Abstract: Ricochet of a bullet in the spinal canal is well known by neurosurgeons but relatively not a common event in usual medico‐legal autopsy practice. This article presents a homicide case of a penetrating gunshot injury of the lumbar spine through the T12‐L1 intervertebral foramen with active movement of the projectile within the spinal canal to the L5‐S1 level. This case illustrates a bullet intradural and intramedullary active movement because of a ricochet of the body of T12 with active redirection of the path. In the current literature, different types of migration in caudal or cranial direction, intradural, or intramedullary are reported. If spontaneous migration of T10 to S1 seems to be more frequent, some authors reported a C1 to S2 migration. Such migration could be asymptomatic or induce neurological impairment. The medico‐legal consequences of these migrations within the spinal canal are described. 相似文献

Bite marks in human skin may be found to have been so forcefully made that the skin surface has been disrupted; the marks have become skin lesions. In the following, a case is reported in which such lesions were found on the back of a victim of assault. The dental examiners found it necessary to arrange for a series of simulated bites to be made in order to obtain adequate material for comparison. 相似文献

Histopathologic studies of dermal dog bites revealed changes identical with those observed in distant gunshot skin entrance wounds and in a presternal skin stab wound made by a screwdriver. The similarity of the epithelial and collagen changes produced by these three totally different traumatizing, perforating agencies indicate that it is the bullet's penetrating and crushing power, and not its caloric content, that is responsible for the characteristic dermal collagen changes noted in these common injuries. 相似文献

Bite wounds on humans have rarely been comparatively analyzed, and the behavior leading to such bites is virtually unknown. Nevertheless, the behavior of a shark is reflected in the bite structure and should be an essential part of shark-accident analysis. This paper compares 3 nonfatal accidents on humans, caused by bull sharks, Carcharhinus leucas, that occurred within a 12-month period in the same area of the Bahamas. Examination focused on wound analysis and accident reconstruction to determine the most likely bite motivation of the sharks. Two sharks targeted the left calf areas of the victims; another one bit the back area of a person. Although both calf bites had a very similar appearance, examination concluded that one of them showed the same triggering behavior as for the shark who inflicted the very different-looking back bite. Those 2 bites were competitive, whereas the other calf bite was initially of exploratory nature, turning into a stress-related bite. 相似文献

Abstract: Bite marks inflicted on animate and inanimate objects will undergo a certain degree of deformation. This fact remains one of the biggest stumbling blocks when analyzing evidence for court presentation. It has been demonstrated that the reliability of pattern association analysis will not be affected by minimal degrees of warping, shrinkage, and distortion. In this study, affine transformations were applied to bite marks to establish if minimal distortions would affect the mathematically determined relationships of the defined features. In a real case study, it was then tested whether the distorted bite mark matched the dentition of the perpetrator by applying an affine transformation. This was confirmed to be the case. Affine transformations will thus not affect the relationships of the individual features found in bite marks. The numerical calculations validate the reliability of pattern association analysis in the presence of minimal amounts of warping, shrinkage, and distortion. 相似文献

A case of bullet embolism is reported wherein a handgun missile, fired during a "shoot-out," perforated (among other structures) the anterior and posterior walls of the thoracic aorta, rebounded into the aortic lumen, and was transported to the left femoral artery where it came to rest. Roentgenographic study was instrumental in promptly locating the errant bullet whose recovery established the identity of the responsible firearm. The implications of bullet embolism of the arterial, venous, and paradoxical types for the forensic pathologist and the clinician are discussed briefly. 相似文献

Abstract: This study was based on a morphometric analysis of bite marks starting from the quantitative definition of the anterior teeth by the geometric acquisition of the “injuries,” using bite marks impressed on pig skin and plastic. Each mark was photographed and acquired. A dedicated program automatically supplied the values of the shape factors and the areas of the pattern geometric figures. The values obtained for the homologous samples were compared to the heterologous values. Statistical comparison was made of the sets by linear regression, determining the correlation coefficient and the determination coefficient for each value. Results showed only 4.8% and 2% of overlap between homologous and heterologous values. This study was carried out in attempting to quantitatively define the anterior teeth of the human dentition and the procedure described and the results obtained support the advantage of morphometric studies and computer‐aided programs in this study of bite marks. 相似文献

A scale of spatial reference for bite mark photography has been developed and evaluated. The scale incorporates both linear and circular graduations to meet the diverse needs of practicing forensic odontologists in the rectification and measurement of photographically recorded bite marks. Its unique L-shaped configuration ensures accurate scaling in both the vertical and horizontal directions and facilitates the gridding of photographs to correct for distortional errors created by oblique camera angles. This paper describes the design and constructional features of the scale and offers guidelines for its effective application to bite mark photography. 相似文献

