物上请求权的诉权与物权基础

一、问题意识 自<民法通则>中规定"民事责任"这一章至今已有二十余载.是否保留这一中国特色,在物权法起草过程中,又成为焦点.赞成民事责任立法者提出不规定物上请求权,将之并入侵权法,在侵权责任编专节规定侵权责任形式,其中规定一条:停止侵害、排除妨碍、消除危险、返还财产不以侵害人有过错为要件.     

The morphological characteristics of the brain injuries in acceleration trauma depending on the conditions of its occurrence

The series of 175 cases of cranio-cerebral trauma (acceleration trauma by mechanism of its formation) was studied. Morphology of percussion and anti-percussion cerebral lesions was shown to depend on conditions of trauma formation and other factors including presence or lack of cranial bone fractures, cerebral vascular pathology, nature of trauma (isolated or combined) etc.     

The effect of Japanese corporate acquisition on the us military-industrial base

This paper utilizes a technique called the analysis of competing hypotheses to study Japanese acquisitions that involve majority interests in US firms. Findings show that there seem to be strategic trends in the Japanese procurement process, and that there are four domestic product groups that appear to be particularly vulnerable. Such foreign control of American commercial enterprises may well be a threat to the economy and national security.     

81例外伤性鼻部骨折的特点及其法医学鉴定分析

研究鼻部损伤后骨折的特点、确诊的方法及法医学鉴定的相关问题。 81例以鼻部外伤为主诉 ,经鼻骨拍摄X线侧位片 ( 62例加做鼻部CT扫描 )检见有鼻骨骨折的患者 ,进行法医临床学鉴定分析。单纯性线性骨折 19例 ,骨折移位者 11例 ,粉碎性、多发性骨折 4 0例 ,鼻骨骨折伴上颌骨额突骨折或 (及 )伴眶骨骨折 11例 ;轻伤 58例 ( 72 % ) ,未构成轻伤 2 3例 ( 2 8% )。多数鼻骨骨折为粉碎性、多发性 ,且可伴有其它部位骨折。鼻骨X线侧位片只能明确部分粉碎性骨折及部分移位明显的骨折 ,CT扫描能确定鼻部骨折形态。     

The pathomorphological characteristics of the vascular plexuses and ependyma of the cerebral ventricles in human craniocerebral trauma]

The morphology of the studied substrates was analyzed in lethal craniocerebral injuries of various origins and in various periods after it was suffered. The data on the pattern and time course of pathomorphologic shifts and functions extend the general notions on the role of the liquor circulation system in the pathogenesis of craniocerebral injury. These results may serve as additional expert criteria of the mechanisms of brain injury.     

The Need for a Stronger Definition: Recognizing Abandonment as a form of Elder Abuse Across the United States

Elder abuse is a growing public health problem in the United States and statistics show that each year, hundreds of thousands of elders are abused in some manner. This Note discusses elder abuse while focusing specifically on the occurrence of elder abandonment and how the majority of states do not recognize elder abandonment as a form of elder abuse in their statutes. Moreover, this Note proposes a model statute to be adopted by every state in an effort for elder abandonment to become more widely reported. Elder abandonment is an unfortunate phenomenon and those who contribute to elder abandonment should face criminal liability similar to those abusers who engage in elder neglect or other types of elder abuse. Furthermore, this Note emphasizes that there should be a greater focus on how caregivers can seek assistance in order to prevent elder abuse in the United States.     

我国当前民间借贷的特点、问题及其法律对策

我国当前民间借贷市场已经进入高级阶段,资金供需两旺,并具有迅速走红网络经济的发展趋势。然而,民间借贷相关立法滞后,市场监管缺位,司法主导突出,整个市场呈现出产生发展的内生化、投资主体的多元化、交易形式的电子化、法律规则的零散化、法律地位的尴尬化以及裁判结果依赖指导性解释等特征。民间借贷组织的主体地位问题、民间借贷合同的效力认定问题、民间借贷利率的法律管制问题、网络借贷平台的风险控制问题以及民间借贷交易的信息监测问题等日益突出,加强监管立法和监管机构主动执法,依法规范民间借贷行为,严厉打击高利贷,已成为金融生态建设中民间借贷法律规制的必然选择。     

The characteristics of injuries to the ribs in children by repeated impact with solid blunt objects]

Mechanisms of occurrence of thoracic lesions as well as characteristic features of repeated rib trauma in children with repeated blunt trauma were studied. Experimental data were compared with expert observations. It was stated that morphological features of repeated rib trauma in children are localized within the limits of substantia compacta or its superficial layers. There is also possibility for straightening primary incomplete fracture in repeated exposure and for forming secondary fracture, which depends on the type of force applied, its application area and direction of force action.     

The theoretical aspects of the time dependent Z equation as a means of postmortem interval estimation using body temperature data only

It has been clearly demonstrated that the rectal cooling curve does not obey Newton's Law, which is exponential. The first success in modelling rectal cooling mathematically was achieved by Marshall and Hoare [1]. An amendment was made to the simple exponential curve which led to a good mathematical model, exhibiting the three main sections of rectal cooling, i.e. lag, linear and quasi-exponential. The resultant method of postmortem interval estimation required a knowledge of the body mass and height. The present study has led to a totally different amendment to Newton's Law, which provides a means of postmortem interval estimation from body temperature data only. The derivation of the method, with a background on Newton's Law follows.

在现代刑事诉讼制度中,对被害人合法权益的保障日渐突出。本文结合我国立法和司法实践的现状,通过比较中国与澳大利亚在被害人诉讼地位和权利保护方面的异同,对如何完善我国的被害人权利保障机制提出了相应的建议。

Trust is hard to come by: Disentangling the influence of structural characteristics and race on perceptions of trust in the police in a major Southern County

The current study will add to the literature on public attitudes toward law enforcement by assessing the individual and contextual-level predictors of one of the key concepts in police legitimacy literature: trust. Examining individuals nested within zip code results showed a significant equalizing effect of structural resource deprivation on both White and Black respondents' perceptions of trust in the police. Additionally, results found respondents who perceived racial profiling to be widespread had a universally decreased likelihood of having trust in the police, and these disparities were exacerbated as structural resource deprivation increased.     

证券犯罪主体特征的犯罪学分析

在客观环境基本相同的条件下,为什么只有少数人实施证券犯罪,为什么是这些人而不是其他人实施证券犯罪,这从刑法学犯罪构成的角度是难以回答的。而从犯罪学的视角看,则不难发现证券犯罪的主体在智能结构、需要结构和道德法律意识等方面均具有显著的特征,正是这些特征构成了证券犯罪的主观基础。     

The cost price of expertise as an objective index of the work-share coefficient of the forensic medical expert]

The author suggests a method for estimating the net cost of a forensic medical expert investigation, consisting in calculation of an objective real coefficient of the ratio of various expert investigations to the reference value. The ratio between forensic medical investigation budget and the total number of these investigations forms the basis for the estimation of the net cost of an expert evaluation.
