliation Courts brought together a working group of thirty‐seven experienced practitioners and researchers to identify and explore conceptual and practical tensions that have hampered effective work with families in which domestic violence has been identified or alleged. Five central sets of issues were raised at the conference and are discussed in this report. These include the following: differentiation among families experiencing domestic violence, screening and triage, participation by families in various processes and services, appropriate outcomes for children, and family court roles and resources. The report emphasizes the need for continued multidisciplinary collaboration in order to better serve families affected by domestic violence and it includes an appendix of consensus points as well as suggestions for formation of ongoing work groups.  相似文献

with increasing frequency, courts and legislatures are focusing attention on visitation disputes in which there are allegations of domestic violence. This article explores the requirements for a careful assessment of the domestic violence issues, theparenting capacities of the adults, and the coping skilk of the children. It then proposes a decision-tree model of access recommendations that incorporates the information gatheredfmm the evaluation procedures.  相似文献

How to integrate the problem of partner violence into a child custody evaluation is analyzed within a risk-assessment approach. The research literature on partner violence is reviewed to examine the issues of establishing a base rate for partner violence and its relative frequencies for both genders. Theoretical typologies of partner violence are reviewed and a new typology presented that is more suitable to the predictive task in the custody evaluation. A model of how the evaluator should approach partner violence is described, with an integration of a risk-assessment approach to child developmental outcomes as associated with custody and parenting time arrangements and a violence risk assessment of a perpetrator/parent.  相似文献

Domestic violence has been an intense area of study in recent decades. Early studies helped with the understanding of the nature of perpetration, the cycle of violence, and the effect of family violence on children. More recently, studies have focused on beginning to evaluate domestic violence interventions and their effects on recidivism. This article acknowledges the importance of what we have learned about the prevalence and impact of domestic violence and explores the need for more focused effort to pinpoint interventions that are effective with perpetrators and victims. Methodological issues relevant to past intervention studies are also discussed and future research directions are outlined.  相似文献

This paper investigates the nature of the relationship between social stress and family violence. Specifically, a model of the stress process is presented, the applicability of the concept of stress to the occurrence of family violence is discussed, important research issues relating to the nature of the relationship between these two variables are raised, and predictions are offered regarding the likely impact of social stress upon the incidence of violence in the American family in the future.  相似文献

Ethical principles are often presented as universal, immutable rules. However, when conducting research with ethnic minority groups, such as Asian Americans and immigrants, ethical issues need to be placed within a sociocultural context as ethical responses are filtered through the specific value orientations and belief systems of the ethnic group under study. Further, when the group is a marginalized population, power dynamics complicate ethical principles of autonomy. The complexities are further accentuated with sensitive topics such as intimate violence or domestic violence. Consequently, ethical questions about autonomy, informed consent, confidentiality, limits to confidentiality, and protecting participants’ safety and reducing distress need to be at the forefront when planning intimate violence research. An overview of sociocultural context of Western biomedical ethics is presented and specific ethical issues that emerge when conducting intimate violence are discussed.  相似文献

Abstract

This article defines what is meant by intimate sexual violence and provides a brief historical context to this phenomenon. The incidence and impact of intimate sexual violence are clarified and discussed, as are the various factors contributing to this abusive behaviour. Current literature on intimate sexual violence in the United States is reviewed and differing approaches to responding to incidents of intimate sexual violence are identified as they might inform assessment and treatment options.

Taking intimate sexual violence seriously has implications for contraceptive counselling, abortion counselling, mental health counselling and family therapy. The article aims to inform practitioners of the essential issues surrounding intimate sexual violence, so that whenever intimate sexual violence is suspected, the social worker or family therapist can assess and intervene in a responsive and effective manner.  相似文献

A review of the dating violence literature reveals a limited number of studies with high school students and few studies that investigate the contextual issues of violence, such as meaning, motivation, and consequences. The present study sought to investigate the extent of dating violence victimization in a New Zealand sample of senior high school students (aged 16 to 18 years) and the perceived reasons for the violence, emotional effects, disclosure of the violence, and relationship consequences. A questionnaire that contained both open-ended and forced-choice items pertaining to experiences of violence and its consequences was developed using material gathered from focus group discussions with high school students. Findings showed gender similarity in the extent of violence and a number of significant gender differences in the aftermath of violence, particularly in the area of sexual coercion. These findings are discussed in the context of future research and prevention of dating violence.  相似文献

