True vehicular homicides are defined as those occurrences in which a motor vehicle is intentionally used as a weapon in taking of a life. A case is presented in which the deceased was traveling in the front passenger seat of a motor car that was deliberately rammed by a heavy jeep that came in the opposite direction, resulting in a serious frontal collision. Immediately after the impact, while the occupants of the car were lying in a dazed condition, the two persons riding in the jeep escaped with a bag containing money that was in the car, leaving the jeep behind. The impact mainly involved the driver's sides of both vehicles. The driver of the car sustained serious injuries but was found to be alive, whereas the front-seat passenger, who did not show any serious external injuries, was found to be in a collapsed state and was pronounced dead on admission to the hospital within 30 minutes of the accident. The autopsy revealed that death was caused by closed hemopericardium from a ruptured right atrium. The evaluation of the external and internal injuries confirmed that the fatal injury and a few serious internal injuries were caused by the seat belt (tertiary-impact injuries). The ruptured right atrium was attributed to blunt abdominal trauma by impacting against the lap belt. The case was a true vehicular homicide in which a motor vehicle had been used as a weapon to kill a person. Various aspects pertaining to road accidents, the safety of the occupants, and the advantage and disadvantage of the safety devices are discussed.  相似文献

Based on a 10-year sample of homicides (n = 50), the hypothesis was tested that it is possible to differentiate between aggression and rejection homicide. The aggression homicide results from the offender/victim relationship, which is no longer accepted for some reason. In contrast, in the rejection homicide the offender radically strives for a goal which can only be reached if the victim is eliminated. Based on forensic-psychiatric expert opinions (n = 50), the case analyses yielded 31 aggression homicides and 18 rejection homicides, one case could not be classified. Aggression homicides differed significantly from the rejection homicides with regard to their main motives. Hate in quarrel (n = 8), violent occupation of the victim (n = 7), delusions (n = 5), revenge (n = 3), self-defence (n = 2), and jealousy (n = 1) characterized the aggression homicides, whereas rejection homicides were dominated by economic motives (n = 14). Two offenders intended to get rid of the victim and one offender wanted to rescue a third person. From a forensic-psychiatric point of view, the pertinent statistical data (social data, diagnosis, criminal responsibility) are reported and the significance of the differentiation between aggression homicide and rejection homicide for medico-legal or criminological case profiling and for the prognosis of the risk potential is discussed.  相似文献

Abstract

The use of swearwords has hardly been investigated scientifically. Virtually nothing is known about the efficacy of swearing. The present studies set out to investigate whether the inclusion of swearwords in a testimony increases the believability of that statement. In study 1, respondents were simply asked whether they believed that using swearwords is a sign of credibility, a sign of deceit, or neither. In the second and third study, participants had to read fictitious testimonies of a suspect and a victim, respectively. Participants were exposed to testimonies with or without swearwords. The results suggested that people self-reported to find swearwords a sign of deceit (study 1), but when actually confronted with a statement, the opposite turned out to be the case (studies 2 and 3). That is, testimonies containing swearwords were perceived as more credible than swearword-free testimonies. Hence it is concluded that swearing increases believability of statements.  相似文献

This study examines the relationship between firearm availability and national homicide rates. The theoretical and empirical literatures are reviewed, and a cross-national two-stage least squares regression analysis is described. The relationship between a circa 1990 measure of firearm availability and the average 1990–1994 homicide rate is examined across 36 countries. Two-stage least squares regression, which controls for homicide's effect on firearm availability in addition to a number of other confounding factors, reveals a statistically significant positive effect of firearm availability on national homicide rates. The magnitude of the association is considerable. The observed relationship is found to be insensitive to sample composition. Results also indicate that homicide rates do not influence levels of firearm availability. The limitations of the study and avenues for future research are discussed.  相似文献

There are case reports of offenders inflicting excessive injuries on their victims when under the influence of benzodiazepines. However, the potential association between benzodiazepine influence on the offender and victim injury severity in a general homicide population has not been studied. We investigated associations between offender positive testing for benzodiazepines or z-drugs (zolpidem, zopiclone and zaleplon) and victim injury severity. Data were drawn from 95 Swedish homicide cases from 2007–2009 in which offenders had known toxicology. There were no significant differences in injury severity between cases in which the offender tested positive vs. negative for benzodiazepines/z-drugs. Thus, the findings do not support the hypothesis that there is an association between benzodiazepine influence on the offender and victim injury severity in a general homicide population.