The Federal Constitutional Court's banana decision of 7 June 2000 continues the complex theme of national fundamental‐rights control over Community law. Whereas in the ‘Solange II’ decision (BVerfGE 73, 339) the Federal Constitutional Court had lowered its standard of review to the general guarantee of the constitutionally mandatorily required minimum, the Maastricht judgment (BVerfGE 89, 155) had raised doubts as to the continued validity of this case law. In the banana decision, which was based on the submission of the EC banana market regulation by the Frankfurt‐am‐Main administrative court for constitutional review, the Federal Constitutional Court has now confirmed the ‘Solange II’decision and restrictively specified the admissibility conditions for constitutional review of Community law as follows. Constitutional complaints and judicial applications for review of European legislation alleging fundamental‐rights infringements are inadmissible unless they show that the development of European law including Court of Justice case law has since the ‘Solange II’ decision generally fallen below the mandatorily required fundamental‐rights standard of the Basic Law in a given field. This would require a comprehensive comparison of European and national fundamental‐rights protection. This paper criticises this formula as being logically problematic and scarcely compatible with the Basic Law. Starting from the position that national constitutional courts active even in European matters should be among the essential vertical ‘checks and balances’ in the European multi‐level system, a practical alternative to the Federal Constitutional Court's retreat is developed. This involves at the first stage a submission by the Federal Constitutional Court to the Court of Justice, something that in the banana case might have taken up questions on the method of fundamental‐rights review and the internal Community effect of WTO dispute settlement decisions. Should national constitutional identity not be upheld even by this, then at a second stage, as ultima ratio taking recourse to general international law, the call is made for the decision of constitutional conflicts by an independent mediating body. 相似文献

This experiment tested the ability of undergraduate mock jurors (N=295) to draw appropriate conclusions from statistical data on the diagnostic value of forensic evidence. Jurors read a summary of a homicide trial in which the key evidence was a bullet lead "match" that was either highly diagnostic, non-diagnostic, or of unknown diagnostic value. There was also a control condition in which the forensic "match" was not presented. The results indicate that jurors as a group used the statistics appropriately to distinguish diagnostic from non-diagnostic forensic evidence, giving considerable weight to the former and little or no weight to the latter. However, this effect was attributable to responses of a subset of jurors who expressed confidence in their ability to use statistical data. Jurors who lacked confidence in their statistical ability failed to distinguish highly diagnostic from non-diagnostic forensic evidence; they gave no weight to the forensic evidence regardless of its diagnostic value. Confident jurors also gave more weight to evidence of unknown diagnostic value. Theoretical and legal implications are discussed. 相似文献

Abstract: Bite Marks: This study demonstrated that surface wetness was the most influential factor affecting ring adhesion to skin. Also, chemical depilatories and shaving creams were to be avoided when cleaning the skin. The second phase of this research examines the tensile stress needed to rupture the bond between TAK® hydroplastic, three new cyanoacrylates, and pigskin with particular consideration for temperature variations. This study also considers solubility issues of different cyanoacrylates in 10% formalin. Finally, the Dorion Type V bitemark excision technique could significantly reduce the risks of tissue distortion when used in conjunction with the following methods and materials. The skin should be devoid of moisture, razor shaved, and cleaned with dishwashing detergent and 98.9% ethanol while avoiding the use of shaving creams and/or chemical depilatories where ring placement is anticipated. The use of unopened cyanoacrylate is encouraged with Permabond® as the cyanoacrylate of choice. 相似文献

Abstract: Unsupported excised skin may shrink by as much as 50% or more. In 1981, a method was developed for ring adhesion to skin with the goal of minimizing tissue distortion upon excision. Five modified versions of the technique bearing the author’s name followed (Dorion types I, II, III, IV, and V). The scientific literature reveals little supporting empirical evidence for the preferential use of one adhesive/suturing technique over another. This study compares the use of various bonding materials (Loctite Super Glue gel®, Dermabond?, Vetbond?), cleaning agents (ethanol, dishwashing liquid, and shaving cream), and depilatory (Veet®) on the effects of ring adhesion to skin. The conclusions indicate that surface wetness is the most influential factor affecting ring adhesion to skin, followed by the type of bonding material, its “freshness,” and by the cleaning agent used to prepare the skin. The use of a depilatory or shaving cream is to be avoided. 相似文献

Bite mark identification is based on the individuality of a dentition, which is used to match a bite mark to a suspected perpetrator. This matching is based on a tooth-by-tooth and arch-to-arch comparison utilising parameters of size, shape and alignment. The most common method used to analyse bite mark are carried out in 2D space. That means that the 3D information is preserved only two dimensionally with distortions. This paper presents a new 3D documentation, analysis and visualisation approach based on forensic 3D/CAD supported photogrammetry (FPHG) and the use of a 3D surface scanner. Our photogrammetric approach and the used visualisation method is, to the best to our knowledge, the first 3D approach for bite mark analysis in an actual case. The documentation has no distortion artifacts as can be found with standard photography. All the data are documented with a metric 3D measurement, orientation and subsequent analysis in 3D space. Beside the metrical analysis between bite mark and cast, it is possible using our method to utilise the topographical 3D feature of each individual tooth. This means that the 3D features of the biting surfaces and edges of each teeth are respected which is--as shown in our case--very important especially in the front teeth which have the first contact to the skin. Based upon the 3D detailed representation of the cast with the 3D topographic characteristics of the teeth, the interaction with the 3D documented skin can be visualised and analysed on the computer screen. 相似文献
