The study of social justice has always been an interdisciplinary undertaking, but in recent years neurobiologists have joined scholars and scientists from other areas to tackle complex questions concerning fairness, empathy, equality, hierarchy, and ideological conflict and polarization. By synthesizing insights from multiple, mutually informative levels of analysis, it is possible to shed new light on basic biological processes that reflect, inspire, and inhibit the pursuit of a more just society. With this special issue we highlight groundbreaking research on the neurobiology of fairness and social justice, bringing together six articles that address core themes of social justice, including individual variability in definitions of fairness, the genetic basis of economic egalitarianism, neural bases of empathy in environmental and intergroup domains, and the neural and genetic correlates of ideological polarization. Taken in conjunction, these diverse contributions bring multiple theoretical perspectives and research methods to bear on the shared goal of understanding and promoting social justice.  相似文献

我国《涉外民事关系法律适用法》在部分涉外关系的法律适用方面要求选择有利于保护某一方当事人的实体法。这种规定虽然有体现冲突法实质正义追求的积极意义,但也为法院查明和准确适用外国法增加了难度,不利于司法任务的简单化。所谓有利的法,要求法院在众多可适用的法中,通过比较选择一个能最好保护一方当事人利益的实体法,这其实是美国最好的法选法方法的翻版。冲突法实质正义的趋向应当是有限度的,不应取代实体法所应发挥的作用,否则会破坏法律选择的稳定性和可预见性,丧失冲突法的规范价值和存在意义。鉴于该法生效时间不长,一时难以修改,可以考虑通过司法解释对之予以适当矫正。  相似文献

法治必须学会对接人工智能和算法。如何面对经由算法的法治、如何达至算法正义,将成为未来时代法治进化的核心主题。在人工智能时代,算法不再仅仅是一种单纯的数学工具和一般的技术应用,它将成为一种调和法治内在结构与机理的本质性力量,即成为未来法治世界中的隐形运行秩序。算法注入法治、改变正义将是根本性的,对法治的助力和对正义的彰显又具有显著优势。面对这场技术革新,中国法学需要作出理论回应与学术设计,为已经到来的算法法治与算法正义构建理论基础,寻找与算法对接的切口,获得与人工智能保持某种契合的力量,以此形成作用于社会治理的合力,进而完成法治现代化的转型。  相似文献

This article argues that corrective justice is an adequate principle of criminalization. On my interpretation, corrective justice holds that, in order for an action to count as a crime, there needs to be a plausible normative story about an offender having violated the interests of a victim in a way that disturbs their relationship as equal persons and a subsequent story about responding to crime in a way that corrects this disturbance. More specifically, I claim that corrective justice is concerned with the protection of interests that persons have in owning private goods throughout standard interactions with other persons. The argument proceeds in three steps. First, I specify the subject-matter that principles of criminal law need to ground and provide an outline of the idea of corrective justice. Second, I show that corrective justice can account for the main cases of crime and the salient modes of criminal responsibility. I also argue that corrective justice can make sense of two prima facie recalcitrant types of cases (rape and inchoate offenses). Third, and finally, I address two objections to my corrective justice theory of criminal law. The first concerns the implications corrective justice has for locating criminal law along the private/public law divide. The second objection raises the putatively problematic consequences corrective justice has for understanding the separation between criminal and civil law.  相似文献

This paper examines the use of legal claims by government officials and citizens in everyday political encounters involving civil rights. Data come from 580 letters sent to the federal government between 1939 and 1941, and from the replies sent by the newly formed Civil Rights Section of the Justice Department. In almost every case, the department refused to intervene and explained its refusal by making legal claims about federal jurisdiction. These legal claims masked the department's discretionary choices and thus helped depoliticize the encounters. Surprisingly, however, a substantial number of letter writers challenged the government's legal claims by deploying their own legal and moral arguments. The willingness of these citizens to challenge official legal pronouncements cautions against making broad generalizations about the capacity of ordinary people to respond effectively when government officials deploy legal rhetoric.  相似文献

This article considers the way in which the Federal Court of Australia has adapted to the native title jurisdiction. Here we see how common law approaches to law and procedure challenge, and are challenged by, the culture of indigenous peoples and customary law. It conveys the risk of cultural violence in a balancing of legal and cultural norms and shows how access to justice debates reach beyond debates about funding and advice into more fundamental issues about legal process and the nature of substantive law. The Court's approach to facilitating access to justice goes deeper than essential procedural changes. Its approach suggests a cultural change within the Court.  相似文献

This paper argues that the positive allocative decisions paradigmatically carried out by the application of legal rules are a necessary condition for arguments about particular justice (i.e., distributive and commutative justice) to make sense. If one shifts the focus from the distinction between distributive and commutative justice to what the two aspects of particular justice are for, namely, providing criteria to judge the allocation of goods, it becomes clear that the distinction is conceptually unstable. The paper argues that stabilizing the distinction is worthwhile and that this can only be accomplished by the introduction of positive allocation schemes.  相似文献

Time is central to Luhmann’s writings on social systems. Social systems, as systems of meaning, operate within three dimensions: factual, social and temporal. Each of these dimensions entails selections of actualities from potentialities (or contingencies) within horizons. Whilst the factual dimension involves selections based on distinguishing ‘this’ from ‘something else’, and the social distinguishes between alter and ego (asking with respect to any meaning whether another experiences it as I do), the temporal dimension operates with the primary distinction of before and after. In the temporal dimension, everything is ‘ordered only according to the when and not to the who/what/where/how of experience and action’ (Luhmann in Social systems. Stanford University Press, Stanford, 1995, p. 78). In this paper, we explore the connection between the temporal dimension of meaning within the legal system and its connection to justice. We begin by setting out succinctly the role played by justice within the legal system, as presented by Luhmann, particularly in his book Law as a social system (2004). From this beginning, we move on to consider the relationship between law, justice and time, taking two examples. The first is the temporality of judicial decisions. The second concerns the relationship between the temporal meaning of law’s own operations, and the presumption of innocence.  相似文献

This essay examines the popular American daytime courtroom programs Judge Judy and People's Court and comparatively analyzes two distinct models of law and justice developed in these shows. Using the techniques of qualitative media analysis, I argue that Judge Judy represents a shift in the way popular culture imagines the role of law in the lives of ordinary people. This shift accords with neoliberal notions of governance and individual self-responsibility for protection against risk. Conversely, People's Court represents an older, liberal-legal model of law that emphasizes individual rights, public participation in the court process, and due process. By demonstrating the supersession of Judge Judy justice over that of People's Court , I argue that this shift in the way law is imagined in American popular culture signals wider shifts in American and indeed international attitudes toward the law in our everyday lives.  相似文献
