Aggression during incarceration impacts on parole release decisions. However, research examining the link between aggressive behaviour in custody and violence post-release is limited, particularly in relation to adult violent offenders. Several factors complicate the use of institutional aggression as a marker of risk for future violence, including environmental causes of aggressive behaviour and adaptation to prison. This study explored the association between aggressive behaviour in prison and violent recidivism post-release in a sample of 148 adult male violent offenders. Prisoners with three or more aggressive incidents recorded in prison incurred a violent charge more often and sooner after release than those with no aggressive incidents, when controlling for age, ethnicity, length of incarceration and risk for future violence. Subjects with one or two aggressive incidents were not at increased risk of violent recidivism. These findings suggest that institutional aggression can be used to identify individuals at risk of violence following release but only when repeated aggressive behaviour is evident. Importantly, some prisoners who were not aggressive in prison were charged with violent offences post-release and some prisoners with three or more aggressive incidents were not violent following release, highlighting the complexity of using in-prison aggression as a marker for violent recidivism.  相似文献

Offenders face a number of significant challenges upon reentry into the community, including securing employment, locating housing, and accessing adequate substance abuse and mental health treatment. These and related issues, if neglected, only bolster rising recidivism rates which have prompted renewed interest in rehabilitation initiatives such as inmate reentry. Many jurisdictions have implemented programs designed to improve offenders' success after prison, but jail reentry programs are far less common. This study examined the effectiveness of one such program, the Auglaize County (OH) Transition (ACT) Program. Using a quasiexperimental design, recidivism was measured a year after release to determine if participation in the ACT Program was predictive of successful reentry. Findings suggest that program participation is strongly related to outcome success as was criminal history. Implications for correctional policy and suggestions for additional jail reentry research are considered.  相似文献

This study uses data from 641 state prison parolees in California to examine the associations between methamphetamine use and three measures of criminal behavior: (a) self-reported violent criminal behavior, (b) return to prison for a violent offense, and (c) return to prison for any reason during the first 12 months of parole. Methamphetamine use was significantly predictive of self-reported violent criminal behavior and general recidivism (i.e., a return to custody for any reason). However, methamphetamine use was not significantly predictive of being returned to custody for a violent offense. These trends remained even after controlling for involvement in the drug trade (i.e., sales, distribution, or manufacturing).  相似文献

Most prior studies of recidivism have used observational data to estimate the causal effect of imprisonment or probation on the probability that a convicted individual is rearrested after release. Few studies have taken advantage of the fact that, in some jurisdictions, defendants are assigned randomly to judges who vary in sentencing tendencies. This study investigates whether defendants who are assigned randomly to more punitive judges have different recidivism probabilities than defendants who are assigned to relatively lenient judges. We track 1,003 defendants charged with drug-related offenses who were assigned randomly to nine judicial calendars between June 1, 2002 and May 9, 2003. Judges on these calendars meted out sentences that varied substantially in terms of prison and probation time. We tracked defendants using court records across a 4-year period after the disposition of their cases to determine whether they subsequently were rearrested. Our results indicate that randomly assigned variations in prison and probation time have no detectable effect on rates of rearrest. The findings suggest that, at least among those facing drug-related charges, incarceration and supervision seem not to deter subsequent criminal behavior.  相似文献

There has been increasing international, national and local recognition of the need for more appropriate responses and services for individuals who come in contact with the criminal justice system and who have an intellectual disability and mental health issues. This article provides an overview of prevalence data that indicates a significant over representation of people with intellectual disabilities in correctional facilities and reviews the problems facing this population. Findings from two specific evaluation studies undertaken by the Centre for Developmental Disability Studies are presented, along with recommendations for future provision based on these results. One of these projects trialled a case management approach to supporting offenders with an intellectual disability upon their release from prison. The 20-month follow-up found that a number of serious barriers were encountered within the overall system of provision for this population; the most serious of which related to lack of adequate accommodation upon release. The second project involved a two-stage evaluation of one model of provision for individuals with intellectual disabilities who are sex offenders, only some of whom were on parole. This service provided both residential and therapy services in a small group home located in the community. Residents were found to have high levels of emotional and behavioural difficulties, in addition to offending behaviour, that continue to require support and supervision. Critical issues, including guardianship involvement, restrictive practices and retrieval, therapy provision, and risk management issues are discussed in relation to overall clinical and lifestyle outcomes.  相似文献

This paper discusses empirical findings and theories about prison higher education and recidivism. The research designs of available evaluations of prison higher education are discussed. Their results in regard to arrest and return to prison after release are presented in tables and figures. Both opportunity theory and moral development theory have been used to justify such prison programs as crime prevention measures. A critical examination of the actual findings of the evaluations carried out up to now suggests that prison higher education may have had only a slight impact on recidivism. One could, therefore, doubt the value of opportunity theory and moral development theory to justify prison higher education as a crime control measure. However, the methods used in the evaluations of this program have been generally weak. Thus, there is a continuing need to carry out well-designed research on this question. The findings of follow-up studies of prison higher education have significance for issues of correctional education policy as well as criminological theory.  相似文献