Prevention research on the related problems of child abuse, youth violence, and domestic violence has grown at an accelerating pace in recent years. In this context, a set of shared methodological issues has emerged as investigators seek to advance the interpersonal violence prevention knowledge base. This article considers some of the persistent methodological issues in these areas and points out emerging research strategies that are forging advances in garnering valid, rigorous, and useful knowledge to prevent interpersonal violence. Research issues and emerging strategies in three key domains of prevention research are considered, including complexities in validly conceptualizing and measuring varying forms of violence as specific targets for preventive intervention, research issues and strategies designed to reliably predict and identify future violence risk to be targeted by preventive intervention, and research issues and emerging strategies in the application of empirical methods to forge specific advances in preventive intervention strategies themselves.  相似文献

This article explores theoretical and empirical issues in the application of clinical neuropsychological evidence to forensic issues in the criminal law. The nature of forensic neuropsychological evaluations is discussed with reference to issues of competency to stand trial, criminal responsibility, and other competencies in the criminal process. Examples of specific disorders relevant to criminal law standards are presented, together with data estimating the prevalence of brain dysfunction in criminal and forensic populations. Research is also reviewed on the role of neuropsychological brain dysfunction in the etiology of violence and criminally relevant behavior. Finally, empirical and ethical issues concerning the applicability and admissibility of forensic neuropsychological data in the criminal context are discussed.  相似文献

The aim of this analysis is to identify latent subgroups of women based on substance use, exposure to violence, and risky sexual behaviors and quantify discrete stages of behavior change over time. Data comes from 317 women recruited from a Municipal Drug Court System in the Midwest. All participants were interviewed regarding their substance use and sexual behaviors, as well as their exposure to violence at baseline, a 4th-month follow-up, and an 8th-month follow-up. A latent transitional analysis (LTA), a longitudinal extension of a latent class analysis (LCA), was used to quantify discrete stages of behavior change. The results of our analyses revealed 4 distinct behavioral profiles in our sample: 1) women with high probabilities of risky sexual behaviors, exposure to violence, and crack/cocaine use, 2) women with a high probability of exposure to violence, and moderate sexual risk taking, 3) women characterized solely by a high probability of crack/cocaine use, 4) women with low probabilities of all factors. The proportion of women in latent statuses characterized by a high probability of crack/cocaine use did not substantially decrease over time. Women who experienced child sexual abuse, had a greater number of lifetime arrests, were older, and believed they had risky drug using behavior that needed changing at baseline were significantly more likely to be in higher-risk latent statuses. Targeted interventions tailored to crack/cocaine users, as well as a wide-spread need for trauma-informed interventions among females involved in the criminal justice system, are needed.  相似文献

The notion of transitions is an increasingly central concept in contemporary criminology and such issues are particularly significant in the study of intimate partner violence (IPV). Here, attention focuses on relationship dynamics and movement into and out of relationships for understanding long-term patterns of victimization over the life course. Still, a focus on transitions raises questions about how IPV is patterned over time and across relationships and how this contributes to stability and change in victimization risk over the life span. Our study examines this issue using data from the National Violence Against Women Survey. Findings from latent transition analyses reveal strong evidence for change in victimization experiences across the life course. Among women, those who experienced serious, multifaceted violence are most likely to transition out of relationships followed by transition into subsequent relationships characterized by conflict and aggression and a similar pattern is observed among men. At the same time, men who experience physical aggression in previous relationships are most likely to transition into non-violent relationships, while women with similar experiences are much less differentiated in the types of relationships they enter into. When we account for background characteristics (e.g., respondent’s race, education, and age) and childhood experiences of parental violence, the latter is particularly significant in accounting for exposure to serious IPV in later adulthood. Such findings extend our understanding of how life course transitions connect to violence and offending and highlight processes of continuity and change beyond the traditional focus on criminal offending.  相似文献

Objectives

Projection effects have been shown to bias respondent perceptions of peer delinquency, but network data required to measure peer delinquency directly are unavailable in most existing datasets. Some researchers have therefore attempted to adjust perceived peer behavior measures for bias via latent variable modeling techniques. The present study tested whether such adjustments render perceived peer coefficients equal to direct peer coefficients, using original data collected from 538 young adults (269 dyads).

Methods

After first replicating projection effects in our own data and examining the degree to which measures of personal, perceived peer, and direct peer violence represent empirically distinct constructs, we compared coefficients derived from two alternative models of personal violence. The first model included an error-adjusted latent measure of perceived peer violence as a predictor, whereas the second substituted a latent measure of directly-assessed, peer-reported violence.

Results

Results suggest that personal, perceived peer, and direct peer measures each reflect fundamentally separate constructs, but call into question whether latent variable techniques used by prior researchers to correct for respondent bias are capable of rendering perceived peer coefficients equal to direct peer coefficients.