The current research produces regression models with sample sizes from 127 to 131 by initially employing a data set of 170 nations. The current study finds that ethnic heterogeneity and linguistic heterogeneity lead to higher homicide rates. However, religious heterogeneity has no impact on homicide rates. The present article also tests an interaction effect between population heterogeneity and income inequality. Unlike J. R. Blau and Blau (1982) and Avision and Loring (1986) proposition, the interaction term is not related to national homicide rates. The current study also discusses the theoretical implications of those findings.  相似文献

While there were numerous studies documenting the neighborhood characteristics that led to increased risk of crime victimization, very little was done to compare the neighborhoods of homicide victims to non-victims. The current research used the case-control design to alleviate this gap in the research. A sample of homicide victims and non-victims collected from Prince George's County, Maryland, in 1993, was used to make these comparisons. Significant differences were noted in the macro-level measures of education, unemployment, household income, and percentage of female-headed households in the neighborhoods of victims and non-victims. Individual elements, such as age, race, gender, and arrest were also strongly associated with the risk of homicide victimization. Both macro and micro level variables needed to be included when studying factors that increased the risk of homicide victimization.  相似文献

Uniform Crime Reports (UCR) arrest and offense data for Chicago for 1960 to 1980 and population data from the 1960, 1970, and 1980 censuses are used to assess the extent to which demographic changes help explain trends in the city's homicide and robbery arrests. The results indicate that a changing racial composition contributed to changes in the age composition of Chicago's population as well as to changes in the homicide rate. Age-specific analysis by race and gender suggests that as much as 24% of the total increase in homicide arrests and 45% of the increase in robbery arrests (from 1962 to 1980) can be attributed to an increase in the number of nonwhite men in the population. Increasedrates of arrest of nonwhite men appear to account for large parts of the increases in homicide and robbery arrests, with increased rates for white men and nonwhite women also accounting for some of these increases. We use 1984–1986 data to estimate lifetime risks of being murdered in each of 50 large American cities and then compare these projections to others made earlier from 1971–1972 and 1976–1977 data. We find strong constancy over time in the average urban resident's murder risk (essentially a 1 in 68 chance of eventually being slain). Moreover, we find a high stability in the dispersion of risk by region, race, and city size and in the relative rankings of the 50 cities by murder risk. We comment briefly about such recent phenomena as the proliferation of crack and the resumption of capital punishment.Throughout this paper, we use the words murder, homicide, killing, and slaying interchangeably, meaning in all cases murder and nonnegligent manslaughter as defined by the FBI.  相似文献

This paper explores a popular yet highly destructive form of property crime — graffiti vandalism. The localities of such destruction selected for study were male and female restrooms. Three hundred and ninety-two cases were collected and analyzed. Prior research theorized the existence of a significant difference in the amount of graffiti produced between the sexes. (It was believed that males produce more graffiti than females). Analysis, however, revealed equal production of graffiti by males and females.Content differences between the sexes were hypothesized. The content categories included homosexual, heterosexual, nonsexual (humorous and political statements) and racial graffiti. The findings as they relate to content differences between the sexes are presented and discussed relative to sex-role socialization theory.  相似文献

Bone marrow (BM) analysis is of forensic interest in postmortem toxicological investigation in case of limited, unavailable or unusable blood samples. However, it remains difficult to determine whether a drug BM concentration is therapeutic or represents overdose, due to the lack of studies on this alternative matrix. Given the variations in BM composition in the body, sample location was suggested to be a relevant factor in assessing BM concentration. The aim of the present study was to compare postmortem caffeine concentrations in various BM sample locations and secondly to consider the correlation between BM and blood concentrations. Six BM samples (right and left side: proximal and medial femur and 5th rib) and a blood sample were collected from 21 forensic autopsies. Gas chromatography coupled to tandem mass spectrometry was performed. Blood caffeine concentrations ranged from 60 to 7591ng/mL. Femoral and rib BM concentrations ranged from 51 to 6171ng/g and 66 to 7280ng/g, respectively. Blood concentrations were always higher than BM concentrations. As a good correlation was demonstrated between blood and rib BM and between blood and the average of the four femoral BM concentrations, blood caffeine concentrations could be correctly extrapolated from BM concentrations. BM caffeine concentration was found to depend on sample location. Rib BM caffeine concentrations appeared to be systematically greater than averaged femur values and concentrations were much more variable between the 4 femur BM samples than between the 2 ribs. From a practical point of view, for caffeine analysis, rib BM appeared more relevant than femoral BM, which requires multisampling to overcome the concentration variability problem.  相似文献