While a large literature establishes the racial and ethnic disparities in sentencing, we know comparatively little about the role of race and ethnicity in prison release. Using data from the National Corrections Reporting Program contextualized in California's political and legislative atmosphere, this article explores the role of race and ethnicity in prison release between 1985 and 2009 by studying components of sentencing and release. Limiting the evaluation of disparities to sentencing or time served in prison at release may inadvertently mask racial and ethnic inequities in the judicial process because events and actors can introduce circumstances between sentencing and release from prison that ultimately influence time served. The analysis confirmed that the measures used at the time of sentencing do not provide enough information to determine the differential experiences of groups in the real amount of time served in prison.© 2014 Law and Society Association  相似文献

Finding sustained employment is an important component of the transition from prison to the community for exiting prisoners. Anecdotal reports from former prisoners indicate that most individuals experience great difficulties finding jobs after their release. However, little systematic information is available about the employment experiences of individuals released from prison or the characteristics of former prisoners who are successful in locating employment. Using a causal framework, this paper examines the employment experiences of a multi-state sample of former prisoners, and identifies the individual factors influencing the likelihood of employment after release from prison, using data gathered from interviews with prisoners before and at multiple times after release. Findings indicate that consistent work experience before incarceration, connection to employers before release, and conventional family relationships improve employment outcomes after release. Individuals who relapse to drug use quickly after release, have chronic physical or mental health problems, and are older or nonwhite are employed fewer months after a period of incarceration.  相似文献

Contrary to a widespread belief about the undesirability of relatively large prisons, a review of the criminological literature yields no empirical evidence that prison size influences behavior inside or after leaving prison. The English prison statistics show that prison offenses, and more specifically assaults, are less likely in larger prisons. However, it was impossible in these analyses to control for the kinds of inmates in each prison. In a more controlled analysis of correctional effectiveness (defined as the difference between predicted and actual reconviction rates), there was a strong tendency for the more overcrowded prisons to be less effective. Size was only weakly related to effectiveness, and this association was reduced further after controlling for overcrowding. It was concluded that an important priority for governmental agencies should be to reduce overcrowding in prisons.  相似文献

A large body of literature has been dedicated to understanding re-offending after release from prison - a phenomenon known as recidivism. A meta-analysis was conducted using fifty- seven published studies on actuarial predictors of both violent and nonviolent recidivism in men and women. The current analysis resulted in 127 effect sizes between violent recidivists and non-recidivists, and sixty-eight effect sizes between violent recidivists with nonviolent recidivists. Several variables (drug/alcohol use, age, and marriage) were predictive of recidivism. Gender differences were also observed. In men, increased violent criminal history was associated with increased violent recidivism. This effect was not true for women. In fact, longer sentences were predictive of violent re-offending in women and not men. Despite limited data on women, pursuing the predictors of recidivism in men and women independently demonstrated that gender differences exist, and supported the need for more data concerning the predictors of recidivism in women.  相似文献

Psychopathy has been linked to violent reoffending in men, but the findings in women have been contradictory. The aim of this study was to examine the predictive validity of the Psychopathy Checklist-Revised (PCL-R) for violent recidivism in a nationwide sample of female violent offenders. The offenders (n = 48) had been assessed by the PCL-R and were followed after their release from prison or a psychiatric hospital. The average follow-up period was 8 years. Of the offenders, 16 (33%) had been reconvicted of a violent crime. Current findings of the performance indicators did not support the use of the PCL-R as a predictive instrument assessing risk of violent recidivism in females. The findings indicate that impulsivity plays a crucial role in female violent recidivism and that the PCL-R should be used with caution in risk assessment with female populations.  相似文献

Donor conception has historically been shrouded in secrecy. Such secrecy has been underpinned by social views and legal issues concemrning the adults involved in the process--the donor, the recipient parent(s), and, at times, the doctor. However, there is increasing recognition of the need to focus upon donor-conceived people's interests and rights to have identifying and non-identifying information about their donors. This editorial examines issues raised in relation to information release, while also introducing some of the arguments presented by other authors in this Special Issue of the JLM. It also considers recent Australian federal and State government inquiries that have favoured information release and the former Victorian Infertility Treatment Authority's service model to support people in the process of information access and release. While there has been a clear shift to favouring openness and honesty, legislative action is still required to ensure the balancing and realisation of people's interests.  相似文献