Conclusions

Research cannot bypass the collection of direct peer delinquency measures via latent variable modeling adjustments to perceived peer measures, nor should models of deviance view perceived peer and direct peer measures as alternative measures of the same underlying construct. Rather, theories of peer influence should elaborate and test models that simultaneously include both peer measures and, further, should attempt to identify those factors that account for currently unexplained variance in perceptions of peer behavior.  相似文献

Although there is a considerable body of knowledge about domestic violence, a limited proportion focuses on domestic violence in rural settings. Using a nonprobability purposive sampling technique, 93 providers of domestic violence services from rural and urban localities in North Carolina and Virginia were located and asked to complete a self-administered survey soliciting provider perceptions about service consumers, the general public, themselves, and inter- and intra-agency issues. Significant differences were observed between rural and urban providers about service consumer needs and experiences, perceptions about the general public, area resource availability, agency funding, provider training, and worker safety. Implications of these differences are discussed.  相似文献

A growing body of empirical research has demonstrated that intimate partner violence is not a unitary phenomenon and that types of domestic violence can be differentiated with respect to partner dynamics, context, and consequences. Four patterns of violence are described: Coercive Controlling Violence, Violent Resistance, Situational Couple Violence, and Separation‐Instigated Violence. The controversial matter of gender symmetry and asymmetry in intimate partner violence is discussed in terms of sampling differences and methodological limitations. Implications of differentiation among types of domestic violence include the need for improved screening measures and procedures in civil, family, and criminal court and the possibility of better decision making, appropriate sanctions, and more effective treatment programs tailored to the characteristics of different types of partner violence. In family court, reliable differentiation should provide the basis for determining what safeguards are necessary and what types of parenting plans are appropriate to ensure healthy outcomes for children and parent–child relationships.  相似文献

This study examined the relationship between childhood exposure to parental violence and adult psychological functioning in a sample of predominantly Mexican American participants. Questionnaires assessing childhood maltreatment, family environment, and current psychological symptomatology were completed by 142 female undergraduates. Findings revealed that witnessing parental violence in childhood was associated with depressive symptoms, low self-esteem, and trauma symptoms in adulthood, even after controlling for child physical and sexual abuse. However, in subsequent analyses, also controlling for levels of nonphysical family conflict, previous associations between exposure to parental violence and adult symptomatology were reduced, such that trauma-related symptoms remained the sole outcome still predicted by a history of witnessing parental violence. Implications of these findings, issues related to the use of statistical control procedures in abuse effects research, and directions for future investigation are discussed.  相似文献

Although evidence of the strong correlation between deviant behavior and exposure to deviant peers is overwhelming, researchers have yet to investigate whether a nonlinear functional form better captures this relationship than does a linear form. Researchers also have yet to examine the extent to which peer effects vary as a function of the neighborhood context. To address these issues, we use data from the Project on Human Development in Chicago Neighborhoods (PHDCN) to examine 1) the functional form of the relationship between peer violence exposure and self‐reported violent crime and 2) the extent to which the effect of exposure to violent peers on violence is ecologically structured. Estimates from logistic hierarchical models indicate that the effect of peer violence exposure on violent crime decreases at higher values of peer violence, as reflected in a nonlinear relationship (expressed in terms of log‐odds). Furthermore, exposure to violent peers increases along with neighborhood disadvantage, and the effect of peer violence exposure on violent crime is attenuated as neighborhood disadvantage increases, which is reflected in a cross‐level peer violence/disadvantage interaction.  相似文献

This paper examines the relationship between violent behavior and a variety of measures of social class. Police records from one study and questionnaire data from two studies are analyzed. The strength of the relationship between class and violence varies significantly, depending primarily on the measure of class used. The implications of these findings are potentially profound for class-based theories of crime and delinquency. Methodological implications of the findings are significant for sampling issues as well as for conceptualizations of class.  相似文献

Specialization in violence is an important scientific and policy topic, and over the past several decades, many analysis techniques for studying specialization have emerged. Research in this area continues to be hampered, however, by remaining methodological problems. To overcome these problems, we propose a new method for studying specialization in violence based on an item‐response theory measurement approach that is implemented through a multilevel regression model. Our approach defines specialization as an individual level latent variable, takes into account the inherent confounds between specialization and overall level of offending, and gauges specialization relative to the population base rates of each offense. Our method also enables researchers to 1) estimate the extent and statistical significance of specialization, 2) assess the stability of specialization over time, and 3) relate specialization to explanatory variables. Using data from three studies, we found substantial levels of specialization in violence, considerable stability in specialization over time, and several significant and relatively consistent relationships of specialization to explanatory variables such as gender, parental education, and risk‐seeking.  相似文献