This paper explores the potential for reducing homicide, with a particular focus on the United Kingdom. It draws upon data from the Homicide Index, international research on homicide, and the general crime reduction literature. Homicide is highly diverse in its characteristics, causes and dynamics, so effective strategies to reduce it are likely to require tailoring to specific forms. The paper focuses upon four important categories: domestic (partner) homicide; the killing of infants; alcohol-related homicide; and homicide involving guns and knives. Attention is also paid briefly to issues around dangerous offenders and mental disorder, and to homicide victimisation in relation to specific occupations.This paper was written in 2001 and accepted for publication by Crime Law and Social Change in 2002. Some minor updating has been undertaken by the authors, but due to the delay some sections will inevitably not refer to the most recent research. Urbanisation has generally been found to be a non-significant predictor of homicide rates in cross-national studies. Despite this, there is strong theoretical support for the presence of a positive association between the two. The present study analyses data for up to 57 nations for the period 1993–2005 and examines the relationship between urbanisation and homicide using pooled ordinary least squares, feasible generalised least squares, panel-corrected standard errors, fixed-effects, and random-effects estimation. The results show that urbanisation is one of the strongest predictors of homicide in the cross-national context. This is consistent with the expected relationship according to modernisation theory and suggests that rapidly urbanising nations should be concerned with the unintended consequences of urbanisation.  相似文献

Purpose

Using the rational choice perspective, the current study investigates the impact that the environment and offending behavior have on serial sexual crime event outcomes.

Methods

The effects of time and place factors, as well as offender modus operandi strategies, on sexual crime event outcomes are tested using Generalized Estimating Equations on a sample of 361 crime events committed by 72 serial sex offenders.

Results

Time and place do impact serial stranger sexual offenders’ modus operandi strategies, but the place characteristics of the crime have more of an effect on the offender’s behavior than do the temporal conditions during which the event occurs. Subsequent analyses indicate that temporal and place factors, as well as offender modus operandi strategies, predict whether the offender completes the rape, his reaction to victim resistance, and the level of physical force that he inflicts on the victim, but not whether the victim is forced to commit sexual acts on the offender.

Conclusions

Serial stranger sexual offenders are effective decision-makers who adapt their strategies to the physical environment in which they commit their crimes, but their degree of rationality can vary as some outcomes are more dependent on the context than the offender and his actions.  相似文献

The case of a 63-year-old man who killed his 52-year-old wife and then staged a sexual homicide at a distant location is reported. A review of all evidence, a forensic psychological interview, and psychological testing indicated that the murder was the result of a narcissistic rage reaction during which the subject beat his wife to death with a paint can, a clothing iron, and a rock. He then drove her body to a field 87.3 miles away, and positioned it in a manner that exposed her breasts and her underwear. He turned himself into the police two days later. There is no controlled empirical research on staging, although this single case supports the criminal investigative theory that staging exists, and is done to deliberately mislead homicide investigations (Douglas et al., 1992).  相似文献

Purpose

This study examined the interaction between homicide victim and offender criminal lifestyles and the situational characteristics of homicides that occurred in the city of Newark, New Jersey from 1997 through 2007. Three research questions were explored: (1) what are the lifestyles exhibited by homicide victims and offenders; (2) are there different types of homicide actors (i.e., victim and/or offender) based on their criminal lifestyle; (3) do varying homicide actor (i.e., victim and/or offender) types influence the characteristics of homicide incidents?

Methods

Five hundred and thirteen homicide incidents was used to answer the three research questions. Hierarchical Agglomerative Cluster and Logistic Regression Analyses were employed to answer the research questions.

Findings

The findings showed that criminal lifestyles were indeed very common among homicide victims and offenders, and that they resemble each other. The findings also showed that there were two types of homicide victims and offenders, and that these types influenced the etiology of homicide incidents.

Conclusion

Overall, the results suggest that researchers and practitioners should take into account the criminal lifestyles of potential victims and offenders when tailoring homicide prevention strategies.  相似文献

Distinguishing between suicide and homicide can be challenging owing to ambiguous and confusing case details. In particular, there is a paucity of useful information comparing homicide and suicide knots and ligatures in the literature. Multiple knot and ligature characteristics have not been recognized previously because complete and accurate information has been lacking. Ninety external tying cases (mainly homicide) and 56 cases involving self‐tying (mainly suicide) were reviewed to compare multiple knot and ligature characteristics. Additionally, 189 survey volunteers performed four standardized external tying tasks and two self‐tying tasks, yielding comparison data from more than 1500 knots. Using all available data, it was determined that the differences between external and self‐tying included types of knots, ligature configurations, ligature tensions, wrist gaps, wend lengths, knot access, external anchoring, and other indicators. These differences are presented in a proposed analysis checklist inspired by medical and psychiatric protocols. The checklist contains 14 potential characteristics for head and neck bindings, 14 potential characteristics for wrists and arms, nine ankle and leg characteristics, and four linkage details. The proposed checklist can be expanded and fine‐tuned as more data are accumulated. It offers experienced knot analysts an additional tool to assist in drawing conclusions, which then can be related to other case evidence by investigators.  相似文献