Recent innovations in sentencing policy across the United States reveal a renewed interest in the idea of selective incapacitation of criminal offenders. This is perhaps most evident in the proliferation of “Three Strikes and You're Out” habitual-offender statutes across the nation. Although the term was first introduced by David Greenberg in 1975, Peter Greenwood and Allan Abrahamse's eponymous 1982 Rand report represents the most fully articulated plan for implementing such a strategy. The report's release stimulated much discussion, because of the AUTHOR'S claims that selective incapacitation could simultaneously reduce crime rates and prison populations. Ethical problems inherent in such proposals as well as methodological inconsistencies in the original research warrant a reexamination of the proposal and of the empirical basis for the conclusions offered therein. Greenwood and Abrahamse's original research is replicated with a representative sample of California state prison inmates (N = 2, 188) in light of these limitations, with specific focus on the methodological issues concerning the construction of the predictive scale. The selective incapacitation scheme advocated by Greenwood and Abrahamse performs extremely poorly in terms of both reliability and validity, thus precluding the implementation of such schemes. The article contains a discussion of other, more ethically acceptable uses of an instrument that identifies “high-rate” or “dangerous” offenders. In conclusion, some observations on the limitations of incarceration-based strategies of crime control are offered.  相似文献

In 1972, the United States Supreme Court ruled in Furman v. Georgia that the death penalty as administered constituted cruel and unusual punishment. This ruling also invalidated the death sentences of over 600 inmates in the United States, who subsequently had their sentences commuted to life imprisonment. This article examines the institutional and postrelease behavior of the 47 Furman inmates in Texas from 1973 to 1986. Prior to the release of these inmates into the general prisoner population, prison officials and clinicians stated that they were dangerous and constituted a substantial threat to other inmates and to the security staff. The institutional and release behavior of the Furman inmates is compared with that of a cohort of like violent offenders. The Furman inmates committed few serious rule violations. They did not kill other inmates or staff. A minority of inmates in both groups committed the majority of prison rule violations. Of the 31 Furman inmates released on parole, 1 committed a new homicide. No cohort inmate killed again. The conclusion is that the execution of these 47 inmates would not have greatly protected society.  相似文献

Turning points, between‐person differences, and within‐person changes have all been linked to desistance from crime. Nevertheless, the means through which between‐person differences are frequently captured in life‐course criminology makes them intertwined with, and perhaps confounded by, turning points in life. We propose that a new way of capturing the between‐person effect—the baseline between‐person difference—could benefit theoretically informed tests of developmental and life‐course issues in criminology. Because they occur at one time point immediately preceding a turning point in life, we demonstrate that baseline between‐person differences establish meaningful theoretical connections to behavior and the way people change over time. By using panel data from the Serious and Violent Offender Reentry Initiative, we estimate models capturing within‐person change and baseline between‐person differences in social bonds (family support) and differential association (peer criminality) at the time of release from prison. The results demonstrate that baseline levels of family support protect people from postrelease substance use but not from crime. Baseline between‐person differences and within‐person changes in peer criminality, however, are robustly related to crime and substance use. Collectively, baseline between‐person differences seem critical for behavior and within‐person change over time, and the results carry implications for reentry‐based policy as well as for theory testing in developmental criminology more broadly.  相似文献

A recurring question in criminological research is whether prisoners meet new accomplices in prison. This article’s objective is to study co-offending among individuals who have served prison sentences. The frequency of co-offending among individuals who have been in the same prison at the same time will be examined. If gender, age, type of prison, offence type and prior experience of co-offending are significant for this type of co-offending will also be examined. The study population comprised all inmates released from a Swedish prison during a half year in 2001–2002 (n = 3.930). The follow-up period is 10 years. The results show that only 3% of those who have been in the same prison at the same time are suspected of committing offences together subsequent to release. The likelihood of being suspected of committing an offence together following the conclusion of a joint stay in the same prison is higher for those released from a closed prison who are aged 31–40, and who had committed large proportion of their offences together with others prior to the relevant prison sentence. The results suggest that the concept of criminal capital is not important for future co-offending after a joint stay in prison.  相似文献

This research used data from a drug treatment follow-up study to investigate the predictive utility of factors associated with latent trait and life-course models of criminal offending among a sample of serious drug users. A sample of 577 incarcerated drug offenders was interviewed prior to release from prison and again at six and eighteen months after release. Structural equation models were used to investigate to what extent sensation seeking and aggression scales predicted marriage, employment, or enrollment in an educational program and, in turn, how both sets of variables predicted drug use and arrest. Results indicated that while aggression was negatively associated with social bonds and positively related to drug use and arrest, sensation seeking was nonsignificant in predicting bonds and negatively associated with drug use. Employment and school were negatively associated with drug use and arrest, while marriage was nonsignificant.  相似文献
