Asian countries are building domestic institutions in response to climate change at both the international and domestic levels. Many countries have adopted the inter-agency coordination mechanism (IACM) as a national institutional approach to adjust the functions of various governmental agencies to tackle climate change. This article compares and contrasts national IACMs in four countries: Japan, the Republic of Korea, China and India. It examines (1) the structure and function of an IACM; (2) agencies and their specific roles in IACMs; (3) measures to empower the participation of other stakeholders including local governments, private sector, civil society and academia; and (4) changes in IACMs and reasons for such changes. Four success factors drawn from our comparative study suggest that an effective IACM should feature (1) strong overall coordination by the President/Prime Minister; (2) empowerment of the industry and environment agencies as joint lead agencies coordinating mitigation and adaptation; (3) involvement of all major sectoral agencies related to mitigation and adaptation; and (4) maximisation of the use of the comparative advantages of other stakeholders. The article highlights successful practices in Asia that can be emulated by other governments considering reform of their own domestic institutions in response to climate change.  相似文献

A significant percentage of the global population does not yet have access to safe drinking water, sufficient food or energy to live in dignity. There is a continuous struggle to allocate the earth’s resources among users and uses. This article argues that distributional problems have two faces: access to basic resources or ecospace; and, the allocation of environmental resources, risks, burdens, and responsibilities for causing problems. Furthermore, addressing problems of access and allocation often requires access to social processes (science, movements and law). Analysts, however, have tended to take a narrow, disciplinary approach although an integrated conceptual approach may yield better answers. This article proposes a multi-disciplinary perspective to the problem of access and allocation and illustrates its application to water management and climate change.  相似文献

Resilient ecosystems are vital to human well-being and are increasingly recognised as critical to supporting communities’ efforts to adapt to climate change. The governing bodies of the Convention on Biological Diversity and the United Nations Framework Convention on Climate Change are encouraging parties to adopt ‘ecosystem-based adaptation’ (EbA) approaches, which utilise biodiversity and ecosystem services to support climate change adaptation. These approaches are wide ranging and include mangrove restoration to buffer against storm surges; watershed management to protect against droughts and floods; rangeland management to prevent desertification; and sustainable management of fisheries and forests to ensure food security. This article examines the emergence of EbA in international legal frameworks for climate change and biodiversity and progress towards implementation. The EbA concept is potentially powerful in catalysing international and national commitments to act due to its key defining features of a focus on societal adaptation rather than ecocentricism, and a targeting of the immediate adaptation needs of the poorest and most vulnerable communities who are adversely affected by climate change. However, examination of national policy and practice in two least developed countries, Samoa and Cambodia, reveals that institutional and legal barriers at national level can pose significant challenges to operationalising EbA to achieve adaptation objectives.  相似文献

With the widespread concerns about cyber terrorism and the frequent use of the term “cyber terrorism” at the present time, many international organisations have made efforts to combat this threat. Since cyber terrorism is an international crime, local regulations alone are not able to defend against such attacks; they require a transnational response. Therefore, an attacked country will invoke international law to seek justice for any damage caused, through the exercise of universal jurisdiction. Without the aid of international organisations, it is difficult to prevent cyber terrorism. At the same time, international organisations determine which state court, or international court, has the authority to settle a dispute. The objective of this paper is to analyse and review the effectiveness and sufficiency of the current global responses to cyber terrorism through the exercise of international jurisdiction. This article also touches upon the notion of cyber terrorism as a transnational crime and an international threat; thus, national regulations alone cannot prevent it. The need for an international organisation to prevent and defend nations from cyber terrorism attacks is pressing. This paper finds that, as cyber terrorism is a transnational crime, it should be subjected to universal jurisdiction through multinational cooperation, and this would be the most suitable method to counter future transnational crimes such as cyber terrorism.  相似文献

The purpose of this paper is to consider how international law has sought to mediate between the promotion of environmentally sound technologies and local community participation. It will be suggested that the paradigm of sustainable development presents the most sensible framework through which to consider these issues. The paper will then present three short case studies centred around various aspects of the ongoing implementation of the Rio Conventions, namely the endorsement of sequestration activities within the 1992 UN Framework Convention on Climate Change, the development of an access and benefit sharing framework under the 1992 Convention on Biological Diversity and further encouragement of community participation in the 1994 UN Convention to Combat Desertification. In conclusion, the paper will suggest that community participation must be given comparable status with the promotion of technological advances if long-term success is ever likely to be attained.

Globalization will intensify contacts – and perhaps conflicts – betweencultures more than ever in the history of humankind. The flow of migrantsaround the world, global business and global consumption provide us withnew experiences of difference and diversity as well as of common ground.As in other social sciences, the concept of culture has recently emerged oncentre stage in criminology. Western criminologists look in awe to Asia, andtry to solve the enigma of modern, affluent societies with low ratesespecially of violent crimes. Asian criminologists warn of an impact ofWestern culture that might cause rising crime rates. Asian models of socialcontrol are studied and adopted in Australia, Europe and the US, and viceversa.Crime and social control are social and cultural phenomena. Therefore,comparing cultures and comparing crime will offer new insights, freshtheories and chances of innovative perspectives. Willpractices of criminal justice be efficient when transported to another socialand cultural environment?Criminologists should develop a clear notion of the problems that arerelated to comparing cultures and crime. Cultures are not monolithic.Cultural comparisons often suffer from exaggerations of differences, andproduce exaggerated predictions and expectations. In view of urgent social and environmental problems, it is important to understand the political dynamics that may promote sustainable development and to identify the agents that make changes in this direction happen. We examine the role and authority of a new type of actor that has recently emerged on the global stage—the social entrepreneur, who tackles social and ecological problems with entrepreneurial means. We consider them as agents that perform functions and provide services that have been considered to be the sole authority of states. For instance, the provision of water services has long been considered an exclusive task of the state. The water sector therefore serves as a good example to explore how these agents come up with their own missions and political agendas. Via an illustrative sample of social entrepreneurs from around the world, we explore their relation to water governance in general and the hydraulic mission in particular. We propose that their innovative potential serves as their main source of authority. Their local embeddedness along with their educational efforts, participatory goals, and accreditation as “social entrepreneur” provide additional sources of authority.  相似文献

This paper provides a decadal review of earth system governance (ESG) literature surrounding access and allocation to water, sanitation and hygiene. ‘access and allocation’ is one of five analytical problems, and ‘water’ a cross-cutting theme, identified in the ESG science and implementation plan (Biermann et al. 2010). A focused review of ESG and related literature reveals that the ESG literature is very robust in relation to access to water, sanitation and hygiene as a human right. However, the ESG literature lacks a robust, independent consideration of the right to hygiene or sanitation or its linkage and costs vis-à-vis other rights. There is no criteria for resolving competing demands on finite freshwater resources, as well as procedures for balancing rights. It is unclear how a transformed nuanced narrative of water access and allocation rights will address vulnerability and social inequality within this new balancing act.
